Babson, • • Mayor , called the meeting to order at 10 :30 P. M. There were • present : C . Maloy Fishback, George E. Isaacs, Emerson H. Janes and John W. Pumphrey, Councilmen. In the absence of the Recorder Mr. Isaacs was elected Re- corder pro-tem. The minutes of the regular meeting held January 9, 1961 were approved as read and corrected. Upon motion of Mr. Fishback, seconded by Mr. Pumphrey , The following resolution was unanimously adopted: Sit BE IT RESOLVED, by the Council for the Town of Leesburg, in Virginia, that the sum of Seven Hundred Dollars ($70J .00 ) be, and Cq the same is hereby appropriated from the unappropriated surplus Q of the general fund to provide for construction of Buick Street between Fayette and Loudoun Streets . Upon motion of Mr . Fishback, seconded by Mr. James the fol- lowing resolution was unanimously adopted: BE IT RESOLVED, that Four Thousand Dollars (884, 000.00) be, and the same is hereby appropriated from the unaqmopriated surplus of the Utility Fund to provide for the payment of non-reimbursable costs of FAA sewer and water line construction contract ; and , BE IT FUdTHER RESOLVED, that Two Thousand Dollars ($2,OOO .00 ) 111 be , and the same is hereby appropriated from tl-e unappropriated surplus of the Utility Fund for purposes of street reaairs of sewer and water street openings ; and, BE IT FURTHER RESOLVED, that the sum of Forty Thousand Dollars (,j40,0U0.00) be, and the 'same shall be borrowed from The Loudoun National Bank of Leesburg, Leesburg, Virginia , for a perabduof twelve (12) months at an interest rate of not PY1Wt2than Six Per Cent (6%) , for the purpose of constructing the water and sewer lines to the FAA property line . Upon motion of Mr. Fishback, seconded by Mr. Pumphrey, the following resolution was unanimously adopted: BE IT RESOLVED, by the Council for the Town of Leesburg, in Virginia, that the agreement with the English Construction Company, Inc . and the Town of Leesburg, bearing date of January 13 , 1961 , providing for the construction of sewer and water lines and re - lated installations to the Federal Aviation Administration Air Control Center, as an extension of the existing contract in effect between the English Construction Company, Inc. and the Town of' Leesburg with the change with regard to unit prices , subject to the furnishing of a performance bond satisfactory to the Town Attorney, be and the same hereby is adopted and acceptei, and the Mayor and Recorder are authorized to authenticate this action by signing the said agreement, and the Recorder is directed to in- corporate a copy in the minutes by stapling. 373: Upon motion of Mr. Fishback, seconded by Mr. -Pumphrey, _ the following resolution was unanimously adopted: BE IT RESOLV'E'D, by the' Council for the Town of Leesburg, in Virginia; that the Virginia Department of Hio!b'a,,s be re- quested to include in theii secondary system in the Town of • Leesburg, Belmont Street in- the Prospect Hills Subdivision from the east right-of-way line of Prospect Drive westward, including the cul-de-sac , for a distance of 0. 16 miles. Upon motion of Mr. Isaacs, seconded by Mr. James , the following resolution was unaniriously adopted: WHEREAS, the Plsnning Commission was requested by the Council to make its report and recommendation with respect to an amendment. of the Zoning Ordinance and maps of B-1 district areas to- B-2 districts ; and, 11 • ;r WHEREAS, the Planning Commission has submitted its recom- mendation that the area east of King Street North and bounded Q on the south by the B-2 district to the Hartley Trundle line, be and the same should be rezoned from a R-1 to a R-2 district ; and, WHEREAS, the proposed rezoning appears to be in the public interest, BE IT RESOLVED, by the Council for the Town of Leesburg, that the proposed amendment to rezone th'e said area be, and the same is hereby re-submitted to the Planning Commission for its formal recommendation pursuant'.to the Article II - Changes and Amendments, Zoning Ordinance for the Town of Leesburg . Upon motion of Mr . Fishback, seconded by Mr. Leach, the following resolution was unanimously adopted: BE IT RESOLVED, by the Council for the Town of Leesburg, that the Planning Commission be, and it is hereby requested to make a report and recommendation as to the desirability of amend- ing the Zoning Ordinance and map by rezoning •from; an R-1 District to an R-2 District, the close in northwest section of the Town of Leesburg. • Upon motion of Mr . Fishback, seconded by Mr. James, the following resolution was unanimously adopted: BE IT RESOLVED, by the Council for the' Town of Leesburg, in Virginia, that the draft of the proposed subdivision bond of Frank J. Schaefer 3: Co. , Inc . , covering physical improvements in Prospect Hills Subdivision, Section Two, be referred to the Plan- ning Commission of the Town of Leesburg for its recommendation '-as to whether a variance should be granted because of the impractic- ability of corporate surety in this instance, and if so , its re- commendation as to the acceptance of said bond, in lieu of aur requiring corporate surety . Upon motion of Mr . Isaacs, seconded by Mr . Leach,- the follow- , I/ ing resolution was unanimously adopted: BE IT RESOLVED, by the Council for the Tom of Leetlrg•, in Virginia, that the sum of Five Hundred Dollars ( ,;.503 .0.)) be transferred within the General Fund from the Special Payments (Legal) to the Emergency Fund. The minutes of the regular meeting held January 23 were approv- ed as written and read.
