SPECIAL AUGUST 30, 1955.
At a special meeting of the Mayor and Council of the Town of •
Leesburg in Virginia, held in the Council Chamber on Tuesday Aug-
ust 30, 1955, at 12 o 'clock noon there were present Emerson H. James
Mayor, Reginald K. Gheen, Howard B. Gill, George J. Durfe , Frank
Raflo, and Morton Riddle, lll, Councilmen.

Due to the -absence of the Recorder and upon motion duly made sec-
onded and carried Reginald K. Gheen was elected to serve as Record-
er Pro-tem.
Mayor James stated that the meeting had been called pursuant to
a published notice regarding the sale of the General Obligation wat-
er and sewer bonds.
The Recorder of the said Town react the following proposed ordinance, and
after the Council had considered said Ordinance, on motion of Frank Raflo, •
seconded by Howard B. Gill, and carried by the following recorded vote: ' •

An ordinance accepting bid for $$160,000.00
General Obligation Water and Sewer Revenue
' Bonds; designating method of delivery of
• bonds and coupons; collection of the pro-
ceeds of sale thereof; and providing for
' deposit of funds derived from sale of bonds. .
WHEREAS, pursuant to and in conformity with ordinances heretofore passed by
the Council of the Town of Leesburg, in Virginia, including an order passed June
20, 1955, providing for the advertisement of sale of bonds and the time for
opening the bids made for the purchase thereof; and,

WHEREAS, said sale of bonds was advertised in THE BLUE RIDGE HERALD,
Purcellville, Virginia, a newspaper published and having general circulation in
Leesburg and in Loudoun County, Virginia, and in THE BOND BUYER, 67 Pearl Street,
New York City, New York,• said advertisement reciting that bids would be received
at a meeting to be held in the Council Chambers at Leesburg, Virginia, at 8
o'clock P.M. (EST) on July,'1955, when said bids would be opened by the Town
Council; and,

WHEREAS, the following bids were submitted and considered:

WHEREAS, the said Council deems it most advisable to accept the bid of
F. W. CRAIGIE & CO., that being the most advantageous bid received for said One
Hundred Sixty Thousand Dollars ($160,000.00) General Obligation Water and Sewer
Revenue Bonds of said Town, and which said bid is in the amount of One Hundred
Sixty Thousand Two Hundred Forty Dollars ($160,240.00), with an interest rate of
2.70 Per Cent; and,
WHEREAS, the said Council desires to reject and not to accept the following
bids: -

NOW, THEREFORE, BE IT ORDAINED, by the Council of the Town of Leesburg,
Virginia, as follows:

(1) That the bid of F. W. Craigie & Co., Richmond, Virginia, for said
One Hundred Sixty Thousand Dollars ($160,000.00) General Obligation Water and
Sewer Revenue Bonds Which bid is in th& amount of One Hundred Sixty Thousand
Two Hundred Forty ($160,240.00) with an interest rate of 2.70 Per Centum, be
and the same hereby is accepted and approved, and the Treasurer of the said Town
hereby is authorized, instructed and directed to depostit the check of Thirty Two
Hundred Dollars ($3200.00), which was enclosed with said bid, to the credit of
the said Town in a special account entitled "Town of Leesburg, Leesburg, Virginia,
General Obligation Water.and Sewer Revenue Bond Account," said deposit to be .
made in The Loudoun National Bank, Leesburg, Virginia.
(2) That the following bids be and the same are hereby rejected and not
accepted: ,

(3) That Horace M. Hattett, Recorder of the said Town, be and he hereby
is authorized, instructed, directed and requested to return immediately the checks
• of the foregoing, whose bids were rejected and not accepted.
(4) That after said bonds shall have been printed and properly executed, and -•�
when the payment of the balance due of the said issue of One Hundred Sixty
Thousand Dollars ($160,000.00) General Obligation Water and Sewer Revenue
Bonds shall have been made to the said Town, George E. Ward, Auditor-Treasurer
of the said Town be and he hereby is authorized, empowered, instructed and
directed. to deliver said bonds and coupons to F. Q. Craigie & Co., of Richmond,
Virginia, the purchaser thereof, or::in the event said purchaser desires to
make settlement in its home city, then the said George E. Ward, Auditor-Treasurer,
shall deliver said signed bonds and coupons to The Loudoun National Bank,
Leesburg, Virginia, and request said bank to draft on the said purchaser
in the sum of One Hundred Fifty Seven Thousand and Forty Dollars 0$157,040.00),
with interest on One Hundred Sixty Thousand Dollars ($160,000.00)'
at Two and 70100 Per Centum (2.70), from October 1, 1955, and to forward
said bonds and coupons with draft for collection to a bank or trust company
designated by the purchaser of said' bonds, for delivery on payment of the
balance due on the purchase price, as provided by said draft.

Upon motion of Morton Riddle,III, seconded by George J. Durfey and .
unanimously carred the following resolution was adopted:
WHEREAS, the Town of Leesburg, in Virginia, a municipal corporation
chartered by the Acts of Assembly of 1936, pursuant to Section 3, subsection
- (t) of the charter of said Town, and the general law of this State, on the
6th day of October, 1941, 1946, duly passed an ordinance creating and
• establishing the Leesburg Volunteer Fire Company, and authorizing the Company to
pass by-laws, rules and regulations, not in conflict with the laws of this
• State and the ordinances of the Town, for the purpose of carrying the Company's
objects into effect; and,
• IWHEREAS, the Council of the said Town, on or about the 1st day of June, 1953,
gave its consent to the Leesburg Volunteer Firu Company to lay a water pipe line
from a point on Ayr Street (Dry Mill Road) and extending in and along Ayr
Street to a point on the Southern side of Loudoun Street, thence in and along
the Southern side of Loudoun Street in an easterly direction to a point just
west of what is known as the "Mitchell" property; and,
WHEREAS, the aforesaid action of the Town was not recorded, said water pipe
line has been laid, and, it is believed that the action taken by the Council
on or about the 1st day of June, 1953, relating to the laying of the said water
line should be ratified, approved and confirmed, and recorded in the minute
books of said Town; and,
• WHEREAS, the Circuit Court for Loudoun County, on the 15th day of June,
1954, in the chancery cause of Matthew Pulliam, et al, Trustees for the
Leesburg Volunteer Fire Company, Leesburg, Virginia, v. G. Shirley.Myers,
et al, Docket No. 1381, granted to the said G. Shirley Myers "the perpetual
right to maintain and repair the water line established by the Leesburg
Volunteer fire Department" along the South side of Loudoun Street;
NOW, THEREFORE, BE IT RESOLVED: -.
(1) That the action of the Council of the Town of Leesburg, in Virginia,
in giving its consent to the Leesburg Volunteer Fire Company to lay a water
line along Loudoun and Ayr Streets as hereinabove set out, and as set out
111 .in the decree of the court -in the chancery cause of Matthew Pulliam, et al
V. G. Shirley.Myers, et al, Chancery No. 1381, be and the same is hereby
ratified, approved and confirmed,
(2) That the said G. Shirley.Myers and Alma S. Myers, his wife, their
heirs and assigns forever, are hereby granted an easement and the perpetual
right to maintain and repair the said water line located about 110 feet South
of Loudoun Street and extending in and along Ayr Street to a point on the
Southern side of Loudoun Street; thence in and along the Southern side of
Loudoun Street in an Easterly direction to a point just West of the Mitchell
property and then along the Eastern edge of the Leesburg Volunteer Fire
Department property in a Southerly direction for a.distance of _872 feet to a
tee, said water pipe line extending for a distance of approximately 9254 feet,
exclusive of the distance across Ayr Street to the Harrison property; and that
in the event said pipe line shall for any reason be removed, disturbed or its
location interfered with, or covered by sidewalks or streets, so as to inhibit
or preclude the repair and maintenance of said water pipe by the said G. Shirley
Myers,'his heirs and assigns forever, then and in that event, the repair and
maintenance of said line shall be the responsibility of the Town of Leesburg,
in Virginia, and in the event that it becomes necessary at any time to
excavate for the repair and maintenance of said line, the Town of Leesburg, in
Virginia, reserves the right to do and make anyyand all necessary repairs.

Upon motion of Howard H. Gill, seconded by George J. Durfey, and unanimously'
' carried the following resolution was adopted:

WHEREAS, the Mayor and Council of the Town of Leesburg, at a duly called
special meeting, have this day accepted the bid of F. W.• CRAIGIE AND COMPANY
for the sale of certain general obligation water and sewer bonds for the

/ improvement, among other things, of the water sup y and distribution system of
the Town of Leesburg, in Virginia; and,
WHEREAS, under an ordinance duly passed on June 20, 1955, the Mayor and
Council of the Town of Leesburg, in Virginia, determined to establish water
and sewer rates which would assure the payment of the interest and principal on the
bonds to be issued in payment for the construction and installation of said
water and sewer lines; and,
WHEREAS, upon investigation and report by the Sewer Committee of the
Town of Leesburg, in Virginia, after consultation with Messrs. Perrow and
Brockenbrough, Consulting Engineers for the Town of Leesburg, in Virginia,
have determined that in order to meet payments of interest and principal on
said bonds, it is necessary and advisable that a sewer service charge be
established in the amount of one-half of the water fee changed all users
thereof; .
. NOW, THEREFORE, BE IT ORDAINED by the Mayor and the Council of the Town
of Leesburg, in Virginia, in a duly called special meeting of said Council
held in Council Chambers on the 30th day of August, 1955, at which all
members of the Council and Mayor were present, as follows:
. (1) That beginning with the quarter ending November 20, 1955, there
be assessed and charged to all persons within or without the Town of Leesburg,
in Virginia, using the sewer facilities of said Townlor •rho have'available
for use said sewer facilities, a •charge of one-half of the amount of their
said. water bill for said guar er, and that said charge shall continue for each
' and every quarter until further order of the Council.
(2) That the Auditor-Treasurer be and he is hereby authorized and
directed to notify all users of the establishment of said sewer charge.
(3) That the Auditor-Treasurer be and he is hereby authorized and .
"directed to notify all users whether within or without the Corporate limits,
of the Town of Leesburg, in Virginia, of the establishment of the
assessment of said charge, and that said charge as hereinabove provided for, shall
be in full force and effect from and after the date of the passage of this
. ordinance, both with respect to users within and without the Corporate
limits of the Town of Leesburg, in Virginia. •

At a special meeting of the Mayor and Council of the Town of Leesburg,
in Virginia, held in the Council Chambers on Thursday September 1, 1955,
at 10 o'clock A.M. There were present: E. B. 1Thite, Mayor, George J._Durfey,
Reginald K. Gheen, Howard B. Gill, C. R. Hollandsworth, C. R. Lytle and
Thelma J. Smoot, Councilmen.

The Mayor and all members of the Council with the exception of the
Recorder were duly sworn in.
Due to the absence of the Recorder and upon motion duly made seconded
and carreid Reginald K. Gheen was elected to serve as Recorder Pro-tem.
Upon motion of George J. Durfey seconded by Howard B. Gill, and unanimously
carried the following resolution was adopted: •
