HomeMy Public PortalAbout1961_02_13 :374 REGULAR MEETING, FEBRUARY 13, 1961 A regular meeting of the Council for the Town of Leesburg, in Virginia, was to be held February 13, 1961 at 8 :00 P. M. George J. Babson, Mayor , called the meeting to order at 10:15 P. M. There were • present : C. Maloy Fishback, George E. Isaacs, Emerson H. James, Hunter M. Leach and John W. Pumphrey. The minutes of the regular meeting held January 23 were approv- ed as written and read. Upon motion of Mr. Fishback, seconded by Mr. James, the follow- ing resolution was unanimously adopted : BE IT RESOLVED, by the Council for the Town of Leesburg, in Vir- ginia, a municipal corporation, that the instrument of Dedication and Vacation between this municipality and Loudoun Properties, Inc. , a Virginia corporation, bearing date on the 13th day of February, 1961 , copy of which is hereto attached, be, and the same hereby is, ratified, approved and confirmed, and the appropriate officers of the Town of Leesburg are authorized and directed to authenticate the same on be • - half of the Town of Leesburg. 1 375 Upon motion of Mr. Fishback, seconded by Mr. Ptimphrey, the fol- lowing resolution was unanimously adopted : WHEREAS, the Leesburg Planning Commission has held a Public Hearing,' • after due publication, to consider proposed amendments to the Leesburg Zoning Ordinance by amending the Zoning Map, and have by RESOLUTION recommended to the Council these proposed amendments be approved, as follows: (1) Rezone the area east of North King Street to the Hartley Trundle line and south to the General Business District as is set forth on the Leesburg Zoning Map; said rezoning to be from One-Family Resi- dence District to General Residence District; this proposed rezoning will include the Woodberry and Lowenbach Subdivisions. . (2) Rezone the area on each side of the Fort Evans Road, Rt. 773, from One-Family Residence District to General Residence District; and, WHEREAS, the proposed rezoning appears to be in the public interest; Cg BE IT RESOLVED, by the Council for the Town of Leesburg, in Vir- �r ginia, that a public hearing be held on February 27, 1961, at 7 :30 et P. M. in the Town Office Building at 112 West Loudoun Street, Leesburg, : Q Virginia, to consider the above stated amendments and that the Recorder' be , and she is hereby requested to insert an advertisement to that effect in the February 16, 1961 issue of THE LOUDOUN TIMES MIRROR. • Upon motion of Mr. Isaacs, seconded by Mr. Leach , the following resolution was unanimously adopted : WHEREAS, by Deed of Correction and Exchange dated 12 July, 1956, between this municipality and Loudoun Properties, Inc . , it was agreed as follows : "(3) ADDITIONAL CONSIDERATION A. It is agreed by and between the Parties hereto that as a part • of the consideration for the conveying of the property by the Party of the First Part- to the Party of the Second Part, as hereinabove set forth, the Party of the Second Part , the Town of Leesburg, in Virginia, hereby promises, covenants and agrees to lay out , grade and construct, within six (6 ) months from the execution of this deed, "Clay Street" at the location shown on the Final Plat of "Virginia Village ," made by Patton and Kelley, Certified Land Surveyors, Falls Church, Virginia, • on the property owned by the Party of the First Part , which said plat consists of two (2) pages and is to be recorded among the land records in the office of the Clerk of the Circuit Court for Loudoun County, Virginia, simultaneously with the recording of this deed and appears in Plat Book * , Folio , of said land records ; and the Party of the Second Part further covenants and agrees that in the laying out, grading and construction of said "Clay Street , " to improve said street by placing thereon sufficient stone or gravel so as to make said street useable by the Party of the First Part and/or others; " and , WHEREAS, a controversy exists as to the extent of work required to be performed by the said municipality thereunder ; and , WHEREAS, it is the desire of said municipality and Loudoun Proper- ties, Inc.- to adjust said controversy in an amicable manner ; NOW, THEREFORE, BE IT RESOLVED, that the Town of Leesburg, in Virginia, upon the execution of a mutual release by and between said Parties with respect to their rights and obligations under the afore said Deed of Correction and Exchange, insofar as the same shall pertain to the construction of "Clay Street, " the Town of Leesburg, in Virginia, shall pay to the said Loudoun Properties, Inc . , the sum of Two Thousand Dollars (82,000.00) within six (6) months after the adoption of this resolution, and its acceptance by Loudoun Propetties, Inc. , in full satisfaction of all claims and demands with respect to "Clay Street," and the Attorney for the said municipality shall approve the form of such mutual release and indicate his approval thereof in writing to the Ityor with an executed copy to the Town Treasurer. • • 13' • • Upon motion of Mr. Isaacs, seconded by Mr. Pumphrey , the meet- . M. 7�Mayor REGULAR MEETING, FEBRUARY 27, 1961 - PUBLIC HEARING A regular meeting of the Council for the Town of Leesburg, . in Virginia, was held February 27, 1961 at 7:00 P. M. George J. Babson, Mayor, called the meeting to order at 9:50 P. M. There were present: C. Maloy Fishback, Colonel George E. Isaacs, Emerson H. James, Hunter M. Leach, John W. Pumphrey and Austin J. Wright, Councilmen. In the absence of the decoder Mn Leach was unanimously elected Recorder pro-tem. The minutes of the regular meeting of February 13 were ap- • proved as corrected. Upon motion of Mr. Fishback, seconded by Mr. James, the following amendment to the "Sewer and Water Ordinance" was unanimously adopted: BE IT ORDAINED, by the Council of the Town of Leesburg, in Virginia, that Section VI of the Ordinance adopted at the Regular Meeting of the Council on November 14, 1960, be amended to read: "SECTION VI : The effective date of this Ordinance shall be 12:01 A. M. , EST, July 1, 1961." . Upon motion of. Mr. Fishback, seconded by Mr. Leach, the following amendment to the 'Ordinance for the Location of ,Trailer Camps" was unanimously adopted: BE IT OrRDAINED, by the Council for the Town of Leesburg, - in Virginia, that the "Ordinance for the Location bf Trailer Camps , " be amended by striking out the words "or for other purposes, " in the first paragraph; and an emergency existing, this amendment shall be effective upon adoption. Upon motion of Mr . Fishback, seconded by Mr. James, the following rezoning was unanimously adopted: WHEREAS, the Leesburg Planning Commission has held a Public Hearing, after due publication, to consider proposed amendments • to .the Leesburg Zoning Ordinance, by amending the Zoning Map , and have by resolution recommended to the Council that these proposed amendments be approved; and, WHEREAS, the Council for the Town of Leesburg, held a Public Hearing on February 27, 1901 at 7 : 30 P. M. regarding . the aforesaid amendments ; `NOW, THEREFORE, BE IT ORDAINED, by the Council for the II .Town of Leesburg, that the Zoning Ordinance be amended by amending the Zoning Mao as follows: (1) Rezone the area east bf North King Street to the Hartley Trundle line and south to the General Business Dis- trict as is set forth on the Leesburg Zoning Map ; said re- zoning to be from One-Family Residence District to:.General Residence District; this rezoning to include the Wood'oerry and Lowenbach Subdivisions .
