SPECIAL MEETING, DECEMBER 28, 1959
• At a special meeting of the Town Council of the Town of
Leesburg, in Virginia, after due notice of a public hearing
published in a newspaper having general circulation in the
Town of Leesburg, held at 8:O0 .P. M. December 28, 1959, there
were present : George J. Babson, Mayor ; C. Maloy Fishback; •
Emerson H. James, George E; Isaacs, Hunter M. Leach, John W.
Pumphrey and J. Austin Wright , Councilmen.
' In the absence of the Recorder C. Maloy Fishback was :ap-
pointed Recorder pro-tem.
The Mayor read the publication to rezone the lands owned •
by William P. Parramore, et al from Residential I to General
Business for a width of two hundred (200) feet behind the pre-
sent three hunded sixty (360) feet from the center of Highway
No. 7, and from the east Corporate limits of the town, west .
to the Fort Evans Road.

M The Mayor offered the opportunity to citizens present
M to speak in favor of said rezoning. Mr. Leonard Parker, Mrs.
`2 Winslow Williams , Mr. Winslow Williams and Mr. C. H. Clemens,
et an adjoining property owner, spoke in favor of the rezoning.
Mr. William P; Parramore advised the Council that the
reason for the request for an additional depth of two hundred
(200) feet was to arrange for parking in front of a proposed
. Shopping Center he proposed to build; that he did not wish
to have parking in the rear.
Attorney Richard E. Hill or-Leesburg stated that he was
present to oppose said rezoning and was representing a group
of citizens of Leesburg. He stated that the proposed Shopping
Center was (1) premature, (2) there is no present need for
same and that it would create a traffic hazard, .(3) the land
involved had just recently been zoned as .part of an adopted
MasterPlan for the Town, and (ay ' that to locate a shopping
center n in this location might be in the apathhof ,the proposed
By-pass and a vast amount of money could be spent on condem-
nation suits. . -
• He further stated that he had two .technical objections,
(1) applicant for the rezoning did not come in by petition,
and (2) the Planning Commission did not make their decision
on the rezoning on the 'day their Public Hearing was advertised.
When asked who he represented Mr. Hill declined to ,say:. •
The Mayor ,asked Mr. Parramore what, plans he had , for an
access road. Mr. Parramore stinted that he would do whatever
the Highway Department required. . n.
The Mayor read the published notice for the rezoning of
the lands of Loeffler,: Harrison, James, .Foster and Simms;
located at the. southern, limits of. Leesburg, from a Geneva]:
Residence District to a General Business: District . No. onei
appeared for or against this rezoning. - . -
Upon motion of Mr. Pumphrey, seconded by Mr. James, the
following resolution was unanimously adopted:

WHEREAS, the Council for the Town:;of •Leesburg,. requested
the Planning ' Commission for the Town of Leesburg to consider
a rezoning of the lands of Parramore, et al from Residential
I to-General Business for an additional depth of two hundred
(200) feet from the _center line of Highway No. 7 and the lands
of Loeffler,. Honicon, James;- Foster and Simms at the southern
limits of the Town of Leesburg, from General Residential to
General Business ; and,

WHEREAS, the Planning Commission held a Public Hearing
thereon on December 15, 1959, pursuant to published notice;
and, .
WHEREAS,-the Planning Commission has recommended- to the
Council the . rezoning •as requested; and, -
• WHEREAS, the Council -held a Public Hearing:,on- December
28, 1959, pursuant • to notice in The Loudoun Times Mirror, a
newspaper having general circulation in the Town of Lees-
burg; .
NOW, THEREFORE, BE IT RESOLVED by the Council for the
Town of Leesburg, '-as follows : - : -
(1) • :That the lands of Parramore et altfrom the -east •
corporate limits of the Town 'of Leesburg to -the 'Fort 'Evans
Road be and the same hereby -are zoned General Business for
an additional :depth of two hundred (200) feet ; and
(2) That the lands of Loeffler, Honicon, James, Foster • -
.and Simms, 'starting at the intersection of Tuscarora Creek
and Route 621 north to Kulzer, thence following the boun-
daries of Kulzer. and Virginia Village east 'to Tuscarora
Creek south to the place of beginning, be and the same
are zoned General Business ; and • •

BE .IT FURTHFR RESOLVED; that the: Zoning Administrator
shail . cause.-the Zoning District Map to be .amendedaccordingly.

This rezoning is to become effective on the adoption of
this .resolution. .
Upon motion of Mt. Isaacs, seconded by Mr. Fishback;
the following resolution was unanimously adopted: •

BE IT RESOLVED, by the Council' for the Town of Leesburg
that the recommendations -set forth in the report of 'Stanton,
Minter and Bruner, Certified Eublic Accountants , dated ' , '
December 1.1, 1959; be' and the same are hereby adopted -as
the fiscal policy for the Town of Leesburg, in Virginia.
Upon motion of Mr. Leach, seconded by Mr. Pumphrey, the
following resolution- was unanimously adopted:
- ' ✓ BE IT ORDAINED, by the Council of the Town of Leesburg,
in Virginia, that the Driving, Under the Influence Ordinance
recorded in the Current Ordinance Book at Page 13, be and
the same is hereby amended to read as follows :
Any person who violates -any 'provisions' of this Ordinance
shall be guilty of a misdemeanor, punishable by a fine of not
less than. One Hundred Dollars ($100.00) nor more than One
Thousand Dollars ($1,000.00) , or imprisonment for not- less
than one month nor. more than six months , either or both in
the discretion of the Mayor or Court trying the same, for
a first offense, and the Mayor or Court, in its discretion,
may suspend the sentence during good behavior of the person
convicted. .Any person convicted of a .second, or subsequent
offense under this Ordinance within ten (10) years hereof,
shall be punished by a fine of not less titan-Me; Hundred
Dollars. nor more than- One Thousand-Rollaiarrs-
and by pmprisonment for not less th Xneimonth net more
/ than one year. • '
