HomeMy Public PortalAboutConsComm Min 2000-11-14Minutes — Orleans Conservation Commission Town Hall Work Meeting, Tuesday, November 14, 2000 (Amended) PRESENT: Adrienne Pfluger, Acting Chairman; George Christie, Arnold Henson,, Bill Parish and Jim Snedecor, voting Commissioners; and Jenny Wood, Conservation Administrator. ABSENT: Steve Paradise, Judy Scanlon, Don Tomlin, Bob Ward and Andree Yager. The meeting opened at 8:48 a.m. 4 NOTICE OF INTENT (CONTINUATION) E. S. Goldman, 18-B Pershing Lane -- by East Cape Engineering, Inc. Assessor's Map 56, Parcel 19. Construction of an addition to the dining area of an existing single family dwelling within 100' of the top of a coastal bank in accordance with plans on file. Tim Brady of East Cape Engineering said that he had talked to Mr. Goldman about the alternatives proposed by the Commission at the October 17th hearing to see what Mr. Goldman would consider for a possible new design. Tim Brady had received a memo from Mr. Goldman indicating that he had explored other options and felt that this proposed addition is what he wants. Tim Brady explained that he had not changed the site plan and he asked the Commission to consider the plan as presented. JW pointed out that a top of bank delineation had not been provided and Tim Brady said he would do this if the Commission approved the project. Arnold Henson said he was concerned about building a structure in the ACEC and granting a variance when there were other reasonable alternatives, even if Mr. Goldman did not like the alternatives. MOTION: A motion to close the hearing to the taking of testimony was made by Arnold Henson and seconded by Bill Parish. VOTE: Unanimous MOTION: A motion to approve the above project and also to approve the variance request was made by Arnold Henson and seconded by Bill Parish. VOTE: 0-4-1 Denied. George Christie recused himself. INFORMAL REVIEWS Dan Schraq, 11 Pond Road -- Informal review for house placement on lot. Mr. Schrag explained that he is in the process of purchasing this 2 -acre lot and talking to Terry Ryder about the placement of the house. He wanted to talk in general terms to the Commissioners about his ideas before having an architect design the house. He is interested in building the house down toward the lake and wondered if there were any restrictions on work within 50' and 100` of the lake and on view clearing. The Acting Chairman said that the Commission only approved view clearing after the house was constructed and occupied. Arnold Henson said the Commissioners prefer tree limbing rather than tree cutting. JW asked Mr. Schrag if he was proposing to build the house on the flat upland area and Mr. Schrag said he would start there and then build down to the lake. JW also said Mr. Schrag could file an RDA to confirm the wetland delineation since it was hard to answer 1 Minutes Work Meeting Tuesday, November 14, 2000 his questions without knowing where the wetland buffer was. The Acting Chairman asked Mr. Schrag if he had a copy of the Orleans wetlands regulations and he said that he would get a copy. Seth Wilkinson, Cape Cod Commission -- Discussion on Namskaket Sea Path. Seth Wilkinson said that he is the coordinator of the Pathways Project and he distributed copies of a newly prepared trail guide for the sea path. He explained that the walking trail runs from Nickerson State Park in Brewster, along the Cape Cod Bay to Skaket Beach and then connects to the bike trail to loop back to Nickerson. The trail guide contains a lot of history about the area, the fishing, railroad and the weirs. George Christie asked Seth Wilkinson if they were working to connect the walkway into Chatham and Seth Wilkinson said not yet. He did say that Brewster's pathways committee was looking at crossing their trails over into the Orleans watershed area. The Commissioners thanked Seth Wilkinson for his presentation. Review Paw Wah Point Management Plan The Commissioners reviewed this draft, which updated the recommendations in the 1991 management plan prepared for this property. MOTION: A motion to approve and adopt as submitted the updated open space management plan for the Paw Wah Point Conservation Area dated November 2000 and to transmit the plan to the Board of Selectmen was made by Bill Parish and seconded by Jim Snedecor. VOTE: Unanimous ADMINISTRATIVE REVIEW Peter Saliba, 13 Quinn Road — Request to repair steps on beach stairway. Posts would not be replaced. Steps are bolted on so that worn steps would be unbolted and new ones bolted into place. JW distributed digital pictures which had been provided by this applicant. MOTION: On a motion by Arnold Henson and seconded by Bill Parish, the Commission approved the above project. VOTE: Unanimous CHAIRMAN'S BUSINESS Approval of Minutes of November 7, 2000 Hearing These minutes were not yet available and will be reviewed at the Commission's meeting on November 21St OTHER MEMBERS' BUSINESS Old Tote Road Affordable Housing Project George Christie distributed a copy of the state's Chapter 40B, Section 21 regulations and read the first part of the section. He said it appeared that the regulations of local agencies must be taken into account on low or moderate income housing construction applications. Arnold Henson suggested that JW ask the Town Counsel for his view on this, 2 Minutes Work Meeting Tuesday, November 14, 2000 Piers and Docks Workshop on November 13ti' Arnold Henson said that he and JW had attended this workshop and the views presented were very similar to the Town's. He also said that the most interesting thing he learned was that the use of wolmanized lumber has little long-term impacts on piers, but that with massive bulkheads longterm impacts are shown as far away as several meters. JW said that information was presented showing that all walkways have effects on the wetlands, the effects just differ by degree of impact. SITE VISITS The Commissioners reviewed the site visits for the November 21st filings. David Lyttle of Ryder & Wilcox will be taking the Commissioners by boat to visit Sipson's Island on Thursday morning, November 16tH CHAIRMAN'S BUSINESS - Continued Sea Call Farm Building Committee Update The Acting Chairman said that the terms for all the Building Committee members had expired as of June 30, 2000 so the Board of Selectmen needs to make new appointments to this Committee. Bob Ward has written to the BOS to discuss the status of the Committee and the renovation plans.
