HomeMy Public PortalAbout1963_07_22 20 Minutes of the Regular Meeting of the Leesburg Town Council,- July 22, 1963 A regular meeting cf the Leesburg Town Council was held in the Council Chambers, Leesburg, Virginia, on July 22, 1963. Mayor Frank Raflo called -the' meeting to order at 7:30 P.M. Councilmen present were:Stanley F. Caulkins, George P. Hammerly, Lynwood L. Lay, Hunter M. Leach, Maurice R. Lowenbach, Jr. and John W. Pumphrey. The minutes of the July 8 , 1963 meeting were approved as read with the general consent of the Council. The Town Manager gave his report to the Council. Upon Motion of Councilman Hamilerly; seconded by Councilman Caulkins the following resolution was approved. Voting-Yeas, Councilmen Caulkins, Hammerly, Lay, Lowenbach and Pumphrey; Abstained , Councilman Leach. BE IT RESOLVED by the Council of the Town of Leesburg, in Virginia that consideration be given to the petitioning of Sydney Z.. Mensh and+ Company for 50 connections for sewer and 50 connections for water on a tract of land known as Mary Ann Farms on the west side of Route 15 and south of the south corporate limits of the Town of Leesburg. The Gp Town of Leesburg will grant to Sydney Z. Mensh and Company water and sewer connections on the following basis: Cu 1. Connection cost will be $250.00 per dwelling ($125.00 water CC . .and .$125.00 sewer) . 2. Water and sewer mains shall be constructed in accordance with the Town' s specifications. 3. The connections to the present mains are to be made at the most.appropriate point in the. present system. 4; Two rows--of• dwellings ,closest- to Route 15 shall sell for not . less than,$1$,500.00. .• • •• 5. Not more than five per cent of the dwellings shall sell for less than $13,500.00. 6. The rates for the consumption of water and the use of the sewer lines shall be as, specified by the Town of Leesburg at an appropriate date in the future. 7. All water and sewer lines connected to the Town system , shall be dedicated and become the property of the 'Town. 8. This agreement shall be contingent upon the receipt-. of. an advanced payment of $12,500.00 within-thirty (30) days of the-date of the adoption of this resolution for the 50 con- - nections for water and sewer abcv a granted. • Mayor Frank Raflo- presented the following letter from the Plan- ning Commission to the Council. • - - - •. • • , - Jufiy= 161 •1963 M Mayor Frank Raflo and • Members of Council Leesburg, Virginia Dear Mayor Raflo: At a regular meeting of the Leesburg Planning Com- mission held on July 11-, 1963, the following, petition was. , presented to the Commission by William. F... Webb, •Jr.r.• • 202 Minutes July 22, 1963 Cont'd • "We, the residents of Wage Drive, request that the street connecting Wage Drive andAnne Street be eliminated . We feel that this street would be a• definitefactor in- disturbing .the pease and tranquility of Dry Mill Run Subdivision. For this and' many other: reasons , we hereby request that this connecting street be eliminated ."' • The above petition was signed by 17 residents. The Planning Commission took the following action:• A motion was made by Mr. Webb, seconded by Mr. Van- - devanter, and tied by a vote of 3 for and 3 against, that it be recommended to the Town_ Council that the connecting • st5eet between Wage Drive and Anne Street be vacated The Acting Secretary was requested to inform the Council of the action taken. Forbes • Acting Secretary Planning Commission Upon Motion of Councilman Hammerly; seconded by Councilman Lowenbach and approved by general consent of the Council this r • request was returned to the Planning Commission for further study. Upon Motion of Councilman Lowenbach; seconded by Councilman Hammerly the following resolution was unaminously approved by roll call vote. • • BE IT RESOLVED by the Town Council of the Town of Leesburg, in Virginia, that the money now on six-month depository in the • Loudoun National Bank in the name of the• Town of Leesburg in the amount of $21,818.00 be transferred into the Utility Fund account. The purpose of the transfer at this time is to enable • the Town to pay off outstanding indebtedness: due contractors on the new Paxton Well. Upon Motion of Councilman Pumphrey; seconded by Councilman Lowenbach the following resolution was unaminously approved by roll call vote. • BE. IT RESOLVED , by the Council of the Town of Leesburg , that a permit is requested from the State Highway Department for the installation by the Town of a 21"' C.M. Pipe on Woodberry Road , • in accordance with Mr. H. H. Harris' letter of May 14, 1963, Mr. C. W. Kestner' s letter of May 16 and Mr. G. P. Bozel' s letter of May 17. It is understood that the installation of this 21"! pipe is on a temporary basis not longer than sir (6) months , at the end- of which time it would be replaced with a size pipe satis- factory to the Highway Department. It is further understood that the Town agrees to save the Highway Department harmless from any damages that might occur by reason of the smaller pipe. Upon Motion of Councilman Leach; seconded by Councilman Ham- merly the following Ordinance was unaminously approved by roll call vote. BE IT ORDAINED, by the Council of, the Town of Leesburg,. Virginia, this 22nd day of July, 1963, that the Police Departmeh of the Town of Leesburg shall, upon application, which shall se t forth his or her name , permanent address , the name of the indiv9 idual, company,- firm or corporation by whom he or she is employed , with the address of same, issue a permit to said applicant to permit the solicitationof orders in the Town of Leesburg on the streets and by going on private property except where it appears • by sign posted in a reasonably conspicuous place that solicitors• peddlers , hawkers , itinerant merchants and transient vendors of merchandise are not desired. But in no event shall said permit effectiveness exceed six (6) months . A regular meeting of the Leesburg Town Council was held in the Council Chambers, Leesburg, Virginia, on August 12, 1963. Mayor Frank Raflo called the meeting to order at 7:30 P.M. Councilmen present were : Stanley F. Caul- 00 kins, George P. Hammerly, Lynnwood L. Lay, Maurice R. Lowenbach , Jr. and John Cr: W. Pumphrey. Also present were Town Manager James W. Ritter , Jr. and Town At- torney George M. Martin. Absent from the meeting was Councilman Hunter M. Leach. L' In the absence of the Recorder , Dorothy B. Rosen was appointed Recorder Pro-Tem. CC CC The minutes of the Regular Meeting of July 22, 1963 were approved with the general consent of the Council . Mayor Raflo gave his report to the Council. • The Town Manager gave his report to the Council . Upon motion of Councilman Lowenbach , seconded by Councilman Pumphrey , the following resolution was unanimously adopted by roll call vote : WHEREAS , the Town of Leesburg acquired certain land situate in the Town of Leesburg, of which the following described land is a portion, by the exercise of its power of eminent domain in order to secure a small portion thereof for the location of a water tank; and , WHEREAS, the balance of the land is not required for any public use and has never been dedicated or utilized for public purposes. BE IT THEREFORE RESOLVED by the Council for the Town of Leesburg that the Mayor be, and he is hereby authorized to execute the following con- . tract on behalf of the Town of Leesburg, and the Recorder be, and he is hereby authorized to affix the seal of the Town. of Leesburg thereto and attest the same. • THIS CONTRACT OF SALE, made this 29th day of July, 1963, between the TOWN OF -LEESBURG, in Virginia, a municipal corporation , Vendor , party of the first part , and THE LOUDOUN COUNTY HOSPITAL, INC. , a corpora- tion, Vendee , party of the second part. WITNESSETH: That for and in consideration of the sum of Fifteen Thous- and Dollars (315 ,000.00) , of which amount the• sum of Ten Dollars ($x10.00) is cash in hand paid , the receipt whereof is hereby acknowledged, and the balance thereof , namely , the sum of Fourteen Thousand Nine Hundred Ninety Dollars ($14 ,990.00) is to be paid as hereinafter set out , the party of the first part has sold and the party of the second part has purchased, all that certain tract or parcel of land situate , lying and being in the Town of Leesburg, Leesburg Magisterial District , Loudoun County, Virginia, fronting on Route 698 and more particularly described as Lots 2, 3, 4, 5, 6 , 7, 8 and 9 on a plat made by Robert K. Wilson , Certified Land Surveyor , dated June 10, 1956, a copy of which is attached hereto and by reference made a part hereof. It is understood that said sale is made subject to a 16 foot access ease- - ment as shown on said plat , and a 10 foot easement for a water line , as shown on said plat , effecting Lot 7.
