Minutes - City Council Meeting, October 10, 2019 6 City Council Minutes 20191010 Consideration of Items for Consent Agenda Mayor Buelterman called the consent agenda to order at 6:30P M on October 10, 2019. Those present were Julie Livingston, John Branigin, Wanda Doyle and Barry Brown. Also attending were City Manager, Shawn Gillen; City Attorney, Bubba Hughes; George Shaw, Community Development; and Jan LeViner, City Clerk. Mayor Buelterman listed the following items on the consent agenda:  City Council Minutes, September 26, 2019, as amended  Alcohol License Request: Special Event-Beer, Liquor and Wine-Tybee Wine Festival(Pickin' and Shuckin' with Beer and Bubbles); 10 Van Horne/Tybee Post Theater; Friday, May 1, 2020  Agenda Request: H & K Event Management -Alcohol License Request: Beer, Wine, and Liquor; 1401 Strand Ave (Event Facility at top of Hotel Tybee, in old Grandview location)  Approval to do an RFP for a GEFA Solar Project at the Water/Sewer Facility Mayor Buelterman closed the Consent Agenda portion of the City Council Meeting. He then asked Frank McColm to approach the podium to speak to the Hazard Mitigation Grant. Frank McColm thanked Mayor and Council for the opportunity to speak. Mr. McColm gave a brief outline of the Grant and is asking Mayor and Council for direction in moving forward. Dr. Gillen stated there are two scenarios: (1) homeowner is responsible for all the cash flow, they turn in the documentation, the City then forwards the documents to GEMA, we give them their money and they get 85% of what they spent or (2) the City pays the contractor directly, the City sends in documents to the State for reimbursement but the homeowner is still responsible for giving the City the 85%. Mayor pro tem Brown stated he prefers the City pay the contractors directly. Dr. Gillen responded he does not have a preference. Mayor pro tem Brown shared his concerns with the homeowners not having the 15%. Dr. Gillen stated there are certain areas where the City must be careful as we need to make sure if the City is capturing this, waiting for reimbursement and working with the homeowner, that we protect that portion of the City’s money. He asked again for guidance from Mayor and Council. Ms. Doyle stated it was her understanding the process from the beginning is to have those op tions to have the meeting, discuss, and then decide so the City can move forward. She does agree with Mayor pro tem Brown as she does not want the City to spin their wheels as these eleven residents have been patiently waiting for answers. Ms. Doyle then asked Dr. Gillen how far the City is away from getting options so they can be discussed, voted on and move forward. Dr. Gillen responded Mr. Shaw has a memorandum that he has drafted for Mayor and Council and will be sent on Friday, October 11, 2019. He re are two decisions that Mayor and Council will need to make: (1) identify of contractors and (2) how is it going to be captured and lay down options per Mr. McColm’s advice on how to do that. One option that can be explored is getting the DCA to front the money to the City and that money can be paid to the contractors. Mr. McColm stated the money will be advanced to the City and there is a requirement that money would need to be placed in an interest bearing account. That money would then be returned to the State. He continued to outline the next steps and that is to provide Mayor and Council with all twelve homeowner’s names for an interview. This will inform the City as to their level of ability 7 to have the 15% needed, their ability to obtain a construction loan, and fund the entire amount for reimbursement. This would be completed prior to October 15, 2019. He will bring that information back to Mayor and Council at the October 24th City Council Meeting with the results of the interviews which will help Mayor and Council make a better decision on the Memorandum Mr. Shaw is sending. Dr. Gillen stated the goal is to have the houses lifted within legal parameters. Mayor pro tem Brown expressed his concerns for those who do not have the funds or ability to get a loan. Mr. McColm then addressed flood insurance as it will vary on circumstances of the structure. By elevating the structure above base flood elevation there will be cost savings. Ms. Livingston stated the key is ensuring the residents can provide the 15% or have the ability to do that. She asked if there is anything available for the homeowners, any type of guidance with financing. Mr. McColm responded in various areas there are financial counseling options through local housing authorities. Ms. Livingston stated she personally supports the option of the City paying the contractors directly but the City needs to secure the 15%. Mr. McColm stated again, the overall goal is to elevate the residence and to ensure it is done properly and compliant. He also feels it is important to keep the risk burden on the City as low as possible. Mr. Branigin stated there needs to be a clear process for dispute resolution as we need to avoid the City being in a position where there is a dispute between the contractor and homeowner. Mr. Branigin confirmed with Mr. Hughes there needs to be an agreement. Ms. Doyle asked Mr. McColm if one of the original 12 homeowners decided they did not want to elevate their home, it would not go to another residence. Mr. McColm confirmed as the State has indicated as much. As to flood insurance, Mr. McColm stated flood insurance is required for the owner of record and will be part of the deed for the useful life of the structure. Mr. Hughes confirmed it is the will of Mayor and Council to move forward; and fund as it needs to be funded as long as it can be done under the rules of the Grant. Mr. McColm then gave an update on the remaining homes that have applied for the Grant. He stated the review process is in the last phases of review and he is not aware of an official date when FEMA will make a determination. Mayor Buelterman asked Mr. McColm about the Flood Mitigation Assistance Program. Mr. McColm responded the Program comes through the National Flood Insurance Fund which is essentially the bank account for the National Fund Insurance Program which is the largest insurer of flood insurance. FEMA prioritizes awards under that Grant Program for severe repetitive loss and loss properties. In general, those are properties that are insured by the National Flood Insurance Program and FEMA has prioritized those properties as the highest risk based upon the number of losses, frequency of losses and volume of those losses. The Program has the same administrative process for the Hazard Mitigation Grant Program. Mayor Buelterman stated the City would make application much as they did for the Hazard Mitigation Grant Program. Mr. McColm confirmed. Mayor Buelterman asked the Clerk to add to the upcoming agenda, October 24, 2019. Ms. LeViner confirmed. Mayor Buelterman called the regular meeting to order at 7:00P M. All those present for the consent agenda were present. Post Theater is requesting waiver of fees at Gym and deposit amount needs to be determined. 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Special Events Application Tybee Wine Festival Memorial Park and Tybee Island Gymnasium Saturday, May 2, 2020 (With set-up starting as early as Thursday and break down completed by Sunday) Friends of Tybee Theater 2020 Wine Festival Information: - This annual event has outgrown the Lighthouse Grounds and is requesting to move their main event on Saturday afternoon, “The Grand Wine Tasting”, to the Memorial Park field (including usage of both the Screened and Open Pavilion) - Due to substantial growth of the festival in recent years, a Kentucky Derby Viewing Party has been added requesting to take place inside the Tybee Island Gymnasium that evening after the main event o F.O.T.T has also requested to waive the resident rental rate for the Gymnasium - The Friday night event has not changed and will remain at the Post Theater with no City requests Items addressed at 10/1/19 Meeting with Department Heads prior to submission for Council consideration: - Concerns about parking were expressed (Parking Director) o The amount of public parking in the surrounding areas able to be utilized for event attendees. Even when the event was on the north end, with the abundance of public parking at North Beach, Parking Services has experienced issues (Parking Director) o Not sure about the 4 parking spots requested in the decal lot by the Gym (Parking Director)  Okay to remove the request for these 4 spots if there is an issue with the decal lot (Event Organizer) o The request for 10 parking spots on Butler by the field for vendors will be fine, will need to be coned or blocked off by DPW or TIPD (Parking Director) - In the site plan presented all parking for VIP will be in the field area between the Fire Department and the Cemetery, which has been ok’d by the City Manager (Event Organizer) o How many spots will there be in the VIP parking area? (Fire Chief)  The were 60 cars altogether at last year’s event (Event Organizer)  We will use the same temporary removable marking chalk used for the soccer field lines to mark the parking spots in the VIP parking area and “once it is full, it is full” (Event Organizer) 29 - Questioning the power needs, electricity usage, generators, etc. (DPW) o An electrician is being brought in to do a walk-through of the power needs and we plan to provide our own generators for these needs (Event Organizer) o “10-4” (DPW) - Plans for trash and recycling? (DPW) o A private company is being hired for trash/recycling, including bringing in extra dumpster(s) (Event Organizer) - Where is the entrance? (DPW) o The entrance is represented on the proposed site plan by the blue squares on the outer side of the red/orange line labeled ‘barriers’ representing where the French barricades will be placed along the perimeter of the festival area (Event Organizer) o The transition from the event in the field to the event in the Gymnasium will be planned and monitored so that all special event alcohol/liquor license approved will be abided by (Event Organizer) - There were questions and discussion of details pertaining specifically to the request to use the Gymnasium (YMCA Director) o The request to serve Mint Juleps in the Gym was addressed and it was stated that the event is only to be advertised as at the Tybee Island Gymnasium not a YMCA facility and the event will have no affiliation with the YMCA (YMCA Director) o What are the hours of the evening Derby event at the Gym? (YMCA Director)  Approximately 4pm to 8pm, the race is at 6pm and we estimate everyone will be out of the gym by 8pm (Event Organizer) o When will advertising for the event start? (YMCA Director)  Historically on Valentine’s Day, if able to start earlier this year we will (Event Organizer) - Further Discussion of the Gymnasium usage schedule and YMCA operational hours occurred between the Event Organizer and the YMCA Director, and the following was addressed: o For set-up prior to the event and clean-up after, the event organizer will pay for a YMCA staff member to be there if not during the regularly scheduled hours of operation o In regards to the post event clean-up on Sunday morning, all major items and equipment will be removed in time for the YMCA’s usual Sunday hours of operation to open at 1pm. The event organizer hopes to be completely done but may still be cleaning the floors o The earliest start time for set-up will be after 3pm on Thursday o The YMCA Director will take care of the notifications for the regularly scheduled pickle ball in the Gymnasium o The Event Organizer will take care of the notifying TIMA in regards to their usage for Gym Class on Fridays. Clean up has been scheduled so that the Gym will be ready for TIMA’s classes as usual by that Monday, and the set-up will not begin until after the class on Thursday 30 P.O. The extent of our NPDES MS4 pro- gram experience includes SWMP preparation, detailed stormwater program assessments, water quality trend monitoring and analysis, regulatory compliance coordination, enforcement response planning, green infrastructure/low impact development (GI/LID), post construction stormwater runoff ordinance development, and stormwater program funding analysis. Our project team per- sonnel have a comprehensive understanding of local stormwater management programs and a successful performance record of assisting local governments in Georgia with development and implementation of NPDES-compliant stormwater programs. • Our staff have written and updated numerous NPDES Phase I Medium MS4 SWMPs for commu- nities in Chatham County, Georgia, including the City of Tybee Island’s most recently submitted SWMP (2017). Our staff have also written NPDES Phase I Medium MS4 SWMPs for the Cities of Savannah (2017, 2012, 2010), Thunderbolt (2017, 2012, 2010, 2005), Port Wentworth (2017, 2012, 2010, 2005), and Garden City (2012, 2010) as well as Chatham County (2010, 2005) • Our staff have extensive experience working with the City of Tybee Island on various proj- ects including the 2008 and 2016 Master Plans and the Carrying Capacity Study. Our planning staff, Courtney Reich and Ed DiTommaso, were previously contracted by the City to be the outsourced Planning Department during a period of staff transition. Through this experience, we have developed a deep understanding of the City’s programs, resources and needs, and we will utilize this knowledge to develop an NPDES program for the City that is cost-effective and compliant. • Prior to her work as a consultant, Courtney, was the Water Resources Planner for the Chatham County – Savannah Metropolitan Planning Commission (MPC), where her responsibilities in- cluded implementing the NPDES Phase I MS4 program on behalf of Chatham County and its co-permittees. Her duties included county-wide program coordination, water quality moni- toring, public education, and Annual Reporting. If GMC is selected, Courtney’s long-standing experience with the evolution of the NDPES MS4 program in Chatham County over the last 20 years will benefit the City of Tybee Island. • Our project personnel have also authored many NPDES Phase II MS4 SWMPs for communi- ties in Georgia, including several coastal communities including Glynn County, Richmond Hill, Brunswick, Effingham County. Our experience with NPDES implementation in coastal environ- ments has enabled our staff to successfully negotiate program amendments with the Georgia Environmental Protection Division (EPD). • GMC staff also understand and are trained to assist with NPDES MS4 SWMP implementation services including MS4 infrastructure GIS inventory and inspections, detention pond/storm- water control inspections, Impaired Waters Plan monitoring, dry weather screening and source tracing, public education, and Annual Report development. We have several employees who have received their NPDES MS4 Certified Stormwater Inspector certification through the Na- tional Stormwater Center (www.npdes.com) and Level II “Blue Card” certification from the Georgia Soil and Water Conservation Commission (GSWCC) for erosion and sedimentation inspections and plan review. Our Project Team person- nel has successfully assisted over 30 local governments in Georgia achieve compliance with the requirements of these NPDES programs. GMC works with local governments to help them under- stand, comply with, and identify resources to implement the various requirements associated with these pro- grams. The extent of our NPDES Phase I MS4 program experience includes SWMP preparation, detailed stormwater program assessments, MS4 GIS inventories & condition assessments, water quality trend monitoring & analysis, regulatory compliance coordination, enforcement response planning, and stormwater program funding analysis. Our Project Team personnel have a comprehensive understanding of local stormwater management programs and has successfully assisted over 25 local governments in Georgia achieve compliance with the requirements of these NPDES programs. We recognize that providing consulting services to support the development of a SWMP requires specialized and unique expertise, including the following: • A detailed knowledge of the City of Tybee Islands Stormwater Management Program • Comprehensive experience with developing SWMPs in compliance with the NPDES Phase I Medium MS4 Permit • An understanding of local government stormwater operations and day-to-day activities • Ability to identify cost-effective methods for compliance • Strong public relations and public education capabilities • Experience in stormwater management program budgeting and financial analysis • A successful work history with the Georgia EPD staff • An understanding of the inter-relationship between the NPDES Phase I MS4 requirements and other relevant regulatory programs such as TMDLs and Watershed Protection Plans This project presents a unique opportunity for the City to assess the strengths and weaknesses of the SWMP and to identify those management practices that have been the most effective in addressing water quality issues. This process will allow the City to streamline its SWMP and ensure the cost-effective implementation of a results-oriented stormwater management program. We work collaboratively with our clients to tailor their community-specific implementation plan to their staff capabilities and available financial resources. We understand that the City of Tybee Island is committed to the protection of water resources and obligated to its citizens to implement the SWMP in the most cost- effective manner possible. We are confident that we can assist the City in updating its SMWP to achieve these goals. 51 Proposal for the Municipal Storm Water Management Plan - RFP # 2019-739 7 GEORGIA EPD COORDINATION Coordination with EPD prior to and through the SWMP update process will be essential to the success of this project. Our Project Team will utilize our long-standing and successful relationships with the EPD NPDES MS4 program managers to broker mutually-acceptable compromises, minimize comments on submittals, and ensure the swift approval of the City’s SWMP Update. Our team proposes to already met with the Georgia EPD NPDES MS4 staff and attended public meetings over the last several years in anticipation of the NPDES MS4 Permit renewals. As the consultant for numerous NPDES MS4 permittees our staff maintain an ongoing dialogue with EPD to develop a comprehensive understanding of EPD’s expectations as the SWMP updates are completed. INTERGOVERNMENTAL COORDINATION The City of Tybee Island may find it desirable to coordinate with other NPDES Phase I MS4 permittees in Chatham County on various elements of the development and/ or implementation of the SWMP. For example, all NPDES Phase I MS4 permittees are required to implement public education and involvement programs. NPDES MS4 permittees in Chatham County have historically coordinated these efforts in order to avoid duplication of efforts and reduce the associated cost burden. GMC is currently working with several other NPDES Phase I MS4 permittees in Chatham County, and is coordinating the Stormwater Stakeholder Committee. If selected, we will ensure that the City of Tybee benefits from any opportunities to coordinate program implementation. SCOPE OF WORK The following scope of work will ensure that the City remains compliant in the most cost-effective manner. GMC has assisted over 25 communities in Georgia, including the City of Tybee Island, with NPDES permit compliance programs including field work, annual report development, and Stormwater Management Plan development. It is our intent that the scope of work below will allow GMC to relieve the City of the burden of daily program compliance to the maximum extent possible. It is our intent to simply “handle” NPDES responsibilities on behalf of City staff and at the City direction. Task A: Review of Tybee Island NPDES Phase I Medium MS4 SWMP Once contracted, GMC will coordinate a meeting to kick off the project, discuss the scope and schedule, provide an opportunity to review the roles of the GMC team and City staff, and to discuss requirements associated with the NPDES Phase I Medium MS4 Permit. Our team facilitate discussions with City staff on the City’s current NPDES Phase I MS4 compliance approach, the recently submitted SWMP, and any desired changes. GMC staff will facilitate this meeting and will provide a written meeting summary to the City. Task B: Dry Weather Screening/Illicit Discharge Monitoring Per the City’s SWMP, GMC will perform Dry Weather Screening in accordance with the procedure submitted to EPD and included in the City’s 2017 SWMP. The City should be conducting dry weather screening for about 20% of their outfalls per reporting period, so GMC will conduct dry weather screening for 9 outfalls in the 2019- 2020 reporting period. For each MS4 Outfall, GMC staff will complete a Dry Weather Screening Form (Outfall Reconnaissance Inventory Form). If flow is not present, the GMC field staff will note it as such, take a photograph of the outfall, and complete the necessary sections of the form – (1) background data, (2) outfall description, and (3) physical indicators for flowing and non-flowing outfalls. If flow is present, GMC field staff will visually evaluate additional 52 Proposal for the Municipal Storm Water Management Plan - RFP # 2019-739 8 physical indicators of odor, color, turbidity, and floatables. The field staff will also measure temperature, pH, salinity, turbidity, and conductivity using a Horiba U-53 probe. The field staff will calibrate the equipment in accordance with standard protocols and also perform a factory calibration once per year, in compliance with QA/QC procedures. A fecal coliform grab sample will be taken and brought to an accredited laboratory, if the field results indicate potential sewage or when there is visual evidence including milky white or gray color and floatables, a sewage odor, or other applicable evidence of potential sanitary sewer discharge. The GMC field staff will gather all results and complete the Dry Weather Screening Forms. For outfalls where an illicit discharge is suspected, the field staff will provide the City with the location of the outfall and the sampling results, such that the City staff can initiate source tracing activities, as appropriate. If requested by the City, the GMC staff may assist with any required source tracing activities, including GIS analysis of land uses and potential sources and additional upstream water quality monitoring. (Source tracing services are considered out-of-scope and can be performed, upon request, as hourly, additional services, and charged accordingly.) Task C: Education, Training, and Community Outreach GMC will assist the City with implementing their Public Education and Public Involvement BMPs outlined in their SWMP. For the relevant activities listed in the City’s SWMP, GMC will assist the City by performing the following tasks, upon request from City staff: • Provide information, links, and documents to download that can be included on the City’s stormwater webpage. • Provide City with electronic versions of educational material related to industrial and highly visible pollutant sources (HVPS) facilities, so that this information can be distributed to facility managers during the City’s inspection of these facilities. • Provide support to the City for annual meeting of the Master Plan Implementation Committee (or similar meeting) that discusses stormwater issues. GMC will also lead a training session on the NPDES Phase I SWMP with City staff, in accordance with the requirements of the NPDES Phase I MS4 permit. GMC staff will develop training materials, provide a sign-in sheet, and maintain adequate documentation for the City’s Annual Report. This training session may be conducted in coordination with other NPDES permittees in Chatham County. Task D: NPDES Phase I MS4 Medium SWMP Based on the City’s feedback, GMC staff will revise the City’s 2017 NPDES Phase I MS4 SWMP to ensure the most cost-effective compliance strategy. Our Team has extensive experience assisting Phase I Ms4 permittees governments with identifying acceptable BMPs to meet the NPDES Phase I requirements including: 1. Structural and Source Control Measures 2. Illicit Discharge and Elimination Program 3. Industrial Facility Storm Water Discharge Control 4. Construction Site Management 5. Highly Visible Pollutant Sources 6. Enforcement Response Plan 7. Monitoring for Discharges to Impaired Water Body 8. Public Education 9. Public Involvement 10. Post Construction 11. Green Infrastructure/Low Impact Development It has been our experience that the most effective BMPs are often those that incorporate existing City Our proposed Project Manager, Courtney Reich, has been working with the City of Tybee Island on NPDES Phase I MS4 permit compliance, since 2001. Over the past 19 years, Courtney has written SWMP documents, annual reports, facilitated community outreach, and performed field work in support of the City’s NPDES Phase I MS4 permit. Her experience with the NPDES MS4 program generally, and Tybee Island’s SWMP specifically will prove invaluable to the City, should the GMC team be selected. 53 Proposal for the Municipal Storm Water Management Plan - RFP # 2019-739 9 programs, procedures, and plans. In many cases, there may be ongoing City programs that can be incorporated as is, or with slight “tweaking” to meet Phase I program requirements. We propose to assist City staff in identifying these opportunities. The Project Team will then meet with City staff to review the recommendations, understand changes that the City staff wish to make, and develop consensus on any proposed SWMP revisions. It is our understanding that the City has not yet received comments or approval of the 2017 SWMP submitted to EPD in October 2017. If and when the EPD provides comments to the City on the 2017 SWMP or an updated SWMP, the Project Team will work with City staff to address those comments. While we will do our best to minimize comments from EPD through pre-submittal coordination, in our experience, minor comments and edits from EPD on the SWMP are likely. We will address EPD comments, update the document and provide a Final NPDES Phase I MS4 SWMP to both the City and the EPD. Task E: NPDES Program Management and Ordinance Assistance GMC will work on behalf of the City of Tybee Island as the liaison to the Georgia Environmental Protection Division (EPD) as it relates to compliance with the NPDES Phase I MS4 Permit. This may include meetings, conference calls and emails with the City’s EPD Program Manager as well as intergovernmental coordination with other local NPDES permittees. In addition, this will include notification to the City on any required ordinance updates as required by the NPDES Phase I MS4 permit, the Green Infrastructure/ Low Impact Development and Enforcement Response Plans. For the purposes of this proposal, GMC assumes that updates will be required to the City’s Stormwater Management Ordinance, Enforcement Response Plan and Green Infrastructure/Low Impact Development Plan. Task F(a): Services for Inspection of the Stormwater Inventory GMC staff will inspect approximately 20% of the City’s MS4 structures based on the procedures included in the 2017 SWMP. The inspections results will be recorded in a GIS database. Any issues discovered in the field will be compiled, prioritized and provided to Clearwater Solutions so that maintenance can be performed as described below. GMC will provide the updated GIS database to the City in any format desired and will summarize the results for inclusion in the Annual Report. Task F(b): Services for Maintenance and Repairs of Stormwater System After inspections have taken place, GMC will provide the list of maintenance needs identified during the MS4 inspections (outlined in Task F(a), above) to Clearwater Solutions. GMC will send a two-man crew to the City to complete the routine maintenance work necessary to comply with the permit. Routine maintenance will include activities such as debris and vegetation removal, letter removal, etc. This crew will be stationed at Tybee Island’s Public Works for the amount of time necessary to address the identified maintenance needs. Structural maintenance issues, for example – a crushed inlet or collapsed culvert, will be summarized and a cost estimate will be provided to the City prior to commencing any work. Once the 54 Proposal for the Municipal Storm Water Management Plan - RFP # 2019-739 10 City approves any recommended structural maintenance activities, Clearwater Solutions crew will schedule maintenance activities. Any serious drainage system capital maintenance needs that are identified during inspections will be handled independently, in a similar fashion to the City’s current Capital Improvement Program. We also anticipate that the City will have emergency drainage issues that stem from citizen complaints, elected official requests, and observations of City staff. Clearwater Solutions proposes to have an “on-call” stormwater professional who will be available to come to the City to address emergency drainage situations, regardless of whether or not they were identified during the MS4 inspections. Clearwater Solutions’ operations in other local communities including Garden City, Port Wentworth and Chatham County, ensure that there are always many qualified public works professionals just a phone call away. Add Alternate Task 1: NPDES Annual Report Assistance If requested, GMC will prepare the City’s NPDES Phase I MS4 Annual Report covering the period of April 1, 2019 to March 31, 2020. In mid 2020, GMC will provide City staff with a compliance matrix that will be a list of documentation that is needed for the Annual Report, after which, GMC staff will meet with City staff to review the documentation and identify any additional best management practices (BMPs) that need to be completed prior to March 31, 2020. Using the documentation compiled, GMC will prepare the Annual Report document, as well as documentation related to any other tasks completed by GMC staff, per this contract. GMC will provide the Annual Report to the City to review and revise it based on comments received from City staff. GMC will prepare and mail the submittal package for EPD, prior to May 15, 2020. GMC will provide the City with an electronic copy of the Annual Report. If requested, GMC will also provide a hard copy. Upon request, GMC can assist the City with addressing any comments from EPD on the Annual Report for an hourly, additional fee, in accordance with the rate schedule in Attachment A. Add Alternate Task 2: Highly Visible Pollutant Sources (HVPS) & Municipal Inspections GMC staff will perform stormwater site inspection for approximately 20% of the City’s HVPS sites based on the inventory and procedures included in the 2017 SWMP. The purpose of the carrying capacity study was to determine the population size that can be supported by the City of Tybee Island, the limiting factors for population growth, and how the City can prepare for future growth and de- velopment in the face of predicted sea level rise. Primary limiting factors can either be resource-based, i.e. available water supply, or infrastructure-based, i.e. ability of the sanitary distribution and treatment system to safely convey and adequately treat domestic wastewater. The Coastal Incentive Grant also included a Greenhouse Gas Emissions inventory. This inventory focused on the amount of greenhouse gas emissions associated with government operations of the City, which included examining energy consumption at government buildings, public lighting, gasoline used by city vehicle, treatment facilities, and employee commuting patterns. The resulting inventory included recommendation for measures the City could take to reduce greenhouse gas emissions directly tied to government operations. POPULATION STUDY The Carrying Capacity Study built on a population study conducted by GMC/EPG to support the Local Option Sales Task (LOST) negotiations. The primary goal of the study was to establish an accurate population count for the city and compare it to the data recently released by the Census Bureau. The following services are completed on an annual basis for the City. Municipal Separate Storm Sewer System (MS4) Structural In- spections: GMC/EPG staff personnel inspect MS4 components in the field and perform a condition assessment. All inspection results are recorded in the City’s MS4 GIS database, and this da- tabase is perpetually updated as part of this process. Dry Weather Screening/Source Tracing: GMC/EPG staff screen MS4 outfalls within the City of Port Wentworth in accor- dance with the procedures outlined in the City’s NPDES Phase I MS4 SWMP. GMC/EPG staff visit each outfall and complete a checklist for each structure. GMC/EPG staff take a picture and re- cord the location of the outfall screened within the City’s GIS database. If the outfall is flowing, GMC/EPG staff perform field monitoring of the discharge per the City’s SWMP with a Horiba U-53 and colorimeter. If the results of the sampling are above baseline limits, GMC/EPG immediately notifies the City and assists with source tracing work and enforcement. Water Quality Retrofit Analysis: GMC/EPG staff perform a water quality retrofit analy- sis for a stormwater capital project in Port Wentworth. This analysis includes a descrip- tion of the suspected water quality impacts from the structure in its existing state, and a recommendation for improvements that could be made to the structure to improve water quality. Detention Pond/BMP Inspections: GMC/EPG staff perform inspections of BMPs (i.e. detention ponds, infiltration basins, bio-retention areas, etc.) to determine if any main- tenance is required. GMC/EPG staff complete the approved inspection checklist for each inspection of a private structural control, and provide a copy of that inspection checklist to the City. If the private structure is deemed deficient in some manner, GMC/ EPG staff draft a letter from the City to the private owner outlining the recommended remedial/maintenance activities. Green Infrastructure Review and Ordinance Update: GMC/EPG staff perform an as- sessment of the City of Port Wentworth’s current development codes to determine if there were any obstacles to smart growth and a green infrastructure approach to storm- water management. GMC/EPG then drafted an update to the City’s Stormwater Man- agement Ordinance that was consistent with NPDES MS4 requirements and the Coastal Stormwater Supplement (CSS). Facility Inspections: GMC/EPG staff perform site inspection of industrial, municipal, and highly visible pollutant source facilities within the City, using the methodology and checklist included in the City’s SWMP. GMC/EPG then works with City code enforce- ment staff to address any deficiencies identified, and GMC/EPG maintains all records for annual reporting. 69 Proposal for the Municipal Storm Water Management Plan - RFP # 2019-739 25 PROJECT DETAILS STATUS: Ongoing OWNER CONTACT: Town of Thunderbolt Mr. Deatre Denion Town Clerk (912) 354-5533 KEY FUNCTIONS: Project Management THUNDERBOLT NPDES PHASE I MEDIUM MS4 COMPLIANCE Town of Thunderbolt, Georgia GMC was contracted to assist the Town of Thunderbolt with the update of the NPDES Phase I MS4 SWMP in compliance with the recent NPDES Phase I MS4 permit reissu- ance in 2017. The 2017 NPDES Phase I Medium MS4 Permit was the first NPDES MS4 permit in Georgia to follow the updated guidelines stipulated by US EPA and GA EPD followed by the NPDES Phase II MS4 permit (updated 2018) and the NPDES Phase I Large MS4 Permit (updated 2019). This project included meetings and discussions with Town staff, coordination with the permittees and their regional planning commission, and ongoing communication with their Georgia EPD Program Manager. GMC personnel served as the project manager and primary author of the SWMP documents. Our work ensured that the communities continued to be compliant with the new regulations and that their future stormwater program commitments were consistent with the communities’ existing resources and programs. One unique feature of this project is that Chatham County and Thunderbolt coordi- nate implementation of various program elements including monitoring and public ed- ucation. Resolution 08-2019, List of Electors 130 RESOLUTION NO. ____2019 RESOLUTION OF THE MAYOR AND COUNCIL OF THE CITY OF TYBEE ISLAND WHEREAS, the City of Tybee Island is a municipality in the State of Georgia in which local elections are held pursuant to the provisions of State Law; and, WHEREAS, through agreement with the Chatham County Board of Elections, the City conducts elections in accordance with its ordinances and charter, and State Law, for filling offices in the City; and, WHEREAS, O.C.G.A. § 21-2-224(e) provides that the Chatham County Board of Registrars shall provide the governing authority of a municipality a list of electors and a list of inactive electors no earlier than the fifth Monday prior to an election and not later than twenty- one (21) days prior to the election for the purpose of permitting the municipality to check the accuracy of the lists; that the municipality shall review the lists and identify in writing to the County Board of Registrars not later than five (5) days prior to the election the names of any persons on the list of electors who are not eligible to vote in such election and state the reason for the disqualification; that the Board of Registrars shall thereafter challenge the persons so identified in accordance with O.C.G.A. § 21-2-228; and that the municipality shall certify the final lists of electors and inactive electors and file a copy of same with the city clerk showing the names of electors entitled to vote at the election; and, WHEREAS, through the assistance of the Chatham County Board of Elections, the City of Tybee Island will have a general election and a special election on November 5, 2019 for the purpose of electing the Mayor and certain Council members, and for voting upon a referendum pertaining to the re-imposition of the special purpose local option sales tax (“SPLOST”); and WHEREAS, the City, through the assistance of staff and others, has reviewed the lists of electors and inactive electors provided by the Board of Registrars and has identified in writing or will identify in writing to the County Board of Registrars, the names of the persons on the electors list who, to the best of the City’s knowledge and belief and based upon its due diligent efforts, are not qualified to vote in the election, and the reasons for such disqualification; and, WHEREAS, the City is now in possession of the final lists of electors and inactive electors showing the names of electors entitled to vote at the elections on November 5, 2019, copies of which having been filed with the city clerk; 131 NOW THEREFORE, BE IT RESOLVED IN OPEN SESSION that the lists of electors and inactive electors, as finalized, be and are hereby certified to be the list of electors entitled to vote at the upcoming elections subject to the outcome of any pending or future challenges which are authorized to be made pursuant to State Law. Resolution 2019-11, Beach Re-nourishment Payment of $2.6M 134 RESOLUTION NO. _11-2019 RESOLUTION OF THE MAYOR AND COUNCIL OF THE CITY OF TYBEE ISLAND WHEREAS, the City of Tybee Island is contracted to and coordinating with the U.S. Army Corps. Of Engineers in connection with a beach renourishment project to commence in late 2019 or early 2020; and WHEREAS, through a grant from the State of Georgia the City has committed funds and is authorized to use funds in connection with the beach renourishment project; and, WHEREAS, the City Council has previously approved the payment of $2.6 million of the grant proceeds for the beach renourishment project as part of the cost of the project and as the City’s share thereof; and WHEREAS, pursuant to such authorization, the City has wired such funds to the USACOE; and WHEREAS, in order to formalize the record of proceedings this resolution is made; NOW THEREFORE, BE IT RESOLVED by the Mayor and Council duly assembled in open meeting that the actions of Council in authorizing payment of the $2.6 million for the purposes of beach renourishment are hereby ratified and the payment of such funds to the U.S. Army Corps. (a) The short-term vacation rental application shall be accompanied by an initial regulatory fee and be subject to an annual fee every January 1 thereafter, as established by the mayor and city council. (1) The regulatory fee shall be $100 per rental unit. An application is valid when completed and filed along with payment of the application regulatory fee. The fee shall be due January 1 of each year for short term rental purposes and, if not paid within 90 days thereof, shall be subject to the delinquency and penalty provisions of section 58-163 as applicable to occupation tax/business license provisions as well as the revocation of any right to use the unit for short term rental purposes until payment of the penalties and fee. In addition to the regulatory fee license as specified herein, the applicant shall also pay the required occupation tax each year. (b) Each property or unit shall be issued a location identification number.registration number. (c) Failure to register as prescribed by this law will result in a fine of $100.00 for each month that the unit continues to operate without registration. (d) The annual application documentationregistration of a unit and the regulatory fee are not transferrable. In the event ownership of a unit changes and even if there is no change in the management company managing the unit, the fee upon ownership change shall be $100 if the change occurs prior to July 1 of the year and $50 if after July 1 of the year . (e) In the event a management company changes, the unit is to be re- registereddocumented by notice to the city and the regulatory fee will be $50 if the management company change is after July 1; otherwise, the fee is $100.  Sec. 34-264. - Signs. All one- and two-family STVR units shall post a sign visible from the street listing emergency contact name and phone number. Such sign shall not exceed 24 inches × 24 inches. The emergency contact name and number shall be the STVR agent as required by Section 34-260(d) unless otherwise specified to and approved by the city staff and any rental agency involved. The purpose of the required sign is to enable officers and third parties to identify appropriate contacts for issues with the property and/or the occupants and, therefore, the sign shall be located at such locations as approved by staff consistent with that purpose. The contact phone number shall be visible from a street nearby. Multi-family units shall post a sign visible from outside the unit listing the required emergency contact name and phone number. It shall be unlawful to throw, place, deposit, sweep or scatter, or cause to be thrown, placed, deposited, swept, or scattered, any paper, food, cigarette butts, bottles, cans, trash, fruit peelings or other refuse upon the beaches or structures erected hereon. Beach goers must have their trash in a container at all times. Littering shall also include the release into the air or surface of balloons, helium or otherwise, and/or heat or flame operated devices sometimes referred to as “sky lanterns”, “Chinese lanterns” of “floating lanterns”, to include, with regard to balloons or lanterns, helium, foil, mylar or “bio-degradable” devices or items from any location in the City, including the beach, structures on the beach and waters adjacent thereto, and such activity shall be classified as “littering” and subject to the prohibition herein. 147 SECTION 2 It is further hereby ordained by the governing authority of the City of Tybee Island that Section 42-60 (5) is hereby amended so as to add the following thereto: The release into air or surface of balloons, floating lanterns, sky lanterns or similar devices sometimes referred to as “Chinese lanterns”, including helium, foil, mylar or “bio- degradable” devices or items from any location in the City, including the beach, structures thereon and waters adjacent thereto, shall be deemed to be “littering” and included as an activity prohibited in this subsection. SECTION 3 All ordinances and parts of ordinances in conflict herewith are expressly repealed.
