Fultz, forthwith. Upon motion of Mr. James, secondedby'•Colonel Isaacs, the meeting adjourned at 10:40 P. -NM. •1 Mayor REGULAR MEETING , MARCH 27, 1961 C9 A regular meeting of the Town Council for the • Ton of Ot Leesburg, in Virginia, was S held March 27, 1961 . George J. Babson called the meeting to order at 7 :02 P. M. act ►-+ Mr . Raymond L. Hough was presented with a silver tray for his forty years ' service to the Town of Lesburg . 1'he minutes of the previous meeting were a par oved as written and read . On motion of Mr . Pumphrey, seconded by Mr. Pishback, • Council recessed. Ciuncil resumed its meeting at 9:55 . U,on motion' of Mr . Fishback, seconded by Mr. Leac h, the folloc,ing motion was adopted by a vote of 5 to 2, Fishback, Isaacs, Pumphrey, Leech, Babson voting for and James and Wright against, the following resolution was carried: • BE IT RESOLVED, by the Council for tEe Town of Leesburg, in Virginia, that the position of Town Manager, at an annal salary of 87200 .00 per year, be, and it hereby is, established effective July 1, 1961. At this point Mr . aright appealed the ruling of the Chair on the grounds that the Mayor• does not hate voting priv-r3..e- te-ne- t—in case. of- a,-tie-. Mayor baoson then read Section VII of the Leesburg Charter which stated that the Council shall consist of aix members and a Mayor. Mr. ?!right Sti--1- maintained his appeal. An appeal having been made as to the ruling of the Chair, _ the Chair. ruled that in this instance a vote of five of the Council was required. This was overriden by a vote of four to two . Upon motion of Mr. Fishback, seconded by Mr . Isaacs, the follov,ing resolution was unanimously adopted: ' WHEREAS, the Planning Commission recommended to the Council the vacation of Gibson Heights Subdivision with the exception of Gibson Street ; and, • WHEREAS, the Council 'iirected the Town Attorney to prepare an instrument of vacation outlining the extension of vacation; and, WYL REAS a plat of said area to be vacated was prepared by Robert K. Wilson, Certified Surveyor, August 26, 1960; and, 380. WHEREAS, a question has arisens to whether or not the State of Virginia Department off Highways may have to join in the vacation because of a change in the entrance toosaid street; and, WHEREAS, it has been suggested that the participation of the Department of Highways can be avoided by not vacating the fifteen ( 15) foot dedication fronting on Route #698; BE IT THEREFORE RESOLVED, that the Planning Dommission give its recommendation to the Council with respect to the above . Upon motion of M . Fishback, seconded by Mr . James, the following resolution was carried by a vote of five to one : . BE IT RESOLVED, by the Council for the Town of Leesburg, • that the Town Attorney be, and he is hereby directed to in- stitute a civil action on behalf of the Town of Leesburg, as provided by the Code of Virginia, to recover the license fees due and owing for the operation of a trailer camp for the year 1960-61 by Leonard W. Parker. Upon motion of Mr . James, seconded by Mr . Wright, the following resolution was unanimously adopted: • BE IT RESOLVED, by the Council for the Town of Leesburg, that the nekt regular meeting shall be held April 24, 1961. Council recessed at 10:30 and resumed session at 10:55. Upon motion of Mr. James, seconded by Mr Isaacs, and unanimously carried, the foregoing resolution was rescinded, and the next regular meeting will be held April 10, 1961. Upon motion of Mr. Fishback, seconded by Mr . Isaacs, the attached resolutions were unanimously adopted. Upon motion of Mr. Leach, seconded by Mr . Isaacs, the • meeting adjourned at 11:00 P.
