Minutes of January 27, 1964 Meeting.

nánce and -use--of said Route-and improvement. The. MUNICIPALITY
further agrees -to perform -or have performed this-work within
thirty (30)- days from. the -date- of written notice to .its Mayor
or Manager- from- the District or Resident Engineer of the Depart-
ment -of Highways and' to perform or have performed said work at
such time and in .such manner as not to delay or interfere with
the work- to be done- by the Department- of. Highways, -its employees-

The MUNICIPALITY agrees- to save- the Commonwealth of Virginia, her
officials and employees, -harmless- from-any :and- all- claims for dam-
ages- that-may- arise- as a result of the relocation-and readjustment
of said pole lines, pipe lines, conduits or other utilities, or
incident to the execution and maintenance of-the "Project", as dis-
tinguished from negligence in the performance of the work.
A letter from Frank Webner relative• to operating- the- new- Airport was turned
over to the Airport•Commission.
Upon motion of Councilman Fishback, seconded by Councilman Cole, the fol-
00 lowing resolution was adopted -by •a vote- of 4 for and 3 against, Councilmen Dodd,
T Lowenbach and Pumphrey •being against the- resolution:

r•I 'BE IT RESOLVED by the Town Council of the Town of Leesburg, that the
CC Town retain another set of .engineers- to prepare a -report on- Sewage.-
Disposal Facilities for the Town -of• Leesburg.
After a great-deal- of discussion on this question, Councilman Fishback
moved, -seconded by- Councilman Orr, that the firm of Hayes, Seay, Mattern and
Mattern be employed to make a study of the Sewage Disposal Facilities for the
• Town. This motion was-carried-by a vote ;of 5 for and- 2 against, those-against
being Councilmen Lowenbach and Pumphrey. '

PUBLIC- HEARING, LEESBURG TOWN COUNCIL, JANUARY -30, 1964.-
A duly advertised Public ,Hearing_ on a .proposed amendment to the Subdivision-
Ordinance
ubdivisionOrdinance was held in the Council Chambers, Leesburg, Virginia, on January 30,
1964 at 7:30 P.M. Councilmen present were : C. A. English Cole, C. Grey Dodd,
C. Maloy Fishback, Maurice R. Lowenbach, Jr..,. Robert- A. -Orr and John W. Pumphrey.
-Mayor Rollins presided at the meeting.
No-one-appeared for or against this. amendment.___ - '
The public hearing was declared closed at 7:40 P.M. and the Council con-
vened in special session to consider theproposedamendment to the Leesburg
Subdivision Ordinance.
Ili" - Sections A and- B ,were approved by voice vote as follows:
A. IMPROVEMENTS OR FACILITIES REQUIRED; '
Improvements or facilities -required by the Planning Commission
shall be as follows: -
1. Monuments at all corners, angles and points of curvature
' in the subdivision boundaries and in the right-of--way lines
of all streets and other public spaces within the subdivision.

Such monuments shall be of:4" X 4"-concrete, stone or of
• iron pipe not less than 1!' in diameter and 2 feet in length,
set in concrete -with the top not less- than 1" nor more than
4" above finished grade.
2. Street improvements on any street not already in the State
System of Highways, sufficient to qualify such street- for
acceptance into the State. System. - (See -specifications)
3. Sidewalks•on both sides of each street, whether in the State
System of Highways or not, composed of concrete or brick not
less than 4 feet wide and installed according to Town speci-
fications but shall be required- only as tothe side of the
street owned by the subdivider or developer.

4. Drains, culverts, curbs, gutters, ditches, catch basins, or
any other facilities for the proper drainage and- disposal
of surface waters from or across all streets and adjoining
properties, as approved by the Resident Engineer of the Vir-
ginia Department of Highways and - the -Town Manager or Town
Engineer,
5. Street .signs, of an approved design, at all street inter-
sections.
6. Water supply and distribution facilities,- including fire
hydrants as approved by the Town Manager or Town Engineer
in accordance with Town-specifications, wherever required
by the lot sizes or character of development.
7. Sewers and sewage disposal facilities as approved by the
Town Manager or Town Engineer in accordance with Town speci-
fications where required by the lot sizes, character of de-
velopment or County Director of Health.
B. PLANS, APPROVALS AND AGREEMENTS.
Plans and specifications shall be submitted to the Town Manager
or Town Engineer for approval prior to construction. All .im-
provements or facilities shall be -subject to final inspection
and approval by the Town Manager or Town Engineer. The subdi-
vider or owner shall execute the standard -agreement- for install-
ation or physical improvements or facilities before commencing
construction and shall convey all such improvements or facili-
ties to the Town of Leesburg, Virginia in fee simple, before
release of any- performance bond or check.
Upon motion of Councilman Orr , seconded by Councilman Pumphrey, Section
Cl was adopted by roll call- vote of 5 to 2,- Councilman Cole- and Mayor Rollins
voting against it, as follows: .
C. CONDITIONS- FOR ACCEPTANCE OF PHYSICAL IMPROVEMENTS.
Before final approval •of the plat by the Planning Commission and
recordation thereof in the clerks office for Loudoun County the
owner or developer of the subdivision shall :
1. Have installedall physical .improvements or facilities re-
quired. under this ordinance .and certify to the Town Council
that the constructioncosts have been paid to the person or
-firm constructing the .same, or .
Upon -motion- of Councilman Lowenbach, seconded by Councilman Orr, Council
unanimously, adopted Section 2 witt_certain changes as follows:
2. Furnish the -Town Council a certified.-check -in the amount of
the estimated-costs 'of construction -as determined by the •
- Town Manager or Town Engineer from plans-and estimates sub-
mitted by the owner or developer on standard forms obtained
from the Town Manager or Town Engineer, which sum shall be
returned by the Town only upon completion and approval of
the physical improvements or facilities, in strict conformity

to the. approved plebs and. specifications, or establish an
escrow- account of- 150% of the estimated costs as determined
by the Town Manager or Town Engineer from plans and estimates
submitted by the owner or developer on standard forms obtained
from- the -Town Manager-.or--Town-.Engineer,- the which shall
.be released as construc.tion...progresses•, -.and-.completion thereof
is certified ,as -completed_by- the., Town Manager ; . the 4sums .of
which shall be ,jointly paid to the :developer and the person
or firm constructing the same. The escrow agent shall be

Upon motion of Councilman Fishback, -seconded,.by-Councilman Lowenbach,
Council unanimously adopted -Section• C3 with- certain changes as follows:
3. Furnish the Town Council- a bond executed on the approved
Leesburg- Standard Form by. an acceptable -surety-company in
an amount sufficient to cover the estimated-costs of con-
struction as determined by the Town Manager or Town Engineer
from estimatessubmitted by the- owner or -deyeloper- on stand-
ard forms obtained from the -Town Manager or Town Engineer,
and. conditioned- upon the construction of .such .physical• im-

OC provements -or facilities in strict conformity to the said
plans- end specifications. The said plans and specifications
shall be referenced in the said bond. The surety- will be
CC subject to the condition that the improvements or facilities
CC will be- completed within- one (1) year after final approval of
the final plat.
The following resolution was unanimously adopted by Council :
WHEREAS,- a certain proposed amendment to the Leesburg Subdivision

WHEREAS, the said proposed amendment has been considered by the
Leesburg Town Council after due publication and public hearing,
NOW, THEREFORE, BE IT RESOLVED, that the following .proposed, amend-
ment to the Leesburg Subdivision Ordinance be sent to the Loudoun
County Planning Commission for its review and recommended approval
or disapproval, in accordance with the provisions of Section 15-967.2
of the Code of Virginia:

SECTION IV
' PHYSICAL IMPROVEMENTS OR FACILITIES .
A. IMPROVEMENTS OR FACILITIES REQUIRED.
Improvements or facilitiesrequiredby the Planning Commission-
shall
ommissionshall be as -follows:.

B. PLANS, APPROVALS AND AGREEMENTS.
Plans •and specifications shall be submitted to the Town Mana-

• All improvements or facilities shall be subject to final
inspection and approval by 'the Town Manager or Town Engi-
neer. The subdivider or owner shall execute the standard
agreement for installation of pRysical improvements or fa-
cilities before commencing construction and shall convey all
such improvements or facilities to the Town of Leesburg, Vir-
ginia in fee simple , before release of any performance bond
or check. ..
C. CONDITIONS FOR ACCEPTANCE OF PHYSICAL IMPROVEMENTS.
Before final approval of the plat by the Planning Commission

2. Furnish the Town Council a certified check in the amount
of the estimated costs of construction as determined by
the Town Manager or Town Engineer from plans and estimates
submitted by the owner or developer on standard forms ob-
tained from the Town Manager or Town Engineer, which sum
shall be returned by the Town only upon completion and ap-
• proval of the physical improvements or facilities, in strict
• conformity to the approved plans and specifications, or es-
tablish an escrow account of 150% of the estimatedcosts as
determined by the Town Manager or Town Engineer from plans
and estimates submitted by the owneror developer on stand-
ard forms obtained. from the Town Manager or Town Engineer,
the sums of which shall be released as construction progresses,
and completion thereof is certified as .completed by the Town
Manager; the sums of which shall be jointly paid to the de-
veloper and the person or firm constructing the same. The
'escrow agent shall be The Loudoun National Bank of Leesburg,
Virginia or The Peoples National Bank of Leesburg, Virginia,
or
3. Furnish the Town Council a bond executed on the approved
Leesburg Standard Form by an acceptable surety company in
an amount sufficient to cover the estimated costs of con-
struction as determined. by the Town Manager or Town Engi-
neer from estimates • submitted by the owner or developer on

neer, and conditioned upon the construction of such physi-
cal improvements or facilities in strict conformity to the
