Gill, • and carried by a vote of three to nothing, the following resolut- ion was adopted : RESOLUTION • WHEREAS, the Town of Leesburg, in Virginia, deos not have a qualified engineer to inspect water and sewer installations in the streets of said Town, or in the streets in -subdivisions in or adjacent to the Town of Leesburg; and, WHEREAS, it is the desire of the- Council of the Town of Lees.- burg, in Virginia, to obtain the services of a competent and qualified engineer for the inspection of the installation and the construction of water and sewer mains and pumping stations in- cident thereto; • NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Town of Leesburg, in Virginia, as follows ; SECTION I : The office of Engineer Inspector for the Town of Leesburg, in Virginia, be, and it is created. • SECTION II : George J. Dufey, a competent and qualified engineer, be, and he is hereby appointed Engineer Inspector for the Town of Leesburg, in Virginia. • SECTION III : The said Engineer Inspector shall, when request- ed by either the Auditor-Treasurer of the Town of Leesburg, in Virginia, or by other interested persons , inspect all water and sewer installations and/or pumping stations incident thereto, and upon the completion of said inspection and certification by cr- - the- said Engineer Inspector to the Auditor-Treasurer, the Auditor- Treasurer of the Town of Leesburg, in Virginia, be, and he is here- by authorized to issue any and all permits , licenses or athori- zations .with respect to the use of said water and sewer and/or pumping station facilities as may be requisite. ' SPECIAL, AUGUST 15, 1955. At a special meeting of the Mayor and Council of the Town Of Leesburg, in Virginia, held in the Council Chamber, on August 15, 1955, at 2 :OO' P.' M. , there were present Emerson H. James, flyor, George J. Durfey, Howard B. Gill and Frank Rano. Due to the absence• of the Recorder, and upon motion duly made, second and carried, Frank Raflo was elected to serve as Recorder Pro-tem. 231 ` Bids on the sewer construction work along Route 7 were opened. The following bids were received : Alexander, Inc. 6 25,030.80 B. A. Bowles Company 6 18,439.10 J. S. McCanless 6 17,539.00 ' George Dwyer 6 17,819.35 No action was taken regarding the above mentioned bids. There being no further business , upon motion duly made seconded and carried, Council adjourned.E4,� (i • g6„ _ Recorder Pro-tem Mayor RESOLUTION • WHEREAS, the Council of the Town of Leesburg, in Virginia, on July 11, 1955, pursuant to the provisions of Section 15-781 of the Code of Virginia, 1950, as amended, proposed the adoption of a Subdivision- Ordinance for the Town of Leesburg and the area within a distance of two (2) miles from the Corporate limits of said Town, as provided for in Section 15-786 of the Code of Virginia, 1950, as amended; and, WHEREAS, notice of the intention to adopt said Subdivision Ordinance, pursuant to the provisions of Section 15-782 of the Code of Virginia, 1950, as amended, was published for two (2) successive weeks in THE BLUE RIDGE • HERALD, a newspaper having general circulation in both Loudoun County and the Town of Leesburg, on July 14 and July 21, calling and specifying a public hearing on August.8, 1955, at 8:00 P. M. at the Council Chanbers in the •r& Town Hall of the Town of.Leesburg, where allpersons affected were invited to tc appear and present their views; and, • WHEREAS, the said hearing was duly called and held; and, WHEREAS, there appeared at `said hearing the chairman of the Planning Commission of the Town of-Leesburg,. in Virginia; and the chairman of the Loudoun County Planning Commission, who expressed their views with respect to said ordinance and suggested certain amendments there to, • NOW, THEREFORE, BE IT ORDAINED, by the Mayor and Council of the Town of Leesburg, in Virginia, as follows: SECTION I. That the regulations entitled Subdivision Ordinance for the Town of Leesburg as hereinafter set forth be and they are hereby adopted subject to such approval as to the area outside the Town Corporate Limits as is required by law, the same being the proposed Subdivision • Ordinance as here'_to fore approved and adopted on July 11, 1955, and published in THE BLUE RIDGE HERALD, a newspaper with general circulation in Loudoun County and Leesburg, for two (2) successive weeks on July 14 and July 21, respectively, as amended, in accordance with the views expressed at the public hearing, .held on August 8, 1955, in the Council Changers in III the Town Hall.of the Council of the Town of Leesburg, in Virginia, which said regulations as published and as amended, shall be known as the "Subdivision Ordinance Ordinance of the Town of Leesburg, in Virginia,” adopted August 15, 1955, and are as follows: SUBDIVISION ORDINANCE FOR THE TOWN OF T,FFSBURG • An Ordinance establishing regulations governing subdivisions within the Corporate Limits of the Town of Leesburg, in Virginia, and beyond, within a distance of two (2) miles from the Corporate Limits of the Town of Leesburg, in Virginia, as provided for in Section 15-786 of the Code of Virginia, 1950, as amended, and providing, among other things, for the size, scale and other details of the plat to be recorded for the harmonious and economic development of the Town of Leesburg, in Virginia,- and its environs, 23-2 • for the coordinatiomof streets within all subdivisions subject to this Ordinance, and with other existing or planned streets within the region in question, for widths, grades and drainage of streets, for adequate open spaces, for traffic, recreation, light and air, and'for a distribution of population and traffic which will tend to create conditions favorable to health, safety, convenience and prosperity, for the other purpdses'as • hereinafterset forth: BE IT ORDAINED, by the Council of the Town of Leesburg, in Virginia, as follows: (1) That the within proposed Ordinance shall be published once a week for two (2) successive weeks in THE BLUE RIDGE HERALD, .a newspaper published in Purcellville, Loudoun County, Virginia, and having general circulation in the Town of Leesburg, and in Loudoun County, Virginia. (2) That such publication shall be in the form of the pro- - - posed subdivision ordinance, and, - - -- (3) That the publication of said notice of intention to adopt the proposed ordinance shall specify -that a hearing shall be held in the Council Chanbers of the Town Council of the Town of Leesburg, in Virginia, at the corner of King and Loudoun Streets of said Town on August 8, 1955, at 7:30 o'clock, P.M. (EST), and, (4) That the publication of said proposed subdivision ordi- nance shall commence not later than the issue of THE BLUE RIDGE HERALD of • July iii, 1955, and that at said hearing on August 8, 1955, and opportunity will be afforded to any person affected, who m$y appear and present their views. (5) The Recorder of the Town of Leesburk, in Virginia, shall forthwith notify in writing the Clerk of the Board of Supervisors, Loudoun .County, Virginia, of the proposal of the Town of Leesburg, in Virginia, to adopt the within ordinance, by delivering a certified copy of this ordinance to the smidCClerk of the Board of Supervisors, and the Auditor-Treasurer in said writing shall request the. Board of Supervisors of Loudoun County, Virginia, to refuse or to approve or disapprove the same, all as provided by Section 15-786 of the Code of Virginia, 1950, as amended. (6) That the provisions of the within ordinance are hereby established on an interim basis and shall be in full foree and effect on and after July 11, 1955, and shall continue in effect until September 1j 1955, unless disapproved by the Board of Supervisors of Loudoun County, Virginia, as provided for in Section 15-786 of the Code of Virginia, 1950, as amended, or amended by the Council of the Town of Leesburg, is Virginia, following the public hearing, after final publication as hereinabove provided for, and prior to final adoption. (7) That the provisions contained in any subdivision ordinance heretofore adopted by the Council of the Town of Leesburg, in Virginia, are hereby repealed from and after July 11; 1955. (8) That the repeal provided for in the preceding section of this ordinance shall not affect any offense or act committed or done, or any penalty or forfeiture incurred, or any contract or right established • or accruing before the said July 11, 1955, nor shall it affect any prosecution, suit or proceeding pending, or any judgment rendered on or prior to the said July 11, 1955. . (9) The Auditor-Treasurer of the Town of Leesburg, in Virginia, is hereby requested, authorized and directed to file a copy of this 'a ordinance, including the within subdivision control ordinance, with the Clerk of the Circuit Court of Loudoun County, Virginia, forthwith.
