HomeMy Public PortalAbout1959_02_09 218 BE TT RESOLVED, by the Council of the Town of Leesburg, in Virginia, that the resignation of officer Samuel H. Barton be accepted to become effective at 6:00 o'clock P. H. (EST) February 9, 1959 and that the Auditor-Treasuer be and he is hereby authorized and directed to pay Mr. Barton his salary in full for the month of February, 1959, less deductions. There being no further business, on motion duly made, seconded and- ca ied, Council adjourned. • rf 'ecor•er rro- -m REGULAR MEETING , FEBRUARY 9, 1959 ' At a regular meeting of the Council of the Town ofLeesburg, in Virginia, held February 9, 1959 in Council chambers , at 7: 30 P. M. there were present : George J. Durfey, Mayor ; Elinor M. Cum Ingham , Recofider; C. Meloy Fishback, Howard B. Gill; Reed Johnson , i.iaeBass Mitchell, 0den Sones and J. Auetin Wright, being all of the Councilmen. The minutes of the regular meeting held December 8, 11959, were read and upon motion of Mr . Gill seconded.by Mrs . Mitchell and unanimously carried were approved as read. • • The minutes of the special meeting held January 6, 1959 were read and upon motion of Mrs . Mitchell, seconded by 1•'r. Johnson and unanimously carried, were a,:)oroved as read. The minutes of the regular meeting of January 12, 1959 were read and upon motion of Mrs. Mitchell, Seconded by i:r. :':right , and carried by a vote of five to one , Fishback , Gill, Johnson, Mitche ll and Wright voting for and Semones against, were approved as read. The minutes of the special meeting of January 13, 1959 were read and upon motion of tir . Gill, seconded by Mrs . Mitchell and carried by a vote of five to one, Fishback, Gill, Johnson, Mitchell and '.right voting for and Semones against, were approved as read. The minutes of the special meeting of January 14, 1959 ti•. ere read and upon motion of Mr.. Wright ,. seconded by Mr . Fishback and unanimously carried, were approved as read. The minutes of the special meeting of January 20, 1959 were read and upon motion of Mrs . Mitchell, seconded by Mr. 'Wright and unan - imously carried, were aujroved as read. The Auditor-Treasurer then presented his financial statement • and special sewer debt fund for the month of January, as well as his statement of appropriations from July 1, 1958 to January 31 , 1959. • Upon motion of Mr . Mr . Gill and .Mr . Fishback were asked byttt Mayor to place this' question befoe the next meeting of the Fire Company. The Auditor-Treasurer then presented a bill fron L. W. Parker with respe ct to the previous Town police car, •.Whiich said bill was in the amount of ' 370'.98. Upon motion of Mr . Fishback, second. ed by Mr. Johnson and unanimously carried, it was : RESOLVED, That the Town Attorney be and he is herthy autho- rized and directed to obtain from Hayes, seay , Mattern and Mattern of Richmond, Virginia, an accurate accounting of the data which was received from them, fmr which data a bill has been rendered the Town of Leesburg, in Virginia , in the amount of 8587 .34. Mr. Francis L. Patton, Mr. George J. Babson, Mr. B. ?oxen Harrison and Mrs . Lowell Riley then expressed their views as to Y. the disadvantage of the varnbus trucks haulingccement through the Town of Leesburg to the Chantilly Airiort, if they are granted permits by the Interstate Commerce Commission . Upon motion of Mrs . Mitchell, seconded by Mr . Wright and unanimously carried, it was : RESOLVED, That the Town Attorney be and•he hereby is authorized and directed to follow up the problems arising from the traverse of the numerous applicant concerns preaosing to haul cement through the Town of Leesburg to the Chantilly Airport, with the understanding that tie Town of Lee sbir is vitally interested in the outcome of this matter . Mrs . Wanner, Zoning Administrator for the Town of Leesbul then presented the matter of the reduction of the ;;50,00.) •00 _2.20 bond which had heretofore been put up by Loudoun Properties, Incorporated, owner of the subdivision known as "Virghia Village, " for the installation of water and sewer lines and streets in said subdivision. - . Upon motion of Mr. Wright, seconded by Mrs. Mitchell and unanimously c arried, it was : .RESOLVED, That the request of• Loudoun Properties, In- corporated for the reduction of the 550,000 .00 bond covering I/the installation of water, sewer and streets in .said sub- - division be and the same is hereby reduced from 50,030 .u3 to "'25,000.00; and, BE IT FURTHER RESOLVED, that the bond be reduced on the condition that an easement be granted, as set forth in Mr. Warren C . Perrow ' s letter of December 31 , 1958; and , BE IT FURTHER RESOLVED, that the Zoning Administrator be authorized and directed to notify Loudoun Properties, In- 'corpor•ated that the Town of Leesburg will accept the properly ' executed instrument conveying to the Town of Leesburg all water and sewer lines constructed in Section I of "Virghia - Village, " including the dedication of all sewer and water • ea•sements as shoc.n on the plat of "Virginia Village" , and • that said instrument be submitted to the Town Attorney for approval ; and, • • BE IT FURTHER RESOLVED, that the aforesaid bond of "550,000.00 be cancelled and a properly executed new bond in the sum of 525,000.00 payable to the Town of Leesburg . be executed by Loudoun Properties , Incorporated, to insure the installation of properly constructed streets , curbs, gutters and sidewalks in the subdivision known as "Virginia Village . " George M. Martin, Town Attorney, was instructed to meet with Stilson H. Hall, Esquire with respect to the sewer easement across the Arthur Godfrey property . Mr. Martin then reported with respect to his trio to Richmond for the purpose of obtaining information with respect to the proposed bond issue for the Town of Leesburg. It was suggested that a committee from the Council be ap- pointed to work with the Town Attorney to the end that a report could be rendered at the next council meeting with respect to the cost of installing water and sewer lines in the annexed area . of the Town of Leesburg and how same is to be financed. • Mr. Gill and Mr . Johnson were duly elected by secret ballot as members of said committee. • Upon motion of Mr . Gill, seconded by Mrs . Mitchell and unanimously carried, 4t was ; RESOLVED, That the policy of the Council with respect to the jurisdiction of subdivisions adopted on opc ,,r„ P p g_ is hereby readopted and is reaffirmed, and the zoning Ad- ministrator is instructed to advise all subdividers that they do not have to submit their plans to the Planning • Commission for the Town of Leesburg if they are beyond the one mile limit, but such subdividers must submit a statement from a certified surveyor showing their exact - distance ; and, • BE IT FURTHER RESOLVED, That the Town Attotnry proceed .to bring this mater before the Circuit Court for Loudoun County to resolve the question of the conflicting juris- diction between the County of Loudoun and. the Tonn of • • 22 Leesburg with respect tothetSubdivision Ordinance . Upon motion of Mr. Gill, 'seconded bar Mrs . Mitchell and unanimously c arr•ied, the following ordinance was adopted: J ' BE IT ORDAINED, by the Council for the Town of Lees- burg, in Virginia, that any person who wilfully violates his written promise to appear, given in accordance with 11 the' traffic ordinance for the Town of Leesburg, shall be guilty of a misdemeanor, regardless of the disposition of, and' in addition to, the charge upon whi ch he was originally arrested. Every person convicted mmbocbtxn r for a violation of this ordinance shall, upon conviction, be punished by a fine of not less than Five Dollars ( 5.00 ) nor More than One Hundred Dollars ( 10O.00 ) , or by imprison- ment in jail for not less than one day or more than ten days, or by both such fine and imprisonment . • N It was unanimously decided to have a special meeting of the Town Council on February 19, 1ii59 to consider the Zoning Map and Zoning Ordinance which has been proposed. - a ,,..., There being no further business to come before the meeting, the meeting upon motion duly made and seconded, adjourned. y-f-U,uI�U !
