James and unaminously carried the following resolution was adopted: WHEREAS, the construction of the Loudoun County Jail at the corner of Church and Market Streets has resulted in the collection and deposit of necessary building materials on the East side of Church Street; and, WHEREAS, the deposit of said necessary building materials has and will continue to make hazardous two-way traffic on that part of Church Street adjacent :., to its intersection with Market Street; • NOW, THEREFORE, BE IT RESOLVED that on and after October 12, 1954, all ', motor vehicle traffic:•. on Church Street in the Town of Leesburg in Virginia, zfrom its intersection with Market Street North to the Town-County parking `'J\> lot, is hereby limited to one-way South bound traffic only; fM 4 AND BE IT FURTHER RESOLVED, that the Auditor-Treasurer and the Town , 2 Sergeant be and they are hereby directed to locate and install such traffic - s:it signs and signals as may be necessary for the direction of traffic as herein Q provided. There being no further business, upon motion duly made, seconded and carried, Council adjourned. ___:.:Zig.."„1or ecorder REGULAR NOVEMBEj8, 1954 At a regular meeting of the Mayor and Council of the Town of Leesburg in Virginia, held in the Council Chamber Monday November 8, 1954, there were present Maurice R. Lowenbach, Jr; Mayor, Horace M. Hallett, Recorder, George J. Duffey, Reginald K. Gheen, Howard B. Gill, Emmerson H. James, and Frank Raflo, Councilman. The minutes of the last regular meeting were read and upon motion of Emmerson H. James, seconded by Reginald K. Gheen, and un- aminously carried were approved as read. The Auditor-Treasurer read his monthly statment for the month of October, 1954, and presented his current bills, and upon motion of Frank Raflo, seconded by Emmerson H. Thomas, Inc ; 3711. 13 ' . $5,219. 15 Mayor Lowenbach requested the Street Committee to check on the Stop Sign that had been located at the corner of Buick and South Streets and advise the Council if it should remain at its present location or be moved. Upon motion of Frank Raflo, seconded by George Durfey and carried by a vote of 4 to 0 Gill not voting the following resolut- ion was adopted: BE IT RESOLVED, by the Council of the Towne4i of Lbesburg in Virginia that the Auditor-Treasurer be and he is hereby authorized and directed write off any town taxes against the property of the Leesburg Volunteer Fire Company. Mayor Lowanbach read letter from the Virginia State Depart- ment of Highways dated October, 29, 1954 regarding resurfacing certain streets in the town. Mayor Lowenbach requested the Water Committee to work out with the Town' s Attorney plans and agreements for running a pump test on the new well. Mayor Lowenbach told the Council that there would be a meet- 1111 ing in the Council Chamber November, 22, 1954 at 7 :30 P.M. to dis- cuss the recreation program, and that he hoped that every member of the Council would attend and that theywouldinvite every one that would offer any assistance. Mr.Vesey told the Council that he was about ready to present the new ordinances for their consideration and asked that the Mayor and Council meet with him in his office Friday night .November 12,0 at 7:30, to read and consider the proposed ordinances. Mr. B. Powell Harrison of the Planning Commission appeared before Council and reported the progress the Commission had 'made . on starting the Master plan for the Town. Upon motion of Emerson H. James, seconded by Reginald R. Gheen and carried by a vote of 4 to 0 -- James, Gheen, Gill and Durfey for, Ratio not voting, the following resolution was adopted: f' RESOLVED, That the Mayor and the Recorder be and they are hereby authorized {� and directed to execute, for and in behalf of the Town of Leesburg, in Virginia, that certain contract dated November 8, 1954, by and between 1' PILOT INVESTMENT CORPORATION, a Delaware corporation, and THE TOWN OF LEESBURG, �. IN VIRGINIA,_AS follows: D THIS AGREEMENT, made and entered into this 8th day of November, 1954, by 1 1111 and between PILOT INVESTMENT CORPORATION, a corporation formed and organized under the laws of the State of Delaware, Party of the First Part, and THE TOWN OF LEFSBURG IN VIRGINIA, a corporation formed and organized by virtue of an act of the State Legislature of the State of Virginia, Party of the Second•Part, ci WITNESSETH: WHEREAS, the Party of the First Part is the contract purchaser of certain lands now owned by Louise H. Patton and lying partially within and partially without the corporate limits of the Town of Leesburg, and WHEREAS, the said Louise H. Patton has subdivided the said lands, which subdivision has been approvedcby the Planning Commission of Loudoun County, Virginia, and e 164' WHEREAS, the Party -of the First Part desires to install water and sewer mains in the said subdivision, the same to be- connected to -the- existing water and sewerage system of the- Town of Leesburg, and • WHEREAS, the 'Town'of Leesburg-is willing to furnish and supply water and sewer'facil.ties to the Party of the-First Part under certain terms and conditions as hereinafter set forth; - - NOW,'THEREFORE, for and in consideration of the sum of One Dollar ($1.00) in hand paid by each Party to the other before the ensealing of this Agreement, and as further consideration the' mutual-promises, covenants and undertakings of the Parties as 'hereinafter 'set forth, it is agreed: (1) The Party of the First Part agrees to install at its own cost and expense the water and sewer mains as shown on Exhibit "A" attached hereto and made part hereof the same as if fully set forth herein. (2) The Party of the First Part agrees in the installation of the water and sewer mains as shown on Exhibit "A" attached hereto, to comply in each and every respect with the. specifications for the installation of the same as set forth in Exhibit "B" attached hereto the same as if fully set forth herein. - • (3) The Party of the First Part by these presents agrees to dedicate for public use the area embraced within the broken or dotted lines shown on Exhibit "A" designating the areas on which no planting of either trees or shrubbery or sidewalks will be made, or obstacles located to interfere with traffic on Woodberry Road as shown thereon, and to include in each and every deed wherein any of said lots or parcels of land shown on Exhibit "A" are transferred by the Party of the First Part, the reservation provided for in this paragraph. It is understood that the '£oregoing dedication for public use shall be satisfied by the reserving of an easement by the Party of the • First Part inuring to the benefit of the Party of the Second Part, when and if the said lands are embraced within the corporate limits of the Town of Leesburg. (4) The Party of the First Part further agrees that the dotted or broken lines as shown on Exhibit "A" covering the easement on sidewalks, trees and shrubbery, referred to in-Paragraph Three above, shall be extended ' from their termination at the boundaries of the corporate limits of the Town of Leesburg, 'to the intersection of Woodberry Road and Market Street for the purpose of notifying any and all purchasers of said lands, and present owners, of the intention of the Town of Leesburg, in Virginia, at a future date, to condemn said lands for the purpose of making Woodberry Road, ' from its intersection with Market Street, North, a secondary road under the Virginia Department of Highways System. (5) It is agreed by and between the Parties hereto that upon 'application by the Party of the First Part for connecting the water and sewer mains shown on Exhibit "A", to the water and sewer mains of the Town of Leesburg in Virginia, that the Party of the First Part will convey, transfer and sign over ''j} to the Town of-Leesburg, all of its right, title and interest An and to said i water and sewer mains and they shall thereupon-become the property of the IJIJ/ Town of Leesburg in Virginia, without charge, obligation or commitment of any kind, except as hereinafter set forth: (a) ' It is agreed by and between the Parties hereto that the Party of • the First Part shall have the benefit of any and all benefits accruing to persons requesting an extension of the water and sewer facilities of the Town of Leesburg in Virginia, if and when a policy providing for' the rein • - bureement of subdividers, or others installing water and sewer mains, is determined upon. (b) It is further understood and agreed between the Parties hereto that in the event the Town. of Leesburg in Virginia shall, by ordinance, l,7 '% provide that persons requesting an extension of water and sewer mains shall pay for same and be reimbursed by an assessment of the Town of Leesburg in • Virginia against intervening, abutting property owners of the property costs of said extensions; that the benefits from said policy shall be accorded the Party of the First Part. • - t: (c) It is understood that the Party of the Second Part intends to, at `, an early date, determine upon a policy with respect to charges for the use of water and sewer facilities of those persons asking for the extension of the present water and sewer facilities of the Town of Leesburg. R 1 65 (6) It is further understood by and between the Parties hereto that the pumping station called for on Exhibit "A" shall be, if and when said facilities in Exhibit "A" are attached to the Town's facilities, turned over to the Town of Leesburg in Virginia, without cost, and the Party of ,the First Part shall, in addition thereto,, and by these presents, agree for and during a period of One (1) year :from the completion thereof, to assume full and complete liability and save the Party of the Second Part harmless from any liability resulting r from the failure of said pumping station to perform, or from any liability or claim resulting from the failure of said pumping station to perform, and in addition, the Party of the First Part hereby,,agrees to turn over to the Party of the Second Part any and all guarantees by the manufacturer, of said' pumpty with respect to performance; that is to say; the Party of the First Part does . IIIby these presents agree to assume any and all liability of any kind for and during a period of One (1) year from the connection resulting from any defects, mechanical or because of the manner of installation, as far as the operation of said pumping station is concerned, and to save the Town of Leesburg harm- less from any liability resulting from such defects during said period. James and unani- mously carried, Frank Raflo was appointed- to serve as Recorder Pro tem. 'B. Powell Harrison, Jr., Chairman-of the Planning Commission for the Town of Leesburg presented the Commission's report on the proposed Master Plan for • the town, presenting an analysis of proposals of five engineers and planners for developing the Master Plan, and stating that the commission felt the Master Plan required a good planner as well as an engineer and that the Com- mission had unanimously agreed to recommend to Council the firm of Perrow & Brockenbrough and Tarrant of Richmond, to do the job, with Garland A. Wood, second choice.
