Tybee Island, Georgia
June 11, 1992
The Tybee Island City Council held its regularly monthly
meeting at City Hall on Thursday, June 11, 1992, at 7:30 P.M. with
Mayor Walter W. Parker presiding. The following members of council
were present: Christopher P. Solomon, James P. Locklear, C. Ansley
Williams, C. Burke Day, and Jimmy Brown. Councilman Jack Youmans
was absent because of illness. City Attorney Thomas J. Mahoney, Jr.
was present to represent the city on legal matters.
Mayor Parker called the meeting to order and asked Councilman
Locklear to give the Invocation. Mayor Parker led the audience in
the Pledge of Allegiance with Attorney Mahoney reading a
Proclamation for National Flag Day on June 14th at 7 P.M.
Mayor Parker requested that Mrs. Kathleen Burke Day to come to
the front in order that he might honor her by reading a
Proclamation proclaiming this summer as Kathleen Burke Day Summer
on Tybee Island. Mrs. Day will celebrate her 71st summer on Tybee
this year. The Mayor announced that Mrs. Days' grandfather was a
Parker, so their is a family relation between the Days' and the
Parkers'.
Mr. Tom Burns thanked the city for most of the merchants,
stating that they really appreciate what the city has done for them
in the past three weeks. Mr. Burns said the reason he is here
tonight is to request that the city approve a Jet Ski competition
to be held one day in the latter part of August. American Power
Boat Association is a co sponsor and will carry $1,000,000.00 in
insurance for spectators and $75,000.00 for the riders. The jet
skis would hold the competition 1,000 feet off shore. Councilman
Williams questioned if there would be anything requested from the
city, such as parking. Mr. Burns said maybe the use of a 4 wheel
drive vehicle. Councilman Locklear asked what area of the beach
would this involve? Mr. Burns answered 16th Street south.
Councilman Locklear said there is an ordinance on the books that
prohibits jet skis. Mr. Burns said this would be a special one day
permit. Councilman Williams asked the city attorney for the
legality on granting the request. Mr. Mahoney stated that the city
can not violate the ordinance and doesn't see how the city could
grant. Councilman Brown said that maybe they could launch the jet
skis from the Back River.
Mrs. Millie Evans requested that the city adopt a pooper
scooper ordinance. The mayor asked Councilman Locklear to revive
the ordinance that he wrote last year for the July meeting.
Mr. John O'Neill invited the public to attend the Beach Music
Festival to be held this weekend. He also stated that as a private
citizen he supported the Mayor and Chief of Police during the
Orange Crush event.
Mr. Earl Shafer suggested that the city give money to the Fire
Department to keep from tearing up grass when they are out checking
fire plugs.

Ms. Kaye Strickland Toomer stated that there was lots of
animosity among the 16th Street merchants concerning the closing of
the street on the weekends. Suggested that the concerts be moved to
the 15th /16th Street parking lot in order to keep the traffic
flowing. Mr. Burns said the merchants want to keep it on 16th
Street. Mayor Parker said that at first the police were going into
businesses and requesting vehicle owners to move the cars. Chief
McCutchen said that if the people had paid to park they should be
allowed to remain parked until the owners decided to leave. The
police at this time would then lead them out of the concert area.
Mrs. Joan Guyer said that a lot of the business owners are
against the closing of the street as it restricts the flow of
traffic and causes loss of business. Mrs. Guyer suggested closing
off a portion of 16th street. Councilman Williams asked Mrs. Guyer
if she was a member of the Merchant Association. Mrs. Guyer replied
that she had been to couple of meetings.
Councilman Williams read a letter from the Maritime Festival
concerning a ball to be held on September 11, 1992. He said more
information will come before council at a later date.
Councilman Locklear introduced Mr. David Rubnitz who is a
candidate for the Savannah Chatham 4th District School Board seat
now held by Mr. Andy Wray. Mr. Rubnitz explained his platform and
his reasons for running.
Mr. John Javis questioned the charge of $2.00 to walk down
16th street on the weekends. Mayor Parker said there is no charge.
Mayor Parker opened the Public Hearing to hear a petition on
a Zoning Text Amendment Sections 8 -4 -31 K and 8 -4 -62 D. City
Attorney read the ordinances. The mayor asked if anyone wished to
speak in favor. Councilman Day asked what is to be achieved by the
change. Mr. Rusty Fleetwood said 8 -4 -31 K ** and * ** lead to
confusion, people think that as long as you conform with the
setbacks that you do not have to ask permission from City Council.
Ms. Jeanne Hutton spoke in favor of the changes, not only for fire
safety but for aesthetics purposes. Mr. Kit Traub stated that he
agrees with Ms. Hutton. As there was no one present to speak
against the change, Mayor Parker closed the public hearing.
Mayor Parker opened the Public Hearing on a variance request
by Mrs. A. Strojny for a 3 foot front yard setback. Mr. Rusty
Fleetwood stated that the Planning Commission recommended to deny
because there is no hardship on the property owner. No one spoke in
favor or against the request. Mayor, Parker closed the public
hearing.
Mayor Parker opened the meeting for business legally
presented. Councilman Williams moved to accept the ordinance change
on 8 -4 -31 K and 8 -4 -62 D.And E. with Councilman Locklear seconding.
City Attorney Mahoney said that the criteria governing zoning
Section 8 -4 -74 was in front of each councilmember and that they are

required to abide by those ordinances when considering a zoning
matter. Vote by council was 3 in favor of the change and 2 opposed
(Brown, Solomon). A second reading will be held at the July
meeting.
Councilman Brown moved to deny the frontyard variance request
made by Mrs. A. Strojny. Councilman Day seconded. Vote by council
was unanimous. Councilman Brown stated that he would like the
Planning Commission to study the setbacks in all residential areas
changing them from a 20 foot front setback to a 10 foot front
setback.
Minutes of the May meeting were approved as written. Bills for
the month of May were accepted as presented. Councilman Day said
that he would like to hold one water sewer bill in the amount of
$5,000.00 to study. Copy is attached to these minutes. Mayor said
hearing no objection the bills stand approved.
Councilman Locklear moved that an adjustment in the Public
Works 1991 budget in the amount of $24,000.00 be made at the
request of the auditor in order to balance Public Works. Councilman
Brown seconded. Vote by council was unanimous.
Councilman Locklear said that he now has another study on the
toll booth concept. This brings the number to three studies. He
stated that he would like to present the findings to the council
and the public within the next two months.
Councilman Locklear stated that the Mayor and Council have
received a corrected copy of the finance statement. You can now see
exactly how much revenue is collect in Real Estate taxes each month
without having to add, subtract, multiply or divide.
Councilman Locklear moved to approve hiring Paul Booton as a
consultant for the next six (6) months for the amount of $12,000.00
to assist Ms. Vivian Maxey with getting all departments on line
with the new system. He stated that computers and software purchase
in the amount of $23,000.00 has already been approve with the GMA
Lease Pool. Councilman Brown seconded. Councilman Day said that Mr.
Booton has done a fine job but he is not so sure he is worth the
expenditure. Councilman Locklear said that he will teach Mrs. Pat
Pagan and her staff, will help the city sell the old NCR equipment
and we have trust in this man. Councilman Solomon asked what is Ms.
Maxey's feeling on this matter. Councilman Locklear said that Ms.
Maxey is in favor. Councilman Williams asked Rowena Fripp for her
input. Mrs. Fripp said that she is fully in favor of this move by
council. Vote by council 4 in favor; 1 opposed (Solomon).

Councilman Locklear moved to purchase an Audio Recording
System for city meetings and have it in place before the July
council meeting. Councilman Williams seconded. Vote by council was
unanimous.
Councilman Locklear gave a financial report on the expenses
from Orange Crush in the amount of $13,132.00. He stated that he
has a letter from Chief McCutchen explaining the police expenses.
He also noted that free parking decals were given out to some of
the police officers. Councilman Locklear complimented Chris Simon
for the free coffee and food for the fire personnel but moves that
the city pay the bills as he feels this is only ethical. Councilman
Day seconded. Vote by council was 2 in favor; 3 opposed (Solomon,
Williams, Brown).
Councilman Williams moved to approve a beer and wine license
for Fannies on the Beach. Councilman Brown seconded. Vote by
council was unanimous.
Councilman Williams moved to approve a beer and wine license
for the Chamber of Commerce with Councilman Brown seconding. Vote
by council was unanimous.
Councilman Brown moved to purchase 50 parking meters form the
City of Savannah at a price of $30.00 each, also need to purchase
the timing device at a price of $12.00 each. Councilman Solomon
seconded. Vote by council was unanimous.
Councilman Brown moved to place the meters in the area around
the Memorial Park with a time limit of 50 cents per half hour.
Councilman Day seconded. Councilman Locklear asked when the price
change would go into effect. Councilman Brown stated as soon as the
meters are installed. Vote by council was 4 in favor; 1 opposed
(Williams).
Councilman Day moved to approve repairs in the amount of
$1,063.00 for Pump Station # 1. This was approved by council.
Councilman Day moved to approve Section 6 -3 -1 (B & C) Water
and Sewer Rates for the first reading. Councilman Locklear
seconded. Vote by council was unanimous.
Mayor Parker appointed Mr. Don Harris as the liaison from the
city and the Beach Task Force to the Corps Planning Group.
At this time Mayor Parker called for a five minute recess.
City Attorney Thomas Mahoney read the Tree Ordinance Section
8 -7 -1 through 8 -7 -12 for the first reading. Councilman Locklear
moved to adopt with Councilman Day seconding. Councilman Brown said
that what we need is a simple ordinance that can be enforced, he

feels that the eight page ordinance presented can not be enforced.
He also stated that the City Administrator and City Marshal have
enough to do. Mr. Rusty Fleetwood did a fine job working on the
ordinance. Mayor Parker said the information required would be on
the building permit. Councilman Day said the ordinance was a great
start and as a builder he knows you sit down with blue prints. He
feels the ordinance is pretty cut and dry. We cannot continue to
let part of our history go, Day stated. Councilman Williams said
that we have no restrictions what so ever and that we need to start
somewhere, but not with another sign ordinance that can not be
enforced. Councilman Locklear said it was up to the Mayor and staff
to see that ordinances are enforced. His first meeting upon
returning to the island was concerning bulldozing and building
method empolyed on the Bull Tract on Butler Avenue. At that time
Councilman Solomon asked about the trees, builders stated that they
would take care of them. Councilman Locklear believes that this is
a good ordinance and we can always .amend it as we go along.
Councilman Solomon agreed that an ordinance is needed but stated
that his house is surrounded by trees and it would have been a
financial burden to his family if they had to adhere to this
ordinance. He stated that he loves all trees but is not ready to
jump on this ordinance, he has seen some unfair enforcement on the
island. We should come up with a good simple, easy to follow
ordinance. Mayor Parker agreed about the grey areas and said we
will have to change as we go along. Mr. Fleetwood said the length
of the ordinance might look like alot, but feels like this is a
short, direct, simple ordinance. We could define grey areas, it
would lengthen the ordinance. He stated that he had learned alot
about trees in the past 8 to 10 months, more than he ever wanted to
know. The number 2 priority on a survey sent out last year was 44%
for a tree ordinance. This is in the best interest of Tybee. The
vote by council on the first reading was 3 in favor; 2 opposed
(Solomon, Brown).
The first reading on Section 8 -2 -3 (a) was read by City
Attorney Mahoney. Councilman Locklear moved to adopt with
Councilman Williams seconding. After discussing at some length,
Councilman Williams moved that this ordinance be tabled until the
July meeting. Councilman Locklear seconded. It was unanimous by
council.
A Resolution for the America the Beautiful grant was read by
Councilman Williams. Councilman Locklear moved to adopt with
Councilman Day seconding. Vote by council was unanimous.
After a long discussion on the Jet Ski one day special permit
from Mr. Tom Burns, Councilman Solomon made a motion to amend the
present ordinance to allow a section on the beach, 30 feet wide for
launching motorized vehicles for special one day events. Councilman
Brown seconded. City Attorney Mahoney will rewrite the ordinance.
Vote by council was 4 in favor; 1 opposed (Locklear).

As there was no further business, Mayor Parker adjourned
the meeting.

P R O C L A M A T I O N
National Flag Day - June 14, 1992
WHEREAS, by Act of Congress of the United States dated June 14,
1777, the first official Flag of the United States was adopted; and
WHEREAS, by Act of Congress dated August 3, 1949, June 14 of each
year was designated "NATIONAL FLAG DAY "; and
WHEREAS, the Congress has requested the President to issue annually
a proclamation designating the week in which June 14 occurs as
NATIONAL FLAG WEEK; and
WHEREAS, on December 8, 1982, the National Flag Day Foundation was
chartered to conduct educational programs and to encourage all
Americans to PAUSE FOR THE PLEDGE OF ALLEGIANCE on Flag Day, June
14; and
WHEREAS, by Act of Congress, Public Law 99 -54 was passed to have
the PAUSE FOR THE PLEDGE OF ALLEGIANCE as part of the celebration
of National Flag Day throughout the nation; and
WHEREAS, Flag Day celebrates our
democracy in a republic, and stands
freedom, to the rule of all, and to
nation's symbol of, unity, a
for our country's devotion to
equal rights for all;

NOW, THEREFORE, I, Walter W. Parker, Mayor of the City of Tybee
Island, do hereby proclaim June 14, 1992. as Flag Day on Tybee
Island and urge all citizens of Tybee Island to pause at 7:00 P.M.
EDT on this date for the thirteenth annual PAUSE FOR THE PLEDGE OF
ALLEGIANCE to the Flag and join all Americans in reciting the
Pledge of Allegiance to our Flag and Nation.

PROCLAMATION
WHEREAS, Kathleen Burke Day spent much of her youth on Tybee
Island, even courting here; and
WHEREAS, she became a minister's wife and was active in the
mission work that led to the founding of Chapel by the Sea
Baptist Church on Tybee Island;• and
WHEREAS, After the death of her husband, Reverend Lon L.
Day, Sr., she returned to Tybee Island, fed her family by
operating a rooming house on 18th Street and teaching the
hospitality business to Cecil B. Day, Sr., her son, an
entreprenauer who founded an international motel chain that
eventually became the third - largest in the world; and
WHEREAS, She was her son's choice to be the first Innkeeper
for the first of the Days Inns, which was built here on Tybee
Island; and
WHEREAS, Kathleen Burke Day coined the phrase and is a
living illustration of "KEEP ON KEEPIN' ON"
NOW, THEREFORE, I, WALTER W. PARKER, MAYOR OF THE CITY OF TYBEE
ISLAND, GEORGIA, DO HEREBY PROCLAIM MRS. DAY'S 71st SUMMER ON
TYBEE ISLAND, THE SUMMER OF '92, TO BE A SUMMER -LONG CELEBRATION
IN HER HONOR, AND DOES HEREBY URGE ALL TYBEE ISLANDERS TO JOIN
TOGETHER WITH THE TYBEE ISLAND CITY COUNCIL TO SHOW RESPECT,
ADMIRATION AND AFFECTION TO MRS. KATHLEEN BURKE DAY, A TYBEE

RESOLUTION
WHEREAS, The City of Tybee Island has recognized the
importance of urban forestry to our deforested barrier island;
and
WHEREAS, The benefits of reforesting our denuded shoreline
are multiple, extending from cultural and aesthetic values to
storm protection, and from making people comfortable to holding
sand on the vulnerable foreshore; and.
WHEREAS, Tybee Island has many local residents and
businesses that are vitally interested in this project, including
the Tybee Island Beautification Association, the Tybee Island
he
Historical Society, the Tybee Island Merchants Association,
16th Street Merchants Association, the Tybee Council of the
Greater Savannah Area Chamber of Commerce and a group of tree -
enthusiasts known as "Palms Up "; and
WHEREAS, Recent years have seen rapid progress in the area of
beautification, especially along our major thoroughfares and
around our public buildings;
NOW, THEREFORE, BE IT RESOLVED, AND IT IS HEREBY RESOLVED BY THE
MAYOR AND COUNCIL IN OPEN MEETING ASSEMBLED, THAT THE CITY OF
TYBEE ISLAND, ITS CITIZENS AND VISITORS, ARE EXCITED ABOUT THE
OPPORTUNITY FOR PARTICIPATION IN THE AMERICA THE BEAUTIFUL
PROGRAM, AND ARE COMMITTED TO PROM.OTING THE REFORESTATION OF OUR
DENUDED ISLAND.
