Meeting to order at 7:30 P.M. in the Council Chambers , Leesburg, Virginia. ' Councilmen present were George J. Babson, Stanley F.- Caulkins , George P. Hammerly and John V. Pumphrey. Hunter M. teach arrived. at :Q:35 P.M.; Maurice ' . R. Lowenbach .arrived_ at 7:43 P.M. . The Minutes of the previous meeting. were approved as read. II The Mayor'. s Report was given. The Town Manager gave his report. Upon Motion. of Coundilman .Lowenbach; seconded by Councilman- Caulkins ' and there being..no objection. to a. roll call_.vote the following..motion was defeated . Votings Yeas, Councilmen .Caulkins.__Hammterly. and , ' Lowenbach;: Nays , Councilmen Babson,. Leach. and Pumphrey. WHEREAS, The Town of Leesburg is in need._of_an. additional water supply and is desirous of obtaining . a well fr.om. Mr. Lucas. D'.. Phillips . and 00 Mr. William WI. Nickels , and t- WHEREAS, it is within the best interests of. the .Town to know the quality and quanity of this water supply • z NOW THEREFORE, BE IT RESOLVED , by the Council for the Town of .Leesburg in Virginia, that the Town Manager is.. authorized to. proceed with the necessary arrangements to have the tests conducted , and .is authorized to spend not more than $2350.00 from. the. Utility Fund , for suchtests and other necessary items to conduct.. such' tests. - Upon. Motion of. Councilman. Lowenbach; seconded -by. BE IT RESOLVED, by the Council for. the Town of Leesburg., .in_Virginia, that the Treasurer be, and_he. is hereby authorized .and empowered to execute a check in. the amount..of-Nine Thousand :Eighty Dollars .($9.,080.) payable.to E. Frank Myers and G. Shirley Myers,. but delivery of said check shall,be made only...under _.the following conditions: 1. That E. Frank Myers and G. Shirley Myers shall have paid by ' cash or certified check. to the Town of Leesburg , the face value of $$9,080.00) of the non-inter.est. bearing..notes. issued..by the Town of Leesburg to thensaid E. Frank:Myers and G. Shirley' Myers;• and 2. The delivery of an instrument conveying._the water line_ and appurtenances under the existing agreement. with. the. said. E. Frank Myers and -G. Shirley Myers4 aaid instrument to be subject to prior approval of the Town Attorney. . • Upon Motion of Councilman Lowenbach; seconded _bq Councilman Leach and ' there being no objection to a roll. call vote the .following resolution was unaminouslypassed. • BE IT RESOLVED, _by the -Town Council of the Town of Leesburg. in Virginia that the Auditor-Treasurer be, and is hereby authorized and directed to distribute and pay the. participants :in the .Route_ 7_ - Parker.. Road. Sanitary Sewer Fund, according to the ratios as established .by the. Loudoun IINational..Bank of Leesburg, and that the .total..amount disbursed shall not exceed the $345.00 , as received from the.Sunoco Service .Station. as front foot sewerage service. charges. Prior approval of. the Participants would be obtained by the Town Manager_ with respect to the proposed dsitribution ratios. • - : - Upon Motion of Councilman. P_umphr.ey; seconded. by Councilman_Caultins and there being.. no..objection to a roll call vote the following resol- ution, was unaminously passed -.: - . : - . i 24 BE IT RESOLVED , by the Council for the Town of Leesburg , in Virginia, that the Virginia Department of Highways be requested to take into their secondary system for the fiscal year 1961-62, West South. Street to the intersection of South. Wirt Street and North along South Wirt Street for a total distance. of approximately 860 feet or approximately 0.163 miles with a guaranteed minimum R/W' of 40 feet , all as are described in Deed Book 13T' s, page 84, Deed .Book 393, Page 331,. Deed Book 390, • Page 35 and Deed Book. 390, Page 608 of the records in. the. Clerk' s Office of Loudoun County, Virginia. BE IT FURTHER RESOLVED, that the Virginia Department of Highways be re- quested to .take into their secondary system for the . fiscal. year 1961- 1962, Buick Street lying between East Loudoun and East Market Street for a total distance of approximately 212 feet or approximately 0.041 miles , all as are described in.Deed Book 395, page 686, and Deed Book 408 , page 273, of the .records in the Clerk's Office. of Loudoun County, Virginia. Upon Motion of Councilman_ Lowenbach;_ seconded by Councilman .Hammerly the following.!resolution was unaminously. passed. BE IT RESOLVED, by The Town Council. of.. the Town .of Leesburg .An. Virginia, that that certain Act of the Legislature of the. State..of .Virginia. of. 1926 entitled "An Act in. relation to local taxes and. revenues for purblic free school purposes in the County of Loudoun" should. be repealed , in that the circumstances existing at the time of this legislation have materially changed and that. the purpose for which. this increased, revenue was needed by the School Board of. Loudoun County has passed.,: and that the circumstances of this .Town have changed materially in. that the' said Town must now provide many services, such as sewer , .water and police protection, which were not being provided at that time., and the revenue which is removed from said Town's budget by said Act of Legislature is now sorely. needed by the Town of Leesburg. ,,,Mr. Jesse Jones representative of the -Koohtz Equiptment Company presented to the- Council recommendation for Parking. in the Town. of Leesburg. ' Upon Motion of .Councilman .Caulkins; .seconded by Councilman .Lowenbach and there being no objection. to a roll call .vote the following .resolution was passe. Voting, Yeas,. Councilmen Caulkins., Hammerly., Leach, Lowenbach, Pumphrey and Mayor Raflo; Nays, Councilman Babson. WHEREAS, the Town of Leesburg is desirous of providing adequate traffic flow and parking within. the- Town THEREFORE, BE IT RESOLVED, by the Council for the ,Town of Leesburg, in Virginia, that a select committee known as the Traffic and Parking Committee , be created consisting of two members of the Council, appointed by the Mayor, .and that said . committee study the overall downtown traffic flow patterns and overall parking situation and report its. findings and recommendations to the Council, at its leisure. The Mayor appointed Councilman Caulkins andCouncilman Pumphrey to the Traffic and Parking Committee. • Notice was given by the Mayor of a special. meeting on Thursday , November 16.; 1961 at' 8 P.M. . Upon Motion of. Councilman_ Hammerly; seconded by Councilman Lowenbach and there being no objection to a roll call vote the following resolution was defeated. Voting .Yeas, Councilmen, Hammerly and Lowenbach• Nays, Councilmen Babson, Caulkins and Pumphrey; Present Councilman Leach. • BE IT RESOLVED by the Town Council of the Town of Leesburg in. Virginia, that the Town Manager be and he is hereby authorized to set water meters and to supply water to lots 1, 2, 3, 4, 6, 7, 8, 9, and 10 located on Wage Drive, Leesburg, Virginia. There being. .no further business to come before the Council .at this time and upon Motion of Councilman Pumphrey; seconded by Councilman- Leach the meeting adjourned at 9:45 P .M. of t "
