1993- 11 -11. City Council Minutes
The Tybee Island City Council held its regular monthly meeting
on November 11, 1993 in the City Hall with Mayor Walter W. Parker
presiding. The following members of Council were present:
Christopher P. Solomon, Jack Youmans, James P. Locklear, C. Ansley
Williams, C. Burke Day, and Jimmy Brown. City attorney Edward
Hughes was out of town but Attorney Dana Braun was present to
represent the city in any legal matters to come before Council.
Mayor Parker called the meeting to order and asked Councilman Day
to give the Invocation with the Pledge of Allegiance to follow.
Mayor Parker asked Senator Tom Coleman and Mr. Charles Griffen,
of the Ga. Ports Authority, to come forward and accept a print by
Mary Adams of the non existing Public Dock as a small appreciation
for all the hard work and effort they have given Tybee Island on
the re- nourishment project. Senator Coleman said he was impressed
because this is the same print that he and the Mayor presented to
the Governor. The senator said that he has strong attachments to
Tybee since he has raised his children every summer on Tybee
Island. Mr Griffen thanked the Mayor and Council on behalf of the
Georgia Ports Authority stating that they have enjoyed working with
Tybee and hope to continue. Mayor Parker introduce Mrs. Berta
Adams, Chairman of the Beach Task Force saying what a great job she
has done for Tybee.
Mayor Parker asked if any other guest wanted to speak to Council.
The Mayor congratulated Pat Locklear, Katrina Hughes, Jack Youmans
and Burke Day on the recent election. He said that Jimmy Brown,
Chris Solomon and Ansley Williams had done a great job in their
term of office. At this point the Mayor then thanked the prettiest
lady on Tybee for all her support and help, this lady is Maryann
Parker, the Mayor stated that he could not have done anything
without her.
Mr. Jim Mauldin of Schwans Delivery Service asked permission of
Council to supply residents with a few days of hand outs and a free
half gallon of ice cream to make the residents aware of their
products. Councilman Brown asked if the trucks would be traveling
throughout the city. Mr. Mauldin said that they would deliver to
the home once every two weeks and he understands the laws about
knocking on doors. Most of their business is done through
referrals, the company was started in 1952 and is all across the
nation, it is a Fortune 500 company. Councilman Day asked where the
office is located. Mr. Mauldin answered in Pooler, but we serve all
over the Savannah area. Councilman Youmans said that this service
is just like the milkman delivering milk, they are requesting only
to make the people aware of their product. Mayor Parker asked if
Schwans could not mail out information about products? Mr. Mauldin
stated that it is better to talk face to face or leave a shopping
guide, that is placed in a plastic bags and hung on the door. Mayor

Parker asked Attorney Braun if research would be needed before a
decision is made by Council. Attorney Braun said that Mr. Mauldin
is before Council requesting a fee amount for this request,
according to code.
Mr. Cedric Stratton asked permission from Council to have the
annual Savannah Marathon on Tybee Island on February 5, 1994 from
8 a.m. to 1 p.m. Mr. Stratton stated that this marathon has been
held in the Savannah streets but last year runners complained about
safety. Mr. Stratton said that he has mapped out a 13 mile single
loop, once around for the half marathon and twice for the full
marathon, also some of the hotels have said that they would be a
host. Councilman Williams said that he believes this would be a
positive boost for Tybee. Councilman Brown asked how many runners
do you expect? Mr. Stratton said probably less than 500 for the
half marathon and about 150 for the full marathon. Councilman Brown
asked if streets would need to be closed off to traffic? Mr.
Stratton answered no.
As there were no further visitors to speak to Council, Mayor
Parker opened the Public Hearing for a. minor subdivision petitioned
by Cory and Susan Weston at 1210 Butler Avenue. Mrs. Weston said
the piece of property to be subdivide is 80 feet wide and about 600
feet long. At this point she gave Council a plat of the subdivision
with the recommended changes requested by the Planning Commission
concerning the width of the access road, stating that she has a
legal document from the owners on the north concerning use of their
access road. This legal access can be transferred to someone else
if need be. Councilman Brown asked if this is the same plat that
the Planning Commission reviewed? Mrs. Weston said no, this one has
the changes that the P.C. requested. Councilman Youmans asked if
their was access to the center lot at this time? Mrs. Weston
answered yes. No one spoke for or against the subdivision. Lloyd
"Jiggs" Watson from the Planning Commission said their
recommendation was 5 in favor, 1 opposed. Mayor Parker closed the
Public Hearing and opened the regular meeting for business legally
presented to Council.
Attorney Braun read and explained a letter from Attorney William
Shearouse concerning the Lazaretto Creek Marina that was faxed to
City Hall at 3:09 P.M. today. He stated that Mr. and Mrs.
Scarbrough are seeking damages from the City of Tybee for wrongful
interference with property rights. Attorney Braun said that no
wrongful action was taken by the Tybee Island elected officials.
Recommendation is to defray denying until an agreement is met and
if no agreement is met than take action. Mayor Parker asked if
there were any questions at this time? Mr. George Rentiers said the
agreement needs to be looked over and read very carefully. Mayor
Parker agreed.
Councilman Youmans moved to grant Weston minor subdivision for
property located at 1210 Butler Avenue. Councilman Day seconded.

Vote by Council was unanimous.
Councilman Youmans moved to grant Schwans permission to go door
to door in order to make residents aware of their products.
Councilman Williams seconded to grant permission but with limits.
Councilman Youmans stated that they are asking permission to knock
on door and hand out information only once. Mr. Mauldin of Schwans
said it would take about one week to cover the island, and they
would not leave door hangers. Councilman Youmans asked the city
attorney if this was legal? Attorney Braun said yes, if he
registers, according to code section 9 -3 -11 and 9 -3 -12, code
section 5 -2 -3 is a little unclear, but it does not prohibit
delivery to households. Councilman Williams asked what the hours
would be? Mr. Mauldin said from 9 a.m. until dark. Mrs. Katrina
Hughes said this company deals in more than just ice cream. Mr.
Mauldin answered yes. Councilman Day said we might be setting a
precedent. Councilman Brown said a grocery store is in the process
of being built, it will sell ice cream. Councilman Williams asked
to see literature. Mr. Mauldin stated that Schwans does have a
business license. Councilman Solomon so moved to amend the original
motion by stating this would be a one time door to door, not to
exceed one week. Councilman Youmans accepted the amendment. Vote on
the amendment was 2 in favor; 4 opposed (Brown, Williams, Day,
Locklear). Vote on the original motion was 2 in favor; 4 opposed
(Brown, Williams, Day, Locklear).
Councilman Locklear moved to grant a parade permit to Mr. Cedric
Stratton to hold the "Savannah Marathon on Tybee Island" on
February 5, 1994 from 8 a.m. until 1 p.m. Councilman Day seconded.
Vote by Council was unanimous.
Councilman Day read the recommendation from the police chief
concerning the transfer of Alcoholic Beverage license at the Anchor
Lounge. Councilman Youmans moved to approve the transfer to Ray
McMillion. Councilman Solomon seconded. Vote by Council was
unanimous.
Minutes for the October 14, 1993 meeting stand approved as read.

Sewer 54,174.96 Councilmembers stated that they have
reviewed their bills, found them in order, and recommend they be
paid.

The following correspondences were read; Resignation from the
Planning Commission from Katrina Hughes; Resignation from the
Planning Commission from William Remeta; Recognition of the Police
Department from Deborah Hanzel; John Sugrue letter commending
police on their performance during a hostage situation; Information
from GMA on Direct Deposit of Retirement checks, the Finance
Committee will meet with Mrs. Pagan, the City Treasurer, and bring
a recommendation back to the December meeting.
Mayor Parker read two proclamations, one for Founders' Day
Savannah State and the other for MADD Designated Drivers Program.
Councilman Solomon moved to accept these proclamations with
Councilman Youmans seconding. Vote by Council was unanimous.
Mayor Parker announced the Open House to be held at the Police
Station on November 15, 1993.
As there was no further business to come before Council, Mayor
Parker adjourned the meeting.

P R O C L A M A T I O N
WHEREAS, By act of the General Assembly on November 26,
1890, the State of Georgia established in connection with the State
University, forming a school for the education and training of
Negro students; and
WHEREAS, The first session was held in Athens in 1891;
and
WHEREAS, In 1892 the school was moved to its present
site, partly in Savannah and partly in Thunderbolt; and
WHEREAS, The school was given the name "The Georgia State
Industrial College for Colored Youths" and awarded its first
baccalaureate degree in 1896; and
WHEREAS, In 1950 the name of the school was changed to
Savannah State College and since that date the school has been in
continuous operation and is now being served by its 10th President;
Now, then, be it resolved by the Mayor and Council of the City of
Tybee Island in Open Meeting Assembled, that the City of Tybee
Island hereby recognizes the contribution to the education of area
youth made by Savannah State College through the years; and
Be it further resolved that a copy of this Resolution be spread
upon the pages of the minutes of the City Council of Tybee Island,
Georgia, and that a copy be forwarded to Mrs. Jacqueline W. Gray,
Chairperson of the Founders' Day Committee, with congratulations

WHEREAS, In 1992 Chatham County experienced 435 crashes,
288 injuries and 8 fatalities as a result of DUI and at least half
of the fatalities happened on U S 80 East, known as "Tybee Road ";
and
WHEREAS, Nationally, during Thanksgiving 1992, 225 of a
total of 399 traffic fatalities were alcohol related, and between
Thanksgiving and New Year's Eve 1992, 1,640 of a total of 3,801
traffic fatalities were alcohol related; and
WHEREAS, Alcohol involvement in crashes peaks at night
and is higher on weekends, and 49% of all fatally injured drivers
from 6 pm on Fridays until 6 am Mondays have BACs of 0.10% or more;
and
WHEREAS, MADD has grown to more than 3.2 million members
and supporters, and the local MADD Community Action Team is
expanding the awareness of drunk driving in the community; and
WHEREAS, The mission of MADD and other Chatham County and
Tybee Island officials is the reduction of drunk - driver related
deaths and injuries through increased public awareness of drunk
driving crimes; and
WHEREAS, Designated driver programs have made a
significant positive impact and major social change in American
attitudes and behavior toward drinking and driving;
NOW, THEREFORE, I, WALTER W. PARKER, MAYOR OF TYBEE
ISLAND, GEORGIA do hereby proclaim the month of November 1993 as
"Designated Driver Month" in support of the effort and commitment
to reduce tragedies caused by drunk driving.
