The Auditor-Treasurer read his monthly report for the month of February, 1955, and presented his current bills, and upon motion of George J. Durfey, seconded by Morton Riddle, 111, and unaminously carried the following resolution was adopted : BE IT RESOLVED, by the Council of the Town of Leesburgin Virginia that the Auditor-Treasurer be and he is hereby authorized and directed to pay the following bills : Virginia Electric & Power Co ; $ &85r85- 285.85 k C. & P. Beavers . . . 18.00 ' _ Total. . . $1, 965.82 ' Upon motion of Morton Riddle, 111, seconded by George J. Durfey, and unaminously carried the following resolution was adopted : WHEREAS, Miss Alice A. Sabin has made application to the Audit- or-Treasurer, for a befund of 1953 taxes in the amount of $4.25 paid on November 17, 1953 because of erroneous assessment , and WHEREAS, the Commissioner of Revenue has certified that said assessment wass in error, THEREFORE, BE IT RESOLVED, by th9 Council of the Town of Lees- burg, in Virginia, that the Auditor- reasurer be and he is hereby authorized and directed to charge oft the 1953 taxes of Miss Alice A. Sabine and refund her the amount of $ 4.25. Upon motion of Reginald K. Gheen, seconded by George J. Durfey , and unaminously carried, the following resolution was adopted : BE IT RESOLVED, by the Council of the Town of Leesburg, in Virginia that the Auditor-Treasurer be andhe is hereby authorized and directed to purchase the Burrough Style P- 201 adding machine from the Burroughs Corporation as per bid of $ 225.00, and that $200.00 of this bill be charged to Captial outlay building improve- ments, and that $25.00 be charged to buildings and grounds. . Mr. Durfey asked that Council go on recorde in extending cong- ratulations to the Times-Mirror on their new office and printing building. f .4' Upon motion of George J. Durfey, seconded by Frank Raflo, 1 e - and unaminously carried the following resolution was adopted : BE IT RESOLVED, by the Council of the Town of Leesburg, in Virginia, that the Council shall adopt as apart of its fiscal policy a procedure whereby proposals for expenditure of funds in excess of the current budget approproation for any department of the 'town, will not be considered by the Council for any action, other than to refer to the finance committee, until said proposal shall have been considered by the finance Committee and its recommendat- ions have been submitted to Council. _ Upon motion of Reginald K. Gheen, seconded by Howard B. Gill and unaminously carried the following resolution was adopted: BE IT RESOLVED, by the Council of the Town of Leesburg, in Virginia, that the b&ll from the Sydnor Pump and Well Company dat- ed 2-28-55 in the amount of 02,638.00 be and it is hereby approv- ed for payment, and that the Auditor-Treasurer is to work a sat- . isfactory agreement between the Town of Leesburg and the said Comp- any for settleing this account. A letter from Mr. John Allen Johnston was read, in which he requested permission to connect the water and sewer lines to a property on the east end of the Town know as the Vepco Sub-Station. Horace Hallett, Recorder and Sanitarian for the Loudoun County. Health Department stated that the Southern States were planning to ask permission to connect it' s building to the town' s sewer line and suggest that s5 me kind of an agreement be worked out between Mr. Johnston, Southern States and the the Totwn regarding this matter, and Upon motion of Frank Raflo, seconded by Gheen and carried by a vote of 4 to 1 Gheen, Raflo, Durfey, and Gill for Riddle ag- ainst, Council requested the Water and Sewer Committee to talk to Mr. Johnston, and The Southern States regarding this matter of water and sewer connecting and report to the Council. A letter from Mr. Lucas D. Phillips was read in which he requested permission to extend the Twon water line to connect to his enroposed sub-division on the east end of town, Council request the Auditor-Treasurer to write to Mr. Phillips and in- form him that Council would not render its decision regarding this request until after it had received the warter report from the Town' s Engineer, which was to be expected between the 20th and 25th of March. Upon motion of Reginald K. Gheen Seconded by Howard B. Gill, and unaminously carried the following resolution was adopted : WHEREAS, the Commonwealth of Virginia, Department of Highways, purposes to construct or otherwise improve a part of State Route 15, within the corporate limits of the Town of Leesburg, between 0.227 Mi. N. of S.C.L. Leesburg and 0.265 Mi. N. of S.C.L. Leesburg (King Street), 'and has prepared and. submitted to the Town-Council plans for the same, designated as Route 15, Project 1853-07, approved January 21, 1955; and - WHEREAS, it is the,opinion of the Town Council that the said construction or other improvement will be of immediate and continuing benefit and advantage to the Town. NOW, THEREFORE, BE IT'RESOLVED: That the Town of Leesburg; through its Town Council, hereby approves the above said plans, and, in consideration of the construction and/or improvement of said Route by the Commonwealth of Virginia, Department of Highways, and the benefits accruing to the Town of Leesburg, by reason of such construction and/or improvement, hereby guarantees to the Common- wealth of Virginia, Department of Highways, the right of way shown on said plans as being required for said construction and/or improvement, together with the right and easement to use such additional widths, if any, that may be required for the proper execution and maintenance of the said construction or other im- provement as are indicated and shown on said plans, as provided under Chapter 64, Acts of the General Assembly of 1930, or subsequent Acts of the General Assembly applicable. n The Town agrees that it will clear, or have cleared, within thirty (30) days from the date of written notice to it's Mayor or Town Manager from the District or Resident 'Engineer of the Department of Highways, at the Town's expense, or 178 without expense to the Commonwealth, the surface of the said right of way and additional widths of all encroachments, utilities, or other things that may interferewith or retard the progress of the work and• future maintenance and use of the said Route and improvement. The Town further agrees, at its own expense, or without expense to the Commonwealth, to relocate and readjust, or have relo- cated and readjusted, such publicly or privately owned pole lines, pipe lines (whether above ground or below ground), conduits or other utilities as may be necessary for the accomplishment of the said construction.or other improvement. - This work is to be done at such time and in such manner as-not to delay or in- terfere with the work to be done by the Department of Highways, its employees or contractors. • It is further understood and agreed that the Commonwealth of Virginia will participate in the costs of securing the required right of way, in ac- cordance with a ruling of the State Highway Commission as follows: "In towns having a population- of less than 3500, the Highway Department, Right of Way Division, in collaboration with the Town Council, will make a care- ful estimate of the cost of right of way, including land, damages, readjustment. of buildings, etc. When the right of way is guaranteed and secured by the town, the Highway Department will participate in the cost up to the amount of the estimate. 'The Right of Way Division will assist the town in securing the right of way and deeds will be taken in the name of the Commonwealth. The deeds will be prepared by the Commonwealth. The local attorney representing the Highway Department will handle the closing of deeds, examination of title, and conduct condemnation proceedings where .necessary. The Commonwealth will pay the legal costs incurred." It is further understood and agreed that in the event one 'or moreproperty owners refuse to execute a deed covering the land required froii their properties for right of way purposes the Town hereby authorizes the Commonwealth of Virginia, Department of Rightways, to institute condemnation proceedings and agrees to pay any court confirmed awards of commissioners over and above the estimated fair value as outlined above. The Town further agrees to save the Commonwealth of Virginia, her offic- ials and her employees, harmless from any and all claims for damages of what- soever nature that may arise from the owners, tenants or lessess of adjoining or nearby lands, as a result of the said construction and/or improvement in accordance with said plans or as a result of the maintenance thereof as so con- structed and/or improved. At a special meeting of the Mayor and Council of the Town of Leesburg in Virginia there were present, Maurice R. Lowen- bach, Jr; George J. Durfey, Reginald K. Gheen, Emmerson H. James, and Frank Raflo, Councilmen. Due to the absence of the Recorder, and unpon motion of Geo- J. Durfey, seconded by Reginald K. Gheen, and unaminously carried Frank Raflo was elected to serve as Recorder. Mr. B. Powell Harrison Jr; Chairman of the Planning Commiss- ion was introduced and he presented a report on the town water and sewage. Other members of the Commission were present and Mr. Perrow of the firm of Perrow end Brockenbrough was also present and dis- cussed this report fully with Council. Messers G111 and Hallett were recorded present at 8:45 P. M. , Upon motion of Reginald K. Gheen, seconded by Emmerson H. James, and unaminously carried, Council requested the Recorder to ascert- ain if it would be possible for a public meeting to held in the County Office Building, April, 5, 1955, 7:3OP.
