A duly advertised Public Hearing on the Proposed Gibson Heights Vacation as advertised was called to order by Mayor Frank Raflo at 7:00 E.S.T. Councilmenapresent were Stanley F. Caulkins, George P. Hammerly, Lynwood Lay,/Hunter M. Leach, Maurice R. Lowenbach and John W. Pumphrey. Since there were no interested citizens appearing for this proposed vacation it was transferred to New Business on the Regular Agenda for October 1, 1962. • • Upon Motion of Councilman Pumphrey; seconded by Councilman Lowenbach the Public Hearing was adjourned at 7:10 P.M. E.S.T . Minutes of the Regular Meeting of the Leesburg Town Council, October 1, 1962 A Regular meeting of the Leesbug Town Council was held in the Council, Chambers , Leesburg , Virginia on October 1, 1962. Mayor Frank Raflo called the meeting to order at 7:25 E.S.T . Councilmen present were Stanley F. Caulkins, George P. Hammerly, Lynwood Lay , Hunter M. Leach, Maurice R. Lowenbach and John W. Pumphrey. Upon Motion of Councilman Th.zmphrey; seconded by Councilman Lowenbach the minutes of the September 10, 1962 meeting were approved as read with the general consent of the members . Mr. Sterling M. Harrison appeared before the Council and presented a Petition, bearing approximately ninty names , in which a request of a Public Hearing on the Air Port be held in the Circuit Court Building on September 15, 1962. The Mayor gave his report. The Town Manager gave his report . Upon Motion of Councilman Lowenbach; seconded by Councilman Pum- phrey the following resolution was approved by a unaminous roll call vote. BE IT RESOLVED, by the Council for the Town of Leesburg , in Vir- ginia, that the Virginia Department of Highways is hereby requested to accept into their secondary road system, under the provisions of Section 3350.4 of the Code of Virginia of 1950, as amended , the following streets: 1. Prospect Drive, from its intersection with State Route T-1011 , thence in a southeast direction a distance of 495 feet or approximately 0.094 miles , all as is des- cribed in Deed Book 390, page 196, with attached plat and Deed Book 410, page 95, with attached plat , of the records in the Clerk' s Office of Loudoun County, Virginia. 2. Belmont Drive , from its intersection with State Route T-1010 , thence in a easterly direction a distance of 1024 feet or approximately 0.194 miles , all as is described in Deed Book 407, page 393 with attached plat , of the records in the Clerk' s Office of Loudoun County , Virginia. 3. Valley View Avenue , from its intersection with State Route T-699 , thence in a southeasterly direction a distance of 491 feet or approximately 0.093 miles , all as is described in Deed Book 416, page 314 with attached plat , of the records in the Clerk' s Office of Loudoun County , Virginia. 4. fyrlee Avenue , from its intersection with State Route T-698, thence in a westerly direction a distance of 478 feet or approximately 0.091 miles , all as is described in Deed Book 410 , page 119 with attached plat , of the records in the Clerk' s Office of Loudoun County, Virginia BE IT FURTHER RESOLVED, that these streets be considered with the request. of Council on June 25, 1962. 1 0 Upon the Motion of Councilman Pumphrey; seconded by Councilman Caulkins the following resolution was unaminously approved by a roll call vote. WHEREAS, Chapter 5, Section 5-2 of the Charter for the Town of Leesburg provides for two: Issuing Justices , and WHEREAS , only one Issuing. Justice has been appointed and the • need exists for the second , - THEREFORE,. BE If RESOLVED , by the Council for the Town of Lees- ' burg in Virginia that James 0 . French be appointed Issuing Justice for the Town of Leesburg. ' Upon Motion of Councilman Hammerly; seconded by Councilman Pumphrey the following Ordinancen was unaminously approved by a Roll Call Vote. BE IT ORDAINED by the Council for the Town of Leesburg that' the following part of the Plat of Gibson Heights Sub-Dvision, Town of Leesburg, Loudoun County , Virginia, as the same is duly recorded in the Clerk' s Office for Loudoun County in Deed Bbok 370, at page 238 00 be vacated: All of Lots 2 through Lott10, inclusive and the 16 Q; foot access road to lot 10 and all easements and restrictions imposed U., on said lots. :r� CC BE IT FURTHER ORDAINED that the following is excluded from this 02 vacation as •follows: The street designated "Future Street" , now "Gibson Street" and the fifteen foot strip indicated on the plat fronting on Route 698 as "Dedicated for Street Purposes." BE IT FURTHER ORDAINED , that the Clerk of this Council shall file a certified copy .of this ordinance of vacation with the Clerk of the Circuit Court for Loudoun County persuant to the statutes of Virginia.
