HomeMy Public PortalAbout1960_11_28 363 REGULAR MEETING, NOVEMBER 28, 1960 After notice duly given by publication in a newspaper having general circulation in the Town of Leesburg, a public hearing was held by the Council of the Town of Leesburg, in Virginia, on November 28, 1960 at 7 : 30 P . M. to consider the rezoning from a R-1 District to an R-2 District , of forty seven acres of land belonging to Walter Phillips , located in the northeast section of the Town of Leesburg. All interested persons were heard and it was the sense of the Council that further study should be given to this matter before a deter- mination was made . The regular meeting of the Council was called to order . by George J. Babson, Mayor, at 10 :50 P. M. There were present : C. Maloy Fishback, George E. Isaacs , Emerson H. James , Hunter M. Leach, John W.. Pumphrey and Austin J. Wright , Councilmen. Upon motion of Mr . Isaacs , seconded by Mr. Wright , and unanimously adopted, the minutes of the regular meeting of ` . November 14, 1960 approved and read . were 1p ,.� Upon motion of Mr . Fishback, seconded by Mr. Pumphrey, the following Ordinance was unanimously adopted : P /IAN ORDINANCE TO PROVIDE STANDARDS FOR THE INSTALLATION OF WATER SUPPLY AND SEWAGE DISPOSAL SYSTEMS AND PENALTIES FOR FAILURE TO CONFORM THEREWITH BE IT ORDAINED, by the Council for the Town of Leesburg, in Virginia, that the ordinance providing for standards for the in- stallation of water supply and sewage disposal systems and penalties for failure to conform therewith adopted November 14, 1960, be and the same is hereby amended to read as follows : SECTION I . It shall be unlawful for the owner of any house or other building where human beings congregate or are employed, to use or lease said house or building for human occupancy unless and until the premises shall have been connected to an adequate water supply and an approved method of disposal of human excrement . SECTION II . DEFINITIONS A. For the purposes of this ordinance a water supply shall be deemed adequate when provided : (1) by connection to the Town of Leesburg public water supply system, or (2) by connection to a private water supply capable of furnishing a flow of fifty gallons per capita per day at pressures equivalent to the Town ' s public water system. B. For the purposes of this Ordinance an approved method of disposal of human excrement shall be by means of a flush toilet connected to an adequate water supply as defined in • Section II-A above and flushing into : (1) the Town of Leesburg' s sanitary sewer system, or (2) a private septic tank system installed in accordance • with Loudoun County Sanitation Ordinance , when and 3 only when : • 364. (a) no public sewer is provided in any street , public right of way, or easement adjoining or traversing the premises , or when (b) compliance with Section II-B-(1) above would require a private sewer line greater than . 200 feet in length, or (3) a private septic tank system conforming to the requirements of the Loudoun County Sanitation Ordinance installed at the time of the effective date of this Ordinance and thereafter maintained in accordance with said Loudoun County Sanitation Ordinance . SECTION III . Notwithstanding the provisions of Sections I and II . • above , whenever the conditions of II-B-(2)a and II-B-(2)b - obtain and when a septic tank- system cannot be installed in accordacne with the Loudoun County Sanitation Ordinance , then and only then, and upon the recommendation of the Town Health Officer and approval by the Town Health Officer and approval by the Town Council , a pit privy installed and maintained in accordance with State of Virginia Standards will be considered an approved method of disposal of human excrement , and the requirements for an adequate water supply will be waived. SECTION IV. Any violation of this Ordinance shall be deemed a mis- demeanor, and the violator, upon conviction, shall be fined not less than Five Dollars (55 .00) nor more than- Twenty Five • Dollars ($25 .00) and a separate violation shall be deemed committed on each day during, or on which a violation continues or occurs . SECTION V. All contrary enactments of the Leesburg Town Council are herewith rescinded and revoked . SECTION VI . The effective date of this Ordinance shall be 12 :01 A. M. , BEST, March 1 , 1961 . Upon motion of Mr. Fishback , seconded by Mr. James, the following resolution was adopted by a vote of five to one ; Mr. Isaacs abstaining: BE IT RESOLVED, by the Council for the Town of Leesburg, - in Virginia, that the resolution readopted at a regular meeting of the Council held on August 22, 1960, appearing on Page 351 of the Current Minute Book , be and the same is amended . to read -as follows on the last line thereof: "due four, five , six, seven and eight years after date , " and, BE IT FURTHER RESOLVED, that the English Construction Company ' s unit price bid based on the existing contract with the Town, be,and the same is hereby declared acceptable for the installation of the "Dry Mill Subdivision" water line, extending from the terminus of the present water line at the Loudoun County High School to the property line of the sub- dividers , G. Shirley and E. Frank Myers , III Y - 365: Upon motion of Mr . Fishback, seconded by Mr . Pumphrey, the following resolution was unanimously adopted : BE IT RESOLVED, by the Council for the Town of Leesburg, in Virginia, that free parking be, and it is hereby permitted on the parking lots and streets of the Town of Leesburg, ssaiJd free parking to commence December 15 , 1960 and terminate at 12 :01 A. M. , December 25 , 1960. Upon motion of Mr. Fishback, seconded by Mr. Wright ,` the. following resolution was unanimously adopted : • BE IT RESOLVED, by the Council for the Town of Leesburg, in Virginia, thatthe sum of One Hundred Twenty FiveDollars (5125:00) be, and the same shall be paid to Elizabeth B. Riley for a sewer line easement as shown on the plat of Walter K. Phillips , dated November 19, 1960.
