REGULAR MEETING, December 8, 1958
At a regular meeting of the Council of the Town of Leesburg,
in Virginia, held December 8, 1958, there were present George J.
Durfey, Mayor; C. Meloy Fishback; Howard B. Gill; Reed Johnson;
Mae Bass Mitchell, Oden Semones and J. Austin Wright, Councilmen.
In the absence of the Recorder Mrs . tiitchell was elected
Recorder_:pro-tem.
The minutes of the special meeting held November 10, 1958
were read and upon motion of Mr. Gill, seconded by Mr. Wright,
and unanimously carried, were approved as read.
The minutes of the special meeting held November 2-, 1958
were read, and after amending same to read "Subdivision Ordinance"
instead of Zoning Ordinance, were upon motion of Mr. Wright ,
seconded by Mr . Gill and unanimously carried, approved as read.
The minutes of the special meeting held November 24, 1958
1T were read and after amending same by adding the words "who was
M low bidder" and "four door" , upon motion of Mr . Gill, seconded
2 by Mr . '":right and unanimously carried, were approved as read.

were ready: and after amending same by adding 1959 instead of
1958, were upon motion of Mr . Wright, seconded by Mr. Johnson,
and .unanimously carried, approved as read.
The Auditor-Treasurer presented his financial statement
and Special Sewer Debt fund for the month of November, 1958.
After a full discussion of the bills of the Lotdouy County
Hospital, Inc . , George M. Partin, Town Attorney and tl Leesburg
Service Station ( the Town Police car having been sold for ..,;300 .00
' after additional work having been done by said station) , it was
upon motion of Mr . Johnson, seconded by Mr . Wright, Fishback,
Gill, Mitchell, Johnson, Wright voting for and Semones against, it was :
RESOLVED, That the Auditor-Treasurer for the Town of Leesburg,
in Virginia, oe and he hereby is authori,ed and directed to pay
the following bills :

Upon motion of Mr. Johnson, seconded by,Mr. Wright mad
unanimously carried, it was :
RESOLVED, By the Council of the Town of Leesburg, in
Virginia, that the Auditor-Treasurer be and he is hereby
authorized and directed to pay to each member of the Leesburg
Volunteer Fire Company the sum of Twenty Dollars 020.00 ) as
a Christmas gift, for the year 1958.
A discussion followed with respect to the compensation
of Mr . Fishback, a Fireman ::nd a Councilman, and it was decided
unanimously to pay him in full as '.hisstenure of office had just
begun.
It was unanimously decided that the contract between the
Town of Leesburg and the Virginia Electric and Power Company
with respect to the town lights be accepted.
Upon motion of Mr . Gill, seconded by Mr. Wright , and un-
animously carried, it was :
RESOLVED, By the Council of the Town of Leesburg in Vir-
ginia, that Elmer F. Sauer, having served his ninety day trial
period as Policeman satisfactorily, be and he hereby is ap-
pointed as a regular member of the Police Department at a
monthly salary of Two Hundred Twenty Five Dollars $225.00) ,
payable semi-monthly : 'and,
WHEREAS, his initial appointment on a trial basis begin-
' ning September 1, 1958 does not appear in the records ;

A letter was read from Hays, 3eay, Mattern and Mattern of
Richmond, Virginia, requesting payment of a former bill, which

• requested to contact Mr: Howard W. Vesey, former Town Attorney ,
with respect to same .
Dr . Stewart R. Nottingham, new health director, was in-
troduced and welcomed by Mayor Durfey.
Kenneth Gheen and Harry Flynn, members of the Leesburg
Scout Troop No . 952, in pursuance of their merit badge , foir
which a requirement is the attending of a municipal meeting,
were welcomed by the Mayor .

The Town Attorney advised that he and Mrs . Warner, Zonirg
Administrator had appeared oefore the Loudoun County Board of
Supervisors and that Mr . Stirlina ' M. Harrison, attorney for
said Board had advised that'"tV °M$'^does rot have jurisdiction
• within the two mile limit o • the Corporate limits of the Town
• of Leesburg since the annexation proceedings . The Town Attorney
• suggested that certain compromises might be made . Hr . Wright
• suggested that the Tovn agree .with the County that the Town
only have jurisdiction to the Corporate limits . ? r. Gill

RESOUVED, By> the Council of the Town of Leesburg, in
Virginia, that the Town Attorney oe and he hereby is autho-
rized and directed to notify the Boc.rd of supervisors of Loudoun
County, Virginia, that the Town of Leesburg has determined
to retain jurisdiction to one rile from the '%or_Yorate limits
of the Town of Leesburg, lith the most stringent regulations .

40,000 square feet or more not be required to have sidewalks,
curbs and gutter; 'and,
BE IT FURTHER RESOLVED, That in the event the Boatd of
Supervisors does not agree with the proposal of the Town of
Leesburg that the Town Attorney be directed to tale such legal
steps as are necessary to resolve the questions in controversey
between the Town of Leesburg and the Board of Supervisors : and,
BE IT FURTHER RESOLVED, That the Town Attorney be and he
hereby is authorized and directed to present any pleading or
pleadings to the Council of the Town of Leesburg, in Virginia,
before taking any final steps .
Upon motion of Mr . Wright, seconded by Mr . Gill, and unan-
imously carried, it was :

01) RESOLVED, That Charles W. Sydnor, through his counsel,
George -F. Weaver has applied for a variance as to sidewalks,
curbs and gutter on his subdivision known as Catoctin hills
et Subdivision about two and one ' half miles Sthuthwest of the Town
s-.
of Leesburg adjoining the new corporate lireits, as required
by the Suodivision Ordinance of the Town of Leesburg;
NOW, THEREFORE , BE IT RESOLVED, That the said. Charles
W. Sydnor is hereby granted a variance as to the physical im-
provements , namely, sidewalks, curb and gutter, on his sub-
division known as -Catoctin Hills Suodivision about two and
one half miles Southwest of the Town of Leesburg.
The Mayor then read a letter from the Town of Round Hill
thanking the Town of Leesburg for the much needed water in their
hour of distress as regards the need for water, in tre it Town .

P. letter was read from Mr . Herbert Sumney with respect to •
the leasing of the Leesburg Airport . The Town Attorney reported
that there was already a twenty year lease for the airport and
the Council could not consider the leasing of it further .
A letter was read from the Department of Comservation and
Economic Development concerning an Industrial survey to be made
if requested by the Loudoun County Board of Supervisors . The
Council was unanimously in favor of such a survey . ,
It was brought out that an offer had been made by Webb and
Divine to sell the Honicon water line to the Town of Leesburg
for $2 ,000.00. Mr . Martin was instructed to reply to this letter
and then report to the Council the reply he receives .
Mr . Forbes of the Loudoun Health Department was reported to
be in the process of preparing a septic tank ordinance which he
would present at a later date .
The matter of the neeligence of the Town in certain physical
injury cases was brought to the attention of the Council . It was
generally decided that in case of such physical injury suits the
Town Attorney should confer with lawyer or lawyers for the injured
person or persons , along with the Mayor and one other member of
the Council in all suits or threatened litigation against the
Town . -
The Mayor was directed to notify each year the lessees of
all lease agreements with the Town so that same could be renewed .

'Mt . Wright advised that Dr . H. M. Jackson had requested a
street light be erected on the electric pole nearest to his
office on Wirt Street . The Auditor-Treasurer was ordered to
have this work done .
No action was taken on the request of Dr . Earl E. Virts
for a parking space near his office .
It was brought out that the Town has requested the State
Highway Department to place a luminuous sign on King and Loudoun
Streets . -
Upon motion of Mr . Wright , seconded by Mr . Gill and unan-
imously carried , it was : .
RESOLVED, That no parking signs be placed on the West side
of Wirt Street between Loudoun Street and Royal Streets .
It was decided that the Town should apply to the State for •
the one-half mile of road for 1959. The exact location of this
road would be determined at a later date .

Upon motion of Mr . Wright , moved by Fishback and unanimously
carried, it was :
RESOLVED , That the Town Attorney be and he is hereby autho-
rized and instructed to investigate the matter of the purchase
of the house on what is commonly known as Town Branch . •
The Mayor advised. thatEMny Tiffany desired to know if he
would have to pay the cost of the sewer line across the easement
• he is giving the Town : also, if the Town would. be willing to
enter into a new deed stating that the Town would not hold him
responsible for installing said line . The Town Attorney was
asked to make recommendations and report at the next Council
•
meeting.
There being no further business to come before the meet-
ing, the meeting upon motion duly made and seconded, adjourned.

SPECIAL MEETING, January 6, 1959
• At a special meeting of the Council of the Town of Leesburg,
in Virginia, held at 7 : 30 in Council Chambers on January 6, 1959•
there were present : George J. Durfey, Mayor ; Elinor M. Cunningham,
Recorder ; C. i."eloy Fishback; Howard B. Gill; Reed Johnson, Mae
Bass Mitchell, Oden Semones and J. Austin Wright, being- all of
the Councilmen.
The purpose of this meeting was to discuss the. proposed
Zoning Ordinance . The complete ordinance was considered page by
page oy the Council along with Mrs . Wanner, Zoning• Ad? inistrator,
and the Town Attorney , George M. Martin, Esquire .
Upon motion of Mr. '."right, seconded by Mr . Gill, grid unan-
imously carried, it was :
RESOLVED, That sidewalks be waived on the subdivision of
