Lowenbach and..John_W. Pumphr.ey_._ Absent. from-the. meeting was. Councilman George F. Hammerly. - , Upon Motion. of_. Councilman . Lowenbach; -seconded. by .Councilman_Leach IIthe_ dinutes of the previous.-.meeting__were_ approved. with.the-.following insertion (1). insert name_,of_,Mr. Paul._Leach_in..lieu...of -Mr. Leach under Petitioners. Virginia,. .at.. a meeting held August 14, 1961, did. by Resolution authorize the .issuance of bonds of the Town. of Leesburg. for_-the . aggregate..principal_.amount c: of $9,080.00 , to finance the cost of acquiring._a water. .line. and ap- purtenances extending from the terminus._of the existing water line at the Loudoun County High School..to .the...property. line of the .sub- division known. as Dry Mill. .Subdivision.,_ and _ • _ WHEREAS,1 said bonds if. discounted.. by .the holder at_ 4,.0% would amount to, $2154.10 in interest for the.term_ of the bonds , THEREFORE, BE IT RESOLVED, that • the. Utility_Committee of .this_.Council I _ be authorized_and directed . to offer the .present-. owner.s . of said-.water line and appurtenances the_ cash sum_of $7000.00 as_ settlement in.full. ,, , Upon Motion of Councilman_ Caulkins;. seconded .by Councilman Lowenbach and there being .no objection to a roll call vote _the following..resol- ution was -defeated.. Upon. Motion of Councilman_.Leach;_ seconded .by Councilman._Lowenbach=and there .being no objection to a roll. call vote ' the following_,r.esolution • IIwas unaminously defeated. WHEREAS, the. Town of Leesburg. was. granted..a Use P.ermit_by the Board of Zoning Appeals of Loudoun: County :to operate a. sanitary_.land_fill on_their•.property. located at =Watson Vir.ginia;_ subj.ect _.to. certain::con- • ditions therein imposed.; and - - • - _ WHEREAS, an appeal-was granted from. said .decision_of the Board of Zoning Appeals by the Circuit Court.. for. Loudoun. County, Virginia,__and a decree was entered by said .Court. appointing_ a referee to . take. testimony .and. make a report and recommendation;.;and • „ . 22 - • WHEREAS, the Town of Leesburg and the Appellants are. desirous of settling this matter_ without further litigation, and have agreed _ that._if_ the Town of Leesburg would operate the_ said. landfill.. according. to the conditions as hereinafter set forth, in addition .to those_imposed under_the Use P'ermit , . the Petitioners .will withdraw their._.appeal; BE IT THEREFORE RESOLVED, by the Council for the Town .of Leesburg, that the Town Attorney. be, and he is hereby. authorized :to .enter into a decree which will impose the following_ conditions.. on. the use and operation of the landfill., _as follows: ( 1) The Town .of Leesbur.g. will..erectan -eight. foot high solid board fence along its property frontigg_ on_ State Route 625. (2) The Town of. Leesburg will leave ..al'll. natural. screening materials along the north, west and south. property lines. • (3) The Town. of Leesburg will_erect fences .ar.ound. the working_ area as required by the Use Permit.- BE ermit.BE IT FURTHER RESOLVED, that the Town. Attorney. be, and.:he:ia. hereby directed to enter into said decree , in .which. the Town will_ pay: all Court costs which have accrued .in. this matter, and which decree will_conclude: any. further, litigation. between .the parties. thereto. • - Upon Motion of Councilman Pumphrey; seconded by Councilman Lowenbach and there being no objection to a. roll_ call vote the following. resolution.was passed. Yeas, Councilmen C'aulkins, Leach, Lowenbach .and Pumphrey.; _Present Councilman Babson. WHEREAS, the Council. for the Town of Leesburg,.._ in. Virginia, .did , at. a• regular business. meeting held, on February 23, 1951, accept the..plan of street main- tenance under the provisions of Section..33-50.1 of the Code of Virginia., and WHEREAS, this. Section provides for the addition of. not_ more than one-quarter of a mile into the State System per year , and WHEREAS, this system is no longer to the best advantage of the . Town of Leesburg, THEREFORE, BE IT RESOLVED, by the Council: of the Town .of Leesburg, in Virginia, that the Virginia.Depar.tment • of Highways. be,. and: they. ere hereby notified , that the Council agrees to accept the following plan as outlined under Section 33-50.4 of theeCode of Virginia:: • 33-50.4 MAINTENANCE, ETC. , BY STATE HIGHWAY COMMISSIONER WHEN NO REQUEST FOR ALLOCATION. If no request is made to the State Highway.Commission. of Virginia by the governing body of any such_town. as herein. provided for .an allocation of three .hundred dollars per mile, the. State Highway Commissioner is authorized and empowered , subject to the approval_ of the State High- way Commission, to maintain, improve, construct and reconstruct all. str.eets• in such incorporated town having. an unrestricted right of way.width of not less than. thirty feet and a hard surface width of. not less. than twelve., feet. and such. streets hereafter. established . by said incorporated town having .a right • of way width. of_ not less than_twenty feet. . by. slid incor- porated town having a right of way width. cif not less than. fifty. feet and . a hard' surface. width of not less: than twenty feet. (1950, p. 162) Upon Motion of Councilman_ Lowenbach; seconded by Councilman Pumphrey and there being no. objection' to a roll call...vote the following. resolution.was passed. Voting, Yeas, Councilmen, Caulkins., Leach,. Lowenbach and Pumphrey. Nays, Councilman Babson. RESOLVED, by the Counoil of the Town of Leesburg, in .Virginia., that .the Auditor-Treasurer be, and he is hereby authorized, and directed , to charge off"the• 1961 taxes assessed against the. Leesburg. Volunteer.Fire Company in 'the amount of Twenty one dollars .and. forty-two. cents (.$21.42) • There being no further business to come before the Council. at this time and upon motion of Councilman. Lowenbach; seconded by Councilman Pumphrey the meeting adjourned .at 8:30 P.M. Sat
