WHEREAS, said public hearing was held at the time and
place advertised and members of the public appeared;
THEREFORE, BE IT ORDAINED by the Council for the Town
of Leesburg, in Virginia, that Section IV-A of the Subdivision
Ordinance be amended by addingsafsubsection "c" to read as
follows: •
"The provisions of this Section shall be complied with by
all subdividers, except that variations from these requirements
may be allowed by the Town Council, where it is deemed necessary
or desirable because of extreme hardship resulting from the
strict application of the requirements of this Section or the
impossibility of conforming to the provisions thereof, and the
allowance of same will notviolate any provisions .of the Virginia
Land Subdivision Act, as amended, or the provisiong of this
Ordinance .
Upon. motion of Mr . Wright , seconded by Mrs . Mitchell and
unanimously carried, the following resolution was adopted and •
copies of same ordered sent to all the proper officials in-
volved:
BE IT RESOLVED, That the Town .of Leesburg, in Virginia,
deems it essential to the economic well-being of the Town and
the surrounding area, as well as to the County as a whole , and
further deems it essential to the safety of its citizens travel-
ing over the public highways and for the adequate safety of
motorists traveling through the Town of Leesburg and of its
citizens; that an access highway be built from the Northern
entrance of the Chantilly Airport to Leesburg, in order to
relieve the already over congested, inadequate and dangerous
Virginia State Route 7.
There being no further business to come before the meeting
the meeting upon motion duly made and seconded, adjourned.

REGULAR MEETING, August 11, 1958
At a regular /netting of the Council of the Town of Leesburg,
in Virginia, held August 11, 1958, at 7 : 30 P. M. in Council chambers,

The minutes of the regular meeting held July 14, 1958 were
read and upon motion of Mrs . Mitchell, seconded by Mr. Johnson,
and unanimously carried, were approved as read.
The minutes of the special meeting held July 16, 1958 were IIread and upon motion of Mrs . Mitchell, seconded by Mr . Johnson,
and unanimously carried, were approved as read.
The minutes of the special meeting held August 4, 1958 were
read and upon motion of Mr. Gill, seconded by Mrs. Mitchell and
unanimously carried, were approved as read.

The Treasurer then presented his financial statement for the
month of July and the special sewer debt fund statement.
Upon motion of Mr. Johnson, seconded by Mr. Gill and unanimously
carried, it was :
RESOLVED, That the Auditor-Treasurer be and he is hereby autho-

Mr: Wright, a member of the Street Committee then reported
that it was the desire of Mr. Steve Savapoulos to have forty
feet of sidewalk constructed on SouthcStreet :inof ront of his
property. This matter was referred to the Street Committee
for further consideration.
Mr. Gill, _a member of the Sanitation Committee , reported
that he had had discussions with Mr . John W. Clemens with
respect to a site for a dump for the Town of Leesburg. He
further stated that his report would be continued until a
later date .

Upon motion of Mr. Johnson, seconded by Mr. Wright and
unanimously carried, it was:
WHEREAS, an amendment to the Subdivision Ordinance was
adopted by the Council for the Town of Leesburg on the 4th
of August, 1958, pursuant to Public Notice ; and,

WHEREAS, the Board of Supervisors for Loudoun County .
was not duly notified of the intention to adopt said amend-
ment prior to the adopts thereof: and,
WHEREAS, the adoption of said amendment is null and
void; and, •
WHEREAS, notice in writing of the proposed adoption
was given to the Board of Supervisors this 11th day of •
August, 1958;
BE IT THER-EFOR' ORDAINED by the Council for the Town
of Leesburg that the amendment to the Subdivision Ordinance .
adopted as aforesaid on August 4, 1958, be and the same is
hereby adopted as if written out herein in full and shall
be effective from this date . .
Mr. -W. B. Ridgeway was then heard with respect to the
rezoning -of the Grimes property. It was decided that the
Council should have more time to consider Mr. .Ridgeway ' s
proposal .
• • Upon motion of Mr. Wright, seconded by Mr. Johnson, _
the following resolution was defeated by a vote of three to
two, Gill, Hollandsworth, Mitchell voting against and Wright
and Johnson voting for: •
• BE IT RESOLVED, that the application of Mr. .Robert G.
Steadman for a variance from Section IV-AIII and IV of
the Subdivision Ordinance for the Town of Leesburg, in
Virginia, be and the same hereby is granted in regard to
sidewalks, curbs and gutters .
• Mr. H. I . Tiffany then appeared before Council with
respect to an easement across his property East of Leesburg
on Route #7 and 'stated that he was willing to give the said
easement to the Town.
• The Town Attorney then read a letter from Mr. Wallenstein,
counsel for the League of Virginia Municipalities, with
respect to the Recorder acting in the absence of the Mayor.
Upon motion of Mr. Gill, seconded by i'Ir. Johnson, and_
unanimously carried, it was
• RESOLVED, by the Cpancil of the Town of Leesburg, in
Virginia, that the ordinance appointing Howard B. Gill as
• Mayor pro tem be and the same hereby is amended to read as
follows:
That the Mayor pro tem, Howard B. Gill, shall act only
in the absence of both the Mayor and the Recorder . • •
Upon motion of Mr. Johnson, seconded by Mr. Gill, and
unanimously carried, it was :
RESOLVED, That in the event Jesse Randolph indicates
an intention to execute the trash and garbage collection
contract which has been furnished his attorney, that the
Mayor and the Recorder be and they are hereby instructed
and directed to execute the said contract .
Upon motion of Mr. Gill, seconded by Mr . Hollandsworth ,
and unanimously carried, the following resolution was
adopted:

WHEREAS, the Town of Leesburg, in Virginia, has had
conducted ' a traffic and engineering investigation of the
speed limits which should be adopted on certain streets
within the - annexed. area; and,

WHEREAS, the Town of Leesburg has caused signs or markers
to be placed indicating the speed limits on Routes 7, 15, 699,
1004/and 773;
THEREFORE, BE IT ORDAINED by the Council for theTown of
• Leesburg, that any person who shall drive any motor vehicle
at a speed in excess of the said posted speed limits on said
streets upon conviction, shall be punished by a fine of not
less than five dollars, ndr more than one hundred dollars, or

by imprisonment in jail for not less than one, nor more than
. ten days, or both such fine and imprisonment; and,
BE IT FURTHER ORDAINED, by the Council for the Town of
Leesburg, as follows : •
• PENALTY FOR DRIVING WHILE LICENSE SUSPENDED:
If any person shall drive any motor behicle upon any street
_or highway while his license is suspended or while forbidden to
N drive or operate a motor Vehicle in the Town of Leesburg, he
:• shall be punished by imprisonment in jail for a period not less
CC • than two days , nor more than six months, or by a fine of not
etless than five dollars nor more than twenty five dollars, or
et both such fine and imprisonment .
SPEED LIMITS--GENERALLY:
0
Except as provided for in Section 46.1--180 of the Code
of Virginia, the State traffic laws regulating the speed of
motor vehicles shall be applicable upon all streets and high-
• ways in the Town except as provided for otherwise under the
section referred to above and any person who shall drive a
motor vehicle in excess of said speed limits shall upon
conviction, be punished by a fine of not less than ten dollars
' nor more than one hundred dollars, or by imprisonment in jail
for not less than one , nor more than ten days, or both such
fine and imprisonment; and,
BE IT FURTHER ORDAINED, That a motor vehicle is defined
as every vehicle which• is self-propelled or designed for self-
propulsion;• and,
BE IT FURTHER. ORDAINED, That the Reckless Driving Ordinance
on Page 14 of the Ordinance Book be and the same is hereby
amended to read as follows, by adding after, "misdemeanor, "
J'a.nd 'upon conviction thereof, shall be punished --
by a fine of not less than five dollars, nor more
than one hundred dollars, or by imprisonment in
jail for not less than five days or more than
six months, or both such fine and imprisonment."
This Ordinance shallffective as of date of adoption.
It was generally agreed that the Town of Leesburg should
work with the County of Loudoun in the matter of a Building
Code .
•
The Mayor referred to the Planning Commission a letter
from Mr . Carleton Penn and Mr . Lucas D. Phillips .
The Mayor advised that the Town of Leesburg had received
letters from Hon. Barry F. Byrd and Judge Smith with. respect
to the resolution heretofore adopted by the Town regarding the
access road to the Chantilly Airport.
• The Mayor also reported that the Perry Engineering Company
felt that the work to be done on the tater and se::er. lines to
the new Douglass Elementary School would be completed in ample
time for the opening of school .

Upon motion of Mr. Gill, seconded by Mr. Hollandsworth;
and unanimously carried, it was:

RESOLVED, That Max Dwyer, one of the Town Policemen
be given a vacation this year .
Upon motion of Mr. Gill, seconded by Mr. Johnson and
unanimously carried, it was :
RESOLVED, That Section VIII of the Trash and Garbage
Ordinance be stricken from said ordinance .

The Town Attorney stated that in a discussion with Mr. ,
Vesey, former Town Attorney, Mr. Vesey advised that he
would not compromise the suit of M. & G. Motors against
the Town of Leesburg.
Upon motion of Mr. Gill, seconded by Mrs. Mitchell, and
unanimously carried, it was :
RESOLVED, That the Town employ an extra stenographer at
a reasonable salary, which stenographer would not be permanent
but would help with the typing of certain codes .

burg , in Virginia , held September 8 , 1958 at 7:45 P . M. in
Council chambers , there were present : George J . Durfey ,
Mayor; Elinor M. Cunningham, Recorder ; Howard B. Gill; C. R.
Hollandsworth; Reed Johnson; Mae Bass Mitchell ; Oden Semones
and J . Austin Wright , being all the councilmen.
The minutes of the regular meeting held August 11 , 1958
