Gore with respect to a proposed violation notice to be placed on the cars of out of State visitors to Leesburg, Virginia. Mr. Hollandsworth was requested to contact the Town Police with respect to service cars that had been parking in front of the. Post Office for long periods of time and thus occupying a parking space that was needed by people receiving and depositing mail. A discussion then followed with respect to the purchase of the Claude Honicon well. Upon motion of Mr. Johnson, seconded by Mrs . Mitchell, the following resolution was unanimoudly adopted: BE IT RESOLVED, by the Council of the Town of Leesburg, that the Mayor be instructed and directed to obtain the chemical analysis and any other necessary- data suggested by the Town Engineer with respect to the character of the water at the Honicon well, and that this set of analysis tests be obtained at the lowest possible cost . .':4• • The Town Attorney recommended that Mr. Honicon be given a • , copy of the aforementioned analysis , with which recommendation the Town Council concurred. . Mr. Vesey tendered his oral resignation as Town Attorey as • of May 1, 1958, but advised that he would do whatever work is necessary for the bond issue and the completion of the annexation Problem. He further stated that it had":been a}_pleasure.;tbfnave been:of; service to the Town Council and that by the 1st of -May the amendments to the Zoning Ordinance would be completed; also the electrical, building, sanitation and plumbing codes would be in order for the consideration of the Town Council. Upon motion of Mr. Gill, seconded by Mr. Hollandsworth and unanimously adopted, it was : RESOLVED, that a special meeting of the Town Council of the Town of Leesburg, in Virginia, be held April 24, 1958 at 7 : 30 P. Hollandsworth, the following resolution was unanimously adopted: WHEREAS, the Mayor and the Town Attorney of the Town of Lees- burg were authorized and directed to negotiate a contract with the Loudoun County School Board for the construction of a water • line and sanitary sewer to serve the Douglass Elementary School, and for the taking over by the Town of Leesburg, in Virginia , of the water and sanitary sewer lines in Ayr Street in the corporate limits of the Town of Leesburg, now owned by the Loudoun County - School Board; and, WHEREAS, the said Mayor and the Town Attorney have negotiated and completed said agreement, which agreement is as follows : "AGREEMENT AND UNDERTAKING • THIS AGREEMENT AND UNDERTAKING, entered into this day of C9 April, 1958, by and between THE TOWN OF LEESBURG, IN VIRGINIA , a municipal corporation created by act of the General Assembly of the Commonwealth of Virginia, sometimes hereinafter referred to as the Q "Town, " or Party of the First Part, and THE LOUDOUN OOUNIY SCHOOL BOARD for Loudoun County, Virginia, a domestic corporation, some - times hereinafter referred to as The School Board, or as the Party • of the Second Part ; W I T N E S SET H : WHEREAS,. the Loudoun County SchoolBoard desires to provide water and sewer facilities for the Jouglass Elementary School now being con- structed, and for the Douglass High School, both located within the Corporate limits of the Town of Leesburg, in Virginia , and to provide for the furnishing of water and sewer ftcilities by the Party of the First Part at reasonable minimum rates ; and, WHEREAS, the Town of Leesburg, in Virginia , Party of the First Part, desires to accommodate the Loudoun County School Board by supplying the requisite and necessary water and sewer facilities for schools within the corporate limits of the Town of Leesburg, owned and operated by the Loudoun County School Board, and for the supply- ing of said facilities at reasonaole minimum rates ;• - NOW, THEREFORE, it is agreed by and between the Parties hereto , • for and in consideration of the sum of Ten Dollars ($10.00 ) in hand paid by each Party to the' other prior to the ensealing of this Agree- ment, and as further consideration the mutual promises , undertakings and convnittments hereinafter set forth as follows : ( 1) The Town of Leesburg, in Virginia, Party of the First Part, by these presents hereby agrees to construct a cast iron and V. C. 10 inch sewer line, including all manholes and connections, and concrete supports, all as more particularly shown on that certain Field Survey made by Robert K. Wilson, C .L. S. , Leesburg, Virginia, dated March 10, 1958, which is attached hereto and made a part hereof and marked Exhibit A, on or before September 1, 1958, and available for use by the Loudoun County School Board on or before September 1,1958, and to permit the Loudoun County School Board to connect thereto . ( 2) The Town of Leesburg, in Virginia , Party of the First Part , by these presents hereby agrees to construct an 8 inch water main in Parker Road, including the connection with the 4 inch main in South Street, together with all valves, fittings and other con- nections, eand to complete .same on or before .eptember 1 , 1958, ao as to provide for a sufficient supply of water at adequate pressures for all Parties connected thereto, including the Loudoun County School Board. 152 ( 3) The Town of Leesburg, in Virginia , does hereby agree to complete on or before September 1, 1958, the construction and installation of a 6 inch cast iron water main running from the 8 inch water main to be constructed and installed in Parker Road, as provided for in Paragraph ( 2) next above, together with all valves, fittings and hydrants, to a point within 200 feet of the present location of Douglass High School, and to a point within 200 feet of the location of the Douglass Elementary School now under construction; and in addition thereto to cog- - struct and install a water hydrant within 200 feet of the Douglass High School, and a water hydrant within 200 feet of Douglass Elementary School ; and in addition thereto , to run a three inch water line from said 6 inch line to the Douglass High Schooj,and a three inch line from the aforesaid 6 inch line to • the Douglass Elementary School. • (4) It is agreed by and between the Parties hereto., and by these presents they do hereby agree that upon the completion of the construction of the water and sewer lines specified in Paragtaphs ( 1) , (2) and ( 3) next above , the Loudoun County School Board will, within ten (10) days from receipt of invoice , to pay to the Town of Leesburg, in Virginia, the sum of Ten Thousand Eight Hundred Dollars ($10,800.00) in full and complete payment for said water and sewer installations, except the water meters which shall be furnished and installed by the Loudoun County School Board. • ( 5) It is further agreed by and between the Parties hereto, and by these presents the Loudoun County School Board does hereby grant and convey unto the Town of Leesburg, in Virginia, all of its right, title and interest in and to that certain sanitary sewer line, and that certain water line now located in Ayr Street in the Town of Leesburg, tn Virginia, heretofore constructed and installed by the Loudoun County School Board, from the former corporate limits of the Town of Leesburg to the manhole in Ayr Street in front of the Loudoun County High School, at which point the Loudoun County High School ' s connecting main connects, and the consideration for this grant and conveyance is by the Agree - ments and Undertakings of theTown of Leesburg, in Virginia , as set forth in Paragraphs ( 1) (2) and (3) above . (6) It is further agreed by and between the Parties hereto , and by these presents the Loudoun County School Board does hereby agree to execute, upon presentation to it, permanent easements across the lands of the Loudoun County School Board, for the pur- pose of construction and installation of the water and sewer lines herein provided for, together with the right of ingress and egress to the Town of Leesburg, in Virginia, and its agents, for the oon- • . str•uction and maintenance of all of said water and sewer lines. ( 7) It is agreed by and between the Parties hereto, and by these presents they do hereby agree that the Town of Leesburg, in Virginia , will, on bnd after the effective date of this agreement , furnishto the Party of the Second Part, the Loudoun County School Board, for all schools owned and operated by it, within the Cor- porate limits of the Town of Leesburg, water and sewer facilities ; and it is further agreed by the Parties hereto that the Town of Leesburg will make no service charge for the furnishing of 'said sewer facilities and will furnish said water facilities in accor- dance with its established effective rates . . Mitchell, the following resolution was unanimously adopted: WHEREAS?, the Town of Leesburg, in Virginia, advertised for bids for the construction of an eight inch water line in Parker Road in the Town of Leesburg, the construction of a six inch water line along and through the easement of the Loudoun County School Board' from its intersection with Parker Road and thence to the new II Douglass Elementary School, and the construction of a ten inch sewer line from the sanitary disposal plant of the Town of Leesbt g, . in • Virginia, to serve the Douglass Elementary School, all as more particularly shown on the plat of the "Proposed Water and Sanitary Sewer Extension' to Serve Douglass Elementary School, " prepared by Warren C. IIWith the exception of the addition of Subsection D to Section I the amendments were approved. • Mr. E. B. White, Attorney at Law, then brought pp the sub- ject of theGeorge Jason Corporation transferring a park area to the Town under the committments made by the Town of Leesburg, the Town acquiring title to same and agreeing to pay ; 100.00 a year • for the maintenance of said park area under the supersision of the Leesburg Garden Club. Mr. White stated that the deed wodld be transferred to five trustees ; namely, The Peoples National Bank, the Loudoun National Bank, the Mayor, the President of the Garden Club andthe Town Attorney. It was generally agreed that the Town Attorney and Mr. White get together with respect to drafting a trust agreement along such acceptance to the Town, all of the aforesaid being predicated upofi the Planning Commission approving the subdivision plat of the George Jason Corporation. It was decided that the Town Attorney, Mr. White, the Chairman of the Board of Zoning Appeals and the Chairman of the Planning Commission meet on Saturday, April 26, 1958 at 1:O0uorelock in order to work out the problems involved with respect to the George Jason Corporation. - • The Town Attorney then discussed the proposed changes to the Zoning Ordinance for the Town of Leesburg, It was decided that a special meeting of the Town Council would be held Wednesday , April 30, 1958, at 7 :30 P. M. in the Council Chambers in order to permit each councilman before that time to familiarize himself with the proposed changes . The Mayor read a letter from Mrs. Sybil W. Wanner, Zoning Administrator, with respedt to a joint meeting of the Planning Commission, at which meeting Mr. Richard C. Dynes , Chief of Local Planning in the State Department of Planning and Economical ilevelopment was present and showed a baselof the Town of Abington. At the aforesaid meeting, upon motion of Mr. Maurice Lowenbach, Jr. , seconded by Colonel George Isaacs, and unanimous±y approved, it was respectfui7.y' re,quested that this Town Council direct:: &be Planning Commission to have a base map made for the Tonn of Lees- burg at a price not to excees $431.00, less 1/3 off to the Town for Planning purposes, from the State Division of Planning and - Economic Development in Richmond;' Virginia. Upon motion of Mr. Gill, seconded by Mr. Wright, and unanimously carried, it was : RESOLVED, by the Mayor and the Council of the Town of Leesourg, that the Planning Commission obtain a base map of the Town of Leesburg for a price not to exceed 6431 .00 less 1/3 off, the cost for planning purposes . • I/The Mayor then read a letter from Mrs . Sybil W. Wanner with • respect to;Aanmeeting of the Plandin_g Commission and the Board of Zoning Appeals . Upon motion of Mr . Mr. Wright, seconded by Mrs. Micthall, and unanimously adopted, the following resolution was unanimously adopted: • 1-5:9 BE IT RESOLVED, by the Mayor and the Council of the Town of Leesourg, that there be included in their 1958-69 budget a sum of $500.00 for the Planning Commission, excluding the cost of the base map ; and, • BE IT FURTHER RESOLVED, by the Mayor and the Council of the Town of Leesburg; in Virginia, a further sum of $150.00 for the Board of Zoning Appeals . Mr.Hollandsworth brought up• the question of some residents on the Fort Evans Road who Wished to hook onto the Honicon Water line, The Torn Attorney advised that it was to the bast interests of the Town to wait until the property owners -were willing to deposit the cost of running the water line that far. The Mayor then asked if the council was in a position to nominate a replacement for the Town Attorney who had heretofore-- tendered his resignation. At the time there were no suggestions. BE IT FURTHER RESOLVED, Thatthe Zoning Administrator be in- structed and directed to publish the proposed changes in the Zoning Ordinance in some newspaper having general circulation. in. the Town of Leesburg for two consecutive weeks , after which time a public hearing of interested citizens will be held. , The Town Attorney then discussed the matter of the Town of IILeesburg supplying the Douglass High School and the Douglass Elementary School with water and sewer facilities and that the Loudoun County School Board was willing to contribute $10.800 . 00 in lieu of the cost to the School Board for running separate lines and pitting in.a pumping station. The Mayor advised thtt the Town Engineer , Warren C. Perrow, had been in Leesburg all day and had obtained some figures 'with respect to the relocation of the afore- said ater line running to the. Douglass Elementary School and the Douglass High School , which re location would give the school Board what they are asking for and permit the Town to have some additional water lines . The proposed relocation of the water lines would take said water line off the school property and place it where other pdople in the Town of Leesburg would benefit . Mr . Perrow stated that the added cost of the proposed relocation would be $$7288.02 for _.the 8 inch water line and ,33944.85 for the 6 inch line .
