HomeMy Public PortalAbout1955_06_27SPEC • SPECIAL MFF'TING, June 27, 1955. • At a special meeting of the Mayor and the Council of the Town of Leesburg, In Virginia, held in the Council Chamber on Monday, June 27, 1955, at 7 :30 o' clock, P. M. , there Fere present, Maurice R. Lowenbach, Jr. , Mayor, Horace M. Hallett, Recorder, George J. Durfey, Howard B. Gill, Reginald K. Gheen, Frank Raflo, and Morton Riddle, III, Councilmen. Mayor Lowenbach read a letter from The Virginia Department of Highways regarding the construction. on Route 15, in front of the Leesburg Laundry, in which it stated that the sewer line was found • to be higher than the Town plans had shown, and that there would not be as large a drainage area under this street ,as had been con- templated. However, it will be far superior to the drainage that had been in operation in the past. Mayor Lowenbach read an application from Mrs. Francis L. Patton requesting permission to connect a building to the line near the Mon- roe Manor Subdivision. Mayor Lowenbach stated that Mrs. Patton had informed him that Mr. Lowe had advised her that he had had the water and sewer line installed, and that he would not give permission for this request to be granted until she had paid him a substantial a- . ' mount for said connection. After some discussion with the Council, and the Town' s Attorney,. Mayor Lowenbach requested that the Water and Sewer Committee meet with the Town' s Attorney, and Messrs. .Ahalt and Lowe, owners of the Monroe Manor Subdivision, and. seeif this problem could not be corrected to the satisfaction of all parties concerned. - Mayor Lowenbach read another applciation for a sewer connection of The. Leesburg Laundry, and Mr. Kerby Kendell informed the Council that it would be much more convenient for him to make this connection while the construction on Route 15 was being made then after said work had been completed. In view of the fact that the State Water '. Control Board, had requested the Leesburg Laundry to install a hold- ing. tank before disposing it' s sewerage into the Town' s sewerage system, the following resolution was adopted. Upon motion of Reginald K. Gheen, seconded by Frank Raflo, and unanimously carried, . the following resolution was adopted: BE IT RESOLVED, by the Council of the Town of Leesburg, in Vir- ginia, that The Leesburg Laundry, be, and they are hereby granted permission to make the said sewer connection in the street in Route 15, but they shall not be permitted to empty sewerage into the Town' s sewerage system until the State Water Controll Board has assured the Council of the Town of Leesburg that it will be. satisfactory for the Leesburg - Laundry to dispose of it' s waste into the 'Town' s sewer system. Mayor Lowenbach read an offer submitted by Carleton Penn, II, in behalf of a client of his .in the amount of 35,000.00 for the pur- chase of the Tonw Hall building. After some discussion, and upon motion of Frank Raflo, seconded by Howard B. Gill, and unanimously carried, the following ordinance was adopted: / r WHEREAS, it is the desire .of the Tobin Council of the Town of Leesburg, in Virginia, to sell ,the property on the Northeast corner of King and Loudoun Streets on which the Town. Hall is located; and, Il • WHEREAS, said property has heretofore been advertised for sale by the Town Council and bids for the pruchase of same requested; and, • WHEREAS, inquiries have been received with respect to the pur- chase of said property; and, WHEREAS, an offer has been received by the Mayor and Town Council of the Town of• Leesburg," in Virginia, to purchase the said Town Hall property in the Town of Leesburg, Virginia; and, . o9 WHEREAS, it is the opinion of• the Mayor and the Town Council of the Town of Leesburg, in Virginia, that the best interest of the Town would be served by the sale of the said Town Hall property, as hereinafter described; NOW, THEREFORE, BE IT ORDAINED by the Mayor and the Council of the Town of Leesburg, in Virginia, in a duly called meeting held in Council Chambers on June 27, 1955, as follows : (1) That the property known as the Town Hall, in the Town of Leesburg, Virginia, situated on the Northeast corner of King and Loudoun Streets in said Town, be sold as hereinafter provided for, after due publication, and more particularly described as follows : "Beginning at (1) the Southwest corner of the brick build- ' ing pn the above lot ; thence with the West side of• the brick building and with said line extended to intersect the South side of the brick building on the Semones lot N 27 deg. S • 71.4 feet to (2 ) thence with the South line of the Semones lot S 63 deg. E 36.3 feet to (3) a point 0.5 feet South of the Southeast corner of the brick building on the Semones lot ; thence with a new division line through the Town of Leesburg property S 80 deg. 58 min. E 35.8 feet to (4) ; thence S 63 deg. E 8.8 feet to (5) the Northwest corner of the Fire Department building; thence with the West side of the Fire Department building S27• deg. W 32.1 feet to • (6 ) an offset in said building; thence with said offset S 63 deg. E 0.9 feet to (7) the Northeast corner of the build- ing on the above lot ; thence with the East side of the brick building on the above lot S 26 deg. 51.min. W 51.66 feet to (8) the Southeast corner of said building, said point being 7.6 feet North of the curb line of Loudoun Street ; thence N 62 deg. 04 min. W 80.2 feet to the point of beginning, con- taining 6,038.27 square feet, more or less ." (2) That the property known as the Fire Department Building, - situated immediately to the East on• Loudoun Street , adjoining the Town Hall property described in Paragraph (1) above, be sold. (3) That the property of the Town of Leesburg, in Virginia, described in Paragraphs (1) and (2) above, be sold as a unit, reserving the right to the Town of Leesburg, - in Virginia, to use said property described in Paragraph (2) , on which the Leesburg - Volunter Fire Department' s Houma is now located, for so long as said property remains the principal and main Fire House Station in the Town of Leesburg, in Virginia. (4) That bids will be received up to 5 o' clock P. M. (EST) on July 11, 1955, for the purchase of the foregoing properties • mentioned in Paragraphs ( 1) , (2) and (3) hereinabove, either as a unit or as individual tracts , at which time the said bids will be- opened by the Auditor-Treasurer of the Town of Leesburg, in - Virginia. • (5) That the Town Council reserves the right to reject any and all bids , and further, said Town Council reserves the right to accept the most advantageous and best bid received. (6 ) That all person desiring to bid for the purchase of said property shall address their proposal to George E. Ward, Auditor-Treasurer of the Town of Leesburg, in Virginia. • (7) That no bid of less than Ninety Per Cent (90%) of the appraised value of said property will be considered, said pro- perty having heretofore been appraised by three (3) independent - appraisers , namely, Arthur S. Jenkins , Harry I. Tiffany and John Allen Johnston, residents of the Town of Leesburg, in Virginia, as follows : For the Town Hall property described in Paragraph (1) hereinabove $ 30,000.00 - 203 For the property on which the Fire House Station of the Leesburg Volunteer Fire Department is now situated, and des- cribed in Paragraph (2), hereinabove .10,000..00 For both the properties described in Paragraph ( 1) and (2) above 40,000.00 (8) That immediately after the opening of said bids on July 11, 1955, as hereinabove provided for, objections., if- any, to said sale will be heard. .(9) That the Auditor-Treasurer of the Town of Leesburg, in -Virginia, is hereby authorized, instructed, directed and request- ed to publish this. Ordinance, providing for the notice of sale of said property., for .two (2consecutive weeks, commencing June 30, 1955, in the BLUE RIDGE HERALD, Purcellville, Virginia, and THE LOUDOUN TIMES MIRROR, Leesburg, Virginia, newspapers published • and having general circulation in Leesburg and in Loudoun -County, Virginia. . /Si Horace M. Hall had requested that the Town of Leesburg turn back to Mr. Arthur Godfrey the property' known as the, "Air Port Proper- ty". Council tabled this matter until a later date. Mayor Lowenbach informed the Council that there would be a - Special Meeting of Council, Tuesday, July 5th, at 7 :45 P. M. At a regular-meeting of the Mayor and- Council. of the Town of Leesburg,- in Virginia, held- in the Council Chamber, Monday, July 11th, at .7 :30 -o!-clock P; M. , there were present Maurice R. Lowen- bach, Jr.-, Mayor,-Horace M. Hallett, Recorder, George J. Durfey, _ Reginald B. Gheen-,--Howard- -B.--Gill, Emmerson H. James, Frank Raflo, and Morton Riddle; III,--Councilmen. Maurice Lowenbach -submitted -his resignation as Mayor of the Town of Leesburg--giving his -reason--that--since he had moved his residence, outside-of -the-corporate-limits , he felt that. he was not eligible to hold this position-any-longer. • And upon Motion -of Frank-Raflo;--seconded by Morton Riddle, III, and unanimously carried, the following resolution was adopted : BE IT- RESOLVED, by the Council of -the Town of- Leesburg, in Virginia,- that--the -Council does hereby -accept the resignation of Mayor Lowenbach--with deep regrets.
