NOVEMBER 12, 1962
1. INITIATION: The regular meeting of the City Council of the City
of Temple City was called to order by Mayor Tyrell at 7 :35 P. M.
2. The Mayor then led the Pledge of Allegiance to the Flag.
3. INVOCATION; Invocation was given by Rev. Hamby of the Community
Methodist Church of Temple City.
4. ROLL CALL :.

ALSO PRESENT: City Attorney Shatford and City Manager Woollett
5. APPROVAL OF MINUTES:
A. Regular meeting of October 22, 1962.
City Manager ,loolLett referred to page 2 the second paragrapl
regarding the UNICEF permit issued to Mrs. Glenda Swartout
to show a roll call vote as follows:

Also on page 3 item No. 12, the time of the Public Hearing
was set for 8 :30 P. M. Also page 7, item No. 17, the roll
call vote of Councilman Merritt should be just "AYE" and in
discussion prior to the vote it should be stated he would
vote in favor of denial of the license only by reason of the
recommendation of the Traffic Commission due to inadequate
parking area,... City Attorney Shatford corrected the wording
of his 'regal opinion rendered in regard to the Public Hear-
ing in the 5th paragraph to read as follows: "that the Hear-
ing was properly held and conducted according to Section
101 of Ordinance No. 58 -60 of the County of Los Angeles
adopted by the City of Temple City ".
Councilman Merritt moved to approve the minutes of the regular
meeting of October 22, 1962, as corrected, Councilman Dickason
seconded, roll call vote as follows:

B. Minutes of Adjourned meeting of October 25, 1962.
Councilman Fitzjohn moved to approve the minutes of the adjourn-
ed meeting of October 25, 1962, as mailed, Councilman Merritt
seconded, and carried by the following roll call vote:

C. Minutes of Special Meeting of October 29, 1962.
City Manager Woollett referred to page 2 paragraph 3 regarding
Civil Defense and added that Mayor Tyrell had appointed Council-
man Dickason to serve on the Civil Defense Committee together
with Director Woollett and Deputy Director Sale. Councilman
Dickason moved to approve the minutes of the Special Meeting; of
October 29, 1962, as corrected, Councilman Fitzjohn seconded,

38751. Following; a lengthy discussion Councilman Fitzjohn moved
to table this ordinance until the next meeting with the City
Attorney to revise the ordinance according, to the previous dis-
cussion, Councilman Dickason seconded, roll call vote as follows.

10. PUBLIC HEARING 7:457. M. Curb & Gutter
City Manager'Woollett advised this petition for curb and cutter
on the north side of Freer St. represented 32% of the frontage
property ownership or a total lineal footage of 685.0 ft. of
the block total lineal footage of 835.12 ft. Mayor Tyrell de-
clared the Public Hearing opened and asked if anyone wished to
speak for or against the petition. This petition covers the
north side of Freer St. between Halifax and Pal Mal. No one
came forward at this time. Councilman Dickason moved to close

City Manager Woollett advised on the south side of Freer St.
between Doreen and Pal Mal a petition for curb and gutter was
submitted representing 100% of the property owners and concerned
369.5 lineal feet. Mayor Tyrell declared the Public Hearing op-
ened, and asked if anyone wished to speak for or against the
installation. No one came forward at this time. Councilman
Fitzjohn moved to close the Public Hearing, Councilman Dickason
seconded, roll call vote as follows:

1 1 . PUBLIC HEARING: 7:50 P. M. Curb & Gutter
City Manager Woollett advised a petition had been received for
curb and gutter on the east side of Welland Ave. from Danies To
Freer representing 68.°%6% of frontage and 710.07 feet of a total
lineal footage of 1031.67 ft. Mayor Tyrell declared the'Public
Hearing opened and asked if anyone wished to speak for or again-
st. Mr. Wm. Holder, 5326 Welland spoke in favor of the petition.
No one spoke against the installation. Councilman Merritt moved
to close the Public Hearing, Councilman Dickason seconded, roll
call vote as follows:

12. APPROPRIATION OF UP TO $1000. for Xmas tree decorations. City
Manager Woollett advised due to the new proposal made by the
Jr. Chamber of Commerce regarding Xmas decorations and which
would have used the budgeted money a little differently than
originally proposed, and which the Council considered and then
later withdrew their approval of that project, left the matter
somewhat in a state of indecision. For this reason he recommend
ed the Council now appropriate $1000. for Xmas tree lights as
budgeted, Councilman Fitzjohn so moved, Councilman Dickason se-
conded, roll call vote as follows:

13. PUBLIC HEARING: 0:00 2. M. Mr. & Mrs. Henry Fricker - appeal from
granted variance.
City Manager 'Woollett explained the Planning Commission after
holding a Public Hearing and considerable study had granted a
variance to the above petitioners with conditions one being a
time limit of three years to re- locate in the proper zone and
limiting the hours for operation of power tools. A petition was
received requesting the repeal of this decision and inasmuch

as the operation of manufacturinc is not permitted in the exist.
Inc zone it would require moving to a new location at once or
to cease and desist the manufacturing of green houses. The pe-
tition was signed by Mr. & Mrs. Nolte, Mr. & Mrs. Tolman, Mr.
& Mrs. Clyde Davis.
Mayor Tyrell declared the Public•Hearinc opened and asked if any
one wished to speak in favor of the petition.
Mr. Clyde Davis, 5234 Sereno Dr., spoke for the petitioners re-
questing the repeal. Mrs. Clyde Davis also spoke in favor of
the petition. No one else came forward,
Mayor Tyrell asked if anyone wished to speak against the peti-
tion.
Mr. Fricker, owner of the property and business involved spoke
against the petition and in support of the variance granted by
the Planning Commission, that they were complying with all con-
ditions imposed and expected to re- locate an or before the ex -`
piration date of the variance, The following people spoke in
support of the granted variance: Dean Rasmussen, 5226 Sereno Dr,
Mrs. Wilbur, 5262 Sereno Dr., Fred Peebles, 5235 N. Sereno, R.J.
Said and Mrs. Richard S::id, both of 5423 Sereno Dr., Mrs. Jack
Fassett, 5249 Sereno Dr., and Mrs. Fricker, 5240 -48 Sereno Dr.
Following lengthy discussion and questioning of each person tes-
tifying, Councilman Fitzjohn moved to close the Public Hearin°,
Councilman Dickason seconded, and carried unanimously. Mayor4
Tyrell declared the Public Hearing closed. Following discussion
of the Council Councilman Dickason moved that the appeal be
denied, Councilman Fitzjohn seconded, roll call vote as follows:

Mayor Tyrell declared a five minute recess at this time,
14. A;r!ARD OF BIDS FOR OUTDOOR LIGHTING SYSTEM !.T LIVE OAK PARK
The City Manager stated that pursuant to instructions of the
Council we went to bid for the outdoor lighting system at Live
Oak Park and 8 Lids met requirements with a low bid of $29S2.
from Cooke Electric Co. of Temple City, and recommended the
Council award the bid to that Company and instruct the City
Attorney to draw the proper contract and for the Mayor and City
Clerk to be authorized to sign such a contract, Councilman
Merritt so moved, Councilman Fitzjohn seconded, roll call vote
as follows:

15. Nr'ARD i NG OF BIDS FC; INSTALLATION OF STEEL PICNIC SHELTER AT
LIVE OAK PARK:
The City Manager advised we went to bid for the steel picnic
shelter at Live Oak i ?ark and two companies submitted bids, the
low bid being $3130. from Rheem Metal Products of Hunt i roc tot:
Park. He recommended the Council award the contract to Rheem
Metal Products and instruct the City Attorney to draw the con-
tract and to authorize the Mayor and City Clerk to sign such
contract, Councilman Fitzjohn so moved, Councilman Merritt se-
conded, roll call vote as follows:

16. TEMPLE CITY PARK 0G DISTRICT #1 .
Al. Krell, project encineer,presented a map of the proposed park-
in° district involving` lots south of Las Tunas Dr. between
Kauffman on the east and Cloverly on the west. The estimated
cost of the land to be acquired would be $131,950, improvements
$16,350., a total of $173,300. He stated the estimated amount
of assessment per 25 ft. lot at $2125. for 20 yr, bond at 5% int.
Following discussion Councilman Fitzjohn moved to approve the
proposed boundaries as set forth on the map submitted, Councilman

17. APPEAL WITH RESPECT TO PUBLIC HEARING HELD: JOLLY COACHMAN
Regarding an appeal presented appealing the decision of the Coun•
cil made at the Public Hearing on October v and claiming the
Hearing illegal, the City Attorney answered the petitioners as
follows: "In my opinion the appeal is without fact. The Public
Hearing held was completely with the law Sections 101 -102,
58 -60 County of Los Angeles, and there is no basis for considera
tion of an appeal and it WAS ,a legal Hearing." Councilman
Merritt moved to adopt the legal opinion of the City Attorney
as stated and mailed under date of Nov. 12, 1962, and to deny
the appeal, Councilman Dickason seconded, roll call vote as
follows:

18. AMERICAN CANCER SOCIETY: Cha fl table Solicitation permit request.
City Manager Woollett read a letter from the American Cancer
Society requesting a charitable solicitation permit for their
annual drive for the month of April, 1563. Councilman Fitzjohn
moved to grant the .permit, Councilman Dickason seconded, and
carried unanimously.
19. TRAFFIC COMMISSION RECOMMENDATIONS:
#5. Additional striping Las Tunas Dr. at Sultana
#6Postponement curb return installation on Baldwin, and place-
ment of intersection signs.
#7. 2.hr. parking, Camellia between Las Tunas & Workman.
#10. 30 mph signs at mi. intervals Woodruff & Temple City Blvd,
#12. Revision of channelization between Rosemead & Muscatel on,
Las Tunas Dr.
#13. Additional striping, stop bar pavement markings and stop
signs
#14. Council approval of proposed Bicycle & Pedestrian Safety
Brochure.
Following review Councilman Dickason moved to approve items #5,
#6, #7, #10, #12, #13, and #14, Councilman Fitzjohn seconded,
roll call vote as follows:

#8. Overnight parking. George Envall, Traffic Advisor, advised
due to the number of complaints the Commission recommended that
this be enforced on a complaint basis only due to the number of
problems that have come up with enforcement of the County ordi-
nance. Following discussion Councilman Merritt moved that the
overnight parking ordinance on all streets be on a complaint
basis only, Councilman Fitzjohn seconded, roll call vote as
follows:

Mrs. Georgia Maxey, Chairman of the Traffic Commission, recom-
mended to the Council that a new ordinance be drawn. She ad-
vised they have investigated 8 or 10 different cities who do
have a permit system with permits limited to only where there is
no other way to handle the matter. Councilman Fitzjohn moved
to refer this matter to the staff For preparation of an ordi-
nance, Councilman Merritt seconded, and carried unanimously.
#i-5i Railroad Crossing Gates at Encinita & Lower Azusa. City
Manager Woollett presented the agreements whereby the Southern
Pacific Railroad would pay for 50% of the cost of installation

for full control Flashers and gates, the Public Utilities 25%
and the cities involved, Rosemead and Temple City paying 25 %,
which would amount to $k,000. for each City. Also maintenance
was to be shared with 25% for each City to pay. Following dis
cussion Councilman Fitzjohn moved to approve the contract as
submitted with costs as indicated, and instruction that these
documents be forwarded to the City of Rosemead, and at such time
as the Mayor and City Clerk of that City are instructed to sign
these agreements, that the Mayor and City Clerk of this City
also be instructed to sign them, Councilman Dickason seconded,
roll call vote as follows:

20. RESOLUTION NO. 62 -246: ,arrants & Demands.
Following discussion Councilman Merritt moved to adopt Resolu
tion No. 62 -246, warrants and demands in the sum of $10,267.33,
Nos. 1865 and 1954 and Nos. 1975 through 2063. Councilman Mer-
ritt seconded, roll call vote as follows:

There followed a discussion regarding preparation of the Resolu-
tion of warrants and demands and the Council agreed to condense
the payroll into one total from each department in the future As
rather than as at present enumerating each individual employee.
21. RESOLUTION NO. 62 -2L :3: Transfer of Petty Cash Fund.
Councilman Merritt moved to approve Resolution No. 62-243

22. REPORT ON CIVIL DEFENSE:
Councilman Dickason reported on the Civil Defense Committee and
that they had prepared an 13 point program with a time schedule
for completion of each project and hoped soon to have a detailed
report of supplies (surplus) available, available radio and heav
duty equipment in the area, doctors, nurses, medical supplies,et4
A further report will be made at a later date.
23. COMMUNICATIONS:
Two letters from the Boundary Commission of Los Angeles County
re annexation #30, City of Arcadia, and #38, City of Monrovia,
were presented by the City Manager. Councilman Fitzjohn moved
to receive and File, Councilman Merritt seconded, and carried.
A letter from the International Order of Rainbow Girls was read
by the City Manager requesting a charitable solicitation permit
to sell camellia hats during the Camellia Festival. Councilman
Fitzjohn moved to approve the request, Councilman Merritt se-
ll and carried.
24. TIME FOR THOSE I N THE AUDIENCE WHO WISH TO SPEAK.
No one came forward to speak at this time.
25, MATTERS FROM CITY OFFICIALS:
Councilman Merritt stated that there is a problem in City Hall
of taking OUTWaltlierrl, time off for overtime work and he moved u-" -
to pay over -time due to the fact that office employees have not
been able to be spared to take the recipratory time off, Coun-
cilman Fitzjohn seconded, and carried by the following roll call
vote:

City Manager Woollett advised we now had plans and specifica-
tions for the Live Cak project and hoped to get it finished be-
fore the racing season. He requested the Council to authorize
him to request bids on this project as soon as the state has
approved. Councilman Fitzjohn so moved, Councilman Merritt se-
conded, roll call vote as follows:

Regarding the American Legion property the City Manager advised
that no bids had been received. He brought this up to ask the
press to give this some coverage and if any organizations could
use it the City could sell if for only $1.00, with buyer to
move the building+ and clear the property, which would have to
be completed by Xmas day. He requested authority to request
bids for removal and clearing. Councilman Fitzjohn so moved,
Councilman Merritt seconded, roll call vote as follows:

RESOLUTION NO, 62-243: Indicating interest in a facility for
Community Assemblage. City Manager Woollett advised he Felt it
advantageous to adopt this Resolution and instruct the City Man-
ager to discuss this with the County of Los Angeles. Councilman
Merritt moved to adopt Resolution No. 62 -249, Councilman Dicke -
son seconded, and carried unanimously.
RESOLUTION NO. 62 -250: appointing stenoc;ra ?her- bookkeeper.
City Manager Woollett advised this appoints Eunice M.Eccles as
stenographer - bookkeeper who was to start work on Tuesday. Coun-
cilman Fitzjohn moved to adopt Resolution No. 62 -250, Council-
man Merritt seconded, roll call vote as follows:

The City Manager stated the School - Safety Council wish to have
brochures dealing with bicycle and pedestrian safety printed at
an estimated cost of $125. and that there is money available in
the budget in the Traffic Commission account. Councilman Fitz-

vote as follows:

3 :10 P. M. on December 10, 1962, to spread the assessment on
+ ^!oolley St. sewer installation. Councilman Dickason so moved,
Councilman Merritt seconded, and carried.
The City Manager reported on the tree survey in the City that
there was placement for 5107 trees and the recommendation that
1+137 could be planted. He would suggest that this be referred
to the staff for budget consideration next year initiating a
procram. Following due consideration the Council agreed to
start on this program next year.
City Manager ,400llet:t recommended a meeting with the architects
for the library and the Council to review the progress to date.
It was finally agreed to meet on Thursday morning, November 15,
1562, at 7:00 A. M. at the City Hall.
The Manager also reported he had the bulletin and tickets For
the Council for the Pomona Mall Workshop.
Mayor Tyrell read a letter from Wm. McCann, President of Calif.
Contract Cities, requesting issuance of a proclamation honoring

Sister Dolcie, a nun noted for her work against Communism and
for the poor peo:le of Brazil. Councilman Fitzjohn moved to
so proclaim, Councilman Dickason seconded, and carried.
26. ADJOURNMENT: Councilman Merritt moved to adjourn to 7:00 A. M.
on Thursday, November 15, 1962, at the City Hall, Councilman
Fitzjohn seconded, and carried. Council adjourned at 10:30 2. M.
