1993- 08 -05. City Council Special Called Meeting
Mayor Pro Tem Jack Youmans called the meeting to order
stating that this meeting was called for the adoption of the
Memorandum of Agreement between the Georgia Ports Authority and
the City of Tybee Island and the Resolution to Four Lane the
Tybee Road. The following members of Council were present:
Christopher Solomon, Ansley Williams, Burke Day and Jimmy Brown.
Mayor Parker was in Atlanta meeting with the Governor and
Councilman Locklear was in Athens, Ga. at the Leadership
Institute for Government.
Mr. Charles Griffen of the Georgia Ports Authority explained
that the Memorandum of Agreement spells out the responsibilities
that the City agrees to concerning the Savannah Harbor Deepening
Project. (Copy of this agreement is attached to minutes.) Changes
need to be made on agreement concerning the signatures, title
should be Mayor not Commissioner. Councilman Williams moved to
adopt the agreement. Councilman Day seconded. Vote by Council
unanimous.
Councilman Williams asked that could decisions be made
concerning items directly related to the Savannah Harbor
Deepening Project. Mayor Pro tem Youmans stated that if the item
has not been advertised as required then it can not have a
decision from Council.
Councilman Williams asked if visitors would be allowed to
speak. Mayor Pro tem Youmans answered that only two items have
been advertised for this Special Meeting and after acting on them
he would allow visitor to speak to Council.
City Administrator Rowena Fripp read the Resolution to Four
Lane of Tybee Road. Councilman Williams moved to adopt the
Resolution. Councilman Solomon seconded. Councilman Brown asked
Ms. Fripp to please add the word Georgia to the Resolution. Vote
by Council was unanimous.
Mrs. Berta Adams presented to Council information from the
Beach Task Force. These recommendations will come before Council
for request for action. Mrs. Adams handed out copies of the Olsen
update. There was discussion between Mrs. Adams, Mr. Griffen and
the City Council. Mayor Pro tem Youmans thanked Mrs. Adams and
Mr. Griffen for their input.
Councilman Brown made a motion to adjourn as there was no
further business to come before Council. Councilman Williams
seconded.

MEMORANDUM OF AGREEMENT
between
THE GEORGIA PORTS AUTHORITY
and
THE C:1'1 'Y OF TYBEE ISLAND, GEORGIA
to contribute funds for
Performing "Reasonable and Prudent Measures"
required by the
SAVANNAH HARBOR DEEPENING PROJECT
This MEMORANDUM OF AGREEMENT (hereinafter referred to as the "MOA ",
entered into this /0 day of August, 1993, by and between the GEORGIA PORTS
AUTHORITY (hereinafter referred to as the Local Sponsor), an agent of the State of
Georgia, acting by and through the Executive Director of the Georgia Ports Authority
and the City of Tybee Island, Georgia, acting by and through the Mayor and Council
(hereinafter referred to as the "City of Tybee "),
WITNESSETH, THAT:
WHEREAS, construction of the Savannah Harbor Deepening Project was
authorized by the Water Resources Development Act of 1992, Pub. L. 102 -580;
WHEREAS, Section 101 of the Water Resources Development Act of 1986, Pub.
L. 99 -662, as amended, specifies the cost - sharing requirements applicable to the Project;
WHEREAS, Section 221 of the Flood Control Act of 1970, Pub. L. 91 -611, as
amended, provides that the construction of any water resources project by the Secretary
of the Army shall not be commenced until each non - Federal interest has entered into a
written agreement to furnish its required cooperation for the project;
WHEREAS, the Local Sponsor has the authority and capability to furnish the
services defined within the project Local Cooperation Agreement and is willing to
participate in cost - sharing and financing in accordance with the terms of the Agreement;
WHEREAS, the Local Sponsor desires to obtain the assistance of the City of
Tybee in performing the Savannah Harbor Entrance Channel Deepening Project related
"Reasonable and Prudent Measures" set forth in the U.S. Army Corps of Engineers
Savannah Harbor Design Memorandum. These "Reasonable and Prudent Measures"
define the necessary and appropriate activities required during placement of dredge
material on Tybee Beach.

NOW, THEREFORE, THE PAR'1'lE;S AGREE AS FOLLOWS:
1. The City of Tybee will monitor Tybee Beach during fill placement
construction for loggerhead sea turtle nests and relocate all discovered nests in
accordance with Georgia DNR requirements.
2. The City of Tybee will enforce their lighting ordinance for protection of the
nesting habitat of sea turtles, including the southern end of Tybee Beach during fill
placement.
3. The City of Tybee will be responsible for completing the following:
• During beach fill placement construction, if sand compaction measures
greater than 500 cone penetrometer index units (cpu) occurs, nourished
beaches will be plowed to a depth of at least 36 inches immediately
following completion of the beach fill operations. Sand compaction
measurements are to be taken in February for at least two consecutive
years following beach fill placement. If compaction exceeds 500 cpu, the
beach must be tilled. If tilling is necessary, it will be completed by the end
of February.
• Escarpments in excess of 18 inches extending more than 100 feet in length
and exceeding 500 cpu will be mechanically leveled to the natural beach
contour. If leveling is needed, next relocation procedures will be followed
as stated in Item 1 above. If escarpments in excess of these criteria reform
in the two subsequent nesting seasons, they will be leveled to the natural
beach contour as described above prior to May 1.
4. The City of Tybee will coordinate and install necessary sand fencing and
plant natural vegetation in accordance with the beach fill placement operations to
maintain erosion control. All fencing and vegetation planting will be coordinated with
and approved by the Georgia DNR.
5. The City of Tybee will develop a report describing the actions taken to
implement Items 1, 2, 3, and 4 above and submit to the Georgia DNR within 60 days of
completion of the proposed work for each year when activity has occurred. This report
will include dates of actual construction activities, names and qualifications of personnel
involved in nest surveys and relocation activities, description and location of hatcheries,
nest survey and relocation results and hatching success of nests.
6. The City of Tybee, upon locating a dead, injured, or sick endangered or
threatened species specimen, will notify the nearest Fish and Wildlife Service Law
Enforcement Office (912 - 652 -4036) and the Georgia Department of Natural Resources
(Weekdays 8:00 a.m. to 4:30 p.m.: 912 - 264 -7218 or 1- 800 - 272 -8363; nights and weekends:

1- 800 - 241 - 4113). Care will be taken in handling sick or injured specimens to ensure
effective treatment and care in handling dead specimens to preserve biological materials
in the best possible state for later analysis as to the cause of death.
7. The City of Tybee will furnish project support personnel on matters of
public safety, security police and emergency medical responses at no additional cost to
Local Sponsor.
8. The maximum limit of the Local Sponsor's compensation to the City of
Tybee is $32,720 for all materials, labor and equipment required to implement the
"Reasonable and Prudent Measures" defined in Items 1, 2, 3, 4, 5, and 6 above.
9. The City of Tybee will produce a monthly summary accounting report of
all project related expenditures to the Local Sponsor by the 10th of each month.
IN WITNESS WHEREOF, the parties have executed this Memorandum Of
Agreement as of the day and year first written above.

RESOLUTION
WHEREAS, THE CITY OF TYBEE ISLAND, GEORGIA is the eastern
terminus point for U S 80, State Route 26; and
WHEREAS, This highway is heavily traveled seasonally by
visitors and tourists unfamiliar with the area; and
WHEREAS, The natural traffic flow on this roadway is
influenced primarily by beach visitation, thereby creating
congestion and hazardous traffic conditions on a regular basis;
and
WHEREAS, There have been, according to the Chatham County
Police Department, 345 major accidents on U S 80 between the
towns of Thunderbolt and Tybee Island since May 1990, including
at least three fatalities in the past sixty days;
NOW THEREFORE BE IT RESOLVED, AND IT IS HEREBY RESOLVED BY THE
MAYOR AND COUNCIL IN OPEN MEETING ASSEMBLED, THAT THE CITY OF
TYBEE ISLAND, GEORGIA THROUGH ITS ELECTED OFFICIALS, GO ON RECORD
AS REQUESTING THE IMMEDIATE WIDENING INTO FOUR LANES OF U S 80,
STATE ROUTE 26 BETWEEN THUNDERBOLT AND TYBEE ISLAND; AND
BE IT FURTHER RESOLVED THAT THE ROADWAY BE MADE INTERMODEL BY THE
INCLUSION OF A TRAIL FOR PEDESTRIANS AND BICYCLISTS IN
PREPARATION FOR THE SAVANNAH AREA'S PARTICIPATION IN THE 1996
OLYMPIC GAMES AS WELL AS FOR THE SAFETY OF THE PUBLIC AND
ENHANCEMENT OF THE ISLAND'S MAJOR INDUSTRY, TOURISM.
