Mitchell , were approved as read. The! Auditor=Treasurer then presented the financial statement and special sewer debt fund for the month of December . Upon motion of Mr . Gill, seconded by Mrs . Upon motion of Mr. Gill, seconded by Mrs . Mitchell, an d • unanimously carried, it was resolved that the aforementioned bill of Mr. Racy should be corrected by Mr. Racy himself . 1 32. ,. q The Auditor-Treasurer then presented his annual roan xnancSnd l reports for the period ending December 31, 1957 . • Upon motion of Mr. I3ollandsworth, seconded by Mr: Gill , and unanimously carried the following resolution was adopted: WHEREAS, the Auditor-Treasurer Bas or sented to Council of the Town of Leesburg, in Virginia, a /& report on all re - ceipts and an athalysis of all disbursements for the year ending December 31, 1957 ; NOW, THEREFORE, BE IT RESOLVED by he Co cil of the Town of Leesburg, in Virginia, that the said = I Ar report be and it is hereby' accepted by the said Council; BE IT FURTHER RESOLVED, by the Council of the Town of Lees- burg, in Virginia, that the Auditor-Treasureree-- he is hereby authorized and directed to have a copy of said "' ' 3'_report published in a newspaper published in the said Town, and also post a copy of said report in front of the Court House in said Town. Upon motion of Mr. Gill, seconded by Mr . Wright, the unan- imously carried; the following resolution was adopted: 1: BE IT RESOLVED, That by and under the authority granted under Section 46-64 of the Code of Virginia of 1950 , as amended, ' the Town of Leesburg, in Virginia, hereby charges a license fee on all -motor Vehicles, except vehicles used by a dealer or manufacturer for sales purposea and vehicles used as common - carriers of persons or property operated between cities or towns in this state and not in intercity transportation, or between cities -and towns on the and hand and points and places without cities -and towns on the other and not in intercity transportation. This license is imposed upon every motor vehicle, inclludiingbbut not limited •to, automobiles, trucks and motorcycles regularly housed •or stored in the Town and used or intended to be regularly operated upon the highways in the Town. 2 : The cost of such license shall be Five Dollars ( 5.00 ) . The licenses shall be purchased from the office of the AUditor- Treasurer of the Town of Leesburg, Virginia. 3: The revenue-derived from all Town motor vehicle licenses under- this law shall be applied to general Town purposes : 4 : This Ordinance is subject to the limitations on the im- position of such licenses by the Town of Leesburg, in Virginia, as is set forth in Section 46-65 of th< Code of Virginia of 1950 , as amended. 5: The period which the said license shall cover shall ce " from the 15th day of April, 1958, through the 14th day of April, 1959, and re-purchase of licenses for the same periodin each succeeding year thereafter shall be rqquired on or before the 15th day of April of each succeeding year, the same to be avail- able not later than the 15th day of March for the ensuing year . Ilr 6. In the event that any person shall make adplication for any such license, as hereinabove described, for any license year, subsequent to the 15th day of October, then the cost thereof shall be one-half of the initial cost thereof . • 7 . In the event ' that any license plate issued under the provisions hereof shall ue lost or mutiliated, or shall become illegible, the person who is entitled thereto .shall make im- mediate application for anal obtain a duplicate or substitute therefor, upon furnishing information of such fact satisfactory to the Auditor-Treasurer of the Town of Leesburg, in Virginia, and upon the payment of a fee of Fifty Cents ( 509) to the said Treasurer, or other agent of the Town appointed for the purpose . I33 8. The said license shall not be transferrable as between persons or vehicles, except in place of replacements of vehicles . • 9 . Upon the application to the Auditor-Treasurer of the Town of Leesburg, in Virginia, or other agent of the Town ap- pointed for the purpose, for said license, upon forms provided therefor, and the payment of the cost thereof as herein pro- vided to the Auditor-Treasurer, or such agent, the Auditor- Treasurer, or such agent, shall issue a license plate and the vehicle for which this license is procured shall have exhibited thereon, in the front or the rear thereof, and attached thereto, the said license plate, in such a manner so the same shall be plainly visible to the general ,public. 10. There shall be exempt from the operation and require- ments of this ordinance all vehicles exempted from the im- N position of state, county, city and town ordinances under the 00 provisions of Article 1 of Chapter 3 of Title 46 of the Code of 00 Virginia of 1950, as amended. et Q 11. No vehicles taxable under this ordinance shall be locally licensed unless and until the applicant for such license shall have produced before the said Auditor-Treasurer, or such agent, satisfactory evidence that all personal property taxes upon the vehicle to be licensed have been paid, which personal property taxes have been assessed or are assessable against such applicant. 12. In the event any provision of this ordinance is de- • clared unconstitutional or otherwise invalid, then such shall not invalidate other provisions of this ordinance. 13. Any person violating the provisions of this ordinance shall be guilty of a misdemeanor and shall, for a first con- viction thereof, be punished by a fine of not less than Five Dollars ($5.00) nor more than one Hundred Dollars ($100 .00) , or by imprisonment in jail for not less than one or more than ten days, or by both such fine and imprisonment ; for a second conviction within one year such person shall be punished by a fine of not less than Ten Dollars ($10.00) nor more than Two Hundred Dollars (' 200.00) or by imprisonment in jail for not less than one nor more than twenty days, or by both such fine and imprisonment ; for a third or subsequent conviction within one year such person shall be punished by a fine of not less than twenty-five dollars ($25.u0) nor more than five hundred dollars ($504.00) or by imprisonment in jail for not less than ten days nor more than six months, or by both such fine and im- prisonment. /'is . � �I n'1 . Recorder The Auditor-Treasurer was, after the adoption of the fore - . going ordinance, ordered and directed to purchase the necessary motor vehicle licenses . Upon motion of Mr. Semones, seconed by Mr. Wright, and unanimously carried, the following resolution was tabled for further consideration at a special meeting of the Town Council to be held on January 23, 1958: WHEREAS, the Virginia Department of Highways on December 271, 1953, recommended that Route No. 7 from the intersection of Loudoun X34 and Market Streets on the West, to the intersection of Market and Loudoun Streets on the East, be made a one-way street going East on Loudoun Street, and a one way street going West on Market Street; and, WHEREAS, if the Town of Leesburg would make Route No. 7 a one-way street as above set forth, the Virginia Department of Highways would immediately give consideration to the allocation of such funds as may be necessary for curb and gutter for a thirty (30) foot curb to curb width on Route No. 7, and that the Town of Leesburg would be eligible for said allocation; and, • WHEREAS, with a thirty ( 30) foot curb to curb section, side- walks would be constructed on one or both sides if the Town of Leesburg providdd a sufficient right-of-way for same , aryl that a forty-five (45) foot right-of-way would be all that would be required by the Virginia Department of Highways, and in. the instal- lation of said sidewalks the Town of Leesburg would pay for one- half the cost thereof ; and, WHEREAS, it is the desire of the Town of Leesburg to pro- vide for the immediate improvement by the Virginia -Department of ;. Highways of State Route No. 7 and State Route No. 15 within the Corporate limits of the Town of Leesburg; and, WHEREAS, the present construction by the Virginia Departre nt of Highways of State Route No . 15 North of the Torn of Leesburg has made Route No. 15 within the Corporate limits a traffic hazard, and it is of immediate necessity that State Route No. 15 be improved by the Virginia Department of Highways so as to accommodate the increasing flow of traffic through the Town of Leesburg on 'State Route No. 15.; NOW, THEREFORE, BE IT RESOLVED, by the Mayor LLand Town Council of the Town of Leesburg, at a duly called meetingheld in the offices of the Town Council on January 13, 1958-pais follows : ( 1) The Mayor of the Town of Leesburg be arr3' he is hereby authorized and directed to request the Virginia Department of Highways to make an immediate survey of State Route Nos . 7 and 15 within the Corporate limits of the Town of Leesburg, to the end that the said streets be improved so as to ranove present traffic hazards, by the installation therein of a thirty (30) foot curb to curb section on Route No. 7 from its intersection with the Corporate limits of the Town, and to construct and in- stall thereon curb and sidewalks under an agreement whereby the Town of Leesburg shall pay one-half the cost of .said sidewalk construction; and, I , • ( 2) That the Mayor be and he is hereby authorized and directed to request the Virginia Department of Highways to in- stall on State Route No. 15 within the Corporate limits ofthe Town of Leesburg, a forty (40) foot curb to curb section, to- gether with curbs and sidewalks, under an agreement whereby the Town of Leesburg shall pay one-half the cost of said sidewalk construction: and, ( 3) The Mayor and the Town Attorney be and they are hereby authorized and directed to acquire for and in behalf of the Town of Leesburg, a forty-five (454 foot right-of-way on State Route- No. oute No. 7, including Market and Loudoun Streets, within the Corporate limits of the Town of Leesburg; and, (4) The Mayor and Town Attorney be and they are hereby authorized and directed to acquire for and in behalf of the Town of Leesburg, a fifty (50) foot right*ofway for Tt:(e0wi) dening of State Route No. 15, so as to provide for e for to curb section, and sidewalks on one side ofthe street; and , 135 ( 5) The Mayor of the Town of Leesburg be and he is hereby authorized and directed to request that the Virginia Department • of Highways, as a part of the Route No. 7 improvement project, include therein the extension of Buick Street from its present terminus with Loudoun Street to the North, to form a connection with Harrison Street, with the understanding that the Town of Leesburg will- provide the necessary right-of-way for the con- 11 struction of s&id_iBuick Street extension which is,..required be- cause of the necessity therefor, in order to provide one-way streets on Route No. 7; and, BE IT FURTHER RE60LVED, by the Mayor and Council of the • Town of Leesburg, that State Route No . 7 from the intersectbn of. Loudoun and Market Streets on the West, through to the inter- section of Loudoun and Market Streets to the East, be made a • one-way street on Market Street for traffic going West and a one- way street on Loudoun Street for traffic going East ; and, 00 BE IT FURTHER RESOLVED, That the Mayor of the Town of Lees- + burg be and he he is hereby authorized and directed, and by this Q resolution, empowered to do any and' all things which may to t necessary to effect the carrying out of the intendment of this resolution, and that the Virginia Department of Highways shall commence and inaugurate the improvement of State Routes 7 and 15 as herein provided for ; and the Recorder be and 'she is herby authorized and directed to mail a certified copy of this reso- lution to the Virginia Department of Highways . • V al/ /J-Lev- AikaA,LtALkL Recorder The Town ATTORNey read a letter from Mr. Wilbur C. Hall, counsel for the Pitts -Tally-Ho Theater with respect to storm and drain water entering the said theater. Upon motion of Mr. Hollandsworth, seconded by Mr. Gill, Mitch ell , Hollandsworth, Gill, Wright, Semones voting for and Johnson voting against, the following resolution was adopted: WHEREAS, it is the ' desire of • the Council of the Town of Lees- burg, in Virginia , to effectuate the construction and installation of that portion of the Major Thoroughfare plan heretofore adopted . by obtaining the necessary ribhts-of-way so as to enable the con- struction of the inner loop thoroughfare between State Route No . 7 to 'State Route No . 15; and thence across the lands of Carter and others to the intersection of said inner loop with State Route No . 7 and Fairview Street ; and , WHEREAS, that portion of the inner loop along parker Road and Catoctin Street has been completed ; and , • WHEREAS, by virtue of the Propspect Hills Subdivision, a sub- stantial portion of the inner loop between Valley View Avenue and Dry Mill Road will be completed by the subdivider ; NOW, THEREFORE, . BE IT RESOLVED, That the mayor and Town Attorney be and they are hereby authorized and directed to immediately inaugurate negotiations for the acquisition of a seventy (70) foot richt-of-way for the Instruction of the inner loop , as shown on the Major Thoroughfare plan , between King Street and Valley View Avenue , and between Dry Mill Road and State Route No. 7 ; and they are further directed to report sack at the next meeting of the Town Council to be held on February 10, 1958 . the results of their negotiations ; and they are further directed not to make anylfirm commitments involving the Town of Leesburg without the tpior approval of the Town Council . 1.36: • Upon motion of Mrs . Mitchell , seconded by Mr . Gill , the following resolution was unanimously adopted : WHEREAS, in order to. provide for the free flow of traffic from the Northeast section of the Town of Leesburg , to the South across Edwards Ferry Road and State Route No . 7 , it is necessary to effect the extension of Parker Road to the North , to the in- tersection with Duke Street ; and , WHEREAS, it is deemed advisable to provide for the exten- sion of Woodberry Road from its intersection with Edwards Ferry Road to the South , to form an intersection with State Route No . 7 ; i'iOW, THEREFORE , BE IT RESOLVED , That the Mayor and Town At- torney be and they are hereby authorized and directed to commence immediately, negotiations for obtaining a seventy (70) foot right- of-way for the extension of Parker Road from State Route No . 7 through to the Edwards Ferry Road , and for the acquisition of a fifty ( 50) foot right-of-way for the extension of Woodberry Road from Edwards Ferry Road to the South to State Route No . 7 ; and they are hereby further directed to report back to the Town Council on the second Monday in February the results of their negotiations , it being understood that no :firm commitments will be made binding the Town of Leesburg until prior approval of same is givenby the Town Council . Upon motion of Mr . Gill , - seconded by Mr . Hollandsworth . and unanimously carried , the following resolution was adopted : RESOLVED, by the Council of the Town of Leesburg , that Mrs . Sybil W. Wanner be employed as Town Zoning Administrator at a salary of Two Hundred Fifty Dollars (3250. 00) per month, for a period of six months. Upon motion of Mrs . Mitchell , seconded by Mr. Hollandsworth , and unanimously carried , the following resolution was adopted : RESOLVED, That the Town of Leesburg cooperate in whatever way is necessary with the Loudoun County School Board in their water and sewer problems at the Elementary School and the Douglass High School . Upon motion of Mr . Hollandsworth , seconded by Mr . Semones , the following resolution was unanimously adopted : RESOLVED, That the Sanitation Committee and the Town Attorney be authorized to negotiate to obtain a necessary tract of land for a town dump and report back to the next meeting of the Town Council . The Town Attorney then read a letter from Mr . Wilbur C. Hall . attorney for George Allen Wagner . whochad been convicted of reck- less driving and his permit taken . The purpose of the letter was to ask for a reopening of the case . The Council unanimously agreed not to reopen said case . It waS the opinion of the Town Council that in the trial of the M. 8 G. Motors case against the Town of Leesburg , that the two witnesses for the Town be paid for the hours they were forced to miss from their employ in order to testify . Upon motion of Mr . Hollandsworth , seconded by Mr . Wright , and unanimously carried , the following resolution was adopted : RESOLVED; That the Town of Leesburg accepts that certain Deed of Dedication of the George Jason Corporation dtted the 13th day of January, 1958 , and the Mayor be and he is hereby authorized and directed to execute said deed for and in behalf of the Town .of Leesburg , and that the Recorder be and she is • hereby authorized and directed to attest to the signature of , the Mayor and affix the Corporate seal thereto . • 137: • Upon motion of Mrs . Mitchell , seconded by Mr . Hollandsworth , and unanimously carried , the following resolution was adopted : WHEREAS, the Town of Leesburg is advised that the George Jason Corporation is willing to dedicate to the Town of Lees- burg , a certain tract or parcel . of land located at the inter- ' section of Loudoun and Market Streets on the Western edge of the Town of Leesburg , containing approximately 8 ,664 square feet of land, all as more particularly shown on that certain plat of ' Robert K. Wilson, Certified Land Surveyor, dated November 15, 1957 ; and, WHEREAS, it is the desire of the Town of Leesburg to accept the dedication of said tract or parcel of land: NOW, THEREFORE, BE IT RESOLVED, That the Town Attorney be and he is hereby authorized to negotiate with the George Jason Corporation for the dedication of the lands hereinabove referred N to, and he is further authorized to negotiate with the Leesburg M Garden Club for the planning and maintenance of the landscaping M . of said tract, with the understanding that if said dedication Q is made andtheaacceptance by the Loudoun Garden Club is obtain- ed, the Town of Leesburg will annually provide a sum not to exceed One Hundred Dollars ($l00.0O ) , or the actual cost of the maintenance thereof, and he is further authorized and directed to report back to the Town Council the results of said negotiations at the next meeting of the Town Council. The Town Attorney then recommended that a special meting of the Town Council be held for the purpose of considering the problems that will arise in connection with annexation, and in particular the amount of money the Town canSexpend in 1958, 1959 and 1960. Mr . William J. Lough was then heard with respect to the Town erecting a light in Monroe Manor . The Town Attorney advised the Council that Monroe Manor had certain commitments with the Town which had not been adhered to. The Mayor asked that this matter be investigated further to see what could be done . Mr . Claude Honicon appeared before the Council for permission to hook on to the sewer of Loudoun Properties back of the Phillips 66 ' filling station in order to provide the proper sewer facilities for his six room apartment .building. The Mayor stated that there was additional information the Council desired before setting a policy as to people desiring to avail themselves of these sewer facilities ' and not using the water facilities of the Town. The Town Attorney recommended that the Water and Sewer Committee give this problwm consideration and report back to the next meeting with a general overall plan for same . Then followed a discussion with respect to the employment of Mr. Glenn Weatherholtz to take the responsibility of the street works, namely, working with the other employees with concrete and sidewalk work, but Mr . Weatherholtz. not to be over Mr. Hough. Upon motion of Mr. Gill, seconded by Mr. Hollandsworth, and unanimously carried, the following resolution was adopted: RESOLVED, That Mr. Glenn Weatherholtz be employed by the Town of Leesburg, in Virginia, at a weekly salary of Seventy Dollars ,/ ($70.00) , to take on the responsibility of the street works in the Town of Leesburg.
