HomeMy Public PortalAbout11-19-2007PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, MONDAY, NOVEMBER 19, 2007 The Common Council of the City of Richmond, Indiana met in regular session Monday, November 19, 2007, at 7:30 PM in the Council Chambers in said City. PLEDGE OF ALLEGIANCE PRAYER BY COUNCILOR LUNDY President Pappin presided and the following business was conducted: ROLL CALL Councilors present were Howard "Jack" Elstro, Etta Lundy, Bruce Wissel, Karl Sharp, Bing Welch, Larry Parker, Al Glover, Gil Klose and Diana Pappin. APPROVAL OF MINUTES Councilor Parker moved to approve the minutes of the meeting of November 5, 2007, with a second by Councilor Welch. Upon a vote viva voce, the motion passed. PRESENTATIONS, MEMORIALS OR REMONSTRANCES, PETITIONS AND INTRODUCTIONS, MOTIONS, RESOLUTIONS None COMMUNICATION FROM THE MAYOR ■ Sharon Palmer, Grants Administrator, has been notified the City has received a grant for recycling bins to be used in the City Building. ■ Richmond will not be the site for one of the 2008 Presidential Debates. ■ Richmond High School Sophomores held a successful community carnival on November 17. REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY Minutes of the October 25, November 1 and 8, 2007 meetings were accepted as presented. REPORTS FROM DEPARTMENT HEADS - None REPORTS FROM STANDING COMMITTEES ■ POLICE MERIT COMMISSION APPOINTMENT — Police Chief Wolski recommended Dr. Amy Viano to serve another term on the Police Merit Commission. Councilor Wissel moved to approve Chief Wolski's recommendation, with a second by Councilor Sharp. Upon a vote viva voce, the motion passed. REPORTS FROM SPECIAL COMMITTEES - None Common Council Minutes November 19, 2007 Page 2 of 4 REPORTS FROM ORGANIZATIONS ■ WAYNE COUNTY TOURISM BOARD APPOINTMENTS — The Board of Directors of the Wayne County Tourism Board recommended Linda VonPein, owner of Advanced Travel of America, to represent the Travel Industry and Sandy Baker, General Manager of Lees Inn of Richmond, to represent the lodging industry to serve two year terms beginning January 1, 2008 and ending December 31, 2009. These nominations will be held until the December 3 meeting to allow additional names to be presented. MISCELLANEOUS BUSINESS - None ORDINANCES ON FIRST READING Councilor Elstro moved to suspend the rules and read Ordinance Nos. 79, 80, 81 & 82 -2007 on first reading by title only with a second by Councilor Parker. Upon a vote viva voce, the motion passed. ORDINANCE NO. 79 -2007 — AN APPROPRIATION ORDINANCE AMENDING THE 2007 BUDGET The Clerk read Ordinance No. 79 -2007 on first reading by title only. This Ordinance would transfer funds within the 2007 Police Department Budget. Councilor Wissel moved to advance Ordinance No. 79 -2007 to second reading and to suspend the rules and read by title only with a second by Councilor Welch. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 79 -2007 on second reading by title only. Council President Pappin declared Ordinance No. 79 -2007 on second reading and public hearing. Speaking in favor was Police Chief Wolski. There being no comments against the Ordinance, Councilor Elstro moved for engrossment of Ordinance No. 79 -2007 with a second by Councilor Lundy. Upon a vote viva voce, the motion passed. Councilor Elstro moved to advance Ordinance No. 79 -2007 to third and final reading and suspend the rules and read by title only with a second by Councilor Parker. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 79 -2007 on third reading by title only. Ordinance No. 79 -2007 was adopted with a 9 -0 roll call vote. ORDINANCE NO. 80 -2007 — A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A STATEMEN TOF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 6 -1.1 -12.1 (Vandor- equipment) The Clerk read Ordinance No. 80 -2007 on first reading by title only. This Ordinance is a request from Vandor Corporation for a 10 -year tax abatement for equipment valued at $2,780,000. Ordinance No. 80 -2007 was referred to the Tax Abatement Committee for due diligence. ORDINANCE NO. 81 -2007 - — A SPECIAL ORDINANCE AMENDING THE ZONING MAP FOR A CERTAIN PARCEL FROM R -3 (one to eight family residence)TO R -3 SPECIAL USE (220 NW 'T' St.) The Clerk read Ordinance No. 81 -2007 on first reading by title only. Common Council Minutes November 19, 2007 Page 3 of 4 This Ordinance is a petition to rezone the property at 220 NW "I" Street from R -3, One -to -Eight Family Residence District, to R -3, Special Use District so the owner may operate a computer repair shop at that location. Ordinance No. 81 -2007 was referred to Plan Commission for public hearing at its meeting on December 20, 2007. ORDINANCE NO. 82 -2007 — AUTHORIZATION FOR TEMPORARY LOAN ENGAGEMENT (Ice Miller) The Clerk read Ordinance No. 82 -2007 on first reading by title only. This Ordinance would authorize the City to borrow $10 million to be used in place of the City's property tax disbursement until the balance of the 2007 allocation is received. Councilor Elstro moved to advance Ordinance No. 82 -2007 to second reading and to suspend the rules and read by title only with a second by Councilor Lundy. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 82 -2007 on second reading by title only. Council President Pappin declared Ordinance No. 82 -2007 on second reading and public hearing. Speaking in favor was City Controller Tammy Glenn. There being no comments against the Ordinance, Councilor Lundy moved for engrossment of Ordinance No. 82 -2007 with a second by Councilor Elstro Upon a vote viva voce, the motion passed. Councilor Elstro moved to advance Ordinance No. 82 -2007 to third and final reading and suspend the rules and read by title only with a second by Councilor Parker. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 82 -2007 on third reading by title only. Ordinance No. 82 -2007 was adopted with a 9 -0 roll call vote. ORDINANCES ON SECOND READING ORDINANCE NO. 62 -2007 — A SPECIAL ORDINANCE VACATING A DEDICATED ROADWAY (100 blk of NW 20 "' St) The Clerk read Ordinance No. 62 -2007 on second reading by title only. This Ordinance is a petition to vacate Northwest 20th Street north of Living Word Christian Church and is part of a proposal to develop the area bordering Northwest 20th Street into eight single - family residential units. This Ordinance was heard by Plan Commission at public hearing on September 27. The Plan Commission voted unanimously to recommend approval of the vacation. Council President Pappin declared Ordinance No. 62 -2007 on second reading and public hearing. Speaking in favor was Kyle Tom, managing partner of KT Associates, David Winemiller, Project Engineer, Bob Wiwi and Kevin Morrow of the Richmond Sanitary District and Scott Zimmerman, City Planner. Speaking in opposition to the Ordinance was Terri Price, 1901 NW "C" Street. Councilor Elstro moved for engrossment of Ordinance No. 62 -2007 with a second by Councilor Wissel. Upon a vote viva voce, the motion failed.
