HomeMy Public PortalAbout1963_01_27 L54 MINUTES OF REGULAR MEETING OF LEESBURG TOWN COUNCIL, JANUARY 27, 1964. • A regular meeting of the Leesburg Town Council was held in the Council Cham- bers , Leesburg, Virginia, on January 27, 1964. The meeting was called to order by Mayor Rollins and Councilman Orr opened the meeting with a prayer. Councilmen present were : C. A. English Cole , C. Grey Dodd , C. Maloy Fishback, Maurice R. Lowenbach, Jr. , Robert A. Orr and John W. Pumphrey. Also present were Town Mana- ger -James W. Ritter , Jr. and Town Attorney George M. Martin. The minutes of the regular meeting of January 14 , 1964 were unanimously ap- proved by Council. • A report was given b;, Chairman of the Airport Commission George P. Hammerly. Several residents of Woodberry Road were present and voiced their objec- tions to the flooding of their properties during heavy rains and asked that steps be taken to correct this situation just as soon as possible. Mr . Walter L. Phillips , Jr. , Civil Engineer , was present and gave a report on the storm drainage survey he, has been working on for the Town, which would include the Woodberry Road section. He stated that the plans are not in firm condition yet , but that it is just a matter of mechanics to put them together. He stated that he would like to know just how far the Town would like him to go on this 'survey though. ' Upon motion of Councilman Fishback, seconded by Councilman Orr , Council unanimously voted that Mr. Phillips be authorized to proceed with the final plan from the grade school to the Town Branch , and completing the other set of plans for Woodberry Road. Mr. Phillips stated that he believed it would help the Woodberry Road situa- tion if the existing pipes would be cleaned out of debris , etc . and Mayor Rollins directed the Town Manager to have this work done. Upon motion of .Councilman Pumphrey, seconded by Councilman Orr , the following resolution was unanimously adopted : BE IT RESOLVED by the Town Council of the Town of Leesburg, that a sum of $1 ,200.00 be appropriated for Police Car Maintenance in order to pay existing repair bills and to meet future expenses on car main- tenance for the balance of the fiscal year . Mayor Rollins reminded Council members of the Public Hearing to be held on Thursday night , January 30, 1964. He also stated that he would expect the Town Manager to prepare the budget for the next fiscal year , along with recom- mendations as to how it can be financed , i.e. , what the tax rate will have to be to finance the budget. • Upon motion of Councilman Orr , seconded by Councilman Pumphrey, the follow- ing resolution was unanimously adopted : WHEREAS, the Commonwealth of Virginia, Department of Highways, -pro- poses to construct or otherwise improve Route 599 from. Int. Rte. 7 E. of Leesburg to Int. Rte. 17 N. of Leesburg, and has prepared and submitted to the Town Council plans for the same , designated as Proj- ect : 0599-053-101 , C-501 ; and WHEREAS, it is the opinion of the Town Council that the said construc- tion or other imtrovement will be of immediate and continuing benefit and advantage to the Town (Hereinafter called the MUNICIPALITY) , NOW, THEREFORE, BE IT RESOLVED: That the MUNICIPALITY through its Council hereby approved the above said plans; and • The MUNICIPALITY agrees that , at its own expense , or without expense to the Commonwealth , it will relocate and readjust , or have relocated and readjusted , such publicly or privately owned pole lines , pipe lines (whether above or below ground) , conduits or other utilities : located on public property which has been dedicated for street or ' road purposes , including uses incidental thereto , within its cor- f : .l is G Minutes of January 27, 1964 Meeting. -- porate limits- as- may•be necessary for the- accomplishment of -the said construction or other- improvement and for •the- future mainte- nance and -use--of said Route and improvement.. The. MUNICIPALITY further agrees-to perform-or have- performed this-work within ri thirty (30)- days from-the •date- of written noticeito -its Mayor or Manager from the District or Resident Engineer of the Depart- ment -of Highways and- to perform or have performed said work at such time and in .such manner as not to delay or interfere with .the work• to be done- by the Department of Highways, -its- employees- or contractors; .and • II The MUNICIPALITY agrees- to save- the- Commonwealth of Virginia, her officials and employees, -harmless. from-any :and. all- claims for- dam ages• that- may- arise- as a result of the relocation•and readjustment of said pole lines, pipe lines, conduits or other utilities, or incident to the execution and maintenance of. thef "Project", as dis- tinguished from negligence in the performance ofithe work.
