Upon motion of Mr. Gill, seconded by Mrs . Mitchell, and
carried, Gill, Hollandsworth, Mitchell and Semones voting for
and Wright against, the following resolution was adopted:
BE IT RESOLVED by the Council of the Town of Leesburg that
the .Mayor of the Town of Leesburg be 'and he hereby is directed
and authorized to arrange a joint meeting with the Board of
Supervisors for the Dounty of Loudoun and the Loudoun County
Planning Commission with the Council of the Town of Leesburg
and the Planning Commission for the Town. of Leesburg to deter-
mine the question of joint jurisdiction under the Subdivision I/Ordinance outside of the Town of Leesburg.
There being no further business to come before the meeting ,
upon motion duly made and seconded, the meeting adjou reed.

REGULAR MEETING, October 13, 1958
At a regular meeting of the Council of the Town of Leesburg,
in Virginia, held October 13; , 1958 inlCouncil Chambers there
were present: George J. Durfey, Mayor ; Elinor M. Cunningham,
Recorder; Howard B. Gill ; C. R. Hollandsworth, Reed Johnson,
Mae Bass Mitchell, Oden Semones and J. Austin Wright:, Council-

Upon motion of Mrs . Mitchell, seconded by Mr. Wright arra
unanimously carried the minutes of the regular meeting held
September 8, 1958 were approved as read.
Upon motion of Mr. Gill', seconded by Mrs . Mitchell and
unanimously carried the minutes of the special meeting held Sept-
ember 25, 1958 were approved as read.

Upon motion of Mr. Gill, secbnded by Mr. 'Wright, and un-
animously carried, it was : T
WHEREAS, the Auditor-Treasurer has presented a report of
all receipts and ansanalysis of all disbursements for the quarter
ending September 30; 1958;
NOW, THEREFORE, BE IT RESOLVED by the Council of the Town
of Leesburg, in Virginia, that the Auditbr.=Treasurer be and he
is hereby authorized and directed to have a coJy of said reports
published in a neswpaper in said Town and also to post a cny in front
of the Court House in said Town.

`• • The Auditor-Treasurer then presented a report of his trip
to the convention of the League of Virginia Municipalities held
in Roanoke, Virginia the last of September .
Upon motion of Mr. Johnson, seconded by Mr. Wright and
unanimouslu carried, it was :
RESOLVED, Bg::the^Council of the Town of Leesburg, in Virginia,
that the American Beverage Control profits remain as they have
formerly been established.
Upon motion of Mr. Gill, seconded by Mr. 'Wrifht and unan-
imously carried, it was :

RESOLVED, by the Council of the Town of Leesourg, in Virginia
that the dues assessed ay the- League of Virginia Municipalities
be increased to Fifteen Per Cent {15%) , which involves an increase
of 811. 25 per year.
Upon motion of Mr. Gill, seconded by Mrs . Mitchell and un-
animously carried, by a vote of four two to one , Semones not
' voting, the following resolution was adopted:
RESOLVED, By the Council of the Town of Leesourg that the
Town Attorney, George M. Martin, Esquire, be authorized and
directed to give notice to Monroe Manor Corporation that no
electric bills, etc. will be paid until said corporation carries
out the contract heretofore entered into with the Town. '

The Mayor reported that he had rliccussed with the Plan-
ning Commission of the Town of Leesburg and the County of
Loudoun the advisability of a meeting looking toward a meet-
ing to determine the jurisdiction of the Town and County under
. the Subdivision Ordinance as respects the two mile 11miti:of
. the Town of Leesburg.
The Mayor also reported that with respect to the water
.and sewer line to the new Douglass Elementary School, all
construction had been completed except for seventy feet of
*three inch'iline and that final payment to Perry Construction
"Company would be made as soon as the property owners con-
cerned gavetthe Town of Leesburg clearance as to the condition
'of the property after construction.
It was reported that three street lights had been
erected in two subdivisions : namely., Monroe Manor Subidivision
'and Woodberry Subdivision, in the Town of Leesburg, Virginia.
Upon motion of Mr. Gill, seconded by Mr'.Hollandsworth and
.unanimously carried, it was : -
RESOLVED, ity the Council of the-. Town of Leesburg , in Vir-
ginia , that Charles Stallings be notified that the said Council
.by ordinance duly adopted heretofore , hereby denies his request
for the right to maintain a trailer at his residence on Route
No . 7 in the Town of Leesburg .
Upon motion of Mr . Gill , seconded by Mr . Hollandsworth ,
.Gill , Mitchell and Hollandsworth voting for and Johnson, Semones
and Wright voting against , Mayor Durfey breaking the tie , the
,following resolution was adopted : .
WHEREAS, Charles W. Sydnor appeared before the Council of
the Town of Leesburg , in Virginia , requesting the waiving of
curbs , gutters and sidewalks as required by the Subdivision
Ordinance of the Town of Leesburg , on his subdivision known
as Catoctin Hills Subdivision about two and one half miles
Southwest of the Town of Leesburg adjoining the new corporate
limits; and ,
WHEREAS , in the near future there is to be scheduled a
meeting of the Town Planning Commission , Town Zoning Board ,
County Planning Commission and County Eoning Board ;
NOW, THEREFORE, BE IT RESOLVED that the request of Mr . •
Sydnor be denied until the aforesaid meeting , at which time
the determination of the jurisdiction of the two mile limit
will be established .
Upon motion of Mr . Semones , seconded by Mr . Wright , and
unanimously carried , the following resolution was adopted :
BE IT RESOLVED, by,the..Council of the Town of Leesburg
that the application of Inez Trammell for a waiver of curbs ,
and gutters , under Section IV A (c) of the Subdivision Or-
dinance , in view of the hardship resulting from the strict
application of the said Ordinance , be and the same hereby
is granted ; and , •
BE IT FURTHER RESOLVED that the application for the
waiver of the construction of sidewalks 'be and the same
hereby is denied and the applicant is requested to furnish
bond in the sum of $500. 00, which shall, be forfeited if con-
struction has not commenced within sixty days after notification
by the Town of Leesburg , in Virginia .

Upon motion of Mr . Wright , seconded by Mrs . Mitchell
and unanimously carried , it was:
RESOLVED, That the application by Herbert Sumney for a
waiver of curbs and gutters as respects the resubdivision of
Lots -rand 6 in the Lowenbach Subdivision be and the same is
hereby granted , and the application for a waiver of sidewalks
be and the same hereby is denied and the . applicant is hereby
requested to give bond in the sum of $500.00 payable to the
Town of Leesburg ; rfor . a'period not exceeding three years,
which shall be forfeited if construction has not commenced
within sixty days after notification by the Town of Leesburg .

Upon motion of Mr . Johnson, seconded by Mr . Wright ,
the following resolution was unanimously adopted :

BE IT ORDAINED , by the Council of the Town of Leesburg
that whenever any motor vehicle , trailer or semi -trailer is
found on the paved or improved surface of any public street
or public grounds within the corporate limits unaccompanied
by the owner or operator thereof , and if such motor vehicle ,
trailer or semi -trailer constitutes a hazard to traffic
or is illegally parked , any police officer for the Town
shall remove it to the nearest ' storage garage for safekeeping
and notice of such removal shall be reported immediately to
the Auditor-Treasurer and to the owner of such motor vehicle ,
trailer or semi -trailer , as promptly as possible . and such
owner , before obtdining -posession of such motor vehicle ,
trailer or semi -trailer , shall pay to the Town of Leesburg
all reasonable costs incidental to the removal or storage
of such motor vehicle , trailer or semi -trailer . Should such
owner fail or refuse to pay the costs or should the identity \,
or whereabouts of the owner be unknown and unascertainable
after a diligent search has been made and after notice to
the owner at his last known address and to the holdelof any
lien of record in the office of the Division ' of Motor Vehicles
in Vieginia against the motor vehicle , trailer or semi -trailer .
the Auditor-Treasurer may , after holding the motor vehicle ,
trailer or semi -trailer ninety days and after due notice of
sale , dispose of the same at public sale and the proceeds
shall be held by the Auditor-Treasurer , who shall pay from
the proceeds of sale the cost of removal , storage , investigation
as to ownership and liens and notice of sale , and the balance
of such funds shall be held by the Auditor-Treasurer for the
owner and paid to the owner upon satisfactory proof of ownership.
Upon motion of Mr . Johnson;csedOnded by Mr . Wright , and
unanimously carried , it was:
BE IT ORDAINED , by the Council for the Town of Leesburg ,
in Virginia , that the "Drunk in Public" ordinance adopted
November 10, 1941 , be and the same is hereby amended by adding
the following :
" If any person be convicted for being drunk in public
three times within one year in the Town of Leesburg , upon
the third or any subsequent conviction for such offense within
the period of one year , such person may be punished by imprison-
ment in jail for not more than six months or by a fine of not
more than Twenty Five Dollars ($25. 00) , or by both such fine
and imprisonment . V � �

Upon motion of Mr . Wright , seconded by Mr . Semones,
Johnson, Semones and Wright voting for and Gill , Hollandsworth
and Mitchell voting against , the tie being broken by Mayor
Durfey , the following resolution was adopted :
WHEREAS , on the 11th day of August , 1958 , the Council
for the Town of Leesburg , in Virginia , denied the request
of Robert Steadman the subdivider of Steadmanor Subdivision,
for a variance from the requirement that he install curbs . I/gutters and sidewalks in said subdivision fronting on Alco
Street ; and ,
WHEREAS , the said Robert Steadman gave security in the
amount of $500.00 cash to instal said physical improvement ;
and ,
WHEREAS , on the 13th day of October , 1958 , the said
Robert Steadman applied to the Council for the Town of Leesburg
for reconsideration of its former action ; and ,
WHEREAS , the Council for the Town of Leewburg deems it
necessary to vary the strict requirements of the Subdivision
Ordinance requiring the installation of said improvements
because of extreme hardship resulting from a strict applica-
tion of the Ordinance ;
THEREFORE , BE IT RESOLVED by the Council for the Town
of Leesburg that its action taken on the 11th day of August ,
1958 . be and the same hereby is rescinded ; and .
BE IT FURTI-E R RESOLVED , that the application for the
variance from the requirements hereinbefore set forth , be and
the same is granted ; and .
BE IT FURTHER RESOLVED , That the Auditor-Treasurer be
and heis hereby authorized to return the $500.00 cash
deposit of the said subdivider , which was posted for in-
stallation of said physical improvements .
Upon motion of Mr . Wright , seconded by Mr . Gill and
carried by a vote of five to one . Mr . Semones not voting .
the following resolution was adopted ;
BE IT ORDAINED . -by the'Council for the Town of Leesburg
✓ that the Parking Meter Ordinance adopted on May 9, 1949 , be
and the same hereby is amended by including the following
provision :
SECTION 4. On parting lots owned by the Town of Leesburg ,
the Town shall cause separate parking spaces to be mai:ked on
the surface of said parking area , or by other appropriate
means shall erect , or cause to be erected , a parking meter
opposite each marked space , and upon the deposit of a coin
or combination of coinsof the United States , or parking meter
token , a motor vehicle or other vehicles may be parked in
such parking space for a limited time , the denomination of
the coin , the time in which the motor or other vehicle may
be parked , and the time when such period has elapsed , all
shall be indicated on the parking meter .
BE IT FURTHER ORDAINED , that the parking meters in said
parking areas shall require a deposit of five cents or the
said parking fneten token foriadperiod of two hours; a deposit
of ten cents for a period of four hours . and twenty-five gents
for a period of nine `hours .
BE IT FURTHER ORDAINED , that the Paragraph numbering of
the said parking meter ordinance be and the same 'hereby is
amended to reflect the change required by the inclusion of
Paragraph 4 as above set forth .
/ BE IT FURTHER ORDAINED, that the aforesaid ordinances
shall be effective on October 14 , 1958 at 12: 01 A.M. EST.
There being no further business to come before the
meeting , the meeting upon motion duly made and seconded ,
adjourned .
