C I T .Y C O U N C I L CITY OF TEMPLE CITY TEMPLE CITY CALIFORNIA NOVEMBER 26, 1962 INITIATION: The regular meeting of the City Council of the City of Temple City was called to order by Mayor Tyrell at 7:30 P.M. The Mayor then led the Pledge of Allegiance to the Flag. INVOCATION: Invocation was given by Rev. Dunkelberger of the First Baptist Church of Temple City. ROLL CALL: PRESENT: Councilmen - Dickason, Fitzjohn, Merritt, Nunamaker, Tyrell ABSENT: Councilmen -None ALSO PRESENT: City Attorney Shatford and City Manager Woollett. APPROVAL OF MINUTES: a. Minutes of the Regular Meeting of November 12, 1962. City Manacer ';'oollett corrected Item 25 changing the wording from "recipratory" to "compensatory''. Also under Item 20 the next to last line to read "into one total with number of em- ployees designated from each department ". Councilman Merritt moved to approve the minutes of the regular meeting of November 12, 1962, as corrected, Councilman Dickason seconded, roll call vote as follows: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Nunamaker,Tyrel NOES: Councilmen -None ABSENT: Councilmen -None b. Minutes of ,Adjourned Meeting of November 15, 1962. Councilman Nunamaker moved to approve the minutes of the adjourn ed meeting of the Council of November 15, 1962, Councilman Fitz - john seconded, roll call vote as follows: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Nunamaker,Tyreli NOES: Councilmen -None ABSENT: Councilmen -None UNFINISHED BUSINESS: 6. ORDINANCE NO. 62 -97: 1st reading. City Attorney Shatford read title to Ordinance No. 62 -97 AN OR- DINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY PROVIDING FOR A CITY COUNCIL IN SITUATIONS OF GRAVE EMERGENCY. Following discussion by the Council Councilman Nunamaker moved to table this item until the next Council meeting on December 10, 1962,` Councilman Merritt seconded, roll call vote as follows: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Nunamaker, Tyre, NOES: Councilmen -None ABSENT: Councilmen -None 7. PETITION TO ANNEX TO COUNTY LIGHTING MAINTENANCE DIST. #1395. City Manager `:loollett advised this concerned Tract No. 26554, the Meeker Development Co., the 'Weber tract, which is located it Temple City, and the Road Dept. of the County advise the devel- opers have contracted with Southern Calif. Edison Co. to install street lights in this subdivision. He advised this was one of the requirements imposed on the subdivision with subdivider to pay energy costs until annexed to a lighting district. He pre- sented a Resolution submitted by the County granting consent and jurisdiction to the County in this annexation to be approved by this City. Councilman Fitzjohn moved to so approve, Councilman Merritt seconded, roll call vote as follows: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Nunamaker, Tyrel NOES: Councilmen -None ABSENT: Councilmen -None 8. CLAIM AGAINST CITY FOR WRONGFUL DEATH: Mr. & Mrs. Geo. Finlay City Manager Woollett read in full a claim submitted by Coleman 377 Council Minutes, November 26, 1962, page 2 & Silverstein, attorneys for Mr. & Mrs. Geo. Finlay of 17428 Glenthorne, La Puente, Calif. in the amount of $15,000.00 in connection with the death of their daughter, Madonna Finlay, on August 20, 1562, who was an occupant in a car hit by the Southern Pacific Railroad at the crossing on Encinita Ave. near Lower Azusa. The City Attorney stated his legal opinion that there is no liability on the part of the City of Temple City in this claim. Councilman Nunamaker made the motion that Claim fc Damages in the amount of $15,000.00 filed by George Finlay on behalf of himself and Mrs. George Finlay against the City of Temple City on the 9th day of November, 1962, for the wrongful death of Madonna Finlay, killed on the 20th day of August, 1962 . at the intersection of EncinitaU Avenue and Lower Azusa Road when the car in which she was riding collided with a Southern Pacific Railroad car, be rejected as there was no negligence or liability on the part of the City of Temple City, and that the City Clerk be directed to write a letter to the Claimant indi- cating that the City Council has considered this Claim and has determined that no liability exists on behalf of the City of Temple City, and that the City Council respectfully rejects the Claim as presented, Councilman Dickason seconded, roll call votE as follows: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Nunamaker, Tyre'. NOES: Councilmen -None ABSENT: Councilmen -None 9. PUBLIC HEARING: Vacation Easement: Weber Development Co. 7:45 Pr City Attorney Shatford explained there were two ways to vacate an easement and the City already had followed the short proced- ure and adopted the necessary measures required to grant the , vacation of easement. However as the Title Co. prefer the long• er method and to avoid any possible problems in the future,-the Public Hearing was scheduled for this time. Mayor Tyrell de- clared the Public Hearing opened and asked if anyone wished to speak for or against granting of the vacation. No one came for ward. Councilman Fitzjohn moved to close the Public Hearing,' Councilman Nunamaker seconded, and carried. Councilman Nuna- maker moved that the City Attorney be instructed to draw the necessary papers to vacate this easement, Councilman Fitzjohn . seconded, roll call vote as follows: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Nunamaker,Ty.rei NOES: Councilmen -None ABSENT: Councilmen -None 10. PARKS & RECREATION COMMISSION RECOMMENDATIONS: City Manager :,'oollett read the recommendation made by the Parks & Recreation Commission after the Hearing held last`,�'ednesday' night with the Senior Citizens, said recommendation made in the form of a motion by Commissioner Lindberg, as follows: 'That since a compromise section to the by -laws of the Temple City Senior Citizens Association has been offered and has been read into the minutes of the meeting stating thusly 'SECTION 2. This: organization is co- sponsored by the Temple City Department of Parks and Recreation, and shall co- operate and affiliate with, such Senior Citizens Groups as shall be determined from time to time by the Executive Board and approved by the general member- ship.' that this section be sent back to the Senior Citizens Group again with the recommendation that this be adopted into their by -laws at their next general meeting and that a.discus- sion and vote be held by them as to whether or not they wish to affiliate themselves with the Los Angeles County Senior Citizen Association, Inc., seconded by Commissioner Gorham, roll call vote as follows: AYES: Commisiorers Andrist, Clemson, Gorham, Lindberg NOES: Commissioner: Gunst ABSENT: Commissioners: None City Manager Woollett advised inasmuch as the Commission has no authority and the recommendation is without regard that the City co- sponsors this group. He advised he had written the President of the Group stating this had to go to the City Coun' 378 Council Minutes, November 26, 1962, page 3 cil for approval, and as far as taking a vote was concerned they had the richt to take this vote when they wished to do so. Following discussion Councilman Dickason moved to approve the recommendation of the Parks & Recreation Commission, Councilman Merritt seconded, roll call vote as follows: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Nunamaker,Tyreli NOES: Councilmen -None ABSENT: Councilmen -None 1 1 RESOLUTION NO. 62 -251: Warrants & Demands. Following discussion; Councilman Fitzjohn moved to adopt Resolution No. 62 -251, war- rants and demands Nos. 2064 through 2090 and Nos. 2105 through 2109, in the sum of $24,405.50, Councilman Merritt seconded, roll call vote as follows: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Nunamaker,Tyrele NOES: Councilmen -None ABSENT: Councilmen -None 12. COMMUNICATIONS: a. City Manager .!oollett read a letter from the Temple City Chamber of Commerce, Merchants Committee, requesting permission to block Las Tunas Blvd. between Temple City Blvd. and Camellia and that this area be cleared of cars between the hours of 6 to 8 P, M. Friday, November 30, 1962, and also that traffic be routed around that block from 7 to 7 :45 P. M. This request is for the purpose of a Christmas promotion of having Santa Claus land in a helicopter during this time. Jerry Martin, 9601 Las Tunas Dr., spoke representing the Chamber of Commerce, and gave details concerning the plans. Following considerable discussion by the Council they agreed that they would prefer having the helicopter arrive on Saturday and in daylight. Councilman Mer- ritt moved that this program be re- arranged to be done during daylight hours on Saturday, December 1, from 9 to 11 A. M., that llibility insurance in the amount of $1,000,000.00 any one acci- dent, and $300,000.00 any one person, and to appoint the City Manager to assume responsibility to determine proper conditions are met regarding this insurance, posting for parkins, necess- ary policing, etc., Councilman Nunamaker seconded, roll call vote as follows: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Nunamaker,Tyreli NOES: Councilmen -None ABSENT: Councilmen -None b.Temple City Jr. Chamber of Commerce. City Manager':!oollett presented a letter requesting the week of Jan. 20 through 26th be proclaimed as Jaycee Week. Councilman Fitzjohn moved to ap- prove, Councilman Dickason seconded, and carried. c. March of Dimes: Kiwanis Club. The City Manager read a letter requesting permission for a line of dimes on north side of Las Tunas Dr. between Camellia and Primrose between the hours of 2 :00 P. M. and 6 :00 P. M. on Friday, Jan. 25, 1963 and to use the loudspeaker in these areas only, also permission to set up a toll road block at the intersection of Las Tunas Dr, and Temple City Blvd. between hours of 2 and 6 P.M. the same date to be manned by adults and in this connection to place a "NO LEFT TURN" sign at this intersection with turn -off lanes used for the workers to stand. They also requested use of a Public Address System from 6 :30 to 8:00 P. M. on Tuesday, Jan. 29, to assist in the Mothers' March. Councilman Fitzjohn moved to approve according to the recommendation of the City Manager that only adults be used as workers, Councilman Dickason seconded, roll call vote as follows: AYES: Councilmen- Dickason, Fitzjohn, Merritt, Nunamaker, Tyrell NOES: Councilmen -None ABSENT: Councilmen -None d. TIME FOR THOSE I N THE AUDIENCE 4HO 'v I SH TO SPEAK: Mr. Chuck Greene, 10523 Lower Azusa Road, El Monte, stated he was concerned with the striping and marking on Lower Azusa Rd, and that the business people of Lower Azusa object to this and would like to have this held up until the City of El Monte act: on this. He was concerned with intersections at Halifax and Doreen, and between El Monte and Arden there would be no left hand turns and no parking at any time. City Manager Woollett advised this was discussed by both the Traffic Commissions in El Monte and our City and also it went to their City Council as well as this City Council. He also advised that no further work would be done until further determinations were made by the two cities. The Mayor recognized Mr. Bob McAlister, Co- ordinator of the Temple City Schools activities and Mr. Hal Greene of Oak Ave. School as well as the number of students present for the Coun- cil meeting. Vincent Britton, 5404 Robinhood, requested a copy of Ordinance 62 -97 under study by the Council. 14. MATTERS FROM CITY OFFICIALS: Councilman Fitzjohn referred to the Christmas lights and advis- ed as to the way they are installed in Burbank connected to street light standards which are in turn cabled to the building adjacent. The Council will consider this further at a later date. Councilman Dickason asked about Kauffman St. and the City Attor, ney advised he was just about ready to file suit, and felt by Dec. 3 the suit will be filed. Councilman Nunamaker asked when the library will go to bid. The City Manager advised final plans will be submitted to the Council for approval on December 10 and if approved will go to bid right after that. Plans expect it will take five months to complete the library or 150 working days City Manager :!oollett referred to Dec. 24 which is a regular Council meetin! night which is Christmas Eve, and proposed as there is a joint Council meeting with the Traffic Commission on Dec. 20 that any necessary business of the Council could be taken care of on the 20th and not have a meeting on the 24th Following discussion this was agreed to by the Council, and at their next meeting they will adjourn until 7:30 P. M. on the 20t of Dec. He also advised he was leaving on the 21st of Dec. for his vacation and would be back the first week in Jan, City Attorney Shatford presented another Claim Against the City for Wrongful Death from Mr. & Mrs. Benj. Peacock in connection with the Southern Pacific Railroad crossing on Encinita where the car and train collided on August 20, 1962, and their son Stanley Earle Peacock was killed, the amount of the Claim being $15,000.00. Councilman Nunamaker moved that Claim for Damages in the amount of $15,000.00 filed by Benj. Peacock end' Mrs. Benj. Peacock ar_iainst the City of Temple City on the 16th day of November, 15o2, for the wrongful death of Stanley Earle Peacock, killed on the 20th day of August, 1962, at the inter- section of Encinita Avenue and Lower Azusa Road when the car in which he was riding collided with a Southern Pacific Rail- road car, be rejected as there was no negligence or liability on the part of the City of Temple City, and that the City Clerk be directed to write a letter to the Claimant indicating that the City Council has considered this Claim and has determined that no liability exists on behalf of the City of Temple City, 380 Council Minutes, November 26, 1962, page 5 and that the City Council respectfully rejects the Claim as pre - sented. A. County Boun- dary Commission regarding annexation 29 to northwest Arcadia, Ur inhabited. Councilman Fitzjohn moved to receive and File, Coun- cilman Nunamaker seconded, and carried. City Manager Woollett advised referred to the cul de sac off from Golden West where four houses are constructed and the last two will be constructed shortly, that the road has been offered for dedication by the owners, and the Road Dept. of the County recommend we accept it. •Councilman Fitzjohn moved to accept this street for dedication and to instruct the City Attorney to draw the necessary legal documents to do so, Councilman Merritt seconded, roll call vote as follows: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Nunamaker, Tyrell NOES: Councilmen -None ABSENT: Councilmen -None The City Manager read a letter from the 7th Day Adventist Church requesting permission to sing and play Christmas Carols from Dec. 11 -25 from 6 to 9 P. M. and to solicit gifts, and also to con- tact personally business friends from now until the end of Dec. the funds to be used in their welfare and mission work. Council- man Fitzjohn moved to approve, Councilman Merritt seconded, and carried. The City Manager recommended that the Council set a Public Hear- ing for the north and south side of Freer from Pal Mal to El Monte. Ave. on Dec. 10, at 7:45 P. M. for curb and cutter. Coun- cilman Dickason so moved, Councilman Nunamaker seconded, roll call vote as follows: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Nunamaker,Tyrell NOES: Councilmen -None ABSENT: Councilmen -None City Manager Woollett advised a letter From Verne Orr, Foreman o' the Grand Jury, to Supervisor Debs, Chairman of the Board of Sup- ervisors, had been received and read the letter in full for the record. The letter recommended as of Jan. 1, 1963, the price for a 5 man car around the clock for law enforcement should be $93,903., not retroactive, and should be recomputed annually about time of budget preparation. The letter dated Nov. 23 was received on Nov. 26 here, and was scheduled �n the agenda for the Board of Supervisors for Tuesday, Nov. 27. Mr. Woollett ad- vised action was being taken to request the Supervisors to table this item until Dec. 18 in order to give the Contract Cities an opportunity to study the Grand Jury recommendations and prepare a presentation for that meeting. The Contract Cities had sugges ed a cost of between $81,000. and $83,000. and the County had re. quested $103,000. It is the desire of the Contract Cities to ex tablish a procedure to determine these costs annually. There was some discussion regarding the progress of the Civil De. fense program and the warning signals. Also the cost of the telephone warning system was stated to be $175. with a $5. month• ly charge. Councilman Merritt referring to charitable solicitation permits felt such requests should be submitted 30 days prior to dates requested in order to properly establish the authenticity of the applicants. Following discussion Councilman Merritt moved to effect a modification of our solicitation ordinance and that the be a 30 day period in advance so there can be an investigation made, and these requests be referred to the staff for study. 381 Council Minutes, November 26, 1962, page 6 Councilman Nunamaker seconded, and carried. 15.
