Babson, Mayor, called the meeting to order at 10:20 P. M. There were present : C. Maloy Fishback , Emerson H. :James, Hunter I/ M. Leach, John W. Punphrey, :-George 'E:' Isaacs acid Austin J. Wright The minutes of the meeting of August 8 were approved as read. Upon motion of Mr. Fishback, seconded by Mr. James, the following resolution was adopted by a vote of four to two, Wright , Fishback, James and Pumphrey voting for, and Isaacs and Leach voting against : CV Cret WHEREAS, at its regular meeting on July 25, 1960, the V: . Council of the Town of Leesburg, in Virginia, adopted the fol- C lowing resolution: d BE IT RESOLVED, that the Town of Leesburg, in Virginia, do enter into an -agreement with G. Shirley Myers and E. Frank Myers, III, the owners of the "Dry Mill Subdivision" whereunder the said subdividers shall construct at their own expense and accord- ing to a contract acceptable to the Town of Leesburg, a water line extending from the terminus of thepresent water line at the Loudoun County High School to the property line of the subdividers, the said Town to bear the engineering costs thereof, and upon approval of said line by said Town, the subdividers shall convey ownership of said line to said Town, and the Town shall thereupon issue its non-interest bearing notes to said subdividers for the actual cost thereof, payable in five- equal installments due five, six, seven, eight and nine years after date ; and, WHEREAS, on July 28, 1960, the Mayor of the Town of Leesburg, in Virginia, submitted to the Recorder of the said Town, the fol- lowing writing purporting to be a veto oT the above mentioned resolution, to-wit : "To the Recorder of the Town of Leesburg, in Virginia Dear Madam Recorder : At the regular meeting of the Town Council on Monday 25, July, 1960, the following resolution was adopted: BE IT RESOLVED, that the Town of Leesburg, in Virginia, do enter into an agreement with G. Shirley Myers and E. Frank Myers, III, the owners of the "Dry Mill Subdivision" whereunder the said subdividers shall construct at their own expense and according to a contract acceptable to the Town of Leesburg, a water line extend- - . ing fro the terminus of the present water line at the Loudoun County High School to the property line of the shbdividers, the said Town to bear the engineering costs thereof, andi;upon approval of said line by said Town, the subdividers shall convey ownership of said line to said Town, and the Town shall thereupon issue its non-interest bearing notes to said subdividers for the actual cost thereof, payable in five equal installments due five, six, seven, eight and nine years after date. I do hereivith veto the foregoing *resolution for these reasons : 1 . As passed by the Council this resolution makes do: provisions for the payment of the engineering costs or of the debt incurred, and is , therefore, fiscally irresponsible. 352 . • 2. If it be considered presently advisable to extend the Town' s water or sewer services beyond the location specified by the annexation order there are other areas that have either an urgent need or a sound economic basis for the expenditure of public funds ; the water line contemplated by this resolution .fails to qualify in either respect . 3 . This resolution lies within a dangerous field of legis- lation in that its effect is to substitute for the blind and impartial ruling of a general ordinance a legislative process of special favor and unequal privilege . M. George. ; , . J. Babson, Mayor, called the meeting to order at 8 : 15 P. M. . There were present C. Maloy Fishback, Emerson H. James, Hunter • • , M. Leach, John W. Pumphrey and Austin J. Wright . • In the absence of the Recorder the Mayor appointed C. . Maloy Fishback as Recorder pro-tem. • • • The minutes of the meeting of August 22, 1960, were approved . as amended and corrected. The Treasurer then presented the financial statement for • the month of August , 1960. Upon motion of Mr. Fishback, seconded by Mr. James, the following resolution was unanimously adopted : • BE IT RESOLVED, by the Council for the Town of Leesburg • that the method employed in the Plat of Vacation prepared by Robert K.Wilson, Land Surveygr aid question as to whether the ' building line restriction on Lot 1, Gibson Heights Subdivision, as suggested in the letter from Stilson H. Hall , Attorney for the Loudoun County Hospital , should be vacated, be and the same is hereby referred to the Planning Commission for itsII report and recommendation. •r Upon motion of Mr. Fishback , seconded by Mr. Pumphrey, the following resolution was unanimously adopted: WHEREAS, Loudoun Properties , Incorporated, has presented to the Planning Commission of the Town of Leesburg, in Virginia, • its plat of the subdivision owned by it , known as "Virginia Knolls ; " and, • WHEREAS, the said Planning Commission has approved said plat , but recommending sidewalks on one side of the streets in said subdivision only; -and,
