HomeMy Public PortalAbout1954_08_23SPEC . . /ss A copy of Mayor Nickel's letter to Judge Snead regarding the,appeals case of the Town of Leesburg and the Mayor having certain veto power was read, and upon motion of Frank Raflo, seconded by Maurice R. Lowenbach, Jr; and unaminously carried the following resolution was adopted: (Mr. Gill was recorded present and voting at this time). , BE IT RESOLVED, by the Council of the Town of Leesburg, in Virginia, that Wilbur C. Hall, Attorney, be and he is hereby authorized to effect an appeal to the Supreme Court of Appeals of Virginia in the Case,of.Howard B. Gill et els, constituting the duly elected Council of the Town of Leesburg, a body corporate and municipal corporation, in Loudoun County, Virginia against William W. Nickels Mayor of the Town of Leesburg, a body corporate and a municipal corp-. oration, in Loudoun County, Virginia in which case the Court held that the Mayor of the Town of Leesburg had the power to veto any ordinance, or any re- III solution having the effect of an ordinance, passed or adopted by the Council of said town. And be it further resolved that all and any former resolutions pertaining to this subject are hereby repealed. I The Council requested Mr. Vesey to reply to Senator Ball's letter re- garding the Monroe Manor Sub-Division. I , Mr. Vesey told the Council that he hoped to be able to put the Town's Ordinances into a loose leaf folder very shortly 1 Upon motion of Morton Riddle, III, seconded by Frank Raflo and unanimously • , carried, the following resolution was adopted: . BE IT RESOLVED by the Council of the Town of Leesburg, in Virginia, that the Auditor-Treasurer be and he is hereby authorized and directed to pay the bill of Robert K. Mayor' (/ Recorder . • SPECIAL AUGUST 23, 1954 • At a Special Meeting of the Council of the Town of Leesburg in Virginia, held in the Council Chamber, August 23, 1954, at 8:30 o'clock P. M. there were _ present Horace M. Hallett, Recorder, Reginald K. Gheen, Howard B. Gill, FAerson H. James, Maurice R. Lowenbach, Jr., Frank Raflo, and Morton Riddle III, Councilmen. All members of Council waved notice of calling a Special Meeting.. Upon motion of neginald K. Gheen, seconded by Howard B. Gill and carried by a vote of 5-0, Raflo not voting, Frank Raflo was elected Recorder pro-tem. Due to the absence of the Mayor, Horace M. Hallett, Recorder acted as Mayor pro-tem. The resignation of 'William W. Nickel'fs, Mayor was read to Council and upon _ motion 'of Morton Riddle_IIT, 'seconded by Emerson H. James, Mr. Nickel's' resig- nation was'accepted with regfet.' 'Lowenbach,• Jr. be and he is herebyyrappointed and elected to the office of Mayor of :the sown of Leesburg; in Virginia, to serve out 'the unexpired term of William W. Nickels.
