Tybee Island City Council
October 14, 1993
The regular meeting of the City Council was opened by Mayor
Walter Parker at 7:30 P.M. The following members of Council were
present: Christopher P. Solomon, Jack Youmans, James P. Locklear,
Ansley Williams, . Burke Day, and Jimmy Brown. City Attorney
Edward Hughes was present.
Mayor Parker asked Reverend Grabie Page to give the
Invocation with the Pledge of Allegiance being recited by the
audience.
Mr. Nicholas Musolino was the first visitor to speak to
Council on a request for a Revocable license for 27 Pulaski
Street. Councilman Solomon said he had sat in on a meeting with
coastal planners once and that public access needs to be
retained. Mr. Musolino said that the DNR public hearing will be
held sometime in November. As there was no other visitor to
appear before Council Mayor Parker opened the Public Hearing on a
height variance request by Mr. George Spirides for the Ocean
Plaza. The reason for the variance is because of the clock tower
that will be over 35 feet. Councilman Youmans asked if the plans
for this part of the motel is the same as the Ocean Plaza. Mr.
Spirides said yes. Planning Commission recommendation was for
approval of variance. No one spoke for or against the request.
Mayor Parker closed the hearing.
Mayor Parker opened the Public Hearing for the request of a
sideyard setback variance petitioned by the Methodist Church.
Reverend Page said that the variance is needed in order to build
four classrooms and that the church is in business to take good
people and make them better. Councilman Brown asked about the
fire wall. Reverend Page said yes there will be a fire wall.
Planning Commission recommended approval of the setback variance.
Mayor Parker opened the meeting for business legally
presented to council. Councilman Youmans moved to approve the
Revocable license for a dune crossover at 27 Pulaski Street.
Councilman Williams seconded. Vote by Council was unanimous.
Councilman Brown moved to approve the height variance
request for Ocean Plaza, Mr. George Spirides. Councilman Day
seconded. Vote by Council was unanimous.
Councilman Locklear moved to approve the sideyard setback
for the Methodist Church. Councilman Solomon seconded. Vote by
Council was unanimous.
Councilman Youmans moved to approve preliminary sketch plans
for Mr. Allen Hendrix. Councilman Williams seconded. Councilman
Day asked if the environmental study had been complete. Acting
zoning Administrator Angela Byers answered yes, it is in and it

is fine.
Councilman Brown moved to table any decision on the
Christmas decorations until we have an answer from Savannah
Electric about what the city can put on poles. Councilman
Locklear seconded. Vote by Council was unanimous.
Councilman Locklear moved to appoint Angela Byers as Zoning
Administrator as she has done a great job as Acting Zoning
Administrator. Councilman Day seconded. Councilman Youmans stated
that there is no reason for the appointment now when all
appointments will be done in January 94. Vote by Council
unanimous.
Councilman Youmans moved to adopt the Resolution on Georgia
Coastal Boundaries. Councilman Solomon seconded. Mayor Parker
explained that we are mandated by law to be a member of the RDC.
Vote by Council was unanimous.
Minutes of the September 9th and 28th meetings were approve
and accepted as read.
The bills for the month of September were reviewed, found in
order, and recommended to be paid. Mayor Parker stated hearing no
objections, they stand approved as follows:

Councilman Williams moved to approve a special event request
from Thirstee's to hold a Halloween Carnival on October 29th and
30th. Councilman Youmans seconded adding that Lewis Avenue should
be closed to traffic, except for residents on October 30, 1993,
because of Trick or Treating by children. Vote by Council
unanimous.
Councilman Youmans moved to approve a request made by the
U.S. Army for a Hail and Farewell party to be held on October 16,
1993 on the beach. Councilman Solomon seconded. Vote by Council
unanimous.
Councilman Solomon made a motion to accept a Caboose from
the railroad. Councilman Youmans seconded. Mayor Parker appointed
Councilmen Youmans, Locklear and Williams to look into the
location that the caboose could be place. Mrs. Faye Lucas has the

information needed for Mrs. Fripp to write letter of request.
Councilman Youmans said it would be ideal for a visitor's center.
Councilman Day questioned the upkeep of the caboose. Vote by
Council unanimous.
Councilman Williams moved to table the tree inventory.
Councilman Youmans seconded. Vote by Council was unanimous.
The following correspondences were read: Letter from Mr. Don
Wildi commending the police department; a report from Olsen
Associates; GMA notification of hospital insurance increase of
premium; Coastal RDC concerning zoning review, Councilman Youmans
asked if the Council needed to act on this proposal from RDC. Mrs
Fripp said letter is just for information and that she would get
estimates before contracting for review.
Councilman Youmans moved to approve Code Section 8- 2 -11(d) &
4- 2 -23(c) Building and Existing Codes for second reading, even
though DCA recommended against ordinance. Councilman Day
seconded. Councilman Solomon stated that this was not the same
ordinance that was read at the last meeting for the first time.
Vote by Council unanimous.
Councilman Day motioned to approve Section 3 -2 -2 Taxation
and Revenue on seconded reading. Councilman Locklear seconded the
motion. Councilman Youmans asked that the last line in subsection
(a) be change to shall instead of may. This was agreed on by
council. Vote by Council was unanimous.
As there was no further business to come before Council
Mayor Parker adjourned the meeting.

REVOCABLE LICENSE FOR DUNE CROSSOVER STRUCTURE — 27 Pulaski Street, Tybee Island
The undersigned applicant hereby requests permission from the City of Tybee Island,
Georgia, to construct a dune crossover structure for the purpose of erosion control
and protection of certain waterfront property located within said city limits since
a portion of the proposed project may encroach upon the sand beaches within th:: city
limits of said municipality. The undersigned understands that the issuance of such
a permit does not relieve the applicant of the obligation to obtain additional auth-
orization from the State of Georgia.
The undersigned further recognizes and agrees that this license does not confer upon
the undersigned any rights, title, estate or interest in said licensed premises; nor
does this license agreement confer upon the undersigned a license coupled with an
interest or easement. This license merely gives the undersigned a revocable privi-
lege, it being expressly understood and agreed that, regardless of any improvements
or investments made, expense and harm incurred or encountered by the undersigned, thi
agreement shall be subject to revocation, cancellation or termination, this license
shall be null and void.
The undersigned shall further indemnify and save the City of Tybee Island free and
harmless from any and all liability, loss, cost, damage or other expense from accider
or damage, either to itself or to the persons or property of others which may occur
by reason of the exercise of the rights and privileges herein granted by this licensE
The undersigned applicant further recognizes that the City of Tybee Island does not
grant permission to proceed with such project unless and until a Shore Assistance.
Permit is issued and a copy of same is filed with the Clerk of Council of said city.

R E S O L U T I O N
WHEREAS, the coastal counties of Georgia make up an integral
environmental region with unique resources, development
opportunities and resources management concerns; and
WHEREAS, the coastal Georgia region has been served successfully
for many years under one regional planning agency, the
Coastal Georgia Regional Development Center and its
predecessor, the Coastal Area Planning and Development
Commission; and
WHEREAS, the coastal Georgia counties share unique resource
development opportunities and constraints, including
special areas of great value to residents of the
region, state, and nation, such as historical sites,
beaches, estuaries, and barrier islands; and
WHEREAS, the coastal Georgia region must developments impacts of
these resources in determining resources of regional
importance, developments of regional impact, and in
implementing local and regional plans for the future
growth of coastal Georgia; and
WHEREAS, review of development proposals under the coordinated
planning program presently being implemented requires
regional analysis of projects in terms of their
projected impacts on multi - jurisdictional areas and
resources unique to the coast; and
WHEREAS, any attempt to fragment the coast into two or more
regional planning districts each under a separate RDC
would result in costly duplication of planning and
review responsibilities as they apply to resources and
development impacts unique to the coastal environment;
NOW, THEREFORE, BE IT RESOLVED, that the Mayor and
Council of the City of Tybee Island strongly advocates
retaining the coastal counties presently being served by the
CGRDC as one integral regional planning district; and
BE IT FURTHER RESOLVED, that the Mayor and Council of
the City of Tybee Island emphatically urges that the Joint
Senate -House Study Committee include the entire coast as one
planning region in their recommendation to the General
Assembly.

Dear Ms. Fripp:
The Georgia Municipal Employees Benefit System's (GMEBS) Life
and Health Insurance Fund has completed its annual review of
claims experience for the membership. Based on this review, it
is necessary to adjust health insurance rates in order to
maintain premiums sufficient to keep pace with the cost of
health care and to keep the Fund financially sound. This is the
first increase since December, 1992.
Rates for life, accidental death and dismemberment, and
dependent life coverages (as well as short -term disability and
dental if applicable) will remain the same. The new rates are
as follows:

The GMEBS Board and GMA staff realize that many of the Fund's
members are experiencing austere financial times, and
consequently, we are constantly reviewing the, benefit plans to
make cost saving changes which will help to hold; down insurance
costs. GMEBS has been able to hold rate increases significantly
below the annual medical inflation rate due to these changes.
On behalf of the GMEBS Board, we appreciate your continued
support of the GMEBS Life and Health Insurance Fund. If you

AN ORDINANCE OF THE CITY OF TYBEE ISLAND, GEORGIA, CODE SECTIONS
8- 2 -11(d) AND 4- 2- 23(c), TECHNICAL BUILDING CODES AND FIRE SAFETY
CODES.
BE IT ORDAINED, AND IT IS HEREBY ORDAINED BY THE MAYOR AND
COUNCIL IN OPEN MEETING ASSEMBLED THAT THE TYBEE ISLAND CODE OF
ORDINANCES BE AMENDED BY DELETING THE ABOVE -NAMED CODE SECTIONS
AND SUBSTITUTING IN THEIR STEAD IDENTIALLY NUMBERED AND TITLED
SECTIONS TO READ AS FOLLOWS:
Code Sections 8- 2 -11(d) and 4- 2 -23(c)
Common walls that separate two or more units or two or more in
stories in a multiunit structure shall be fire walls and any
deviation from this requirement shall require a petition for
variance before the Tybee Island Planning Commission and City
Council.
(1) In all multifamily structures of two or more units, each
dwelling unit shall be separated by either:
1. A firewall as defined in the latest edition of SBCCI as
meeting four -hour resistance with protective openings of three -
hour resistance (Table 600) and which shall extend from the
foundation and through the roof, unless non - combustible roofing
materials are used forty (40') feet to each side of the wall,
thus by its construction enabling the collapse of a structure on
either side of the wall without collapse of the wall itself.

ii. Each unit shall be fully sprinkled by a system
conforming to NFIPA Standard 13 as modified by NFIPA 231 and
NFIPA 231(c) and installed by a firma holding a valid Georgia
State Competency Certificate.
(2) In those areas designated as V -zones of NFIP maps published
by the Federal Emergency Management Agency, only "ii" above shall
be permitted.

AN ORDINANCE OF THE CITY OF TYBEE ISLAND, GEORGIA,
CODE OF ORDINANCES, PROVIDING FOR THE PROCEDURES
FOR THE COLLECTION OF DELINQUENT TAXES AND /OR
ASSESSMENTS AND FOR SALES IN EXECUTION IN
CONNECTION THEREWITH AND ADOPTING SECTION 3,
CHAPTER 2, TITLE 3, TYBEE ISLAND CODE OF
ORDINANCES, ENTITLED "TAXATION AND REVENUE" WHICH
ORDINANCE IS SPECIFICALLY CUMULATIVE OF ALL OTHER
EXECUTION PROCEDURES PERMISSIBLE BY LAW. SAID
ADOPTED SECTION TO READ AS FOLLOWS:
§3 -2 -3
(a) Taxes on real and personal property and any and all
assessments due to the City may be collected and executions therefor may
issue as provided in §52 of the Charter of the City of Tybee Island,
Georgia.. The City Clerk shall be authorized to designate an agent,
including the City Treasurer, to bear teste in the name of the Mayor or
the Mayor Pro Tem. In addition to the Chief of Police all executions
may be directed to the City Marshal, or other levying officer, and all
sales -err be conducted in council chambers, City Hall, Tybee Island,

(b) Forms for execution procedures shall be substantially as
follows:
1. Consolidated Fi Fa.
2. Levy Notice.
3. Notice to owner, security deed holder or mortgagee.
4. No particular forms or language shall be required for
publication notice, written evidence of sale and /or any other
documents which might be necessary or appropriate in dealing
with the collection of delinquent taxes, executions and
conveyances in connection therewith.
(c) Included within the "costs" collectible as a result of an
execution shall be all costs for advertising the sale of the property
levied upon) all postage and other costs of notices provided to the
defendant in execution or to the indebted party, and all recording costs
and fees.
