Minutes of, the Regular Meeting of the Leesburg Town Council., April 23, 1962
' A regular meeting of the Leesburg Town Council was held on
April 23 , 1962 in the Council Chambers, Leesburg, Virginia.
Mayor Frank Raflo called the meeting to order at 7: 30 P.M.
Councilmen present were George J. Babson, Stanley F. Caulkins, George
P. Hammerly, Hunter M. Leach, Maurice R. Lowenbach. and John P. Pumphrey.
Upon motion of Councilman Pumphrey seconded by Councilman Lowenbach
the minutes of the April 9, 1962 meeting were approved as read with
general agreement of the Council members.
The Mayor gave his report to the Council. '

The report of the Town- Manager was given. •
Upon Motion of Councilman Lowenbach; seconded by Councilman
Caulkins and there being no objection to a roll call vote the following•
resolution waseunaminously approved . Voting Yeas, Councilmen Babson,
Caulkins , Hammerly, Leach, Lowenbach and Pumphrey.
BE IT RESOLVED, by the Council for the Town of Leesburg, in - •
Virginia, that the appropriations for Fiscal Year 1962, as originally
passed by Council on June 12 , 1961 and subsequently thereafter, be
further amended as follows, and
BE IT FURTHER RESOLVED , that the following sums of money, or as
much thereof es may be authorized by law, or as may be needed or deemed
necessary to defray all expenses and liabilities of the. Town of Leesburg,
be and the same are hereby appropriated for the corporate purposes and
objects of said Town and. said appropriations shill be paid from current
revenues:

Upon Motion of Councilman Caulkins, seconded by Councilman Lowen-
bath and there being no objection to a roll call vote the following'
resolution was approved . Voting Yeas, Councilmen Caulkins , Hammerly,
Lowenbach and Pumphrey. Nays , Councilmen Babson. and Leat!;:-.;'.
WHEREAS, Mr. H. H. Harris, Commissioner of the Virginia Department
of Highways ,- did by letter dated March 27, 1962, advise that $125,000
has been allocated by- the Commission toinitiate the financing of the
Leesburg By-Pass , and •
WHEREAS , by this same letter the Commissioner also advised that
$75,000 was available for a one-way street system in the Town of Lees-
burg and that this $75,000 can be applied to the By-Pass fund if it is
the desire of.,,the Town Council of Leesburg,
THEREFORE, BE IT RESOLVED, by the Council for the Town of Leesburg,
in Virginia,_ that the Commissioner of Highways be and is hereby requested
to transfer, the $75,000 designated for a one-way street project' for the
Town to the original By-Pass allocation of $125,000, thereby making a
total initial amount of $200,009 available for the Leesburg By-Pass.
Upon Motion of Councilman Hammerly; seconded by Councilman Caulkins
and there being no objection to a roll call vote the following resolution
was approved. Voting Yeas , Councilmen Caulkins , Hammerly, Leach, and
Lowenbach; Nays , Councilmen Babson and Pumphrey.
BE IT RESOLVED THAT Herbert A. Sumney be and he is hereby offered
the sum of $2000.00 in full payment for the so called Honicon water line
and easements in compromise of the suit pending in the Circuit Court of
Loudoun County , Virginia, against the Town of Leesburg , upon the following
conditions:

1. Dismissal of suit without prejudice.
2. Conveyance by the said Herbert A. Sumney of the water
line and easements relating thereto by instrument,
approved in advance by the Town Attorney , conveying a
fee simple absolute title therein by general warranty
deed .
3. Furnishing a plat as a part of said instrument showing
extension and location of water line and easements.
4. A Title Policy from a recognized Title Insurance Company
insuring that a fee simple title is conveyed to the
Town of Leesburg by said instrument.
5. All costs of preperation of instrument and plat shall
be borne by the said Herbert A. Sumney.
Upon Motion of Councilman Lowenbach; seconded by Councilman
Hammerly and there being no objection to a roll call vote the following
resolution was approved . Voting Yeas , Councilmen Caulkins , Hammerly,
Leach, Lowenbach and Pumphrey; Abstained Councilman Babson.
pr BE IT RESOLVED that the May regular meeting of the Leesburg Town
Cr. Council shall be held at 6:30 P.M. , E.S.T. , in the Council Chambers
U- and General Notice is hereby given.
Upon Motion of Councilman .Leach; seconded by Councilman Pumphrey
and there being no further business to come before the Council at
this time the meeting was adjourned with general agreement at 8: 50 P .M.
