The Council agreed to table this matter until its next regular meeting. Mr. Raflo said that since there had been some talk throughout the Town of the cost to the Town for printing certain posters and handbills regarding the bond issue , that he would like to have it entered upon the minutes of this meeting that the said costs for these handbills . were in no way a responsibility of the Town of Leesburg and were being paid for by the Citizens Committee for Water. Mayor Lowenbach requested the Street Committee to investigate the flooding -condition in front of the Tally-Ho Theater and submit such recommendations as they deem advisable to the Council for the correc- . tion of the same. . M. , • there were present : Maurice R. Lowenbach, Jr. , Mayor; Horace M. Hallett, Recorder; Emerson H. James, Howard B. Gill, Reginald K. Gheen, George J. Durvey, Frank Raflo and Morton Riddle, III, Councilmen. • Upon motion of Frank Raflo, seconded by Emerson H. James, and II unanimously carried, the following resolution was adopted: II WHEREAS, Wilbur C. Hall and George F. Weaver, Esquires, Leesburg, Virginia, Agents for John E. Caviness, Ruth A. Caviness, Robert F. . Caviness and.Audrey F. Caviness; and Elijah B. White, Esquire, Lees- • burg, Virginia, Agent for John H. Ours, the same being the sellers and . purchasers respectively, under a contract dated May 3, 1955, pursuant to which the title to said land not having as yet been transferred, have requested the Council of the Town of Leesburg, in Virginia, to rezone a portion of the aforesaid parcel of land covered by said 19'1 • contract, be rezoned from "Residential I" to "Business," said land being all of that portion of the farm known as the "L. G. Caviness Farm, " contained within the Corporate limits of the Town of Leesburg and fronting on the East side of State Highway Route No. 15, the same being South King Street, and containing approximately two and one- half acres of land; and, WHEREAS, pursuant to the laws of the State of Virginia, it is provided that the Town Council is authorized to submit proposed amend- ments or .supplements to any zoning regulations, to the Board of Zoning Appeals for its report and recommendations; NOW, THEREFORE, BE IT ORDAINED by the Council of the Town of Leesburg, in Virginia: • (1) That the Council hereby refers to the Board of Zoning Appeals, for its report and recommendation, the said request of John E. Caviness, Ruth A. Caviness, Robert F. Caviness, Audrey F. Caviness and John H. Ours to chanbe the present designation of that portion of the "L. G. Caviness Farm, " contained within the Corporate limits of the Town of Leesburg and fronting on State Highway Route No. 15,. -the same being South King Street in the said Town, containing approximately two and one-half acres of land, from that of "Residential I" to "Business, " after a public hearing in relation thereto, to be held by the Board of Zoning Appeals in pursuance of law. (2) That the Recorder of this Town shall forthwith deliver a certified copy of this Ordinance to the Board of Zoning Appeals. G. Caviness Farm contained within the Corporate limits of the Town of Leesburg, and fronting on U. S. Route 15, containing approximately two and one- half (22) acres of land. By contract bearing date on the 3rd day of May, 1955, John E. Caviness and Ruth A. Caviness , his wife, and Robert F. Caviness and . Audrey F. Caviness , his wife, the owners of the said' property, agreed to sell the same to John H. Gill, and unanimously carried, the following resolution was adopted: WHEREAS, on May 21, 1954, at a special meeting of the Town Council held in Council Chambers in Leesburg, Virginia, at 5:00 P.M. , a resolution was duly adopted authorizing and requesting The Peoples - 'National Bank of Leesburg, Virginia and The Loudoun National Bank of • Leesburg, Virginia, depositories of the. Town of Leesburg, in Virginia, to pay all checks drawn by the Auditor-Treasurer and countersigned by the Recorder, until "otherwise notified and directed in writing" ; and, ' WHEREAS, on April 12, 1954, the Council of the Town of Leesburg, in Virginia, at a regular and duly called meeting held in Council Chambers, adopted the following ordinance : "BE IT RESOLVED, by the Council of the_Town of Leesburg, in Virginia, that Officers Venable, • Athey and Turner, be retained by the Town on a permanent basis beginning on the first day of May, 1954, to continue to the 31st day of August, 1955, at a salary of $250.00 per month for officer Venable, and $225.00 per month for Athey and Turner; " and, WHEREAS, at a meeting of the Council of the Town of. Leesburg, in Virginia, regularly and duly called and held on April 12, 1954, the following ordinance was adopted: "BE IT RESOLVED, by the Council of the Town of Leesburg, in Virginia, that if charges of failure of a policeman to properly perform their duty or charges of conduct detrimental • to the best interest of the Town be raised against any one of the police officers the said charge will be told at a meeting of the whole Council, and the officer in question be granted an opportunity to speak and defend himself;" and, • WHEREAS, at a regular and duly called special meeting of the Council of the Town of Leesburg, in Virginia, held on April 16, 1954, the Mayor of the Town of Leesburg did in writing notify the Town Council of his veto of the aforesaid ordinances; and, WHEREAS, on June 13, 1955, the Supreme Court of Appeals of the Commonwealth of Virginia, in the proceeding known as Howard B. Gill et al v. William W. Nickels, Mayor, did uphold the right-of the Mayor of the Town of Leesburg to veto ordinances passed by the Town Council; and, WHEREAS, it is now necessary that the Mayor and Council of the Town of Leesburg, in. Virginia, approve, ratify and affirm payments heretofore made by the Auditor-Treasurer to Officers Venable, Athey and Turner commencing on May 1, 1954, to date, and to determine the manner of withdrawal of funds from the depositories of the Town of Leesburg, in Virginia; NOW, THEREFORE, BE IT -ORDAINED by the Mayor and Council of the Town of Leesburg, in Virginia, as follows : (1) That each of the depository banks of said Town, namely The II Peoples National Bank of Leesburg, Virginia and The Loudoun National Bank of Leesburg, Virginia, be and it is hereby authorized and re- quested to pay all checks which are drawn by the Auditor-Treasurer and countersigned by the Recorder, pursuant to all ordinances and resolutions heretofore or hereinafter passed. Morton Riddle, III AGAINST NONE A quorum of the Council being present and voting for the passage of said ordinances, which are hereinafter set forth in full: ORDINANCE NOTICE OF SALE $160,000.00 GENERAL OBLIGATION WATER AND SEWER REVENUE BONDS OF THE TOWN OF LEESBURG, LOUDOUN COUNTY, VIRGINIA The Town of Leesburg, in Virginia, a municipal corporation of the Commonwealth of Virginia, hereby invites sealed proposals for the pur- chase of One Hundred Sixty Thousand Dollars ( p160,000.00) , principal amount of. its. bonds hereinafter described. Each proposal must be en- . -closed in a plain envelope- securely sealed and marked "Proposal for General Obligation Water and Sewer Revenue Bonds" and addressed to the undersigned Recorder at Leesburg, Virginia. 198 . The .proposals must be received on or before 11:00 A.M. (EST) on the .30th day of kigUtnt, 1955, and proposals so received will be opened by the Town Council in the Council Chambers in the Town of Leesburg immediately after such time . The bonds are designated "General Obligation Water and Sewer Revenue Bonds, " are dated October 1, 1955, and are payable serially on October 1 of each year as follows : Four Thousand Dollars ($4,000.00) in each of the years, 1956 to 1960, inclusive; Five Thousand Dollars, ($5, 000.00) in each of the years 1961 to 1965, inclusive; Seven Thou- sand Dollars ($7,000.00) in each of the years 1966 to 1970, inclusive; and Eight Thousand Dollars ($8,000.00) in each of the years 1971 to 1980, inclusive. The bonds are serial coupon bonds and are in the, denomination of One Thousand Dollars ($1,000.00) each. The interest is payable semi- . annually on April 1 and October 1. Both principal and interest, will be payable at The Loudoun National Bank in Leesburg, Virginia. The bonds payabl-e on or after October 1, 1966, shall be redeem- able prior to their respective maturities at the option of the Town of Leesburg, in Virginia, on October 1, 1966, or on any subsequent interest payment date, at par and accrued interest, upon giving suit- able notice of the intention to make such redemption. The bonds re- . deemed at any one time shall be the outstanding .bonds 'bearing the highest identifying' ntimbers. Each proposal submitted must name the rate of interest per annum to be borne by the bonds bid• for and the rate named must be in multiples of one-tenth (1/10) of one per cent and must be the same for all ' the bonds bid for. The bonds are issued under the provisions of Sub-section B of Section 127 of the Constitution of the Commonwealth of Virginia, and in addition, are general obligations of the Town of Leesburg, and the Town is authorized and required by law to levy upon all property taxable by the Town, ad valorem taxes sufficient to pay the bonds and the interest thereon, without limitation as to rate or amount, in the event the rates to be charged for water and sewerage shall fail to produce sufficient revenue to meet said payments. The proceeds of the bonds will be used to construct a water storage reservoir to obtain and maintain an adequate supply of water, and to provide for additions to, and the rearrangement of the water distribution system, and for additions to the present sewerage disposal plant, including pumps, tanks and additional connecting and circulating sewer mains for the Town of Leesburg. The Town will contract with the purchasers of the bonds that the' rates to be charged for services rendered by the system will be fixed and maintained at a level which will produce revenues sufficient to pay for the cost of operation and administration of the sewerage system .(including interest on bonds issued therefor) at an annual amount to be covered in a sinking fund sufficient to pay, at or before maturity, all bonds issued to finance such water and sewerage system, and that the revenues derived from such water and sewerage system will be segregated and applied to the payment of such cost of opera- tion and administration, and the payment of such annual amount. No proposal for less than all of the bonds will be considered. The price offered foruthe bonds must not be less than One Hundred Sixty Thousand Dollars ( p160,000.00) . Bidders must, at the time of making their, bids, deposit a certified or cashier' s or treasurer' s . check for Three Thousand.
