BE IT RESOLVED, by the Council of the Town of Leesburg in Virginia, .that the Auditor-Treasurer be and he is hereby authorized to request bids for a 12 volt two way radio to be usedd� in the town's police car. Mr. Frank Carirell and Mr. Julian Tarrant of the Town of Leesburg Planning comm- ission appeared before the Council and presented and discussed a proposed Zoning ordinance, upon motion of Reginald K. Gheen seconded by C. R. Hollandsworth, and unaminously carried the following resolution was adopted, .BE IT RESOLVED, by the Council of the Town of Leesburg in Virginia, that the N Council receive the:proposed zoning ordinance submitted by the Town of Leesburg CO Planning @ommission, that a public hearing be held August 6th, 1957 at.8 f.M; in the Council Chamber and that due notice of publication be made. Q .Mrs. Mitchell presented to Council a request for the installation of a street ,, light on Liberty between Market and Loudoun Streets. The matter was refered to the Street Committee. Mayor White read a letter from the Leesburg Laundry in which they requested permission to connect the laundry waste line from their plant to the town's sewer system. Council requested Mayor White to inform the. Leesburg laundry that they may connect the waste line from the laundry to the town's sewer system providing the connectqe approved by the Town of Leesburg's Engineer. .Upon motion of Reginald K. Gheen, .seconded by C. R. Hollandsworth and unam- inously carried Council voted to go into an executive session. Upon motion of Reginald K. Gheen seconded by Howard B. Gill and unaminously carried Council voted to return to the regular session. .There being no further business and upon motion duly made seconded and carr- ied Council adjourned. Mayor. 'ecorder. REGULAR MEETING, August 12, 1957 At a regular meeting of the Mayor and Council of the Town of Leesburg, in Virginia, held at the Council Chambers on August 12, 1957, at 7:30 o'clock P.M., there were present E. B. White, Mayor, Horace M. Hallett, Recorder, George J. Durfey, Reginald K. Gheen, Howard B. Gill, C. R. Hollandsworth, Dr. James T. Jackson, and Mrs. Pae Bass Mitchell, Councilmen. The minutes of the regular meeting of July 8th, 1957, were read and upon motion of Reginald K. Gheen, seconded by Howard B. Gill, and unanimously carried, were approved as read. At 8:00 P.M., Mayor White stated that in compliance with the minutes of July, 1957, the bids for the purchase or rental of a police car were to be opened. Be opened and submitted to the Town Council bids from the Brock Chevrolet, Inc., Colonial Motor Sales, Inc., and Parker Motor Company, Inc. The Parker Motor Company vas the only bidder who submitted a bid for the rental of a town police car. -- Upon Motion of Howard B. Gill, seconded by C. R. Hollandsworth, and unanimous- ly carried, the following resolution was adopted. 100 • BE IT RESOLVED, by the Council of the Town of Leesburg, in Virginia, that the bid of $85 per month for the rental for a town police car submitted by Parker Motor Company, Inc. be and which is hereby accepted and that a necessary contract be drawn and executed for a term of one (1) year. • Mr. Gill reported that the present radio in the police car was originally a 12-volt system and could be reconverted back to a 12-volt system for approximately $100. The Auditor-Treasurer presented his monthly report and his current bills for the month of July, 1957, and upon motion of Reginald K. Gheen, and seconded by Howard B; Gill, the following resolution was: adopted. BE IT RESOLVED, by the Council-of the Town of Leesburg, in Virginia, that the following bills with the exception of the bill of Mr. Julian Tarrant in the amount of $494.25 be paid and that the said bill of Mr. Tarrant be withheld until a satis- factory explanation of this bill had been obtained from the Town's attorney. Gheen presented to Council from Garrett Insurance Agency for the insurance in the amount of $15,000 which is being carried on the fire house now owned by Myers and White. After some lengthy discussion on this flatter and upon motion of Mae Bass Mitchell, seconded by Dr. James T. Jackson, and carried by a vote of 5 to 1,• Mitchell, Jackson, Durfey, Gill, and Hollandsworth for, Gheen against, the following resolution was adopted.- BE IT RESOLVED, by the Council of the Town of Leesburg, in Virginia, that the Auditor-Treasurer be and he is hereby authorized and directed to notify Dyers and White and the Garrett Insurance Agency that the Town Council considers $7,500 as a maximum insurance coverage� which it feels obligated to carry on the fire house. Mr. T. B. Telt, Resident Engineer of the Virginia Department of Highways, appeared before Council and expressed his appreciation for the cooperation he-had received from the Town Council during his term of office as Resident Engineer for the area. -Mr. Tolbert expressed certain projects which he felt should be carried out within the Town of Leesburg and stated that he hada limited amount of money in which to do the work desired; however, he preferred the Ayr Street project and re- quested Council's expression in which project they felt most desirable. Council agreed with Mr. Tolbert that the Ayr Street project should have first priority. 'Council expressed their appreciation to Mr. Tolbert and to the Virginia State Depart- ment of Highcays• for its fine cooperation in working with the many problems in the Town of Leesburg in the past. 10 - Mr. White stated that he had received a letter from Mr. J.. R. Lintner, complaining about the drainage problem on North Street near his hone in the Downs sub-division. This matter was discussed at some length but no action was taken. Upon motion of Reginald K. Gheen, seconded by C. R. Hollandsworth, and unanimously carried, the following resolution was adopted. BE IT RESOLVED, by the Council of the Town of Leesburg, in Virginia, that the Mayor and Town' . attorney draft a proper ordinance regulating the installation and use of commercial garbage grinders within the Corporation limits. Upon motion of Dr. James T. Jackson, seconded by C. R. Hollandsworth, and carried by a vote of 5 to nothing, It. Gheen not present for this voting, the following ordinance was adopted. ' BE IT ORDAINED, by the Council and the Mayor of the Town of Leesburg, in Virginia, that this Ordinance shall become effective commencing September 1, 1957, and until amended by further action of the Council of the Town of Leesburg, in Virginia; and shs+1i be known as the "Garbage and Trash Ordinance," and any other ordinance in con- flict with the provisions hereof be and the same is hereby repealed. • • SECTION I. It shall be unlawful for any owner or occupant of premises within CQ the Corporate limits of the Town of Leesburg to allow garbage, ashes, trash, rubbish, M.• or other refuse to accumulate on such premises in an offensive or unsanitary nature cf or manner. Q +-- SECTION II. It shall be unlawful for any person to throw or dump garbage, ashes, 'trash, or other refuse, on to any vacant lot, street, or sidewalk in the Town of Leesburg. SECTION III. All occupants of premises in the Town, whose garbage, ashes, and refuse is to be removed by the Town, or by a contractor with the Town, shall provide a sufficient number of water tight, metal receptables of not over twenty gallons capacity, with tight fitting covers, for the removal of garbage. All receptacles for ashes and refuse shall not weigh when filled, more than one hundred pounds. All receptacles, as provided for herein, shall be suitable for, and shall be strong enough to withstand handling. SECTION IV. All receptacles containing garbage, ashes, or refuse for collection by the Town, or by a contractor with the Town, shall be set out not later than the hour hereinafter provided for on collection days, and shall be placed in such location as may be designated by the Auditor-Treasurer, with the advice of Council, so that they can be easily and conveniently reached by the Town's or contractor's employees: • • (a) All collections shall be made semi-weekly, and unless otherwise determined by the Auditor-Treasurer, on Tuesday and Friday of each week. • (b) All receptacles shall be set out as hereinabove provided for on the collection days not earlier than 5:30 P.M. 'of the day preceeding collection and not later than as followsr . U(0.) Business, commercial and industrial districts - 4:30 A.M. (2) Residential Districts - 7:30 A.M. (c) All containers shall be removed as promptly as possible following collection of refuse. SECTION V. No receptacle shall be filled more than level full. SECTION VI. No rejected building materials, factory cuttings, or trade waste shall be set out for the removal by the Town, or by a contractor of the Town. . SECTION VII. The Town Council shall establish and specify the days and hours each week when the Town employees, or contractors, shall collect garbage, ashes, arra refuse in the Town and the routes to be served at the time so specified, but until further order by the Town Council the days and hours shall be as hereinabove speci- fied. 102 SECTION VIII. Any'garbage or trash not prepared and placed for hauling in compliance with the provisions of this ordinance may be left at the discretion of the garbage collector, who shall immediately report such non-compliance to the . Auditor-Treasurer. The Auditor-Treasurer shall investigate such report of non- compliance immediately and in the event he believes such report to be well founded, the Auditor-Treasurer sh'11 notify the person placing such refuse for removal. Upon a second report of non-compliance by the same person, the Auditor-Treasurer shall swear out a warrant against such a person charging a violation of this ordinance. SECTION IS. Any violation of the provisions of this Ordinance shall constitute a misdeameanor, and shall, upon conviction, be fined not less than Two Dollars ($2.00) nor more.than Five Dollars for each offense. Each day that said violation shrill con- tinue shall be a separate offense. Mayor White stated that he had received a verbal offer from Messers Phillips and Nichols for the sale of the well located east of Leesburg in the amount of $25,000. Upon motion of George J. Durfey, seconded by C. R. Hollandsworth and unanimously carried, the following resolution was adopted. BE IT RESOLVED, by the Council of the Town of Leesburg, in Virginia, that the salary of Raymond L. Hough, Superintendent of Water Works, be increased from $275.00 per month to $325.00 per month, said increase to be retroactive to July.1, 1957. Upon motion. of George J. Durfey, seconded by Dr. James T. Jackson, and unanimous ly carried, the following resolution was adopted. WHEREAS, it has become necessary to discontinue the dumping of garbage and trash in the town landfill because of limited space; and WHEREAS, Jesse C. Randolph who is presently under contract to haul said garbage and trash from the streets of Leesburg to the.town landfill has agreed to haul said garbage and trash to his landfill eight miles from the Town of Leesburg for the sum of $250.00 per month. . THEREFORE, BE ITPRESOLVED, by the Council of the Town of Leesburg, in Virginia, that Jesse C. Randolph be paid at the rate of $250.00 per month for hauling said garbage and trash to his landfill, same to be retroactive to the week of July 22, 1957. Upon motion of George J. Durfey, seconded by C. R. Hollandsworth, and unanimous- ly carried, the following resolution was adopted. BE IT RESOLVED, by the Council of the Town of Leesburg, in Virginia, that the Auditor-Treasurer be and he is hereby authorized and directed to pay to each Official and Councilman of the Town of Leesburg attending the anual convention of the League of Virginia Municipalities to be held in Ridbmond, Virginia, September 15, 16, and 17, 1957, the sum of $50.00 as expenses. • Upon motion of C. R. Hollandsworth, seconded by Howard B. Gill, and unanimously carried, the following resolution was adopted. WHEREAS, in view of the fact that due to the eictreme dry Breather, it has become necessary for the citizens of the Town of Leesburg to water lawns and shrubs- and that the said water used on the lawns and shrubs do not drain into or pass through the Town sewer system. rartf'ORE BE IT RESOLVED, that the sewer charge be reduced from 50% of the water charge to 25% for the quarterly period ending August 20, 1957.
