Councilmen present were Stanley F. Caulkins, George P. Hammerly, Lynwood Lay, Hunter M. Leach, Maurice R. Lowenbach. and John W. Pumphrey. In the absence of the Recorder, Robert Sharp was appointed recorder pro-tem. 4 The Mayor announced there would be no regular meeting of the ` 'I Council on December 4 , 1962 and that any urgent business would be conducted at a special called meeting. . Councilman Lynwood Lay was appointed to the Hospital Planning Agency by Mayor Raflo. The resignation of Robert Sharp, Town Manager of the Town of Leesburg, was accepted with regrets by the Council. L-: CC Upon Motion of Councilman Lowenbach; seconded by Councilman CC Pumphrey the following resolution was unaminously approved by a roll call vote. . BE IT RESOLVED by the Council. for the Town of Leesburg, in • Virginia, that the Town Manager is authorized to accept the proposal of Southern Pipe Tool Co. dated November ..l2; 1962, for the purchase of a Model SCPS-4 sewer rodder with attachments for the sum of $2650.00. Upon:•Motion' of Councilman Lbwenbacht seconded by Counoilman IIPumphrey the following resolution .was unaminously approved by a roll call vote. BE-IT RESOLVED , by the Council for the Town of Leesburg , in Virginia, that the Auditor-Treasurer be, and ishereby authorized and directed , to charge off the 1962 taxes assessed against the Leesburg Volunteer Fire .Company in the -amount of Twenty-one'dollars and forty-two cents ($21.42) . Upon Motion of Councilman Lowenbach; seconded by Councilman Caulkins the:following resolution was unaminously approved by .a roll call vote. BE -1T -RESOLVED, by the Council for the Town of Leesbir g, in • Virginia, that the Town Manager is authorized to cash the $10,000.00 U. S. Treasury Certificate, due 5/15/63, if the money is needed to meet obligations concerning the drilling and improvement of the well on the Paxton Home Property. . Upon Motion of Councilman Caulkins; seconded by Councilman Hammerly the following resolution was unaminously approved by a roll cAll vote. `4 WHEREAS, the Council for the Town of Leesburg, in Virginia; hitherto, at a regular meeting, held on April 9 , 1962 , referred the .question of the following amendments to. the Planning Commission for the Town of Leessburg; in Virginia, -for the purpose of holding a public hearing on such question and making recommendations as pro- vided by Chapter 28, Section 15-968.5 of the Code of Virginia; and WHEREAS , the said Planning Commission caused _ notice - of a public hearing on the question submitted to it to be published •on •the 13th day of September, 1962, and the 20th day of September, 1962, in the Loudoun Times-Mirror , a newspaper 'published in and having a gen- eral circulation in the own of Leesburg , a notice in accordance with the provisions of Chapter 28 , Section 15-961.4 of the Code of Virginia, that the said commission woud hold .a public hearing on the question referred to it , which public hearing would be held on the 27th day of September, 1962, and which notice designated the time and place of such hearing; and J • X28 • WHEREAS, the 'said Planning Commission did hold such public hearing and heard all persons desiring to be heard on the question of adopting the following amendments to the Zoning Ordinance; and • WHEREAS, the said' Planning Commission thereafter considered the question of adopting the following amendments and at a' regular meeting of the said-Planning Commision held the 4th day of October., 1962 , the . -said Commission duly adopted and • recommended to the Councifor the Town- of Leesburg , in Virginia, the enactment of� the following amendments; and WHEREAS, the said Council for the Town of Leesburg, in Virginia, caused a notice of public hearing on the following amendments to be , published on the 25th day of October , 1962, and the 1st day of . November, 1962 , in the Loudoun Times-Mirror, a newspaper published. in and having a general circulation in the Town of Leesburg, a notice in accordance with the provisions of Chapter 28 , Section 15-961,4 of the Code of Virginia, that the said Council would hold a public hearing on the following amendments , which public hearing would be held on the 12th day of November, 1962, and which notice .designated the time and place of such hearing; and • WHEREAS, the said Council, did hold such public hearing and hear • all persons desiring to be heard on the question of enacting the following amendments to the Zoning Ordinance; and WHEREAS, it is to the best interest of the Town that the following . • amendments to the Zoning Ordinance. be adopted and enforced; NOW, THEREFORE , BE IT ORDAINED by the Council for the Town of Leesburg, in Virginia, that the Zoning Ordinance be amended as follows: • Attached as Schedule Upon-Motion of Councilman Pumphrey; seconded by Councilman Lowenbach the following resolution.was unaminously approved by a roll call vote. • ., • BE IT RESOLVED by the Council for the Town of. Leesburg, in Virginia, that the recommendation is hereby made to the Leesburg Planning Com- mission that the preliminary plat of Exter Subdivision shall be approved since the Council intends to acquire from Anna and Murray. Dyer sufficient land to provide .a fifty foot right-of-way for. Wildman Street to the existing east end of North Street. _ Upon Motion of Councilman Lay; seconded by Councilman Hammerly• the following resolution was unaminously approved by a roll call vote. . WHEREAS, representatives of the Loudoun County HealthmDepartment are willing to conduct a 16 hour course in a Medical Self Help program, which will be offered to residents of Leesburg and Loudoun County, to teach the individual to. give self medical held in. any atomic disaster, • THEREFOR E, BE IT RESOLVED, by the Council for the Town of Leesburg, in Virginia, that the Town of Leesburg will assist in the advertisement and promotion of this program which shall be held at a time and place set by the Health Department • Upon Motion of Councilman Caulkins; seconded by Councilman Pum- phrey the following resolution was unaminously approved by. general consent sof the Council. BE IT RESOLVED, by the Council for the Town of Leesburg , in Vir- ginia, that free parking be, and is hereby permitted on the metered lot and streets of the Town of Leesburg, said free..parking to commence on December 10, 1962 , and to extend through December 24, 1962. The Mayor was authorized by the General Consent of the Town Council to make necessary contacts for obtaining. and interviewing qualified persons for the Postion of Town Manager of Leesburg. _ . 1 2 9 The Applicaton of the Loudoun Properties for an R-3 re- zoning ICKX.1t of 125 acres was referred to the Planning Com- mission for their recommendations with the general consent of the Council. " ' • . . • . . . .. _ '• • . . • . . . • . • , . : • . . _. • ; :.1 - . . . , . . . . . . , • . i . ..r . - • . . - • - • . •- . : . • ' - • - AN ORDINANCE TO AMEND THE ZONING ORDINANCE FOR THE TOWN OF TEF'SBURG Amend Article I, 1-1 to read as follows: 1-1 DISTRICTS For the purpose of this Ordinance the Town of Leesburg is hereby divided into the following districts: "R-1" One Family Residence District "R-2" General Residence District "R-3" Town House Residence District "B-1" Community Business District "B-2" General Business District "M-1" Industrial District The term "R" Districts, as used hereinafter, means the "R-1", "R-2" and "R-3" Districts; "B" Districts means the "B-1" and "B-2" Districts. Amend Article 4 by adding, subsequent to the word "camp" in 4-4-2, the following: ARTICLE 4A - "R-3" TOWN HOUSE RESIDENCE DISTRICT - USE REGULATIONS 4A-1. PERflTTED PRINCIPAL USES 4A-1-1. "P.-1" District permitted principal uses. 4A-1-2. Town Houses as defined in Article 15-1-6-a. 4A-2. PERHITTED CONDITIONAL USES WHEN AUTHORIZED AS A SPECIAL EXCEPTION BY THE BOARD OF ZONING APPEALS UNDER SUCH CONDITIONS AS IT MAY DEThRLUNE WILL NOT BE DETRIMENTAL TO OVER USES IN THE "R-3" DISTRICT. 4-A-2-1. "R-i" District conditional uses 4A-3. PER2fTTED ACCESSORY USES 4A-3-1. None unless lot-use and sizes conform to "R-1" District use regulations in which case "R-1" District permitted accessory uses apply. 4A-i4. PRCHIBIriw USES 4A-4-1. Same as "R-1" 4A-4-2. No building or structure other than a principal structure may be erected or placed on any lot on which a Town house as defined in Article 15-1-6-a has been or is to be constructed. Amend Article 8 by inserting beneath all items in the R-2 District Table of Requirements the following:. R-3 Height Lot Sizes Front Yard Side Yards Rear Yard residence Same as Area. , 20 ft. None except that Least depth when used for R-1 2000 sq.ft. a side yard of 30 ft. Town Houses as Widths 15 ft. shall be defined in 15- ft. provided in conn- 1-6-a. Amend Article 8-2 by inserting subsequent to the word "itself" in 8-2-10, the following: 8-2-11 Town Houses 8-2-11-1 No motor vehicle shall be parked on the front of any lot upon which a Town House has been or is to be erected, nor may any Torn House have attached to its front facade a garage or carport. 8-2-11-2 No more than two contiguous Town Houses shall have the same set-back line, as determined by the front wall of each Town House, and such set-back shall vary not less than 1 foot from the contiguous pair of Town Houses. No two facades shall have the same architectural treatment. 8-2-11-3 Not more than 12 Town Houses shall be included in one structure. 8-2-11-U Area and Density Irrespective of the minimum area;:requirements for Town House lots, density of development shall not exceed 12 dwelling units per gross acre, with "gross acreage" defined as all land within the exterior boundaries of the tract constituting the development, including private lots, private drives, parking areas, walkways, parks, school sites, and such other open space as may be designated for common use by the occupants of the development, and public streets and other public or semi-public use established as part of the tract development plan. 8-2-11-5 Requirements concerning common areas. In connection with Town House developments, and as a condition precedent to the creation of an R-3 district, the owner, or owners of the land within such district shall enter into an agreement with the Town of Leesburg whereunder all such land thereafter sold and having appurtenant the common use of non-public areas not in individual ownership, shall be bound by a restrictive covenant or covenants vhich shall assure that such areas designated for the common use and enjoyment of the occupants of town houses, dlall be maintained without expense to the Town of Leesburg. 8-2-114 The provisions of the two preceding sub-sections, 8-2-1144 and 8-2-11-5 may be waived by the Town Council after referral to the Planning Commission of the Town of Leesburg, and the finding by both bodies that development of the lot or parcel in question by the use of town houses would improve property values on both sides of the street within the block affected; that the same is in conformity -with the master plan of the Town of Leesburg; that provisions exist or will be made for ade- quate traffic flow and parking; and that such lot or parcel to be so develoxied is within an "R-3" District, as herein defined. Add to: ARTICLE 15 - DEFIilITIONS 15-1-6-a. Dwelling, Torm House. A single family dwelling forming one of a series of 2 or more attached single-family dwellings separated from one another by party walls without doors, windows, or other provision for human passage or visibility through such walls from floor of basement to roof, and having roofs which may extend from one such dwelling unit to another, continuously, in whole or in part. Also add to the end of sub-section 15-1-9....," or in the case of a town house, as herein defined, the piece or parcel of land. occupied or to be occupied by it and its yards.
