HomeMy Public PortalAbout1963_07_08 194 MINUTES OF REGULAR MEETING OF LEESBURG TOWN COUNCIL, JULY 8, 1963. A regular meeting of the Leesburg Town Council was held in the Council Chambers, Leesburg, Virginia, on July 8, 1963. Mayor Frank Raflo called the meeting to order at 7:30 P.M. Councilmen present were : Stanley F. . Caulkins, George P. Hammerly, Hunter M. Leach, Maurice R. Lowenbach, Jr. and John W. Pumphrey. Absent from the meeting was Councilman Lynwood L. Lay. In the absence of the Recorder , Dorothy B. Rosen was appointed Recorder Pro-Tem. The minutes of the Public Hearing on June 24, 1963 and the Regular Meet- ing on 'June 24 , 1963 were approved with the general consent of the Council. Mayor Raflo and the Town Manager had no report for Council. Mr . Robert Sharp appeared before the Council , presenting a draft of agreement between the Town of Leesburg and the W. & 0. D. Railroad concerning the building of a proposed railroad crossing on Catoctin Drive in the Leesburg Terrace Subdivision. The Mayor referred this matter to the Utility Committee to study and bring back a recommendation to Council. Mr. Robert C. Forbes presented a petition for rezoning by Armel H. Heilman of 14.4628 acres on the west side of Lee Avenue from R-1 to R-2 zoning. Upon motion of Councilman Hammerly, seconded by Councilman Lowenbach, this matter • was referred to the Planning Commission. • Mr. Robert C. Forbes presented a petition for rezoning by John Allen Johnston of 20.108 acres to the west of Fairview Subdivision from R-1 to R-3 • zoning. Upon motion of Councilman Hammerly, seconded by Councilman Lowenbach , " this matter was referred to the Planning Commission. Upon motion of Councilman Hammerly, seconded by Councilman Caulkins, the following resolution was brought before the meeting: BE IT RESOLVED by the Council of the Town of Leesburg, in Virginia, that consideration be given to the petitioning of Sydney Z. Mensh and Company for 100 connections for sewer and 100 connections for water on a tract of land known as Mary Ann Farms on the west side of Route 15 and south of the south corporate limits of the Town of Leesburg. The Town of Leesburg will grant to Sydney Z. Mensh and Company water and sewer connections on the following basis : 1. Connection cost will be 9250.00 per dwelling ($125.00 water and 9125.00 sewer ) . 2. Water and sewer mains shall be constructed in accord- ance with the Town 's specifications. 3. The connections to the present mains are to be made at the most appropriate point in the present system. 4. Two rows of dwellings closest to Route 15 shall sell for not less than 316 ,500.00. 5. Not more than five per cent of the dwellings shall sell for less than $13 ,500.00. 6. The rates for the consumption of water and the use of the sewer lines shall be as specified by the Town of Leesburg at an appropriate date in the. future. 7. All water and sewer lines connected to the Town system shall be dedicated and become the property of the Town. 8. This agreement shall be contingent upon the receipt of an advanced payment of $25,000.00 within thirty (30) days of the date of the adoption of this resolution for the 100 connections for water and sewer above granted. Councilman Hammerly moved that the number of connections be amended to read "50" and that the advance payment should be "$12,500.00". Upon motion of Councilman Pumphrey, seconded by Councilman Lowenbach, this resolution was tabled until receipt of report on sewer plant report of Johnson and Williams from the State Water Control Board. Minutes of Meeting of July 8, 1963. X95. Upon motion of Councilman. Lowenbach, seconded by Councilman Hammerly, the following Ordinance was adopted by roll call vote. Voting Yeas, Councilmen Caulkins, Hammerly, Lowenbach and Pumphrey ; Voting Nays , Councilman Leach: BE IT ORDAINED by the Town Council of the Town of Leesburg, in Virginia, that the following ordinance sections pertaining to water and sewer service charges be amended to read as follows : , Section 19-31. Water rates and sewer rates and charges inside corporate limits. Water rates based on quarterly meter readings taken 'to the nearest 1 ,000 gallons shall within the corporate limits of .the Town be in accordance with the following schedule : Minimum charge - $6.00 per quarter (7,500 gallons oriless) 1st 50,000 gallons - 3.80 per . thousand 2nd .50,000 gallons - 3.60 per thousand 3rd 50,000 gallons - 3.50 per thousand 4th 50,000 gallons - 3.40 per thousand Over 200,000 gallons - $.30 per thousand 00 p Section 19-34. Charge for sewer service where sewer I`. and water are connected. L" CC Where water and the sanitary sewer are both connected CC within the corporate limits of the municipality, the additional quarterly charge for sewer service shall be one-half the quarter- ly bill. Section 19-35. Charge for sewer service alone. Where the sanitary sewer only is connected within the cor- porate limits of the municipality , the flat charge will be 36.00 quarterly for sewer service. Section 19-35.1 . Charge for sewer service to two or more apartments, houses, trailers, or dwelling units. Where two or more apartments, houses, trailers, or dwell- ing units are served by a single water meter , the minimum sewer charge for each apartment, house , trailer or dwelling unit , whether occupied or not , shall be a minimum of $3.00 per quarter. Mayor Raflo brought before the meeting the fact that the Paxton Home Agreement with the Town had pever been formalized. Upon motion of Councilman Lowenbach, and with the con$ent of the Council , it was decided to table this matter until the next meeting. . Mr. Robert C. Forbes asked the Council to interpret the word "subdivision." This matter was referred to the Town Attorney for his ruling. Upon motion of Councilman Hammerly, seconded by Councilman Caulkins, the following Ordinance was unanimously adopted by roll call vote : • AN ORDINANCE To accept the offer of the .grantof funds by the United States of America to aid in the construction of a Municipal Airport. The Town of Leesburg hereby ordains : 1. That the offer of the United States of America made through the Federal Aviation Agency of a grant of Two hundred, nine thousand and five hundred ($209,500.00) dollars to aid in the construction of the Leesburg Municipal (Godfrey) Airport. It is hereby accepted upon and subject to the conditions and assurances set out in the document entitled : "Grant Agreement Part I - Offer , and Part II - Acceptance , dated July 2, 1963, Project No. 9-44-914-C401 , Contract No. FA-EA=441" , attached to the draft of this ordinance. 196 . Regular Meeting of July 8, 1963. • 2. That the Town Manager , James W. Ritter , Jr . , is hereby authorized and directed on behalf of the Town of Leesburg to execute the said document indicating the Town of Leesburg's acceptance thereof and the Clerk of said Town of Leesburg, H. Frederick Mang, is authorized and directed to affix the seal of the Town of Leesburg thereto. 3. This ordinance was adopted , duly enacted and passed by . the Town Council of the Town of Leesburg in Virginia July 8, 1963: - 4. This ordinance shall be in force and effect July 8, 1963. 1- (A Copy Teste) _ Clerk - • Upon motion of Councilman Lowenbach , seconded by Councilman Pumphrey, the following resolution was unanimously adopted by roll call vote : BE IT HEREBY RESOLVED that the Town of Leesburg, in Virginia, a political subdivision, acting by and through the Town Council , does hereby elect to have such of the employees and officers of m. the Town, who are regularly employed full time on a- salary basis , and whose tenure is not restricted as to temporary, or provisional appointment , to become eligible , effective July 1 , 1963, to participate in the Virginia Supplemental Retirement System, under the conditions set forth in Title 51 , Chapter 3.2, Section 51-116.9 through Section 51-111.67, Code of Virginia, as such codehas been or may be amended from time to time and said Town agrees to pay its cost for partici- pation of its employees for all services for Town of Leesburg prior to July 1 , 1963 , for which credit is authorized and•established on Forms required by the Retirement Board and for membership service in the System after such date and also to deduct from 'said employees ' wages and pay over in the manner prescribed, the respective amounts required by law. NOW, THEREFORE, Frank Raflo , Mayor of the Town of -Leesburg, and James W. Ritter , Jr. , Town Manager , are hereby authorized and di • - rected in the name of said Town, to execute any required contract in order that employees of Town of Leesburg may become entitled to benefits provided under the Virginia Supplemental Retirement Act. In execution of any contract which may be required , the seal of said Town of Leesburg shall be affixed and attested by the Manager and said officers of Town of Leesburg are hereby authorized and directed to do any other thing, or things, incident and necessary in the lawful conclusion of this matter and in conformity with law. The Treasurer of Town of Leesburg be and is hereby authorized and directed to pay from time to time such sums as are due to be paid under said contract by Town of Leesburg and its employees. • CERTIFICATE • • • I , James W.
