.It was generally agreed by the Council members that a
special meeting would be held on May 15, 1958, at which time
the aforesaid Plumbing Code would be considered for final
adoption and the proposed Sanitation Code would be discussed
in detail .
•
There being no further business to come before the meeting ,

At a regular meeting of the Council of the Town of Leesburg,
.-. in Virginia, held in Council Chambers on May 12, 1958 at 7:30 P.
M. there were present: George J. Durfey, Ma or ; Elinor M.

the Councilmen.
The minutes of the regular meeting held on April 14 , 1958 were
read and upon.motion of Mr. Gill, seconded by Mr. Wright and unanim-
ously carried were adopted as read.
The minutes of the special meeting held on April 24, 1958 were
read and upon motion of Mrs . Mitchell, seconded by Mr. Hollandsworth ,
and unanimously carried were adopted as read.
The minutes of the special meeting of May 1 , 1958 were read
and upon motion of Mr. Gill, seconded by Mr . Wright andunanimously
carried, were adopted as read.
The minutes of the special meeting held on May 5, 1958 were
read and upon motion of Mr . Hollandsworth, seconded by Mr. Wright ,
and unanimously carried, were adopted as read.
The minutes of the special meeting of May 8, 1958 were read
and upon motion of Mr. Hollandsworth, seconded by Mrs. Mitchell,
and unanimously carried, were approved as read.
Upon motion of Mr. Gill, seconded by Mr. Wright, Gill ,
Hollandsworth, Mitchell and Wright voting for and Semones against,
it was :
RESOLVED, That the Auditor-Treasurer be and he is hereby
authorized and'directed to pay the following bills:

The Auditor=Treasurer also presented his mnntihly financial
statement and special sewer debt fund for the month of April.
. Upon motion of. Mr . Hollandsworth, seconded by Mrs. Mitchfll,
and unanimously carried, it was :
RESOLVED, That the Town Council hold a pubticlhearing June
3, 1958, •which would be after due publication of the Subdivision
Ordinance amendments for two weeks, in a newspaper having general
circulation in the Town of Leesburg,Virginia, to consider the
adoption of the Subdivision Ordinance as amended.
Upon motion of Mr. +'right , seconded by Mr. Gill and unanim-
ously carried, it was : _
RESOLVED, By the Council of the Town of Leesburg, in Vir-
ginia, that the Auditor-Treasurer be and he is hereby instructed
and directed to charge off the following 1957-58 license and
penalty: Frances C. Herndon, Merchant-Retail-$12.00 ..
The Mayor then read a form of bond presented by the Virginia
Department of Highways that had to do with incorporated cities
and towns obtaining permits to construct, install and maintain
certain public works along and upon the Highway system of Vir-
ginia, which bond was in form as follows :
INCORPORATED CITIES AND TOWNS MAY FURNISH IN LIEU OF A GUARANTEE
FEE AN OFFICIAL ORDINANCE, SUBSTANTIALLY AS FOLLOWS:
KNOW ALL MEN BY THESE PRESENTS, That the Town of Leesburg,
Virginia, a municipal corporation of the State of Virginia, is
held and firmly bound unto the COW'ONWEALTH OF VIRGINIA in the
full and just sum of ONE THOUSAND DOLLARS ($1,000.00 ) current
money of the United States, to be paid to the said Commonwealth
of Virginia, to the payment whereof it hereby binds itself
firmly by these presents, sealed with its seal and dated this
day of , A.D. , 19
WHEREAS, it becomes necessary from time to tine forthe
Town of Leesburg, Virginia, to obtain permits from the Vir-
ginia Department of Highways to install, construct, reconstruct,
maintain. and operate certain public works along , across , over
and upon the highway system of Virginia; and,
WHEREAT, expense, damage or injury may be sustained by the
Commonwealth of Virginia growing out of the granting to said
Town of Leesburg, Virginia by the Virginia Department of Hi -
ways of said permits for the work aforesaid : and,
WHEREAS, one of the conditions of such permit or permits
is that the Town of Leesburg, Virginia shall indemnify the
Commonwealth of Virginiaagainst all damages and injuries to the

Highways and bridges and to persons or property lawfully upon
• such highways ;

NOW, THEREFORE, The condition: of this obligation is such
that if the said Town of Leesburg, . Virginia shall in all respects
comply with all of the conditions of permit or permits that have
been, or will be, granted said Town of Leesburg, Virginia , and
shall indemnify and save harmless the Commonwealth of Virginia
against and from all loss, cost, expense , damage or injury to
highways and bridges and to persons and property lawfully on such
highways, growing out of the granting of such permit or permits
to said Town of Leesburg, Virginia, then this obligation to be
void, otherwise to be and remain in full force and virtue .
IN WITNESS WHEREOF, the said Town of Leesburg, Virginia , has
caused this bond to be .executed and its official seal affixed
the day and year above written, pursuant to an ordinance adopted
by its Council on the day of , 19

Town Attorney
The Town Attorney was instructed to investigate this form
as to legality and report back to the next Council meeting.
The Finance Committee advised .that the budget was not com-
plete and that any committee needing funds for the coming year
should report same to said committee . It was generally decided
by the Council members that a special meeting of the Town Council
be held May 28, 1958 for the purpose of considering the adoption •
of a proposed budget for the ensuing year . The Finance Committee
also had some proposed changes in the license fees for the Town
of Leesburg, which also would be discussed at the aforesaid special
meeting. The Town Attorney was uncertain as to the procedure to
be followed in order to adopt same and. desired to await further
advice from the councel for the Virginia League of Municipalities .
Upon motion of Mr. Gill, seconded by Mrs . Mitchell, Gill ,
Hollandsworth, Mitchell and Wright voting for and Semones against,
the following resolution was carried:
WHEREAS, at a special meeting of the Council of the Town of
Leesburg, in Virginia held May 1, 1958, at 7 :30 2 ; M. in Council
Chambers, an Administrative Code for the Town of Leesburg was
unanimously adopted;
NOW, THEREFORE, Be it resolved that the Administrative Code
is hereby adopted by the Council of the Town of Leesburg, in Vir-
ginia, and shall become effective at 12 :01 EST June 1 , 1958; and,
IIBE IT FURTHER RESOLVED, That the Recorded be and she is hereby
instructed and directed to place said Administrative Code in the
Ordinance Book of the Town of Leesburg, in full form as adopted,
the same as if fully incorporated in these minutes.
Upon motion of Mr. aright, seconded by Mr. Hollandsworth,
the following resolution was adopted:
WHEREAS, the Zoning Administrator was directed to publish
the Zoning Ordinance as adopted, in a newspaper having general
circulation in the Town of Leesburg, in Virginia; and,
•
WHEREAS, doubt has arisen as to the necessity of a public

hearing before such adoption:
IT IS THEREFORE RESOLVED, That the Zoning Administrator
be and she is hereby directed to hold this publication in
abeyance until further order of the Council .
It was generally agreed that the Council of the Town of
Leesburg should publicize through the means of the LOUDOUN
TINES MIRROR the fact that on May 21 , 1958, the trash collector
would gather all branches of trees, etc . that were put out by
the citizens of the Town.
Upon motion of Mr . Wright, seconded by Mr . Gill , and un-
animously carried, the meeting adjourned.

SPECIAL MEETING, May 15,1958
At a special meeting of the Council of the Town of Leesburg,
' in Virginia, held May 15 , 1958, ate?:30ePe M. in the Council
Chambers, there were present: George J. Durfey, Mayor ; Howard •
B. Gill, C. R. Hollandsworth, Mae Bass Mitchell, Oden K. iemones
and J. Austin' Wright, Councilmen and George M. Martin, Town At-
•
torney.
In the absence of the Recorder Mrs . Mitchell was appointed
to serve as Recorder Pro Tem. II• The Mayor stated that the meeting was called for the pur-
pose of further consideration of the Plumbing Code and other
codes that may come before the Council.
•
George M. Martin, Esquire, reported that he had received a
letter from Mr . Wallenstein, Counsel for the Virginia League 0
of Municipalities, in which he confirmed Mr. Martin' s opinion
that any increase in tax and license rates or any new licenses
to be imposed by 'the Town would have td be advertised before
adoption.
The Town Attorney further reported his approval of the bond
between the Town of Leesburg and the Commonwealth of Virginia,
which appears on Page 164 and lb•5 of this Minute Book, and which
has heretofore been read in full.
Upon motion of Mrs. Mitchell, seconded by Mr. Gill, the
following resolution was unanimously adopted:
BE IT RESOLVED, 8y the Council of the Town of Leesburg, in
Virginia, that the new Zoning Ordinance and the Administrative
Code be spread upon the pages of the General Ordinance Book
and that reference thereto be made in the Minute Book.
The Mayor then laid before the Council the matter of the
Plumbing Code, which had been discussed at a special meeting
on May 8, 1958.
After a discussion by Council, and upon motion of J. Austin . ••
Wright, seconded by Howard B. Gill and unanimously carried, the
matter was tabled until June 3, 1958, to give Council more time
• to study the code . At the aforementioned meeting the proposed
building and electrical codes will be discussed. Further , the
Town Attorney is directed to publish notice of this meeting if
he deems it necessary.
• The matter of a proposed budget for the Town of Leesburg was
discussed and it was agreed that Council would meet on May a) ,
1958 to consider same .
