REGULAR MEETING, June 11 , 1956
At a regular meeting of the Mayor and Council of the Town of
Leesburg, in Virginia , held in the Council Chambers on Monday , June
. 11 , 1956, at 7 :30 o 'clock, P. M. , there were present E. B. White,
Mayor, Horace M. Hallett , Recorder, George J. Durfey, Reginald K.
Gheen, Howard B. Gill, C. R. Hollandsworth, C. R. Lytle, and Thelma
J. Smoot , .Councilmen.
The minutes of the last regular meeting were read and upon
II motion of C. R. Lytle, seconded by George J. Durfey, and unanimously
carried , . were approved as read .
The Auditor-Treasurer presented his monthly statement for the
month of May, 1956, and)PYs current bills , and upon motion of Howard
B. Gill, seconded by Reginald K. Gheen, and unanimously carried ,
the following resolution was adopted :

The Street Committee recommended that no further repairs be
made on Alco Street at this time. They stated that an investigat-
ion of the request for the need of repairs for this street had been
. made and they were of the opinion -that there were many areas in the
Town that were in much greater need than the said Alco Street .
The Council discussed at some length the need of repairs ,

Mayor White stated that the time, 8:00 o 'clock P. M. had " been
set to give any citizen an opportunity to express his views regard-
. ing the proposed budget for the• year beginning July 1 , 1956, through
June 30 , 1957. No citizen expressed any opinion regarding the pro-
- posed budget , and upon motion of Reginald K. Gheen, seconded by
_ Thelma J. Smoot , and unanimously carried , the following resolution
was adopted .

WHEREAS , the following proposed budget was presented to Coun-
cil on the 14th day of May, 1956, and the same was published- in a •
• newspaper published in the Town of Leesburg, and every citizen was
given an opportunity to express his views regarding this budget at
the regular meeting of the Town Council on .June 11th, 1956, and no
• obtecti.ons, were made thereto by .any citizen Of the Town ,of Leesburg.

NOW, THEREFORE ,. -BE IT RESOLVED, by the Council of the Town
of Leesburg, in Virginia , that the following budget , be,, and the
same is hereby approved and adopted :

• • Upon motion of Thelma J. Smoot ,. seconded by Howard B. Gill
and unanimousi carried,• the following ordinance was adopted :
• BE -IT ORDAINED,• by the Council of the Town of Leesburg , in
Virginia , that the- general tax and license ordinance for the ?own
of Leesburg, in Virginia , as amended , adopted May 23, 1938, be
further amended by adding thereto the following :
63:. TRADING STAMPS . • On every- person, whether acting for
himself or as agent for another engaged in the selling or redeem-,
•ing of trading stamps , coupons , tokens or other device for a like
purpose, or who shall engage in the business of providing plans
or schemes• for the use by others of• such stamps , coupons , tokens
or other device for a like purpose, a specific license tax of
Three Hundred Dollars ($300.00) payable upon the issuance of
said license, and thereafter a license tax of Three Per Cent .
-(3%) of the gross receipts of every such person for each calendar

quarter, payable on the 15th day of the ne 'tucceeging cal-
endar month. The license requiaal herein. shalsl- no.t e. required
of a' person who as an incident' to his business as a wholesale
or retail merchant or manufacturer in the Town of Leesburg, .
in Virginia , issues or redeems trading stamps, coupons , tokens
or other devices for a like purpose.
" Any peison 'or agent engaging in any such business without pay-
ing the- license therefor, shall be fined Five Hundred Dollars ,,($500. ) ,
and for failing to make any of the quarterly payments herein requir-
'ed the fine -"shall be Five 'Hundred. Dollars ($500.00) for each offense.
Any person or agent who shall fail to pay any fine imposed on
him for the violation of this ordinance, shall be imprisoned for not
less than 'thirty (30) 'clay nor thdre than sixty (60) days .
This amendment shall become effective on and after July 1,, 1956.
Mr. B. Powell Harrison, Of the Town Planing Commission submitted
a report and made certain recommendations regarding annexation and
the street development plan. •
And upon motion 'of 'Reginald K. Gheen, seconded by C. R. Lytle, -
and unanimously carried , the following resolution was adopted : - -
BE IT RESOLVED, 'by the Council of the Town of Leesburg, in .
Virginia , that the Council receive the report of the Planning Com-
Mission regarding annexation for further, study.
And upon motion of Reginald K. Gheen, seconded by C. R.- Lytle,
and unanimously carried, the following resolution was adopted :
BE IT RESOLVED, by/theCouncil of the Town of Leesburg, in
Virginia , that the Council accept the report of the street develop-
ment plan for further 'study.
Upon motion of ,Reginald K. Gheen , seconded by Thelma J. Smoot ,
and carried' by a vote of . five to "one, Gheen, Smoot, Durfey,' Hollands-
Worth and Gill for, Lytle against, the following resolution was adopt-
ed : •
BE IT RESOLVED; by the Council of the Town of Leesburg, in
Virginia, that the Council hold a special meeting in the Council
Chambers of the Town of Leesburg on June 12th, at 7 : 30 o 'clock, P.M.
An application from Mr. Reed Johnson requesting permission
for a water connection to a temporary water line at Parker Road and
Route 7 was read , and after some lengthly discussion on this matter,
'and upon motion of Reginald K. Gheen , seconded by C. R. Lytle,- and
the vote being three for and three against , the-Mayor casting the
tie-breaking vote, and against the proposed resolution, the follow-
ing resolution was defeated.

E IT RESOLVED, by the Council of the Town of Leesburg, in
Virginia , that Mr. Reed Johnson be given permission to connect to
the temporary water line at. Parker Road , and that the Town set the
necessary water meter for said installation.. •
Upon motion of Reginald K. Gheen, seconded by C. R. Lytle,
and unanimously._carried , the .following resolution was adopted :-
BE IT RESOLVED, by the Council of the Town of Leesburg, in
Virginia, that the Council hold a special meeting in the Council
Chambers in the. Town of Leesburg on June 26th, 1956, at 8:00 o 'clock,
P. M. for the purpose of considering a report on annexation and
street development , and to take such action as they deem necessary.
Upon motion of Reginald..K. .,Gheen, seconded .by C. R. Hollands-
worth, and' unanimously carried , the , following resolution was adopted :
BE IT RESOLVED, by the Council of the Town of Leesburg, in: ,
Virginia; that the Town 's Attorney and the Mayor be requested to
defend' the Town of Leesburg in the motion for judgment being heard
in the Circuit Court and against the Town of Leesburg. •

The Police Committee reported that the Town Police Car was in
need of a great deal of -repair, and the the said Police Car should
be completely overhauled , or that a new motor be installed , and upon
-motion of C. R. Hollandsworth, seconded by George J. Durfey, and
carried by a vote of four to nothing , Hollandsworth, Durfey, .Gheen
and Lytle for, Gill not voting , and Mrs . Smoot not present for this
resolution, the following resolution was adopted : -
BE IT RESOLVED, by the Council of the Town of Leesburg, in
Virginia, that Mr. Howard B. Gill , be, and he is hereby .authorized
' and directed to have the Town !s Police Car overhaulrfl and such other
work done to the said car that he deems necessary, and that all repairs
to be made on the said Police Car in the future be made by Mr. Howard
-B.• Gill .

There being no further business , upon motion duly made, seconded
and carried , Council adjourned .

SPECIAL,MEETING, JUNE 12 , 1956
°-' At a Special Meeting of the Mayor and Council of the Town of
Leesburg, held in the Council Chamber on Tuesday, June 12, 1956 , at
. 7 :30 o' clock P. M. , there were present E. B. White, Mayor, George J.
Durfey, Reginald K. Gheen, Howard B. Gill, . C. R. Hollandsworth and
C. R. Lytle, Councilmen.
Due to the absence of- the Recorder, and upon motion duly made,
seconded. and carried, Reginald K. Gheen was elected to serve as
Recorder Pro-tem.
Upon motion of C. R. Hollandsworth, seconded by C. R. Lytle,
and carried by a vote of four to nothing, Hollandworth, Lytle, Gheen
and Durfey' for, Gill not voting, the following resolution was adopted.
BE IT RESOLVED, by the Council of the Town of, Leesburg, in Vir-
ginia, that the resolution adopted on the 11th day of June, 1956,
authorizing. Mr. Howard B. Gill to have certain repair work done to
the Town Police Car and providing that he make all future repairs
on said car, be, and it is hereby rescinded.
Upon motion of Reginald K. Gheen, seconded by George J. Durfey
and -unanimously carried, the following resolution was adopted:
WHEREAS, it is the desire of the. Council of the Town of Lees-
burg, in Virginia, to carry out at the earliest possible date the
. recommendation of the Planning Commission as prosposed for the'
development of the parking area West of King Street and East of
Wirt Street, between Loudoun and Market Streets ; and,
WHEREAS , negotiations have been undertaken to obtain the nec-
essary property from the present owners to carry out said develop-
ment ; and,
•
WHEREAS , said property owners have not as of this date agreed
upon;_a sales price or terms and conditions under which they would
rent.'or sell said property to the Town, of Leesburg, in Virginia;
NOW, THEREFORE, BE IT RESOLVED, that it is the sense of the
Council of the Town of Leesburg, in Virginia, that unless the
,obtaining of said property can be negotiated and proposed contracts
submitted for the approval of .the Council of the Town of Leesburg,
in Virginia, on or before June 26 , 1956 , that the Town Council, at
a Specail Meeting to be held on June 26 , 1956, have as its. first
order of business the consideration of the advisability of institut-
-- ing condemnation proceedings for the acquisition of said property.
Council heard Mr. Julian Tarrant, Town Planning Consultant', ex-
. plain the Planning Commission' s recommendations for annexation and
major thoroughfare plans.. Maps and exhibits were presented and '
questions asked by the Mayor and Council.
