PUBLIC• HEARING , JUNE 11, 1962
Aiduly advertised Public Hearing on the Proposed Budget for the
Fiscal Year 1963 was held in the Council Chambers, Leesburg , Virginia,
at 7:30 P.M. on June 11, 1962. Councilmen presenfor this hearing
were Stanley F. Caulking , George J. Babson, G'eorge P. Hammerly, Hunter
M. Leach, Maurice R. Lowenbach and John W. Pumphrey. Mayor Frank
Raflopresided at the meeting.
There were no interested citizens appearing at the meeting.

Minutes of the Regular Meeting of the Leesburg Town Council, Leesburg,
. Virginia -
A regular meeting of the Leesburg Town Council was held in the
Council Chambers , Leesburg, Virginia on June 11, 1962.

Mayor Frank Raflo called the meeting to order at 7:35 P.M. .
Councilmen present were George J. Babson, Stanley F. Caulkins) George
P. Hammerly, Hunter M. Leach, Maurice R. Lowenbach and John W. Pumphrey.
Upon Motion of Councilman Lowenbach; seconded by Councilman
I. Hammerly the minutes of the May 28 , 1962 meeting were approved with the
`-:-: general consent of the Councilmen.
n Garland Timbrook appeared as spokesman for the VFW at which time
he discussed the plans of that organization to present a carnival in
Leesburg from June 18 thru June 23, 1962 at the Virginia Village
Shopping Center.
' Upon Motion of Councilman Lowenbach; seconded by Councilman
Pumphrey and with the general agreement of the Councilmen the rules
or order Were suspended at this time to consider the resolution on
the carnival for the VFW.
IIUpon Motion of Councilman Hammerly; seconded by Councilman
Pumphrey ,and .there being no objection to a roll call vote the following
resolution was passed . Voting Yeas, Councilmen Caulkins, Hammerly,
Leach, Loiaenbach and Pumphrey. Abstained , Councilman Babson.

BE IT RESOLVED by the Council for the Town of Leesburg, in
Virginia, that the requirements for a• carnival license be waived for
the Veterans. of Foreign War , Post $1177, who will sponsor a carnival
from Junetl8-23, 1962 in the Virginia Village Shopping Center.
Upon Motion of Councilman Lowenbach; seconded by Councilman
Pumphrey and there being no objection to a roll call vote the following
Ordinances was passed. Voting Yeas, Councilmen Caulkins , Hammerly,
Lowenbach, Pumphrey and Maryor Raflo; Nays Councilmen Babson and Leach.
BE IT ORDAINED, by the Council of the Town of Leesburg., that
the following sums of money, or as much thereof as may be authorized
by law, or as may be needed or deemed necessary to defary all expenses
' and liabilities of the Town of Leesburg, be and the same are hereby
appropriated for the corporate purposes and objects of said Town, herein
specified for the fiscal year beginning July 1, 1962 and ending June
30, 1963. .

BE IT THEREFORE ORDAINED, by the Council of the Town of Leesburg,
in Virginia,' asfollows:
Thert' shall be levied and collected in the manner described by
the .ordinandes of the Town and laws of the State of Virginia, for the
fiscal year ''beginning July 1, 1962 and ending June 30, 1963, and also
for each andevery year thereafter, until otherwise changed , for the
support of the Town Government, .the payment of interest on the town •
debt and for other municipal purposes , taxes .as follows:
(1) ion all taxable real estate and tangible 'personal property,
including the tangible personal property separately classified
by Sections 58-829.4 58-829.2 and 58-829.3 of the Code of
Virginia, shall be taxed at the rate of Eighty Five Cents II
($0.85). on every One Hundred Dollars ($100.00) of the assessed
value thereof. _
(2) On the tangible personal property and real estate of all
railroads , express , telegraph, telephone, power, light
,companies and other public service corporations shall be
.'taxed at the rate of Eight Five Cents ($0.85) on every
One Hundred Dollars ($100.00)• of the assessed value thereof.
(3) Any person who shall fail to pay to the Town Treasurer on
for before December 5th of each year the personal property .
:and real estate tax then due and payable, shall pay a
penalty of Five Per Cent ( 5%) on the amount of the unpaid
tax and interest at the rate of Six Per Cent ( 6%) per annum
. shall be collected upon principal and penalties of all such
!taxes and levies remaining unpaid from the 30th day of June
!of the year next following the assessment year; and , .
BE IT FURTHER ORDAINED, that any bank, as defined in Chapter 10,
Title 18, of4. the 1950 Tax Code of Virginia, and located in this 'Town, shall
deliver annually beginning with the calendar year 1963, to the Treasurer
for the Town• of Leesburg , a copy of the report which such bank is re-
quired by said Chapter to furnish to the Commissioner of Revenue for the
County of Loudoun; and , 11.

BE IT FURTHER ORDAINED that there is hereby imposed a tax at
the rate of Eighty Per Cent (80% ) of the State rate of taxation oil
each Ocie Hundred Dollars ($100.00) of the taxable value of the shares
of stock in such banks located in this Town, and the Treasurer shall
annually make such assessments accordingly.

BE IT: FURTHER ORDAINED that an additional sum of $5616.50 be •
and the same. is hereby appropriated from unappropriated surplus from
fiscal year 1962 to the general Fund for the purposes of fiscal 1963.
' BE IT FURTHER ORDAINED, that the following sums be and the same.
are hereby appropriated form the utility fund: •

This Appropriation shall consist of the entire Bevenue from the
Utility Fund for the. Fiscal Year 1963 plus the unappropriated Surplus
as maybe required for the above expenses. .

Upon Motion of Councilman Lowenbach; seconded by Councilman
Pumphrey and there being no objection to a roll call vote the following
Ordinance was passed. Voting-Yeas, Councilmen Caulkins , Hammerly,
Lowenbach, Pumphrey andMayor Raflo. Nays , Councilmen Babson and Leach.
BE: IT ORDAINED BY the Council Of the Town of Leesburg , in
Virginia, that the following Budget for. Fiscal Year 1963 is hereby
adopted for the purpose of fiscal planning.. -

Robert Grubbs as spokesman for the Loudoun County Rescue Squad
II appeared before the Council and advised them of the Loudoun County •
Rescue S'quad' s desire to. locate a rescue vehicle in Leesburg and
asked the Council for help in doing same.
Upon Motion of Councilman Lowenbach; seconded by Councilman
Caulkins and there being no objection to a roll call vote the following
resolution was passed.. Voting Yeas ,. Councilmen Babson, Caulkins,
Hammerly , Leach, Lowenbach and Pumphrey.
BE. IT RESOLVED, by the Council for the Town of Leesburg, in
Virginia; that the proposal to purchase a tract of land from Lucas
pp D. Phillips and William W. Nickels in the eastern section of the Town
G; of Leesburg, which said land is circular in shape and measures by a
N radius of sixty feet from the well located thereon, and an easement
=:-' ten feet in width

the boundary line with Walter Phillips
CC to Washington Street, and an additional five foot easement to be
obtained from the Aetna Building and Supply Company paralleling and
running With the said - easement, which said easements are- for the
purpose of ingress and egress and the installation of water and public
utility lines , and the proposal to utilize the well thereon_f:or a
town water supply, and to erect a pump house , be, and the same is here-
by referred to the Planning Commission for teport and recommendation
to the Council, pursuant to Section' 15-909 of the Code of Virginia of
1950, as amended . .
' - Upon Motion of Councilman Hammerly; seconded by Councilman
Pumphrey and there being no objection to a roll call vote the following
resolution was passed. Voting Yeas, Councilmen Caulkins , Hammerly,
_ . .,_. Lowenbach, Pumphrey and Mayor Raflo; Nays , Councilman Babson;;
Abstained , Councilman Leach.
WHEREAS , the U. S. Army Corps of Engineers is proposing the
construction of a Potomac River Dam at Seneca Creek, and
•
WHEREAS, this proposed dam would be detrimental to the economic
stability .of the Town and is therefore undesirable,
•
THEREFORE , BE IT RESOLVED, by the Council of the Town of
Leesburg, in Virginia, that Chief of the Corps of Engineers be so
notified by copy of this resolution showing the position of the .
Council 'as being opposed to the proposed Seneca Creek dam and reser-
voir.. i -
"Upon Motion of Councilman Lowenbach; seconded by Councilman
Hammerly and there being 'no objection to a roll call vote the following
resolution was passed. Voting Yeas , Councilmen Caulkins , Hammerly,
Leach, Lowenbach and Pumphrey; Nays , Councilman Babson. -
BEIT RESOLVED by the Council for the Town of Leesburg, in
Virginia, that the entire length of Washington Street , as shown on
the plat 'of the Lowenbach Subdivision in Deed Book 8 Q, Page 436
be and the same is hereby accepted as a public street.
Upon Motion of Councilman Babson; seconded by Councilman:Hammerly,
and -since there was no further business to come before the Council at
this .time the meeting was adjourned at 8: 50 P.M. with the general
consent of the Council.
