HomeMy Public PortalAbout1963_01_14 1-313 Minutes of the Regular Meeting of the Leesburg Tbwn Council, January 14, 1963 A Regular Meeting of the Leesburg Tarn Council was held in the Council Chambers , Leesburg , Viirginia on January 14, 1963. Mayor Raflo called the meeting to order at 7: 30 P .M. Councilmen present were Stanley F. Caulkins , George P. Hammerly, Lynwood L. -Lay, Maurice R .Lowenbach and John W. Pumphrey. Absent from the meeting was Councilman Hunter M. Leach. -Upon Motion of Councilman Pumphrey; seconded by Councilman Lowenbach the minutes of the prior meetings were passed with the general consent of the Council Members. Petitioners appearing before the Council this session were E. Frank Myers , III, Frank Caldwell and Robert Sharp. The Mayor gave his report to the Council. .The Acting Town Manager gave his report to the Council. Upon Motion of -Councilman Lowenbach; seconded by Councilman Pumphrey the following Resolution was unaminously approved by a roll • call vote. BE IT RESOLVED by the Council for the Town of Leesburg, in Virginia, that the Town Att rney, George M. Martin, be and he is hereby authorized and directed to sign the following order which is spread in hac verba hereafter. VIRGINIA: IN THE CIRCUIT COURT FOR LOUDOUN COUNTY FRANK FLIPPO , et als ) ) v. ) .AT LAW NO. 2103 ) • THE BOARD OF SUPERVISORS ) FOR LOUDOUN COUNTY, ) VIRGINIA , et al ) - ORDER This cause came -on this day to be heard upon the papers formerly read and upon the suggestion of counsel for all the parties that the subject matter of this suit has'•been settled subject , however , to cer- tain restrictions being imposed by Decree of this Court upon the use of the land constituting the subject matter of this cause , and was argued by counsel. . The Court perceiving no just cause why this suit should not be settled upon the stipulations following: THE COURT DOTH ADJUDGE AND ORDER that the Defendant the Town. of Leesburg , a municipal corporation, or those claiming under them, shall hereinafter utilize the premises mentioned and described in the Bill of Complaint for the disposition of waste materials only if the following conditions shall be maintained in effect:: (1) Effectual screening shall be provided from public view. (2) The area of dumping will be enclosed in such fashion as to prevent papers being blown over surrounding properties . ( 3) Standard land fill practices , including daily covering of the dumped materials , shall be maintained . (4) The use shall be conducted in such fashion as not to pollute any existing stream. WHEREAS , the Leesburg Planning Commission did hold a. Public Hearing on January 3, 1963 , after due publication, to consider the request of Loudoun Properties , Inc. to have rezoned a parcel of r land belonging to Loudoun Properties , Inc . , and have by resolution recommended to the Council said rezoning to be as follows: "Amend the Zoning Ordinance by amending the land use as designated on the Zoning Map to rezone from a General Residence District to a Town House District a Parcel of land belonging to Loudoun Properties, Inc. , containing 125 acres , more or less , lying on the southerly side of Tuscarora Creek and on the westerly side of State Route No 643 , adjoining and bounded_ by said Highway and the lands now or formerly belonging to Stowers , Scott , Catoctin Trading Company, Inc. , Hammerly, other land of Loudoun Properties , Inc. , and the Town of Leesburg ." BE IT THEREFORE RESOLVED , by the Council for the Town of Leesburg, in Virginia, that a Public Hearing be held on January 28 , 1963, at 7:00 P.M. to consider the above recommended amendment and that the Recorder be and he is hereby requested to insert an advertisement to that effect in the January 17, 1963 , and January 24 ,• 1963, issues of the Loudoun Times-Mirror. Upon Motion of Councilman Caulkins, seconded by Councilman • Lowenbach the following resolution was unaminously approved by a roll call vote. 138. BE IT RESOLVED by the Council for the T.awn of Leesburg in Vir- ginia, that the Town Atttorney be and he is hereby requested to submit all necessary instruments to the Loudoun County Planning Commission in order to secure all necessary permits for the construction of and all appurtenances to the new Town well located on the Paxton Home Property. • Upon Motion of Councilman Lowenbach; seconded by Councilman Hammerly and there being no further business to come before this session of the Leesburg town Council, the meeting was adjourned with general consent at 8:40 P.M. 4 Mayor Recorder • . • • • • • • 1 • 1
