HomeMy Public PortalAbout1955_10_24 1 SPECIAL October 24, 1955 At a Special Meeting of the Mayor and Council of the Town of Leesburg, in Virginia, held in the Council Chamber on Monday, October 24, 1955 at 7:30 P. M. there were present: E. B. White, Mayor, Horace M. Hallett, Recorder, George J. Durfey, Regin4ld K. Gheen, Howard B. Gill, C. R. Hollandsworth and C. R. Lytle, Councilmen. . -May br White told the Council that he had received a letter from the Executive Board of The Loudoun County Hospital and that the letter had been signed by four of its five members, in which they expressed a desire that the town proposed water tank not be located near the said hospital. 111) Upon motion of C. R. Hollandsworth seconded by Howard B. Gill and carried by a vote of 4 to 0, Hollandsworth, Gill, Durfey and Lytle for, Gheen not voting, the following resolution was adopted: WHEREAS, the Council of the Town of Leesburg, in Virginia, is advised by its Consulting Engineers, Perrow and Brockenbrough, that the one and one-half million gallon water storage reservoir which. is to be erected • for supplying. water to the Town of Leesburg, in Virginia, shouid be located on the property of Harry I. Tiffany.opposite the Loudoun County Hospital and fronting on the Waterford Road; and, 09 09 WHEREAS, it is necessary for the Council of the Town of Leesburg, in Virginia, to obtain immediately the necessary real estate for the location s.r of said water storage reservoir; and, WHEREAS, it is the desire of the Council of the Town of Leesburg, in Virginia, to purchase at a fair and reasonable. price, the necessary real estate for the location of said water storage reservoir; - -NOW, THEREFORE, BE IT RESOLVED, by the Council of the Town of Leesburg, in Virginia, as follows: SECTION I. It is the opinion of the Council of the Town of Leesburg, in Virginia, that the purchase of that certain-tract or parcel of land located on the West side of the Waterford Road and adjoining to the West the lands of the Loudoun County Hospital, containing approximately 3.87 acres, is necessary in order for the Town of Leesburg, in Virginia, to properly.locate . a water storage-reservoir and connecting mains in order toprovide an adaquate supply of water for the. citizens of the Town of Leesburg, in Vir- ginia. • SECTION II. That it is hereby resolved by the Council of the Town of Leesburg, in Virginia, to purchase that certain tract of.land of Harry I. Tiffany mentioned in Section I hereof,' and the Auditor-Treasurer be and he is hereby authorized and directed.to offer in behalf of the Town of Leesburg, in Virginia, the sum of Fourteen Thousand Six Hundred Dollars ( $$14,600.00) to the said Harry- I. Tiffany for the. purchase of the said property, and in said offer to request a reply thereto on or before 12:00 Noon Saturday, October 29, 1955, so that the Council of the Town of Leesburg, ' may be properly advised and enabled to act upon the bids heretofore received for the construction of said water, storage reservoir, which action is re- quired on or before November 6, 1955. Ward, secretary of the Town Planning Commission, sub- mitted thefollowing report to the 'Council: • October 24, 1955 To: The Mayor and Town Council . - .Town of Leesburg Leesburg, Virginia ; Gentlemen: • Your Town Planning Commission humbly and respectfully submits 2 the following report of its regular monthly meeting Friday, October 21, 1955, for your information and for such action as you might care to take. The following five items which were on the agenda were discussed with the results indicated: • • 1. Worsley Subdivision of Grover Downs.. Final plat was submitted . for a .subdivision but the requirements of the Town Subdivision Ordinance were not met in five respects. A letter has been • dispatched to Mr. Downs outlininggthese five matters and what must be done in order to get approval. Three of the items are quite simple to be taken care of. A fourth pertains to the making of satisfactory arrangements for Town water and sewer lines along . Church Street Extended for the length of the property being sub- divided. The fifth and final item is the making of an arrangement satisfactory to the Town Engineer for the 'handling of drainage11 water on and across a corner of the property. 2. Parking Plan. The parking plan for the Town of Leesburg, an integral section of the Master Plan, was submitted to the Planning Commission .and the Town Council by Mr. Tarrant in July. Subsequently the Planning Commission made it public in order that the townspeople might study and debate it. It is now desired to complete action on the plan and the Planning Commission has set Tuesday, November 15, 1955, as the evening for a public hearing on the plan. State law requires the Planning Commission to use this procedure and to advertise the meeting for any and • each part of the Master Plan.. Following the public hearing the • Planning Commission will take• final action on the parking plan at its regular meeting on November 18th, after which it will send the finally recommended plan to you of the Council for such action as you care to take. 3. Subdivision Control Outside Town Limits. The Planning Commission • is of the opinion that the Town of Leesburg is now in a precarious situation tax wise by virtue of its having no voice in the manner in which subdivisions are set up in the area just outside the Town limits. In fact the benefits from the Master Plan now in preparation . will be largely nullified unless a voice can be had in that area. Three specific dangers involved are these: (a). The major hope of giving relief to the traffic congestion within the Town lay in the proper street development in what is now outside the Town. If streets are placed in these new subdivisions without regard to the traffic flow problem of the Town, the present Town of Leesburg will be • stuck forever with a grave but insolvable, problem. • (bU -It is the policy of the Town of Leesburg to see that all future streets have a 50 foot or greater width so that their maintenance can be taken over by the State Highway Department. It is, therefore, extremely important that all new streets put in subdivisions, which ultimately might be a part of the Town, be at ,least 50 feet in width so that t)ie present taxpayers of Leesburg'will never be called upon to' maintain these new streets. • (c) Water and sewer. The installation of water and sewer facilities in these new subdivisions is a matter of deepest concern. If the facilities are installed by the developer to his own specifications, when they are ultimately con- nected to the Town system tremendous problems will result. ' The Town has had experience in this line in the past two • years which would indicate that a failure to see that new water • and sewer facilities are installed in accordance with the Town specifications which are dictated by the design of its present system and the expected manner of expanding them, could cost`the taxpayers a tremendous amount of money. It can be seen from just the three points enumerated above that the tax liability to the present people of Leesburg as, a result of failure to control this growth,on the extremities of the Town Could be so great as to require an increase of the present tax base by three or four times. This is.a seriogqs, thing to contemplate. The only means by which this raft/iiesperate situation can be remedied'is through the Leesburg Subdivision Ordinance which is set-up to regulate these problems. However, the Ordinance is not now effective in the area just outside the • Town. 3 The Town Planning Commission therefore suggests that if the Town Council desires to protect the present taxpayers of the Town as in- 4 dicated above, it proceed to ask the Circuit Court to grant the Town . . the authority it needs as set forth in the Code of Virginia pertaining to the area surrounding. the Town from its present limits to a distance • of two miles out. . . . 4. Master Plan. Mr. Tarrant indicated that the next section of his master plan study and recommendation will be ready in one to two months. It will be the section on traffic flow and street development. 5. Annexation. The Planning Commission studied the annexation plan • submitted by it two years ago. This was done in view of the request from the Town Council that it bring the annexation study up to date as regards 111 any area to be annexed. The Planning Commission was in agreement that the boundaries suggested two years ago are now largely out of date. It. has requested Mr. Tarrant and the Town Engineer to submit study of new boundaries, which Mr. Tarrant believes can be done within a few weeks. The Planning Commission hopes to move ahead on this subject at its November meeting. 1Q . Respectfully submitted, M. CO 41. GEORGE E. WARD, Secretary psi Leesburg Planning Commission . Lytle and . unanimously carried, the following resolution was adopted: • WHEREAS, the Council of the Town of Leesburg, in Virginia, heretofore on August 8, 1955, approved and adopted. a Subdivision Control Ordinance for the Town of Leesburg and for the area within two (2) miles of the Corporate limits of the Town of Leesburg,. in Virginia; and,. IIIillWHEREAS, the Board of Supervisors of Loudoun County,. Virginia, on the 6th day of September, disapproved said ordinance insofar as it relates to the area outside of the Corporate limits of the Town of Leesburg, in Virginia; . NOW, THEREFORE, BE IT RESOLVED by the Council of the Town of Leesburg, . in Virginia, as follows: . SECTIONJI. The Town Attorney be and he is hereby authorized and directed, for and in behalf of the Town of Leesburg, in Virginia, to take any. and all actions which may be necessary or requisite, in accordance with the provisions of Title 15, Section 788 of the Code of Virginia of 1950, as amended, to obtain from the Circuit Court for Loudoun County,. Virginia, a determination of the Subdivision Control Regulations which shall be adopted for the area within two (2) miles of the Corporate limits of the _. Town of Leesburg, in Virginia. Lytle and unanimously carried the following resolution was opted: BE IT RESOLVED, by the Council of the Town of Leesburg in Virginia, that the inspector on the route 7 sewer line extension be paid at the rate • of $100.00 per week.
