REPEAL OF GREENCASTLE ORDINANCE NV. 1992-2,1
PROHIBITION OF OPEN ALCOHOLIC DEVERAGE CONTAINERS IN MOTOR VEHICLES.

WHEREAS, in the last sOssion of th" Indiana General assembly, blouse
No. 1645 was introduced which would have prohibited open alcoholic
beverage containers in motor vehicles. This Dill and various other
amendments offered during the last session of the Indiana General Assembly
were allowed to die in the House Committee without vote.
The Common Council acknowledges that the best means of addressing
this type of issue is through State law.
WHEREAS, the City of Greencastle enacted a P2OMIDITIUN OF UPLN
ALCOHOLIC DUVERAGE CONTAINERS Ordinance along with over 42 other
communities illustrates that there is widespread interest in Indiana.
The Common Council acknowledges that the best means of addressing
this type o is through State law. Not through a patchwork of local
ordinances in ich a motorist could drive through three communities and
be subject to three different levels of restriction and penalties that are
inconsistent and unfair to the citizens of the State of Indiana.
WHEREAS' the St'at'e, through its General Assembly and Alcoholic
beverage Commission, has e::clusive power to regulate the sale, use, and
transportation of alcoholic beverages.
® The Common Council acknowledges the State's Constitutional and
St'at'utory authority in this public safety matter.
Whereas, the Common Council supports State legislation to male it
illegal to drink and drive.
The following Ordinance is believed to be in the best interest of the
City and the State of Indiana.

GREENCASfLE, INUTANA;
SECTION 1. The following Chapter is hereby repealed From the City of
Greencastle Code;

PROHIDITION OF OPEN ALCOHULIC DEVERAGE CONTAINERS
SECTION '_'.
This Ordinance shall be in full force and effect from and after its
passage by the Common Council, approved by the Mayor, and legal
publication as required by law.
