HomeMy Public PortalAbout1957_11_11 Z .1-9 REGULAR MEETING, November 11 . 1957 At a regular meeting of the Council of the Town of Leesburg in Virginia , held in the Council chambers on November 11 . 1957 at 7 : 30 P . M. there were present : George J . Durfey , Mayor ; Elinor M. Cunningham , Recorder ; Howard B. Gill ; C. R. Hollandsworth; Reed Johnson; Mae Bass Mitchell ; Oden Semones and J . Austin Wright , being all of the Councilmen. The minutes of the regular meeting of the Council of the Town of Leesburg held on October 14 . 1957 were read , and upon motion of C. R. Hollandsworth , seconded by J . Austin Wright and unanimously carried , were approved as read . The Auditor-Treasurer presented the financial statement , the general fund and the special sewer debt fund-'for the month of October . Upon :motion of C. R. Hollandsworth . seconded by J . Austin Wright . the following resolution was unanimously carried : `, BE IT:RESOLVED by the Council of the Town of Leesburg , in Vir- M C'� ginia , that the Auditor-Treasurer be and he is hereby authorized and et directed to pay the following bills : et Virginia Electric & Power Co . $ 39L1. 08 C. & P. White- 350. 00 Newell Cole Company 31 . 25 Total $ 5052. 23 Mrs . Mitchell reported that the three appraisers , namely . Reginald K. Gheen , C. Maloy Fishback and W. F. Peach . had appraised the building now housing the Leesburg Volunteer Fire Department equipment at $10,000.00 . and that the bill of the Garrent Insurance Agency amounted to $132.60. Upon recommendation of Mr . Gill the aforesaid bill of Garrett Insurance Agency was tabled for further investigation. The bill of Bartenstein and Bartenstein in the amount of $1197 . 00 was tabled for further investigation . Upon :motion of Mr . Wright . seconded by Mr . Hollandsworth, the following resolution was unanimously adopted : RESOLVED, by the Council of the Town of Leesburg , in Virginia , that the Town agree to pay the electric bill in connection with the Christmas street lights andrbther decorations which are each year placed in the Town by the Leesburg Chamber of Commerce; and . BE IT FURTHER RESOLVED, That the Mayor is authorized to sign the application in behalf of the Town , for the said electricity. 1.20 Upon motion of Mr . Wright , seconded by Mr . Hoilandsworth , the following resolution was unanimously adopted : WHEREAS , it has come to the attention of the Council of the Town of Leesburg , in Virginia , that the post office Department has announced in a release dated November 2 , 1957 , that a:stamp is to be issued on April 28 . 1958 , honoring the 200th anniversary of the birth of President James Monroe ; and , WHEREAS , President James Monroe had a very intimate connection with Leesburg while he was residing at "Oak Hill , " the home he built near Leesburg , where he received dignitaries of this and other countries; and , WHEREAS , Leesburg is today the nearest first class post office to his former home , "Oak Hill ; " and , WHEREAS , the Clerk' s Office in Leesburg contains records and papers pertaining to "Oak Hill " and president Monroe ; and , WHEREAS , the Court house green in Leesburg is the actual site where a luncheon was given by the Town- of Leesburg in honor of General Lafayette in 1824 , attended by President James Monroe ; and , WHEREAS , the Town of Leesburg will in 1958 celebrate the bi _ centennial of its`founding-;__, THEREFORE , BE IT RESOLVED, by the Mayor and Council of the Town of Leesburg , that the Post Office Department he requested to select Leesbung for the first day issuance of the new Monroe stamp on April 28 , 1958 ; and , BE IT FURTHER RESOLVED, That the Mayor is hereby authorized and directed to submit to the Honorable , The Postmaster 'General , a request on behalf of : the Town of Leesburg , that the Town of Leesburg be chosen for the first day issuance of the stamp honor- ' ing the 200th anniversary of the birth of President James Monroe . WHEREAS, the Town of Leesburg will in 1958 celebrate the 200th anniversary of its incorporation by an act of the legislature approved in September of 1758; and , WHEREAS , the Town of Leesburg has in the 200 years since its founding . contributed much to the history of Loudoun County , the State of Virginia . and to the welfare of the residents of the community; and , WHEREAS . it seems appropriate that the occasion of the 200th anniversary of the incorporation of the Town of Leesburg should be formally observed by the officials and residents of the Town; THEREFORE, BE IT RESOLVED. that the Mayor of theTown of Leesburg , in Virginia , is hereby authorized and directed to issue a proclamation commemorating the 200th anniversary of the Town of Leesburg urging the observation of this occasion by the residents . businesses , civit and religious organizations of the Town. Mr . Caldwell , Chairman of the planning Commission for the Town of Leesburg was heard with respect to the necessity for •five new traffic lights in the Town of Leesburg . The Mayor recommended that Mr. Caldwell work with the Street Committee with respect to this matter . Upnn motion of Mrs . Mitchell , seconded by Mr . Gill , the following resolution was unanimously adopted : RESOLVED, That the Street Committee . together with the Town Attorney , confer with the proper authorities of the State Highway Department in Richmond , Virginia , for the purpose of as- certaining exactly what the Department will do with respect to ' streets, sidewalks and the like in the Town of Leesburg; and , 121 • BE IT FURTHER RESOLVED, That the Town of Leesburg pay the expenses of the aforesaid parties involving their conference in Richmond , Virginia . Mr. Frank Raflo then appeared representing the Leesburg Chamber of Commerce and their proposed idea of parking during the Christmas shopping season. Upon motion of Mr . Hollandsworth , seconded by Mr. Wright . the following resolution was .;unanimously adopted ; BE IT RESOLVED, by the Council of the Town of Leesburg , in Virginia , that an agreement be entered into and approved with the Chamber of Commerce of Leesburg , Virginia , whereby : 1 . . The Town purchase 5000 packing tokens of 5d par value for use in the Town' s parking lots. N 0? 2. The Duncan Meter Company be instructed to M make the necessary changes in the parking Cmeters on the Town' s parking lots so that — they will accommodate these tokens . 3. The Chamber agrees to underwrite the entire cost involved in the printing of the tokens and the adaption of the meters . 4. The Town agrees to sell the tokens at par value to those merchants and business firms whom the Chamber designates as official members of their park and shop program , and to those firms only . 5. The park and shop program will be put into effect at once and this resolution will be effective upon its passage by the Council and proper signature by the authorized officers of the Chamber . 6 . The Auditor-Treasurer is hereby authorized ' and directed to carry out the details of the above program with full authority to act in accordance with the above agreement . The Town Attorney then recommended that the Town of Leesburg have framed some of the most important annexation maps and place same in the Town Office for the information of everyone desiring same . Upon motion of Mrs .. Mitchell , seconded by Mr . Wright , the . following resolution was unanimously adopted : RESOLVED, That the Town of Leesburg , in Virginia . have the light , water , sewer and the corporate limit maps framed at the most reasonable cost to be obtained . - Uponimotion of Mr . Hollandsworth , seconded'-py Mrs . Mitchell , the following resolution was unanimously adopted : RESOLVED, That the Town of Leesburg , in Virginia, impose an automobile tax of $5.00 on each and every motor vehicle owned by a resident of the Town of Leesburg; and , BE IT:'FURTHER RESOLVED, That the County of Loudoun be notified that the Town of Leesburg intends to impose said auto- mobile tax , and that thereafter the residents of the Town of Leesburg will purchase Town automobile tags and the residents outside of the corporate limits will purchase County tags . 121. Upon motion of, Mr . Gill , seconded by Mrs . Mitchell , the following resolution was unanimously adopted : WHERES , the Charter of the Town of Leesburg , in Virginia permits and authorizes the selection of a vice-mayor from the members of the Town Council , to serve and act in the place and stead of the Mayor during his absence from the Townor in the event of illness , which prevents the Mayor from performing his duties; NOW, THEREFORE, BE IT RESOLVED, That the Town Council of the Town of Leesburg ,. in Virginia , elect a vice-mayor from among its membership , and that the Vice-Mayor so elected shall be and he is hereby directdd to act in and for the Mayor during his absence or disability , and he is hereby vested with all of the powers of the Mayor under law, when and during such times as he shall serve in place of the duly elected Mayor of the Town of Leesburg . After a duly conducted election Mr . Gill was elected as Vice-Mayor for the Town of Leesburg , in Virginia . • The Mayor then read a letter from the Board of Supervisors . of Loudoun County with respect to the stray dog problem. Upon motion of Mr . Samones , seconded by Mr . Hollandsworth , the foli•owingiresolution Was unanimously adopted : RESOLVED, That the aforesaid letter from the Board of Super- visors of Loudoun County be acknowledged by the Town of Leesburg , • in Virginia , and that the Town of Leesburg work with the County of Loudoun in doing whatever is necessary to alleviate the canine problems that have arisen. Upon motion of Mr . Wright , seconded by Mrs . Mitchell , the following resolution was unanimously adopted : RESOLVED, That the application of the Community Oil Company . Incorporated , addressed to the Town of Leesburg and the Zoning • Administrator , for a variance on certain property located on Royal Street for the construction of an automotive parts building and storage shop be referred to the Board of Zoning Appeals for the Town of Leesburg , in Virginia . • The Mayor then asked for a report on the contemplated purchase of a new Police car and was advised by the Auditor-Treasurer that Mr . Leonard W. Pahker of Parker Motors , .would have a 1958 Plymouth automobile in the very near future , at which time the Town would enter into negotiations with respect to obtaining same . Upon motion of Mr . Holladdsworth . secondedrby Mr . Wright , the following resolution was carried by a vote of five to one : RESOLVED, That the Town of Leesburg , in Virginia , arrange for one hour parking in front of the J . T. Hirst Company building on South King Street for the purpose of loading and unloading. Upon motion of Mr . Hollandsworth , seconded by Mr . Wright . Gill , Hollandsworth , Johnson, Mitchell and Wright voting for , and Semones against , the following resolution was carried : RESOLVED. That with respect to the allowance of parking on West Market Street across from the Leesburg Presbyterian Church on Sundays from 9:00 A. M. to ?1 :00 P . M. , as heretofore requested , the parking situation shall remain the same as has been effective in the past . A discussion then followed with respect to granting Dr. Robert A. Orr a parking space on the North side of Loudoun Street and this matter was referred to the Street Committee for further inirestigation. 123 Mr . Hollandsworth then presented the: problem 'of the traffic situation at the Honicon houses on South Market Street . Upon motion of Mr . Hollandsworth , seconded by Mr . Wright . the following resolution was unanimously adopted : RESOLVED, That the Town Attorney be given authority to investigate the aforementioned of the 'traffic situation at the ' Honicon houses , as respects the deed of dedication and like matters involved in this problem. The following resolution made by Mr . Hollandsworth , seconded by Mr . Gill , Hollandsworth and Gill voting for and Johnson , Mitchell , Semones and Wright :voting against , died on the floor : RESOLVED, That the Town of Leesburg , in Virginia , pay the sum of $198. 00, the same being the estimate of C. Maloy Fishback . for the continuation of the sidewalk on the North side of Corn- wall Street from the property of Mr . W. J . Cox to the corner of M King and Cornwall Street . 0, Q The Town Attorney thennpresented the matter of Pierpoint vs . Q The Town of Leesburg , in Virginia , involding an accident in the Town of Leesburg , in which case Mr . Wilbur C. Hall , attorney for Mr . Pierpoint , has advised that suit will be forthcoming against the Town of Leesburg for the damages incurred . The Town Attorney was advised to await further instructions from the Council of the Town of Leesburg . Upon recommendation of Mr . Hollandsworth , the application of Mr . W. B. Ridgeway for a permit to build on a piece of property located on Market Street was referred to the Subdivision Controll Board of the Town of Leesburg . ' Upon motion duly made by Mrs . Mitchell . seconded by Mr . Hollandsworth , and unanimously carried , the following resolution was adopted ; RESOLVED, That the Town of Leesburg , in Virginia , employ the Town Attorney, Howard W. Vesey , Esquire , to prosecute the drunken driving and reckless driving cases at a fee of $25.00 per case ; and , BE IT FURTHER RESOLVED, That after the trial of the afore- mentioned cases , if: it becomes necessary that the Town Attorney appear in the Circuit Court for Loudoun County in the case of an appeal , that said Town Attorney be paid an additional fee of $25. 00 per case . Upon recommendation of Mr . Wright the Auditor-Treasurer was ordered to place no parking signs on North Street in front of . the Colored Church. Upon recommendation of Mr. Hollandsworth the trees in front of the residence of Mrs . Mary P . Titus on West Loudoun Street were ordered removed by .the Town of Leesburg , in Virginia. s Upon motion of Mr. Gill , seconded by Mrs . Mitchell , the following resolution was unanimously carried : RESOLVED, by the Council of the Town of Leesburg . in Virginia , that the Auditor-Treasurer be , and he is hereby authorized and directed to charge off any town taxes against the Leesburg Volunteer Fire Company for the year 1957 . .` 124 . Mr . Semones reported that he had investigated the roof on the spring house at Rock Springs Farm , from which the Town obtains water , and that this roof was badly in need of paint . Mr. Gill then advised that the Leesburg Volunteer Fire Company was desirous of the Town purchasing five hundred feet of 2 1/2 inch hose . It was decided to get bids on the cost of the aforementioned fire hose . Upon motion of Mr . Gill , seconded by Mr . Hollandsworth , the Council went into executive session. Upon motion of Mr . Gill , seconded by Mr . Hollandsworth , the Council came back into regular session. There being no further business , upon motion duly made and seconded , the meeting adjourned . /� d,� nnnx ` w1 Q ��/ `- � corder ill, i e. �11I / •r r (/ SPECIAL MEETING, November 26 , 1957 WAIVER OF NOTICE SPECIAL MEETING OF THE TOWN COUNCIL OF THE TOWN OF LEESBURG, 'IN VIRGINIA We , the undersigned , being members of the Town Council of the Town of Leesburg , in Virginia , do severally waive all of the statutory requirements as to notice of time , place and pur- pose of a special meeting of the Town Council and consent that the meeting shall be held in the Council Chambers of the Town Council at 10:30nA.
