At a special meeting of " the "Mayor and Council of the Town of
Leesburg, in Virginia, held in .the ' Council " Chamber at 12 o ' clock
noon, there 'were present William W. Nickels, Howard B. Gill, Emmer-
son H. James, Maurice R. ' Lowenbach, Jr; and Frank Raflo Councilmen. •

Due to ' the absence of' the" Recorder, and upon motion duly made
seconded and carried Firank' Reflo . was' elected to' serve as Recorder
Pro9Tem.
Upon motion of Maurice R. 'Lowenbaah, Jr; seconded by Frank
Raflo, and unaminously carried' the following resolution was adopted :
BE IT RESOLVED, by the Council of the Town of Leesburg, in Virg-
inia that sections A and B of the ordinance passed July 16, 1954, re-
garding' the use of water be and it is hereby recinded. '
Upon motion of Frank Raflo, seconded by Howard B. Gill, and un-
aminously carried the following resolution was adopted:'
_ BE IT RESOLVED, by the Council of the Town of Leesburg, in Virg*
inia, that the proposal of Mr. G. B. Thomas of Berryville, Virginia
to drill a well for the town o$ the property of the Leesburg Fire
Company be and it is hereby accepted, and,
BE IT FURTHER RESOLVED? that the Mayor be and he is here yy auth-
orized, instructed, and directed to sign the proposal and%or oh''te
half of the Town of Leesburg, in Virginia and that Mr. Thomas be not-
ified to begin work on drilling said well forthwith.
There being no further business upon motion duly made seconded
and c rried Council adjourned.

1 . REGULAR August 9, 1954.
At a regular meeting of the Mayor and Council of the Town'of
Leesburg held in the Council Chamber, on Monday, August, 9, 1954, at
7 :30 o ' clock P. M; there were present William W. Nickels, Mayor,
Horace M. Hallett, Recorder, Reginald K. Gheen, Howard B. Gill, Emm-
erson H. James, Maurice R. Lowenbach, Jr; Frank Raflo, and Morton
Rid-lelll, Councilmen.
The minutes of the regular meeting of July, 12, the special
meetings of July, 16, 22, and 29th: were read and upon motion of
' Morton Riddle 111, seconded by Frank Raflo, and unaminously carried
were approved as read.
Mr. Raflo, tol9 the Mayor and Council that he was in error in
stating that the veto appeals case would 'be handled at no expense to
the Town, but that ' it would be handled at absolute minimum cost to
the Town.
The Auditor-Treasurer read his monthly statement, read the cur-
rent bills, and upon motion of Emmerson H. James, seconded by Frank
Raflo, and unaminously carried the Following resolution was adopted:

Mayor Nickels read a letter from Mr. Albert F. Anderson attorney
for Mr. Frank Epps, again requesting a payment of $1,400.00 for
the use water from thh rock query.
' Upon motion of Maurice R. Lowenbach, Jr; seconded by Frank
Raflo, the following resolution was offered; that the Auditor-
Treasurer be and he is hereby authorized and directed to pay the
sum of $ 1,400.00 to Mr. Frank Epps for the use of the water take-
en from the rock wary. This'motion never came to a vote.
Upon motion of Reginald K. Gheen, seconded by Emmerson H.
James, and unaminously carried the following resolution was ad-
opted :by-
BE IT- RESOLVED, by the Council •of the Town of Leesburg, in
Virginia that matter of the bill in the sum of $1,400.00 from Mr.
Epps , be tabled until the next regular meeting of the Council,
and in the mean time the water committee investigate this matter.
Mayor Nickels, read a letter from the Loudoun National Bank
in which it requested the removal of the Newspaper Honor Racks.
Mayor Nickels instructed Mr. Venable to have the newspaper racks
' removed- from the streets in compilince with a town ordinance.
The Auditor-Treasurer read a report from the Board of Zon-
ing Appeals, and upon motion of Frank Raflo, seconded by Maurice
R. Lowenbach, Jr; and unaminously carried the following resolution
was adopted:
That the enactment of the advertisement in Loudoun Times
Mirror calling for a public hearing before the Council of the
Town of Leesburg be and it is hereby radified; to 'consider the
rezoning ;
1 That certain or lot of land located in the eastern part of the
Town of Leesburg, a short distance north of Fayette Street in
Loudoun County Virginia, containing 1,347.7 sq; feet more or less,
and
2 That certain parcel or lot of land located in this eastern part
of the Town of Leesburg, An- a short distance north of Fayette,
Street in Loudoun County Virginia contaning 7,517.4 sq; feet more
or less, and that the said meeting shall be held in the Council
Chamber of the Town of Leesburg, in Virginia on the 16th, day of
August, at 7 P. M.
Mayor Nickels turned over to the Auditwr-Treasurer two signed
copies of an agreement with the Leesburg Fire Company for the lay-
ing of a sewer line, also a copy the the agreement with the Wash-
_ ington Old Dominion Railroad.
Mayor Nickels read a letter from Hayes, Saey, Mattern; and
Mattern, and from the Blackwell Construction Company, regarding
the sewer to be laid• to the New School.
Upon motion- of Howard' B; Gill; seconded by Emmerson H.James
and unmminously Carried the following resolution was adopted :
BE IT RESOLVED, by the 8ouncil of the Town of Leesburg, in
Virginia thatsection• C of• the' Water Usage Ordinance found on
page 144 of the Town-minute book' be and it is hereby recinded.
Mayor Nickels; Stated - that he had the assurance of the Virginia
State, Highway Departpent that they would assist• the Town in making
Loudoun and Market Streets one way should the Council so desire.
A letter from Senator Ball regarding Monroe Manor, also 4 9
the resignation of Mr. Stilson H. Hall Town' s Attorney, and upon
motion of Maurice R. Lowenbach, Jr; seconded by Emmerson H. James,
and unaminously carried• the fblowing' resolution was adopted;
BE IT RESOLVED, by the Council of the Town of Leesburg, in
Virginiathat the' resignation of the Town's Attorney, ' be and it
is hereby accepted, and that proper letter thanking Mr. Hall for
his services to the Town be written, and that the said letter shall
become a part of' these minutes.
Upon motion of Maurice R. Lowenbach, Jr; seconded by Howard B.
Gill, and unaminously carried the following resolution was adopted :
BE IT RESOLVED, by the Council of the Town of Leesburg in VirgiA
that officers Ronald L. Athey and C. R. Turner of the-Police Depart-
ment be given two weeks vacation or pay' at the regular rate in lieu
thereof.
Upon motion of Maurice efLowenbach, Jr; seconded by Emmerson
H. James and unaminously carried the following resolution was adop-
ted :
BE IT RESOLVED, by the Council of the Town of Leesburg in
Virginia that the street between South King Street and South Church
be roped off and closed to traffic on August 27, from 4 to 8 P M.
for the benifit of the Colored Methodist Church.
The Auditbr-Treasurer was requested to request the Vigbia
Electric and Power Company to install a street light on the light
pole in back of Bodmers, and Simmons stores.
Upon motion of Reginald K. Gheen, seconded- by Frank Raflo,
and unaminously carried the following resolution was adopted:
BE IT RESOLVED► by the Council of the Town of Leesburg, in
Virginia that the Auditor-Treasurer be and he is hereby authorized
and directed to employ a clentto assist him with the duties of his
office, at a salary rate not to exceed $150.00 per month.
Mr. Gheen of the Water Committee presented a report, and up-
on motion of Emmerson H. James, seconded by Reginald K. Gheen, and
unaminously carried the following resolution was adopted:
BE IT RESOLVED, by' the Council of the Town of Leesburg, in
Virginia, that the report of the Water Committee be and it is here-
by accepted and adopted, and that proper ordinance be presented to
the Council at their regular meeting on Spetember 13, 1954 so as
to put the said report into effect. . - -

Proposal to increase water rates in the Town of Leesburg, Va.
The current operating budget of the Town provides funds for
the normal operation of the water department as it existed on
July 1, 1954. It becomes necessary however toprovide for
additional revenue to- provide sufficient funds for the necessary
expansion of the' water supply and for increasing the facilities
of the• Town water system. •
The average quarterly revenue from all water users for the
, last three years was approximately;; $4, 500.00.

It is recommended that the rates for water rent be adjusted
as follows:

It is recommended that_ the next rates become effective with •
the quarter starting August- 21, 1954.
It has also been determined that the cost of a new meter
installation for water service coats the Town approximately
$40.00 ; which includes the cost of the meter, accessories and
labor. This expense is now being born entirely from Town revenue. f
This seems to be an expense which should be paid by the consumer
and not by the supplier. This is a practice followed by many -
suppliers of utilities and by many municipal corporations, and
it seems that the Town of Leesburg should adopt this policy.
It is therefore recommended that in the case of a new
installation for residence within the corporate limits an in-'
stallation charge of $25.00 be made. In the case of installation
for a commercial" user, where a larger meter is used, the charge
should be $25.00, plus the additional cost of the larger meter,
over the cost of. the meter used for a residence.

In the case of a new installation for residence outside of
the corporate limits the charge 'shouldd be".450.00,.:and in the
case;of".:installatioin:•fora .business requiring.:a-.meter..larger
than that for a residence the charge should be $50.00 plus the
additional cost of the larger meter over the cost of the meter
for a residence.
It is also recommended that in cases- where an installation
already exists and the water has been cut off that a charge of
$2.00 be made for turning the water back on:.

It is recommended that the charges be collected at the time 111the permit is issued for the service.

• At a Special meeting of the Mayor and Council of the Town
of Leesburg, in Virginia, held in the Council Chambers on
August 16, 1954 at 7:00 o ' clock P. M. , therewere present:
William W. Nickels, Mayor, Horace M. Hallett, Recorder, R. K.
Gheen, Howard B. Gill, Emerson H. James, Morton Riddle,. III,
Frank Raflo and Maurice R. Lowenback, Jr, Councilmen.
Upon motion of Morton Riddle, III, seconded by R. K.
Gheen and unanimously carried, the following Ordinance was
enacted:

Whereas, The Council of the town of Leesburg, in Virginia,
has heretofore submitted to the Board of Zoning Appeals for its
report the advisability. o.f, .the request to change from "Residence
District I" to ."Business District'. certain property owned by
Solomon Feldman and Arthur T. Elgin and wife, located in the
eastern part.of. the Town of Leesburg described as follows :
