Pumphrey, seconded by Mr. James , the . following resolution was unanimously adopted : BE IT RESOLVED, by tthe Council for the Town of Leesburg, in Virginia, that the amount stated to be the present salary. of the Superintendent of Water and Sewer Works set forth in the reso- lution increasing the salary for said position, adopted October 10, 1960, be and the same shall be amended to read Four Thou- sand Ninety Five Dollars ($4,095 .00) in lieu of Four Thousand Two Hundred Dollars ($4, 200.00) ; and, • BE IT FURTHER RESOLVED, that Two Hundred FiftyODollars ($250.00) be appropriated from the Utility Fund and placed in the Operation and Maintenance Personal Services Account in lieu of the One Hundred Fifty Dollars ($150.00) previously allocated. Upon motion of Mr. Isaacs, seconded by Mr . Pumphrey, the following resolution was unanimously adopted: BE IT RESOLVED, by the Council for the Town of Leesburg, in Virginia, that the Auditor-Treasurer be and he is hereby authorized and directed to charge off the 1960 Real Estate taxes of the Leesburg Volunteer Fire Company in the amount of Fifty One Dollars ($51 .00) . • Upon motion of Mr. James, seconded by Mr. Wright , and unanimously adopted, the meeting adjourned. tiff)C7,,,,,dri • rfb1/2" yor REGULAR MEETING, NOVEMBER 14, 1960 A regular meeting 'of the Council for the Town of Leesburg, in Virginia, was to be held November 14, 1960, at 8:00 P. M. George J. Babson', Mayor, called the meeting to order at 10 : 15 P. M. There were present : C. Maloy Fishback , George E. Isaacs, Emerson H. James , Hunter M. Leach, John W. Pumphrey and Austin J. Wright , Councilmen. The minutes of the meeting of October 24, 1960, were ap- proved as previously read. Upon motion of Mr . Fishback, seconded by Mr. Pumphrey, the following resolution was unanimously adopted : BE IT ORDAINED, by the Council for the Town of Leesburg, as follows : • SitC1ION I• ' It shall be unlawful for the owner of any house or other building where human beings congregate or are employed, to use or •,lease said house or building for human occupancy unless and until the premises shall have been connected to an adequate water supply and an approved method of disposal of human excrement . ' SECTION II . Definitions' A. For the purpose of this ordinance a water sppply shall be deemed adequate when provided : 3 6 F (1) by connection to the Town of Leesburg public water supply system, or (2) by connection to a private water supply capable of furnishing a flow of fifty gallons per capita per day at pressures equivalent of the Town 's public water system. ' B. For the purposes of this ordinance an approved method of disposal of human excrement shall be by means of a flush toilet connected to an adequate water supply as defined in Section II-A above and flushing into : • (1) the Town of Leesburg' s sanitary sewer system, or (2) a private septic tank system installed in accor- dance- with Loudoun County Sanitation Ordinance when, and only when: N (a) no public sewer is provided in any street , OC public right of way, or easement adjoining or traversing the premises , or when Q (b) compliance with Section II-B-(l) above would require a private sewer line greater than • 200 feet in length. SECTION III . • Notwithstanding the provisions of Sections I and II above, whenever the conditions of II-B-(2)a and II-B-(2)b obtain and when a septic tank system cannot be installed in accordance with the Loudoun County Sanitation Ordinance , then and only ' then, and upon the recommendation of the Town- Health Officer and approval by the Town Council, a pit privy installed ' and • maintained in accordance with State Standards will- be considered an approved method of disposal of human excrement , and the re- quirement for an adequate water supply will be waived. SECTION IV. Any violation of this ordinance shall be deemed a misdemeanor, and the violator, upon conviction, shall be- fined not less than Five Dollars ($5.00) nor more than Twenty Five Dollars ($25 .00) and a separate violation shall be deemed committed on each day during, or on which, a violation continues or occurs . SECTION V. • • All contrary enactments of the Leesburg Town Council are herewith rescinded and revoked. SECTION VI . The effective date of this ordinance shall be 12 :01 A.M. , EST. , March 1, 1961 . --- • ' Upon motion of Mr. Fishback, seconded by Mr. Isaacs , the following resolution was unanimously adopted: BE IT RESOLVED, by the Council for the Town of Leesburg, in Virginia, that the Recorder be, and she is hereby instructed to publish a copy of the above Sewer Ordinance for one week in THE LOUDOUN TIMES MIRROR, a newspaper having general circulation in the Town of Leesburg. 6.2 Upon motion of Mr . Fishback, seconded by Mr . James, the following resolution was unanimously adopted: WHEREAS, the Council referred the request of Walter Phillips , the contract owner, to rezone forty seven (47) acres in the northeast section of the Town from an R-I to an R-II District ; and, _ WHEREAS, the Planning Commission held a public hearing with respect thereto; and, WHEREAS, the Planning Commission recommended that the said forty seven (47) acres be rezoned to R-II District ; • BE IT THEREFORE RESOLVED, that a public hearing regarding the petition be, and the same shall be held at the Town Office Building on the 28th day of November, 1960, at 7 :30 P. M. , by the Council, and that the Recorder shall cause an appropriate notice thereof to be inserted in THE LOUDOUN TIMES MIRROR on the 16th day of November, 1960; and, BE IT FURTHER RESOLVED, that the petitioner be advised that the petition should be amended to set forth the names and addresses of twenty per cent (20%) or more of the registered . owners of all properties lying within three hundred (300) feet of any part of the property proposed to be changed.
