This expense is now being born entirely from Town revenue. f� This seems to be an expense which should be paid by the consumer and not by the supplier. ' This is a practice followed by many .- suppliers of utilities and by many municipal corporations, and it seems that the Town of Leesburg should adopt this policy. It is therefore recommended that in the case of a new installation for residence within the corporate limits an in- stallation charge of 025.00 be made. In the case of installation for a commercial- user, where a larger meter is used, the charge should be 025.00, plus the additional cost of the larger meter, over the cost of the meter used. for a residence. . In the case of a new installation for residence outside of the corporate limits the charge 'should4be•450.00, _and in4the case;of-.installation:-for_a .business requiring:a-meter.larger than that for a residence the charge should be 050.00 plus the additional cost of the larger meter over the cost of the meter for a residence. It is also recommended that in cases- where an installation already exists and the water has been cut off that a charge of 32.00 be made for turning the water back on`. • It is recommended that the charges be collected at the time the permit is issued for the service. M. , therewere present: William W. Nickels, Mayor, Horace M. Hallett, Recorder, R. K. Gheen, Howard B. Gill, Emerson H. James, Morton Riddle,. III, Frank Raflo and Maurice R. Lowenback, Jr, Councilmen. Upon motion of Morton Riddle, III, seconded by R. K. • Gheen and unanimously carried, the following Ordinance was enacted: ORDINANCE PROVIDING FOR AMENDMENT TO ZONING 'I REGULATIONS 'AFFECTING PROPERTIES OF FELDMAN AND ELaIN Whereas, The Council of the `Town of Leesburg, in Virginia, • has heretofore submitted to the Board of Zoning Appeals for its report the advi-sability. of. the -request to change from "Residence District I" to -"Business District'. certain property owned by Solomon Feldman and Arthur T. Elgin and wife, located in the • eastern part,.of the Town of Leesburg described as follows: 1 - That certain parcel or lot of land located in the eastern part of the Town of Leesburg, a short distanb.0 north of Fayette Street, Loudoun County,: -Virginia, bounded as follows : 101 Beginning at (1) a post in a fence corner in the north line of the land of Southern States and a corner between E)4in •and Feldman; .thence with Elgin N 26 deg. -30 min. E 52:17 feet _to (2) an iron peg in the fence line between Elgin and Feldman; thence with two new division lines through the land of Feldman S 57 deg. E 31.0 feet to (3) an iron peg; thence S 37 deg. 30 min. W 52.0 feet to (4 an iron peg at the north-east corner of the land of Southern States;i-thence with the north line of the land of Southern States N 57 deg. W 21.00 feet to the point of beginning, containing 1,347.7 square feet, more or ' less. - • Being a portion of the same land conveyed to Solomon Feldman by Claude Honicon by deed dated November 13, 1945, recorded in: the Clerk' s Office of the Circuit Court of Loudoun County, Virginia, in Deed Book 12 C'.s, page 230. 2 - That certain parcel or lot of land located in the ' eastern part of the Town of Leesburg, a short distance north of Fayette Street, in Loudoun County, Virginia, bounded as follows : Beginning at (1) a post in a fence corner in the north line of the land of Southern States and a corner between Elgin and Feldman; thence with Feldman N 26 deg. 30 min. E 52.17 feet to (2) an- iron peg in the fence line between Elgin and .Feldman; thence with a new division line through Elgin' s land N 57 deg. W 144. 3 feet- to (3) an iron peg a corner to the land of General Marshall ; thence with General Marshall S 27 deg. 50 min. W 52.1 feet to (4) an iron peg at a fence corner, the northwest corner of the land of Southern States in General Marshall' s line; thence with the-north line of the land of Southern States S 57 deg. . E 145. 5 feet to the point of beginning, containing 7,517.4 square feet, more or less. • Being a portion of the same land conveyed to A. T. Elgin, Jr. and wife, by deed of record in the Clerk' s Office aforesaid in Deed Book 11 S' s, page 31. WHEREAS', by written report the Board of Zoning Appeals of said Town has recommended- that the said requests be granted and has given the Council pertinent reasons therefor; and WHEREAS, as required by law, the Board of Zoning Appeals, • prior to its meeting published notice of a public hearing on said applications in the Loudoun Times-Mirror, Leesburg, Virginia, and the Council of said Town, prior to its meeting to consider said applications published notice ten days prior thereto of a meeting to consider changes in its zoning ordinances ; and WHEREAS, the Council of the Town concurs fully in the said findings of the Board of Zoning Appeals. NOW-, THEREFORE, --BE IT ORDAINED by the Council of the Town of Leesburg, in Virginia, as follows ; 1 - That the Council hereby adopts the report of the Board of Zoning Appeals submitted in writing on July 27, 1954. 2 : That the zoning regulations of said Town be, and they are ' hereby, amended and changed to 'include in the "Business District" and remove from "Residence Districe I" the hereinbefore. described properties of Solomon Feldman and Arthur T. Elgin and wife. Upon motion of Frank Raflo, seconded by Morton Riddle, III, and unanimousay carried, the following resolution was adopted : BE IT RESOLVED by the Council of the Town of Leesburg, in Virginia that the resolution -passed at the regular meeting of July 12, 1954, found on page 141 of the minute book, authorizing the Mayor to enter into an agreement with Herbert Howard and Lillian Howard, his wife, in which the latter grants an easement to the town over their property on which a sewer line is to be laid to the new school, be rescinded. • • Councilman James was recorded present and voting at this time. 1 5 2 Upon motion of- Frank E2aflo, ;_seconded by Howard B. Gill and unanimously carried the following resolution was adopted: BE IT RESOLVED by the Council of the Town of Leesburg, • in Virginia, that the Town of Leesburg, - in Virginia, do enter into an agreement with Herbert Howard and his wife, Lillian Howard, in which the latter grants an easement to the Town over their property on which a sewer line is to be laid to the new school, which agreement is as follows : AGREEMENT THIS AGREEMENT, made this .8th day of July, , 1954, by and between HERBERT HOWARD and LILLIAN HOWARD, his wife, Parties of the First Part, and THE TOWN OF LEESBUEG, IN VIRGINIA, Party of the Second Part. W I T N .E S S ETH : WHEREAS, the Party of the Second Part is desirous of enter- ing upon the land of the Parties of the firet Part for 'the pur- pose of constructing and maintaining a sanitary . sewer, including manholes and accessories, and installing connections thereto, as required within the limits of the easement hereinafter described ; and, WHEREAS, the Party of the Second Part, in consideration of the rights hereby granted, has agreed to indemnify and save harm- less the Parties of the First Part by the payment of any reason- able damages done to said property due to the maintenance or re- pair of said sanitary sewer and has agreed to restore the premises to as good condition as existed when this grant was made, NOW, THEREFO RE, . THIS AGREEMENT WITNESSETH: That for and in consideration of the_ sum. of One Dollar. ( $1.00) in hand paid prior to the ensealing of this agreement, the receipt of which is here- by acknowledged, and as further consideration the Party of the Second Part agrees to install a gne (1) inch water line from the water main on Ayr Street to the own water meter on the property of the Parties of the First Part; together with• all connections thereto, at its own expense, and the said. Herbert Howard and Lillian Howard, his wife, Parties of the First Part, hereby and herein grant to the Town of Leesburg, in Virginia; Party of -the Second Part, the right to enter upon the land owned by the Parties of the First Part, to lay out, construct and maintain a sanitary sewer, including manholes and. acceseories, and install-connections ' thereto; as required within the limits of the hereinafter des- cribed. easement:. - • "Beginning at a chiseled cross on the foot bridge across the Town Branch on the Souther- ly side:of_Dry .Mill Road, said cross marking the corner common to Howard and the Leesburg Volunteer Fire Company; thence with the line . common to Howard and Leesburg Volunteer Fire Company a distance of 100 feet, to the East, • said easement to be 5 feet in width and para- llel to the aforesaid common property line." This easement extends over, through and across a portion of the same land conveyed unto the said Herbert Howard by W. A. Metzger, surviving executor of N. S. Purcell, deceased, by deed dated the 11th day of December, 1936, recorded in the clerk' s Office of, the Circuit Court of Loudoun County, Virginia, in-Deed Book 10 W s, Page 77, to which deed and the references therein reference- is made for a more particular description of the same. • Upon completion of the sewer over the hereinbefore described lands, the trench shall be back-filled, all excess earth and material removed and the premises put in as good condition as existed when this grant was made. Further, the right is granted the Town of Leesburg, in Virginia, to enter upon.said land at any time after the sewer system is completed for the- purpose of inspection, maintenance or repair, it being understood that the. Town of Leesburg, in Virginia, will save harmless the said Herbert Howard and Lillian Howard, his wife, and will pay any reasonable damage done to said property due to such maintenance or repair, it being under-1 53 stood that this easement shall be in perpetuity and shall run with the- land. James, and unaminously carried the following resolution was adopted: / BE IT RESOLVED, by the Council of the Town of Leesburg, rin Virginia, that Howard W. Vesey be and he is hereby elected and appointed as Town Attorney for the period -begining August 16, 1954 and continuing until August 31, 1954, at an annual salary of $ 100.00 per year payable semi-annually. Mayor Nickels called to the attention of the Council the letter from Senator Ball, regarding The Monroe Manor Sub-Div- ision. Mr. Lowenbach Jr; was recorded present and votitg at this time. Mr. Riddle told the Council he had talk to Mr. Gore of the Leesburg Laundry, regarding the connecting the said plant to the Towns sewer system. Council requested Mr.Riddle to request The Leesburg Laundry to submit plans for the hold tank and for the connection to the sewer. Upon motion of Reginald K. Gheen, seconded by Emmerson H. James, and unaminously carried the following resolution was ad- opted : BE IT RESOLVED, by the Council of the Town of Leesburg in Virginia, thatthe Auditor-Treasurer be and he is hereby author- ized and directed to pay Mr. Stilson H. Hall. through August 31, 1954. • Upon motion of Frank Raflo, seconded by Maurice R. Lowen- , bath, Jr; and unaminously carried the following resolution was adopted : BE IT RESOLVED, by the Council in the Town of Leesburg, that Bailey' s Community Center Inc ; be and they are hereby giv - en permission to hold hold a boxing and wrestling show in the Town of Leesburg, and that the said boxing and wrestling show shal be held under the supervision aH the Virginia Athletic Commission. Gheen, Maurice R. Lowenbach, Jr; Frank Raflo, and Morton Rid- dle 111, Councilmen. • The following notice was read : August, 18, 1954.
