M. in the Council Chambers, Leesburg, Virginia. There were present : Stanley F. Caulkins, George P. Hammerly, Emerson H. James and Colonel George E. Isaacs. In the absence of the Recorder, Mr. Caulkins was appointed Recorder pro-tem. ✓ The minutes of the regular meeting of July 24, L961 and the special meeting of July 31, 1961 were accepted and ap- proved as submitted: Upon motion of Mr. Hammerly, seconded by Colonel Isaacs, the following resolution was unanimously adopted: C9 BE IT RESOLVED, by the Council for the Town of Leesburg that a certified copy of the amendments to the Zoning Ordinance, Subdivision Ordinance and Zoning Map adopted May 22, 1961,. be, _ ,d. and the same shall hereby be transmitted to the Clerk of the- Circuit Cburt for Loudoun County pursuant to Section, 15-908 .- and 15-783 of the 1950 Code of Virginia;- as• amended.. • Upon motion of Colonel Isaacs, seconded by Mr•.. James, the following resolution was unanimously adopted: - . • BE IT RESOLVED, by the Councilfor the Town of Leesburg;: in Virginia, that all ordinances now- ineffect__pertaining to.. . . . . . the control of dogs, be,' and the same are hereby repealed,•. effective upon the adoptionof this resolution, specifically the ordinances relating to dogs on Page 18, 47 and 57 in the current Ordinance Book; Upon •motion of Colonel Isaacs, 'seconded by Mr: James, the following resolution was unanimously 'adopted: BE IT RESOLVED, by the Council for the Town of Leesburg; in Virginia, that the Treasurer be and he is hereby instructed to draft a check in the sum of Two Thousand Dollars ($2,000.00) payable to Loudoun Properties; Inc. to be dated August 16, 1961, and deliver the same upon the presentation by Loudoun Properties, Inc. of a release of the ToWn of .Leesburg.'from the terms :-and conditions of the deed of correction and -exchange between--Loudoun Properties, Inc: and the Town of Leesburg; dated July 12.,;. 1956., and only after said release is approved by the Town Attorney., . as set forth in the resolution on Page 375 and Page 377 of the minutes, and that Loudoun Properties, Inc. and its attorney, be advised of this action: Upon motion of Colonel Isaacs, seconded by Mr. James, the following resolution was unanimously adopted: • WHEREAS, Warren C. Perrow, Engineer., has advised and re- - commended by letter dated July 7, 1961, that the installation ' by the' English Construction Company of the F. A. A. water and sewer lines be absolved from the delay in making the final test of the pumping station and be paid in full for the construction thereof; BE IT RESOLVED, by the Council for the Town of Leesburg., in Virginia, that the work and installation of said water and sewer 'lines by the English Construction Company, be, and the same is hereby approved and accepted per "Estimate for Partial payment-FINAL" , and that payment in full be made; and, BE IT FURTHER RESOLVED, that the Federal Aviation Agency be and the same shall be furnished a copy of this resolution. Mr. C. Meloy Fishback, a member of Council, arrived 'at the meeting at 8:05. 420 • Upon motion of Mr. James, seconded by Colonel Isaacs,. the following resolution was unanimously adopted: . . WHEREAS, by deed dated August 15; 1955., recorded in need Book 348, . Page 502; Pilot Investment Corporation did. grant and convey a certain parcel -of land• therein described.- . . . so long as said tract-of-land was used' as a pumping station- location, tatinlocation, . and upon failure to use said land for a pumping station, the said tract of land would revert to the grantee or ' its assigns; and, WHEREAS, the Town of Leesburg has ceased using said tract of land for a pumping station; BE "IT THEREFORE RESOLVED; by the Council for the Town of Leesburg, in Virginia, that the use of said land for the location of a pumping station is no longer required* Upon motion of Mr. Hammerly, seconded by Colonel Isaacs, the following resolution- was -unanimously--adopted: WHEREAS, the Council requested bids for the painting of the interior and exterior of the new Town Water Tank; and, WHEREAS, the following bids were submitted: . Dominion Tank & Iron Co. $ 6,936.00 - .. The George Tarbuk Company 8,650.00 Virginia Erection Company 7;900.00 American Tank & Tower Co. 10,150.00 WHEREAS, the bid of the Dominion Tank & Iron Company is the lowest bid; • BE IT THEREFORE RESOLVED, that the bid of the Dominion Tank & Iron Company be, and the same is hereby accepted. Upon motion of Mr. Fishback, seconded- by Mr. James, the following resolution was unanimously adopted: . WHEREAS, the Council requested bids for painting the exterior of the Town Office Building; and, WHEREAS, the following bids were submitted: Spinks Bros. $755 .00 less $25.00 for repairs • John S. Rhodes $722.00 WHEREAS, the bid of John S. Rhodes is 'the lowest bid; BE IT THEREFORE RESOLVED, that the bid of John S. Rhodes be, and the same 'is hereby accepted. Upon motion of Colonel Isaacs, seconded by Mr. Caulkins, the following resolution was unanimously adopted: BE IT RESOLVED, by the Council for the Town of Leesburg, in Virginia, that "the sum of $722.00 is hereby appropriated from the unappropriated General Fund for the painting of the exterior of the Town Office Building. ' Upon motion of Mr. Hammerly, seconded by Colonel Isaaxs, the following resolution was unanimously- adopted.: • -. BE IT RESOLVED, by the Council.ifor the Town of Leesburg, in Virginia, that the resolution adopted on April 24, 1961 and May 22, 1961, in reference to the request of Council to the Highway Department, that they include the streets in the . Monroe Manor Subdivision in their secondary system, be amended to include a fixed right-of-way on these streets, all as are shown on the Plat of Monroe Manor Subdivision recorded in the Clerk' s Office of Loudoun County on May 10, 1954 in Plat Book 5, Page 205 and Deed Book' 14 L' s, Page 369. 421 Upon motion of Mr. Fishback, seconded by Mr. Hammerly, the following resolution was unanimously adopted:- BE IT RESOLVED, by the Council for the Town of Leesburg, . in Virginia,- that the 'report -of the Planning Commission dated August 9, 1961, in reference to naming the unnamed streets within the Corporate limits of Leesburg, - be, and the same is hereby accepted and adopted. Isaacs Cl: QAGAINST - . °-' NONE ` WHEREAS, the Council has by a resolution duly adopted on August 14, 1961, provided for the issuance •of $9,080.00 water bonds described in the notice hereinafter set forth and it is • necessary, in order to comply with the provisions of the Public Finance Act of 1958, that the notice hereinafter set fortt shall be published; NOW, THEREFORE; • BE IT RESOLVED by the Council of the Town of Leesburg, as follows : II (1) The Town Recorder is hereby- directed to publish the following •notice : • NOTICE OF THE ISSUANCE OF BONDS OF THE TOWN OF LEESBURG . PLEASE TAKE NOTICE that the Council of the Town of Leesburg has by a resolution duly adopted on August 14, 1961, pursuant to the Public Finance Act of 1958 of Virginia, authorized theissuance - of bonds of the Town of Leesburg of the aggregate principal • amount of $9,080.00 dated August l4, i961-; and that a certified copy of such resolution has been filed with the Circuit Court of Loudoun County, and that the Town of Leesburg. will. .issue_said_ bonds to finance the cost of- acquiring a water line and appur- • tenances extending- from• the -terminus^of the. -exist.ing.:watenline at the Loudoun County High. School'--to• the property line of -the subdivision known as Dry Mill Subdivision, and that this notice is being published pursuant to Section 15-666.40 of said :Public . OF THE • TOWN OF LEESBURG WHEREAS, G. Shirley Myers and E. Frank Myers, III, have con- 1 structed a waterline and appurtenances extending from the :ter- minus of the existing water line at the Loudoun County High School to the property line of the subdivision known as Dry Mill Subdivision, in accordance with an-agreement tade .with. them by the Town, and the Town- Council desires -to. -acquire said water line and appurtenances as a part of -the water system maintained- , by the Town to provide water -to its inhabitants for the sum of $9,080.00, which is- the actual cost- of constructing said water . . line and appurtenances ; NOW, THEREFORE:- BE IT RESOLVED, by the Council of the Town of Leesburg, as follows : - (1) In order to finance the cost of acquiring said water , line and appurtenances the Town of Leesburg shall issue, pur- suant to the Public Finance Act of 1958, of Virginia, -its bonds . . of the aggregate principal amount of $9,080.00.., - • (2) Said bonds shall be dated August 14, 1961 and shall consist of five bonds of the denomination of 1,816 .00 each, numbered from 1 to 5, inclusive, in the order of their maturity .' and payable, one bond on August 1 in each -of the .years 1965- to . 1969, inclusive. Said bonds shall bear no interest. Each .of said bonds shall be payable at the office of The Loudoun National Bank of Leesburg, in the Town :of Leesburg, Virginia, and shall be payable to G. Shirley Myers and E. Frank Myers, III, or their .legal representatives, successors or transferees. (3) Each of said bonds shall be in the following form: 11No. $ 1,816.00 UNITED STATES OF AMERICA COMMONWEALTH OF VIRGINIA TOWN OF LEESBURG WATER BOND • The TOWN OF .LEESBURG, (hereinafter referred to as "Town") , a municipal corporation of the Commonwealth of Virginia, hereby . acknowledges itself indebted and for value received promises to pay to G. SHIRLEY MYERS and E. FRANKfl1YERS , • III, or their legal representatives, successors--or transferees; on August 14, • the sum of ONE THOUSAND -EIGHT HUNDRED AND-SIXTEEN -DOLLARS - . ($1,816.00) , at the - office of The•- Loudoun-National Bank of ... . Leesburg, in, the Town of Leesburg, Virginia, in any coin or currency of the United States of America which at the time of payment is legal tender for the payment of public and private • debts. - This bond is one of an autorized- issue, the aggregate : principal amount of which is $9,080.00, the bonds of which are of like tenor, except as to number and maturity, and are 11issued pursuant to the Public Finance Act of 1958 of Virginia and a resolution entitled "Resolution Authorizing the Issuance of $9,080.00 Water Bonds of the Town of Leesburg, " adopted by the Countil of the Town on August 14, 1961. The faith and credit of the Town are hereby irrevocably pledged for the punctual payment of the principal of this bond according to its terms. 423 • It is hereby certified and recited that all conditions, acts and things_required by the Constitution and statutes :of - 'the Commonwealth of Virginia to exist, to have happened and . to have been performed precedent to and in the issuance .of. . this bond, exist, have happened and have been performed;. . and that the issue of bonds of which this is one, together-. with all other indebtedness of the Town, is within every debt and other limit prescribec by the Constitution and laws of such Commonwealth: IN WITNESS WHEREOF, the Town has caused this •bond to .be signed by its Mayor and .to be attested by its Recorder, and has caused its corporate seal to be hereunto affixed, and this bond to be dated August 14, 1961. /100 COMayor Ot Q ATTEST: a Recorder •(4) The Mayor of the Town of Leesburg and the Town Recorder are hereby authorized and directed to sitn said bonds and to affix the corporate seal of the Town thereto. (5) -The full faith and credit--of -the -Town of Leesburg is pledged to the payment of the• principal of said bonds and an ad velorem tax shall be leyied annually on all property subject to taxation: by the Town for the purpose- of paying such principal as the same becomes due and payable. (6) The Town Treasurer is hereby directed to deliver said bonds, when they shall have been executed as herein provided, to G. Shirley Myers and E: Frank Myers, III, upon receiving in payment therefor the principal amouht 'of said bonds.. Louis Roberts-, -Chairman of the- Leesburg Civic Association -. requested that a Committee—be?-set—up,- on Human-Relations• in -the • interest of having a--better understanding between the colored and white people of Leesburg. Mayor Leach stated that proper action would be taken on this request. There being no further business to come before the Council, the meeting adjourned. .yor I/ •
