HomeMy Public PortalAbout1961_05_22 • 389 REGULAR MEETING, MAY 22, 1961 A meeting of the Leesburg Town Council Was called to order by Mayor George J. S'abson at 7 :00 P, M. E. D. T. Thoseopresent were C. Meloy Fishback, George Isaacs, Emerson H. James, John cr. Pumphrey and Austin J. Wright, Councilmen. In the absence of the Recorder Colonel George Isaacs was appointed Recorder Jro-tem. Mr . Leach arrived at the meeting at 7 :02. The minutes of the May 8th meeting were approved as written and read. Nominations for Mayor were opened to fill the unexpired term of the _present incumbent. • N Upon motion of Mr. eumphrey, seconded by Mr. ',:right , Hunter M. Leach was nominated to be voted on for the office of Mayor. d The nominations being closed Mr. Leach was elected as Mayor by a show of hands, the Nominee abstaining. Mr. Leach will take office at 12:01 June 16, 1961 . No action was taken to fill the vacancy on the Council at the this time . • Upon motion of Mr . i'umphrey, seconded by Mr . Leach, the following resolution was unanimously adopted: BE IT RESOLVED, by the Council for the Town of Leesburg, in Virginia, that Frank Raflo be granted permission to install a orick in cement sidewalk at his own expense , in front of his place of business located at 106 King Street: and, -, • BE IT FURTHER RESOLVED, that said sidewalk shall be installed subject to the inspection and supervision of the Superintendent of Streets for the Town of Leesburg. Council recessed for a short committee meeting gt 7 :24 P. M. Council reconvened at 7:30 P. M. for an advertised Public Hearing on amendments to the Zoning May , Subdivision Ordinance and Zoning Ordinance . No member of the public appeared either • in favor or in protest to said amendments . Upon motion of Mr. Pumphrey, seconded by Mr . Wright , the < �' following resolution was unanimously adopted: Rezone from a One Family Residence District to a General Residence District all the area beginning with the north corner of Ayr and Cornwell Streets, thence west -to the east line of • the Whitmore tract, thence north- and- west to the east line of Kirkpatrick, thence north to the Corporate limits of Leesburg, thence with the Corporate limits of Leesburg east to King Street , thence south with King Street including the presently Zoned General Residence District to the presently Zoned Community Business District, thence west and south with said Community Business District to the presently Zoned General Susiness District to Liberty Street, thence north to Cornwall Street, thence west with Cornwall Street to the place of beginning. Council reconvened at 10.: 22 P. M. Mr . Wright had left the meeting. 390 • Upon motion of Mr. Pumphrey, seconded by Mr. Pishback, the following resolution was unanimously adopted: BE IT RESOLVED, by the Council for the Town of. Lees- burg, in Virginia, that the following amendments to the, Sub- . division Ordinance be, and the same are hereby adopted: Amend Section I-A by deleting the words " two miles" and I/insert in place thereof "one mile . " Section I-B delete the entire sentence after the word "observed" and also delete the quotation marks . Section II-B-f after the word "scale" delete. the words "with their dimensions" and add the words in accordance with the Zoning Ordinance . Section II-B-4- ( a) add after the word "Owner" the words proprietor and trustees if any. Section II-B-4- ( c) insert a period in place of the semi • - colon after the word "pertinent" and delete the remainder of the • sentence . Delete all the words in the third sentence up to the word "lots" , in the fifth line and capitalize the letter S in the word Such to start a new sentence . • Section IV-B amend this paragraph to read as follows: • Plans and specifications for all improve,lents shall be submitted to the Planning Commission for approval prior to construction. All improvements shall be subject to final inspection and approval by the Town Engineer . Upon such approval , the subdivider shall convey all such improvements to the Town of Leesburg in fee simple, before release of any performance bond or check. aa • Upon ,ration of Mr . Pumphrey, seconded by %:r. James, the following resolution was unanimously adopted: BE IT RESOLVED, BY THE Council for the Town of Leesburg, in Virginia, that the following amendment to the Zoning Ordinance be and the same are hereby adopted: Article 2-5 second sentence , after the word structures add Except that existing signs and billboards may not be enlarged. Article 2-6-1 add at the end of the phrase; except as pro- vided in Section 10-2-3-1. Article 3-add a new section numbered 3-4 Prohibited Uses: 3-4-1 Mobile Hone, Trailer Coach or Trailer 3-4-2 Mobile Home Park, Trailer Coach Park, Trailer Park or Trailer Camp N C% Article 4-add a new section numbered4-4 Prohibited Uses: OT4-4-1 Mobile Home, Trailer Coach or Trailer. 4-4-2 Mobile Home Park, Trailer Coach Park, Trailer Park or Trailer Camp . Article 5-2-1 renumber Sections 2-7-2 and 2-8 to read Sections 2-7-2-1 and 2-7-2-2 ARTICLE 6-1-2 transpose and of sentence to read after the cord "bakery" , warehouse billboard, feed store but not milling and • grinding; unless such uese are probihited in the "M-1" District . Add under Article 7-3 a new section numbered 7-3-2 Mobile Home, Trailer Coach, Trailer. 7-3-3 Mobile Home Park, Trailer Coach Park, Trailer Park or Trailer Canp. Article 8-1-R-2 delete the words 5,000 sq. ft. per family arid add after the words 3 or more, see paragraph 6. Article 8-0 insert the word Land between minimum and area. ARTICLE 8-1-B-1 under Front Yard Least depth after the words "R" district, add then average . Article 8-2-3 delete the "R" . in the first line. Article 8-2-4 after "front yards" add a comma after" corner lots" . Article 8-2-5-1 after the word "features" in the second line add a semi-colon: and after the word "feet" add a full colon; after the word "grade" in the third line add a semi-colon; and after the number (6) add a full colon. Article 11-1 delete the words "by ordinance" in the third line ; after the word "unless" add the proposed amendment, change or supplement. II Article 11-2 in the first line to read any such amendment, change or sup,�lement may be initiated, etc. , and delete the words etition or. " Delete the entire last sentence . Article 15-1-6 Insert a period after the word "Buildings" • and delete the rest of the sentence. 92 • Article 15-1-23 Mobile Home , Trailer Coach, Trailer, means any vehicle or similar portable structute having no foundation other than wheels, jacks, skirtings or blocks and so designed or constructed as to permit occupancy for dwelling or sleeping purposes. Article 15-1-24 Mobile Home Park, Trailer Coach Park, Trailer Park or TrdilerCamp means any plot of ground upon which two or more mobile homes, trailer coaches or trailers, occupied ' for dwelling or sleeping purposes, are located, regardless of whether or not a charge is made for such accommodation. Upon motion of Mr . Fishback, seconded by Mr. James, the following resolution was unanimously adopted: BE IT RESOLVED, by the Council for the Town of Leesburg, in Virginia, that the resolution adopted on April 24, 1961, in reference to the request of Council to the Highway Department, that, they include the streets in the Monroe Manor Subdivision in their secondary system, be amended to include a fixed right- of-way on these streets, all as are shown on the Plat of the Monroe Manor Subdivision, recorded in the Clerk' s Office of Loudoun County on May 10, 1954. Upon motion of Colonel Isaacs, seconded by Mr. Leavh , the following resolution was unanimously adopted: WHEREAS, the Council for the Town of Leesburg, has pre- • pared the attached budget for the fiscal year 1961 through 1962, for informative and fiscal planning purposes, only pursuant to Section 15-575 of the Code ov Virginia , as amended, and, WHEREAS, for informative and fiscal planning purposes, the Code of Virginia requires that a brier synopsis of said budget shall be published in a newspaper having general circulation in the Town of Leesburg, and notice given of one or more public hearings in relation thereto, at least seven days prior to the date set for said hearing; and, BE IT THEREFORE RESOLVED, by the Council for the Town of Leesburg, that the Mayor shall cause a copy of the attached synopsis of the budget and notice of ppuub1ibehear. ng in relation thereto, to be held at the Town Office Building on June 5, 1961, at 6 :30, E.S.T. , to be published in THE LOUDOUN TIMES MIRROR at least once seven days prior to the date set for said Public Hearing.
